Background: Bullet holes at a home in Atlanta where a 9-year-old boy was shot Saturday. Inset: Surveillance video allegedly shows the drive-by shooting in Atlanta that nearly took a 9-year-old’s life Saturday (WAGA/YouTube).

A 9-year-old boy in Atlanta was nearly shot to death while sleeping in his home over the weekend — with a bullet going through his back and into his leg, where it became lodged “close to a large artery” — during a drive-by shooting that saw his uncle return fire to “defend the family,” the victim’s aunt says.

“I was asleep,” the boy told local Fox affiliate WAGA on Saturday after being discharged from the hospital with the bullet still inside of him. “I was just crying because I was bleeding, and I didn’t know they were gunshots.”

The boy’s aunt, who asked to remain anonymous, said doctors told her the boy would be at risk of being paralyzed if they tried removing the bullet from his leg. He was shot early Saturday at around 3:45 a.m. by suspects in two different vehicles who were caught on surveillance video opening fire on his home.

“They said the bullet had went through his back and into his leg and the bullet is located close to a large artery, and if they removed it then he might not be able to walk,” the aunt said.

Footage obtained by WAGA shows the suspects pulling up on the child’s residence and stopping in front of it. They can be seen firing multiple shots at the home before speeding off in the two cars.

“My husband did return fire,” the aunt said. “We’re not sure if he hit anybody.”

At first, the family told WAGA they didn’t know whether anyone was hurt in the shooting, nor did they know if they were the intended targets. Another home that’s nearby has been targeted in multiple drive-by shootings, according to the aunt.

“Our house and the other house are identical,” she said. “My nephew, he was on the ground and I asked if he was okay, and he was bleeding from his back.”

More from Law&Crime: Gang member linked to drive-by shooting that killed innocent mother of 4 and paralyzed her friend learns his fate

Police say the boy was rushed to Children’s Healthcare of Atlanta hospital after the shooting, where doctors were unable to remove the bullet from his leg. His aunt says they have to wait several weeks until they will know what to do.

“They have to give it a couple of weeks to monitor the bullet traveling so they can see if they can get him some surgery,” she told WAGA.

Bruce had just visited his grandmother and was driving home when, for the first time in his life, he suffered a seizure. He slowly drove off the road and down into a 20-foot embankment. Two other drivers, who saw he was having a seizure went to his aid, called 911 and relayed to dispatchers what had transpired.

Police and firefighters arrived on the scene and began to assess the situation, body camera footage obtained by Law&Crime showed. Bruce, then 21, looked barely conscious and could not coherently answer first responders’ questions.

“He’s having a seizure, just let him be,” instructed Officer Joshua Goldstein.

But that mindset changed.

“The defendants were trained and knew that the last thing an officer should do when dealing with a seizure victim is restrain him, because seizure victims often react instinctively to physical contact,” the lawsuit said. “Ignoring this training, they repeatedly poked, prodded, shook, and yelled at Plaintiff, ordering him to leave his car.”

Things escalated from there.

Jack Bruce being arrested after a traffic stop in California (Hercules Police Department).

Officers berated him with “Get out of the car” and “We wanna help you, but do not f—ing fight” and “You will get f—ing ripped out of this car.” Bruce seemed confused and had to be pulled out of the car, the video showed.

Bruce’s lawyers say the California Commission on Police Officer Standards and Training expects cops to follow a set of protocols on how to deal with someone in the throes of a seizure.

“Medical authorities have long known that attempting to physically control a seizure victim is precisely the wrong thing to do,” plaintiff lawyers Craig M. Peters of Altair Law and David L. Fiol of Brent & Fiol wrote.

The protocol says officers should expect agitated behavior and that should not be “perceived as deliberate hostility or resistance to the officer.”

But Goldstein, along with Officers Angel Garcia and Michael Thompson did the opposite, Bruce claims.

“They attacked him,” Peters and Fiol wrote.

