<p>A <a href="https://lawandcrime.com/tag/new-mexico/" target="_blank" rel="noopener">New Mexico</a> mom who handed her son a firearm and told him to shoot a <a href="https://lawandcrime.com/crime/i-still-dont-believe-what-he-got-was-fair-man-who-livestreamed-himself-shooting-a-homeless-man-gets-3-years-in-jail/" target="_blank" rel="noopener">homeless</a> woman was found guilty of second-degree <a href="https://lawandcrime.com/crime/weighed-him-down-2-men-sentenced-in-gilligans-island-group-murder-of-man-beaten-hog-tied-anchored-to-cinder-block-and-dumped-in-lake-to-drown/" target="_blank" rel="noopener">murder</a>.</p>
<p>According to a Facebook post by Bernalillo County District Attorney Sam Bregman, 46-year-old Kristina Withrow was <a href="https://www.facebook.com/berncoda/posts/pfbid0GCLAbw3uCXoNQdZzMSMo6goaA7PMvwuiK7x6yyKf8FBoz9XuPV29jt12ovYVhV5ml" target="_blank" rel="noopener">convicted</a> by a jury Thursday of second-degree murder with a firearm enhancement, aggravated assault with a firearm enhancement, and tampering with evidence following a jury trial. The verdict marked the end of one chapter of the fallout related to the shooting death of 36-year-old Monique Garcia, who died of gunshot wounds she received at the hands of Kristian Crespin, 20, Withrow’s son, in April 2023.</p>

<p>On April 3, 2023, Withrow saw Garcia in the walkway of her apartment building and told her to leave because she “assumed the victim was homeless,” according to a press release by the Albuquerque Police Department <a href="https://www.cabq.gov/police/news/apd-arrests-woman-charges-son-for-mondays-fatal-shooting" target="_blank" rel="noopener">at the time</a> of the shooting. The two women then got into a verbal argument, during which time Withrow retrieved her handgun.</p>
<p>Withrow then handed her gun to Crespin and “told her son to shoot” Garcia. Crespin fired three shots at Garcia, who was then rushed to the hospital. She died the following day from her injuries.</p>
<p>In an interview with police, Withrow said that she had fired at Garcia. But eyewitnesses came forward and reported seeing a male fire shots before fleeing from the scene.</p>
<p>Crespin eventually confessed to the shooting and was charged with an open count of murder, conspiracy to commit murder, and tampering with evidence. He pleaded guilty to both charges in April 2024 and was sentenced to 18 years in prison.</p>
<p>Withrow was also charged with first-degree murder and conspiracy to commit first-degree murder, but was not convicted on those counts. She is set to be sentenced at a later date.</p>

<p>A <a href="https://lawandcrime.com/tag/north-carolina/" target="_blank" rel="noopener">North Carolina</a> man placed a call to 911 not because he was in danger, but to <a href="https://lawandcrime.com/crime/nah-hes-dead-81-year-old-man-blasted-roommate-with-shotgun-for-rude-comment-he-made-and-then-calmly-called-911-cops-say/" target="_blank" rel="noopener">report a murder</a> — that he allegedly committed.</p>
<p>Travis Huff, 40, was arrested on Feb. 19 at a CubeSmart <a href="https://lawandcrime.com/crime/this-is-what-you-get-woman-locked-boyfriend-in-overstuffed-pitch-black-storage-unit-described-as-a-hoarders-paradise-for-4-days-police-say/" target="_blank" rel="noopener">storage facility</a> in Cary, North Carolina. Police reported to the scene after 911 dispatchers got a call about a “murder” at the apartment of Rebecca Carter, 41. Carter was a manager at the CubeSmart and lived in an apartment connected to the facility’s leasing office. The <a href="https://www.wral.com/news/local/search-warrant-boyfriend-admits-murder-woman-cary-storage-facility-february-2025/" target="_blank" rel="noopener">911 call</a>, which was described in an arrest warrant obtained by WRAL, a local NBC affiliate, had been placed by Huff, her boyfriend of about two years, who allegedly told dispatchers, “There’s been a murder.”</p>