Garcia, who was sitting in the backseat, yanked Bruce out of the car by his hair while Goldstein pulled at his arms. Thompson also aided his fellow officers in removing Bruce out of the car and onto the ground. The officers then began to tase the plaintiff in order to get him to put his hands behind his back. Bruce howled in pain. They picked him up by the arms and the legs and placed him on a gurney before he was taken to a hospital. Bruce suffered a lacerated lip and other cuts and bruises. Much of his shirt was bloodied.

Thompson concluded that “he must be high on something” and Garcia responded, “he’s high as f— on something, I just don’t know what it is.” Plaintiff lawyers also accuse Thompson and Garcia of authoring a police report that was “designed to cover up their senseless use of force by suggesting they had probable cause to believe” Bruce was driving under the influence.

Bruce’s attorneys note that no drugs or alcohol were found in the car. Cops arrested Bruce for resisting arrest but prosecutors dropped the case.

The lawsuit accuses the cops of an unlawful arrest, which violated Bruce’s Fourth and Fourteenth Amendment rights. His lawyers write:

Defendants Garcia, Thompson and Goldstein had no factual basis for believing that Plaintiff had committed a crime or was an immediate threat to his own safety when they encountered him sitting peacefully in the front seat of his car. The mere fact that a person is in a single vehicle accident does not constitute probable cause for believing he was driving while impaired by a intoxicating substance, or that he had committed any other crime. This is so particularly in light of the fact that witnesses told dispatchers that Plaintiff appeared to be suffering from a seizure, and that information was successfully conveyed to Garcia, Thompson and Goldstein before they encountered Plaintiff.

The police department set out a statement that said it takes all excessive force accusations seriously but does not comment on pending litigation.

Bruce has continued to suffer from seizures, his lawyers say.

A woman denied throwing a “first date” brick through her ex’s window, but according to deputies in Lee County, Florida, surveillance footage caught her in the act.

“I live here,” Sabrina Deanna Coyne, 34, told deputies in body camera video dated the night of Jan. 24.

The ex said, however, that Coyne moved out of the house when they broke up about six months before, according to court documents. He is the sole owner of the residence, authorities said, citing county property appraiser’s records. They said they found no women’s clothing in the residence, and no indication Coyne was getting mail there.

The video, heavily edited by the sheriff’s office, shows the first deputy finding Coyne at the front door.

“I’m trying to get in touch with my ex-husband,” Coyne said.

According to documents, the man said they had never been married.

The ex was sleeping on his couch in the living room, waking up to the sound of loud banging on the windows and front doors, documents stated.

“Shortly thereafter, he heard a loud noise indicating glass breaking coming from the front living room,” authorities wrote.

On video, a deputy asked Coyne if she had been banging on the door.

“I banged on the door because he wouldn’t let me in,” she said.

She denied throwing anything at the window, but in the edited footage, the sheriff’s office pointedly repeated the surveillance video in which a woman, Coyne, picked something up from the floor and tossed it while holding a flashing object — apparently a cellphone — in her other hand.

“I did not break the window,” she said on body camera.

The sheriff’s office described the item as a “first date” brick. A close up picture from authorities showed that it commemorated a jet skiing tip from June 14, 2020.

Coyne was arrested for criminal mischief and throwing a deadly missile into an occupied dwelling. She posted a $7,500 bond on Jan. 26 and is scheduled for an arraignment set for Feb. 24.

Detectives in Jacksonville, Florida, confronted a man they believe was the getaway driver behind a 13-year-old boy’s murder.

“Marcel, I feel like I have shown you that I know what the f— is going on today,” an investigator told Marcel Johnson, 24, in footage dated Dec. 15, 2022. “That I know what this is about. That I know what happened. Why it happened. And I know it was a f— up. You weren’t trying to kill no 13-year-old.”

“I didn’t kill nobody at all,” Johnson said.

Authorities claim he drove the vehicle from which gunman Kentrevious Tyree Garard, 27, opened fire at another vehicle, striking three people. A young man and a juvenile survived, but young Prince Holland, 13, died. He had been going home from football tryouts.

In footage, Johnson maintained innocence. For example, he said was on his phone. Authorities said they could prove that he had actually turned off his phone and switched it back on 20 minutes after the murder.