<p>During the 911 call, Huff allegedly told dispatchers that he “choked” Carter, saying, “She’s no longer here” and “I killed her.” According to the arrest warrant <a href="https://abc11.com/post/cubesmart-murder-rebecca-carter-found-dead-storage-facility-apartment-boyfriend-travis-huff-charged/15960454/" target="_blank" rel="noopener">obtained</a> by WTVD, a local ABC affiliate, Huff claimed that he and Carter had gone to a bar and gotten into an argument, after which Huff said he “lost control.” Their altercation became physical, and Huff allegedly “strangled Rebecca with his hands and stabbed her at least twice in the chest.”</p>
<p>After she was dead, Huff allegedly told police that he invited a friend to the apartment, where Carter was covered by a comforter, and they allegedly “consumed crack cocaine.” That was when Huff placed his 911 call.</p>
<p>According to the warrant, he also told police that he texted Carter’s boss to tell them that she was sick and that they shouldn’t worry if she didn’t show up at work.</p>
<p>When police arrived at the scene, Huff was still there, and Carter was found with a knife sticking out of her chest. Huff was brought to the station to be interviewed by police and was charged with murder. He is being held at the Wake County Jail with no bond and is scheduled to appear in court on March 12.</p>

<p>A California judge admitted that he shot his wife in a text to court personnel, in a police car and when sitting alone in a police interrogation room, jurors were told Wednesday.</p>
<p>Judge Jeffrey Ferguson of the Orange County Superior Court in California is accused of fatally shooting his wife in August 2023 while watching the AMC TV show <em>Breaking Bad</em> at their home and arguing about finances. Their adult son was also present.</p>
<p><a href="https://www.law360.com/articles/2300101/-convict-my-ass-judge-admits-killing-wife-in-police-video">Law360</a>, the <a href="https://apnews.com/article/california-judge-wife-shooting-murder-jeffrey-ferguson-54c6fbef0300695fae66a3e2cc0a7c9f">Associated Press</a> and <a href="https://abc7.com/post/superior-court-judge-jeffrey-ferguson-murder-trial-oc-shot-killed-wife-during-heated-argument-prosecutors-say/15933732">KABC</a> have coverage.</p>
<p>Ferguson’s defense lawyer maintains that the shooting was an accident, according to the AP.</p>
<p>Orange County, California, Deputy District Attorney Seton Hunt showed jurors a copy of a text to Ferguson’s clerk and bailiff, the articles report.</p>
<p>“I just lost it. I just shot my wife. I won’t be in tomorrow. I will be in custody. I’m so sorry,” the text said.</p>
<p>Jurors were also shown a video of Ferguson muttering to himself in a police interrogation room, according to Law360.</p>
<p>“I killed her. Ladies and gentlemen of the jury, convict my ass. I did it,” he said.</p>
<p>In the back of the police car, Ferguson said, “I killed my wife. F- &#8211; -. Ugh, s- &#8211; -,” video showed.</p>
<p>At the police station, Ferguson’s blood alcohol level was 0.065. Hunt said a forensic scientist would testify that the level was likely 0.17 or more when Ferguson’s wife, Sheryl, was shot.</p>
<p>The adult son testified that he had stepped outside as his parents argued and heard his mother say words to the effect, “Why don’t you point a real gun at me?” The son said he turned around and saw his father fire the gun, according to Law360.</p>
<p>Hunt is seeking a second-degree murder conviction, according to KABC. It’s unclear whether jurors will also be able to consider a manslaughter charge.</p>