“You ain’t scrolling,’ the detective said. “You ain’t on FaceTime. You ain’t getting DMs. You ain’t doing none of that stuff because your phone is off. Your phone is turned completely off.”

“Ya’ll sprayed a car full of kids knowing there were kids in there,” the detective said at another point in the video.

“I didn’t do anything,” Johnson said.

A hearing in his and Garard’s case is set for Feb. 4.

Aftermath of Lake County Sheriff’s Office deputy crashing on Nov. 6, 2024 (Lake County Sheriff’s Office).

A sheriff’s deputy who crashed on body camera lied by omission by initially hiding the fact that he was looking at porn at the time, says the Lake County Sheriff’s Office.

“Gosh darn it,” he said on footage after the crash. “Yeah, that f—ing really sucked.”

The internal affairs report from the Office of Professional Standards determined that he lied, was looking at porn on his phone while driving the patrol vehicle, and also failed to wear his seat belt.

Law&Crime is not naming him because he has not been charged with a crime. The deputy resigned during the investigation, Cpl. Chanel Martin of the Lake County Sheriff’s Office told Law&Crime in an email.

The crash

His bodycam from the afternoon of Nov. 6, 2024, shows him with his phone out, though it is unclear what it has on. But what is clear is that the yellow air bag bursts out.

He indicated to at least one passerby he was OK. He walked over to another vehicle that apparently got caught up in the crash. Law&Crime is omitting this encounter because it shows the woman, but in it, the deputy is checking on her.

“Hello, ma’am,” the deputy tells the other driver in the video. “Are you OK? I’m so sorry.”

“It’s OK,” she said.

“My brakes locked up,” he said.

She said she was OK.

The internal affairs report

According to the internal affairs report, the deputy allegedly wrote that he ended a phone call when he saw a vehicle stopped in front of his because a school bus was stopped in the opposite lane with lights on.

On top of that, the light for his auto-brake system was on after he left speed calibrations at the IPS range, so his brakes locked up.

But a sergeant who reviewed video footage determined the deputy was looking at images on his phone when the crash happened.

The deputy allegedly described having finished a call with a colleague at the time of the crash.

More Law&Crime coverage: Deputy says she’s ‘such an idiot’ for causing head-on crash that killed 80-year-old man, injured driver’s 76-year-old wife, police say

“He went on to say that he was scrolling through text messages on his phone from a group text with his sector three colleagues just prior to the crash,” the report stated. “He stated he was not sending text messages when the crash occurred.”

But video did not show him scrolling through texts, authorities said. Instead, he was allegedly “viewing a picture or a video at the time of the crash,” the report stated. A supervisor later described there being no videos or pictures in the group chat.

The investigator also determined that the deputy was not wearing a seat belt at the time of the crash.

In an interview on Nov. 20, 2024, the deputy admitted he was, in the report’s words, “looking at inappropriate pictures.” Asked to clarify what he meant, he allegedly “stated pornographic material like boobs or whatnot.”

He reiterated that his bakes did lock up, but he did not have the time to stop when he realized the vehicle was stopped in front of him.

He ultimately admitted “he knew he was looking at inappropriate pictures, which was the leading cause of the crash, and he deliberately left that information out of his report.  He stated that it is called lying by omission.  He further said he knows that one all too well.”

Mackenzie Shirilla (Strongsville Police Department).

Bodycam footage shows police taking in a teenage girl, who was later convicted of murder for speeding into a wall at up to 100 mph to kill her boyfriend and another young man.

“Could you please be careful taking this one off so it doesn’t break the bracelet,” Mackenzie Shirilla said as an officer began to switch handcuffs.

An Ohio judge convicted her in a bench trial in August 2023 of charges including murder for killing both her boyfriend, Dominic Russo, 20, and Davion Flanagan, 19.

Surveillance video showed that Shirilla, now 20, turned slowly from Pearl Road onto Alameda Drive, then she sped down the three-quarter mile street into a brick wall.

Russo and Flanagan died. Shirilla survived, stuck in the driver’s seat.