<p>A teen accused of <a href="https://lawandcrime.com/crime/he-said-she-fell-on-a-knife-teen-murders-mom-with-zero-remorse-after-shooting-dad-on-valentines-day-last-year-cops-allege/" target="_blank" rel="noopener">stabbing his mom to death in Florida</a> — two years after claiming to kill his dad in <a href="https://lawandcrime.com/crime/i-just-wanted-her-dead-after-blood-found-everywhere-man-allegedly-claims-self-defense-in-killing-of-woman-found-bludgeoned-with-space-heater-and-frying-pan/" target="_blank" rel="noopener">self-defense</a> — can be heard talking to his grandmother in a newly-released <a href="https://lawandcrime.com/video/gosh-darn-deputy-who-crashed-in-bodycam-footage-was-looking-at-porn-on-his-phone-sheriffs-office-says/" target="_blank" rel="noopener">bodycam</a> video about how he told his mother, “I’m not a murderer,” less than a year before allegedly taking her life.</p>
<p>“I was saying, ‘Mom, I’m not a psychopath,&#8221;” Collin Griffith, 17, can be heard telling his grandmother in a bodycam video captured by a deputy with the Charlotte County Sheriff’s Office and released by local Fox affiliate <a href="https://www.fox4now.com/port-charlotte/i-want-foster-care-video-shows-charlotte-teens-pleas-before-mothers-murder" target="_blank" rel="noopener">WFTX</a> on Tuesday.</p>

<p>“I’m not a murderer,” he recalled saying to his mother, <a href="https://www.instagram.com/cathygriffith1985/" target="_blank" rel="noopener">Catherine Griffith</a>, 39, during a fight they were having in November 2023, which prompted police to be called and led to him being arrested for domestic violence. “I’m just trying to peacefully leave or peacefully coexist. She kept telling me to shut up and shut up, and when I wouldn’t shut up, she hit me.”</p>
<p>Griffith, who is charged with first-degree murder, was in the back of a police car while speaking to his grandmother during the video. He can be heard telling a deputy that he’s “in a constant state of fight or flight” and worried that he may attack his mom.</p>

<p>“If I think she’s going to do something, even if she’s not, I might act,” Griffith says. “I’m not going to, like, go crazy or anything. But I’m not sure, honestly.”</p>
<p>The deputy goes on to ask, “You’re not sure if you’ll hurt your mom?”</p>
<p>Collin replies, “Only if she tries to hurt me.”</p>
<p>Griffith is behind bars in Polk County after allegedly killing his mother on Sept. 8, <a href="https://www.facebook.com/polkcountysheriff/videos" target="_blank" rel="noopener">according to police officials</a>. The slaying took place in a 55-and-over community in Auburndale, some 50 miles east of Tampa, where Griffith’s grandmother is a resident and where the bodycam footage was captured in November 2023.</p>
<p>Griffith allegedly called police after murdering his mom and told a dispatcher that they “had a very long fight and she fell on a knife.” Cops said they found Catherine Griffith stabbed multiple times in the neck. Polk County Sheriff Grady Judd <a href="https://www.facebook.com/polkcountysheriff/videos" target="_blank" rel="noopener">said at a press conference</a> in September that her injuries could not have been accidental.</p>
<p>“The medical examiner said it’s just not reasonable or plausible that she died the way that he said she did,” Judd said. “It just didn’t happen.”</p>
<p>In February 2023, Griffith allegedly killed his father in <a href="https://lawandcrime.com/tag/oklahoma/" target="_blank" rel="noopener">Oklahoma</a> but avoided prosecution after successfully claiming self-defense. When <a href="https://lawandcrime.com/tag/florida/" target="_blank" rel="noopener">Florida</a> deputies encountered him after his mom’s murder he was allegedly acting “calm, cool, collected,” according to Judd, who said that Griffith showed “zero remorse.”</p>
<p>“He looked the deputy in the eye and said: ‘I know my rights,” Judd recalled Griffith saying. “‘I want an attorney.&#8217;”</p>
<p>Griffith’s grandmother can be heard telling police in the bodycam video from November 2023 that the teen didn’t want to live with his mother anymore before she was killed.</p>
<p>“Collin did not want to come back home,” she tells a deputy. “And I said, ‘You don’t have a choice, you have to go back home.’ And he said, ‘No, I want foster care,’ and even the corporal said that foster care isn’t good for you. You have issues you need to work on.”</p>