Surveillance footage was the key evidence.

“The video clearly shows the purpose and intent of the defendant,” Judge Nancy Margaret Russo (no relation to Dominic) said in WKYC footage. “She chose a course of death and destruction that day.”

Whether Shirilla intended to kill herself too was a matter of speculation and irrelevant to evaluating the evidence at hand, Russo said. The judge ruled that the defendant, whose actions were “controlled, methodical, deliberate, intentional, and purposeful,” meant to kill the young men.

More Law&Crime coverage: Man accused of kidnapping and killing 2-year-old girl makes shocking statements during arrest in just-released bodycam footage

She was sentenced to life in prison, with the possibility of parole after 15 years. At sentencing, however, Judge Russo voiced doubt that Shirilla will get out after 15 years. She agreed with the prosecution, who maintained the defendant showed a “shocking lack of remorse.”

For example, before the charges were brought, Shirilla attended a concert in her wheelchair while recovering from the crash.

Shirilla maintained her innocence in court, even shaking her head during victim impact statements when Dominic Russo’s mother, Christine Russo, took her to task.

“No one wanted this to be a murder, or to punish Mackenzie Shirilla for this accident, but this was not a car accident,” Christine Russo said in court. “The evidence and science proved that Mackenzie Shirilla murdered my son Dominic as well as Davion.”

Two girls who pleaded guilty to helping their male friend kill another teenager separately told police they expected it was only going to be a fight.

“Andre told me that somebody had pissed him off, or somebody that was messing with somebody else’s girl or something — it had to do with some type of chick — and that he was upset and that he needed some backup for a fight,” Jaslyn Smith, then 16, told police with her mother at her side on Oct. 19, 2021. “He told me it was just a fight.”

“I didn’t think he meant, like, actual murder,” Christie Parisien, then 17, told police in an interrogation room on Oct. 23, 2021. “I thought he meant fighting him, beating him up or something. Classic little high school boy-boy, ‘I mess with your girl, you mess with my girl’ type fight thing.”

It was not a fight. Lead defendant Andre Clements, who faces trial scheduled for next year, murdered Dwight “DJ” Grant, 18, with a sword for hooking up with his ex-girlfriend, authorities say.

Smith, now 19, and Parisien, now 20, were sentenced on Aug. 29 to 25 years in prison for second-degree murder, tampering with evidence, and conspiracy to commit murder.

In the footage, Smith told police that she held down Grant’s legs at Clements’ command.

“He hurt him,” she said.

Clements, who was 17 during the murder and is now 20, is charged with first-degree murder, tampering with evidence, and conspiracy to commit murder. He is scheduled for trial to begin Jan. 13.

As seen on bodycam, Oklahoma mother Tina Ramirez invoked her right to remain silent when Piedmont police arrested her for allegedly abusing her children.

Her husband, Anthony Ibeziako, spoke a fair bit, however.

“This is not a normal family. This is some f—ing prison or some s—,” he told an investigator on March 19, citing the number of cameras at home.

“Yeah, that’s what I’m thinking. Thank you,” said the investigator, who spent the interrogation exasperated with Ibeziako.

On video, the husband said Ramirez was in charge of feeding the children. But police say that the children were malnourished. According to documents, the abuse landed on law enforcement radar when one of the kids ran away and was found hiding under a blanket behind a building.

“Upon uncovering herself, it was evidence that [she] was in an emaciated state.”

The investigator confronted Ibeziako with the children’s physical condition.

“They’re stealing food all the time, and they’re skin and bones,” said the investigator. “They’re hungry, Anthony.”

In the document, authorities said that the runaway “described being locked in a closet for extended periods without food, as punishment. She also reported being struck, tased, choked, and subjected to other forms of physical violence.”

Though Ramirez did invoke her rights on March 19, cops say she spoke to them on the 15th of that month.

“She admitted to employing physical force to discipline her children, acknowledged their emaciated appeared and admitted her failure to seek medical attention for their condition,” police wrote, describing her words from March 15. “Moreover, her explanation for locking away food items contradicts the assertion that the children were adequately nourished. Tina admitted to the use of a handheld taser in proximity to her children, and even admitted that she had tased [a child] in the eye once when she waved it too close to his face.”