<p>Before police were called, Griffith allegedly pushed his mother to the ground and “stomped on her” after she took away his video game privileges, according to PCSO officials. Griffith claimed self-defense, but that argument failed, and he went to jail.</p>
<p>Two months before that incident, Griffin was involuntarily committed for mental health reasons after he allegedly made a threatening statement, claiming: “I’ll kill myself, or I’ll kill my mother by shooting or stabbing her,” according to police officials.</p>
<p>Polk County authorities have asked prosecutors to charge Griffith, who is being held without bond, as an adult.</p>

<h2>Appeals judge told state attorney how to handle resentencing while badmouthing others, texts indicate</h2>

<p>A Florida appeals judge who obtained a 2004 murder conviction of an alleged gang leader texted advice to the Miami-Dade, Florida, state attorney handling his resentencing while “denigrating defense attorneys and badmouthing local judges,” according to the <a href="https://www.miamiherald.com/news/local/community/miami-dade/article295257249.html">Miami Herald</a>.</p>
<p>The judge, Judge Bronwyn Miller of the Third District Court of Appeal in Florida, is a state’s witness in the resentencing of the defendant, Corey Smith, who was convicted in four murders.</p>
<p>Prosecutors announced Sunday they would no longer seek the death penalty in Smith’s resentencing, the Miami Herald reports in <a href="https://www.miamiherald.com/news/local/crime/article295351309.html">a separate story</a>. Prosecutors attributed the decision to the passage of time and the unavailability of witnesses.</p>
<p>Smith was <a href="https://www.abajournal.com/news/article/longtime-prosecutor-resigns-after-judge-tosses-him-from-case-citing-perry-mason-type-revelations">being resentenced because</a> two capital murder convictions were based on less-than-unanimous juror votes, a practice that had been banned in a 2017 Florida law.</p>
<p>“Miller’s text messages show a close relationship with Miami-Dade’s elected state attorney and a low regard for the judge overseeing the case and defense attorneys in general,” the Miami Herald reports. “Though she left the state attorney’s office about 20 years ago, the texting reveals a familiarity allowing Miller to browbeat [Miami-Dade State Attorney] Fernandez Rundle and second-guess how she runs the office.”</p>
<p>In the text messages, sent between January and July, Miller:</p>
<p>  • Told Rundle that “there is a huge factual error” in a document that referred to “potential favors provided to witnesses.” Miller’s requested changes were included in a later court filing. The text was sent in April, while the Smith case was pending before the Third District Court of Appeal. The case was moved to another appeals court in July.</p>
<p>  • Criticized Rundle for allowing a “misogynistic pervert anti-death penalty campaigner” to work on the Smith case. The prosecutor had written a novel called <em>Death Penalty Desired: Passion and Murder</em> that was, in the Herald’s words, “rife with sexual violence and misogyny.” Two weeks after Miller sent her text, the prosecutor was told to leave within two months.</p>
<p>  • Told Rundle that two judges, including the one handling Smith’s resentencing, disliked Rundle because she didn’t back elements of a bail reform plan that they supported. Judge Andrea Wolfson “will destroy you because of the bail bond issue,” Miller wrote. Wolfson <a href="https://www.abajournal.com/news/article/longtime-prosecutor-resigns-after-judge-tosses-him-from-case-citing-perry-mason-type-revelations">kicked two prosecutors off</a> the resentencing case in March.</p>
<p>In February, Miller testified about a memo that she wrote in the murder trial that said witnesses were given favors, such as food, beverages and cigars. Defense lawyers said they were unaware of the memo. Miller testified that she didn’t know about a witness having sexual contact at the police department, as had been alleged.</p>
<p>The state attorney’s office released a statement to the Miami Herald on Sunday that said Miller sent “occasional and brief texts” to Rundle “in pursuit of the truth.” The statement said Rundle is “engaged in the decision-making on all major cases prosecuted by her office and specifically those involving the death penalty.”</p>
<p>Smith’s lawyers, Allison Miller and Craig Whisenhunt, alleged in an email to the Miami Herald that Miller “simultaneously played the parts of judge, prosecutor, witness,” and the texts call into question her ability to serve as a judge.</p>
<p>Miller told the Miami Herald that she can’t comment. She cited the advice of an ethics expert who said she should not make public comments because they could affect the pending proceedings.</p>

<p>A <a href="https://lawandcrime.com/tag/las-vegas/" target="_blank" rel="noopener">Las Vegas</a> teen is accused of spearheading a murder conspiracy by telling a group of friends that they needed to “stick to the same story” after a fatal shooting.</p>
<p>Daisy Gonzalez is linked to a Jan. 2 shooting at an apartment complex, Las Vegas CBS affiliate KLAS <a href="https://www.8newsnow.com/news/local-news/teen-girl-accused-in-las-vegas-death-told-co-conspirators-to-stick-to-the-same-story-police/" target="_blank" rel="noopener">reported</a>. Police had received a call from someone who said his neighbor, Darian Gonzalez, was shot inside his apartment and several people were seen running from the residence.</p>

<p>Citing arrest documents, KLAS reported that Daisy Gonzalez was among the people who had gone to Darian Gonzalez’s apartment that night sometime after 6 p.m., along with a small group of friends. She reportedly told police that they were recording a song in a makeshift studio in Darian Gonzalez’s apartment, where they also smoked marijuana and drank alcohol.</p>
<p>She told police that she was in the bathroom when she heard “a lot of shots,” and when she came out, she saw Darian Gonzalez lying on the floor. She and her friends fled the apartment, although one of them had been shot in the leg and ended up at a hospital around 20 minutes after the shooting, KLAS reported, citing the arrest warrant.</p>
<p>Darian Gonzalez was ultimately found by a neighbor who heard the gunshots and came to his apartment, KLAS reported.</p>

<p>Less than an hour after the fatal shooting, police said, Daisy Gonzalez sent messages to that injured friend via social media that read: “Don’t mention nothing that happen.”</p>
<p>“You both have to stick to the same story,” she allegedly added, referring to her friend and his girlfriend.</p>
<p>A few days later, she allegedly sent Instagram messages acknowledging that “If I get locked up and charged Cz nobody’s talking,” she “might do a little time … because I’m an accessory.” She also implied that “she could have “prevented all this [from] happening,” KLAS reported.</p>
<p>“I have good lawyers,” she also allegedly wrote, according to the warrant.</p>
<p>Investigators later recovered Instagram messages indicating that the group of friends hadn’t gone to the apartment to record a song — but instead were there to steal one of Darian Gonzalez’s guns.</p>
<p>At least three other people have been indicted in connection with the shooting, KLAS reported.</p>
<p>Gonzalez was 15 or 16 at the time of the shooting, KLAS reported, and has been certified as an adult. Court records show that she is charged with murder, conspiracy to commit murder, robbery, and conspiracy to commit robbery.</p>
<p>Court records show that Gonzalez is currently in custody and her next court appearance is scheduled for Sept. 16.</p>

<p>A group representing immigration judges has spoken out in the past to criticize court administration and advocate for more independence.</p>
<p>But now, representatives for the National Association of Immigration Judges can’t speak to Congress, journalists and professional forums without Department of Justice approval, report the <a href="https://apnews.com/article/immigration-courts-judges-union-backlog-751f55a0ae60af5c04d6c0ca420d36ae">Associated Press</a> and <a href="https://www.govexec.com/workforce/2024/03/doj-issues-gag-order-immigration-judges/394694">Government Executive</a>. They are also banned from writing articles and blog posts absent approval.</p>
<p>The ban was imposed in a Feb. 15 directive by Judge Sheila McNulty, the chief immigration judge of the DOJ’s Executive Office of Immigration Review, which is the DOJ office that oversees the immigration court system.</p>
<p>McNulty said any bargaining agreement that preserved a right to speak out is no longer valid because the National Association of Immigration Judges lost its recognition as a union in November 2020. The National Association of Immigration Judges is appealing that decision by the Federal Labor Relations Authority.</p>
<p>Th AP reached out to union leaders Mimi Tsankov and Samuel B. Cole for comment. They said they were not permitted to comment without approval.</p>
<p>Matt Biggs, president of the International Federation of Professional and Technical Engineers, called the directive “pretty draconian” and “pretty unprecedented” in an interview with Government Executive. The federation is the parent union to the National Association of Immigration Judges.</p>