The investigator voiced frustration with Ibeziako, telling him he should have taken them to a doctor or professional.

“They’re adopted,” the husband answered. “I’m not on their papers.”

He is scheduled for a preliminary hearing on Jan. 10. Ramirez is set for a hearing on Jan. 29.

Witness and police video shows a man acting out at a gas station before striking a cop car with his vehicle, driving off, and fleeing futilely into a restaurant.

The suspect, Jordon Vasquez, 34, is currently locked up in the Bernalillo County Jail in New Mexico for armed robbery, aggravated assault with a deadly weapon, aggravated fleeing a law enforcement officer, and resisting, evading, or obstructing an officer.

In the witness footage from Feb. 7 in Albuquerque, an exasperated employee of the gas station apparently spoke to authorities over the phone offscreen. She said the suspect struck two homeless people with his hands.

More Law&Crime coverage: Mom accidentally shot to death by 2-year-old son with gun that was ‘negligently’ stored, police say

“He’s sitting out there nonchalant like nothing happened,” she said, describing the suspect sitting in a vehicle, his feet up, in the middle of the parking lot.

She said that the man had been trying to get cigarettes, although he did not have money.

“And he was like, ‘I don’t have money. I don’t have ID,” and he went to grab the cigarettes from the counter, and I was quick enough to swipe them back, and he was like, ‘girl, don’t make me go back there,”” she described.

She said he went behind the counter and stole cigarettes.

As seen on footage, the man lounged in the vehicle, arguing with a bystander until cops arrived. The suspect drove off, but before backing his vehicle into a cop car.

“He just hit the freaking cop’s car,” a woman said.

Bodycam shows police soon tracking down the suspect, taking him down, and handcuffing him.

An Alabama man will likely spend significant time in prison after he repeatedly forced a child to perform sexual acts on him in exchange for allowing her to play video games on her console system.

Dustin Lamar Peoples, 43, was found guilty by a jury in Blount County this week on one count each of sexual abuse of a child under the age of 12 and sodomy in the first degree. The former is a Class B felony, while the latter is a Class A felony in the Yellowhammer State.

Content warning: child sexual abuse.

In March 2019, the victim came forward, alleging Peoples abused her from Aug. 7, 2018, through Christmas that year.

Days later, the girl was interviewed at the Blount County Children’s Center.

“She spoke as a child. As an innocent child,” Blount County District Attorney Pamela Casey said in a statement provided to AL.com. “Dustin Peoples stole this child’s innocence.”

First, the girl confided in an adult she trusted and then later made the official report, Casey told People magazine.

The defendant was indicted in August 2019 — but remained on bail pending trial.

More Law&Crime coverage: Florida man allegedly drove cross-country to pick up and marry 16-year-old girl he met on World of Warcraft but got caught after she logged into her account at his house

The Trial was quick. Proceedings began Monday.

During the trial, prosecutors presented evidence that the defendant touched the girl’s genitals with his hands. He also forced her to perform oral sex in exchange for video game access at least four times.

The victim herself described the abuse during the trial.

“This young lady appeared at the Children’s Center when she was just 10 years old. She did her best to explain the things that had been done to her using terms she understood at the time,” Casey added. “She was innocent. She did not know the common words that adults or even teenagers would use to describe what had happened to her.”

The defendant reportedly took the stand in his own defense and denied any wrongdoing with regard to the child.

Jurors, however, apparently did not believe him.

After the conviction, Presiding 41st Circuit Judge Gregory Reid remanded Peoples to the custody of the Blount County Sheriff’s Office, pending a sentencing hearing slated for Nov. 19.

The defendant faces a minimum sentence of 20 years in state prison — and a maximum sentence of life behind bars.

Typically, a Class A felony would carry a minimum 10-year prison term — with a Class B felony carrying a minimum 2-year term — but due to the girl’s exceedingly young age at the time of the abuse, Peoples faces harsher mandatory punishment.
