Chief Justice John Roberts has paused a Monday deadline for the Trump administration to return a protected Maryland resident who was mistakenly sent to El Salvador as part of President Donald Trump’s deportations of Venezuelan migrants back to the United States through a judge’s order after the Justice Department urged the U.S. Supreme Court to do so.

Issuing an order on Monday afternoon, Roberts temporarily halted a preliminary injunction in which U.S. District Judge Paula Xinis gave the DOJ just over three days to facilitate bringing Kilmar Abrego Garcia back to the country, referring to his deportation as “an illegal act” in her order. The 29-year-old was sent to El Salvador on March 15 in error as part of Trump’s proclamation invoking the Alien Enemies Act of 1798 to rush through mass deportations, which have since been blocked by a federal judge, without providing due process to those being flown out of the country.

Abrego Garcia was in the U.S. with protected legal status at the time of his deportation. His wife and 5-year-old child are both U.S. citizens. The DOJ admitted to the lower court on Friday that his deportation was an “administrative error,” leading to the suspension of a 15-year DOJ vet who made the public confession.

Roberts said Monday that the midnight deadline set by Xinis would be put on hold until the Supreme Court can come to a conclusion on whether to lift the judge’s order altogether.

“It is further ordered that a response to the application be filed on or before Tuesday, April 8th, 2025, by 5 p.m.,” Roberts added.

Instead of waiting until Tuesday, though, Abrego Garcia’s attorneys chose to file their response mere moments after the Supreme Court decision was handed down.

“This case is one of one,” wrote Abrego Garcia’s legal team. “It presents the ‘extraordinary circumstances’ of the Government conceding that it erred in removing Kilmar Armando Abrego Garcia ‘to a foreign country for which he was not eligible for removal,”” the response said. “The Government knew about the court order prohibiting Abrego Garcia’s removal to El Salvador, and admits that removing him in violation of that order was an ‘administrative error.’ Abrego Garcia has never been charged with a crime, in any country. He is not wanted by the Government of El Salvador. He sits in a foreign prison solely at the behest of the United States, as the product of a Kafka-esque mistake.”

More from Law&Crime: ‘Should not have been removed’: 15-year vet at Justice Department suspended after admitting Trump wrongly deported father with protected legal status

With just hours to go before the Trump administration was set to return Abrego Garcia, the DOJ tossed up its “Hail Mary” bid to the Supreme Court on Monday morning — asking it to put the kibosh on the efforts — after Xinis doubled down on her order Sunday.

In a 22-page opinion, Xinis said she would not back off from forcing the Department of Homeland Security and DHS Secretary Kristi Noem, who are being sued by Abrego Garcia, to return him to U.S. soil. The DOJ filed an emergency motion to stay Xinis’ preliminary injunction on Saturday with the 4th Circuit Court of Appeals and lower court, “given the urgency of harms to the government,” the DOJ filings said. The 4th Circuit denied the motion on Monday shortly before the DOJ filed its Supreme Court application.

In prior arguments as well as the SCOTUS filing Monday, DOJ lawyers called Xinis’ order “indefensible” and impossible to carry out on account of where he’s being held.

“The United States does not control the sovereign nation of El Salvador, nor can it compel El Salvador to follow a federal judge’s bidding,” wrote Solicitor General D. John Sauer in the DOJ’s Supreme Court application to vacate the order.

“The Constitution vests the President with control over foreign negotiations so that the United States speaks with one voice, not so that the President’s central Article II prerogatives can give way to district-court diplomacy,” Sauer said. “If this precedent stands, other district courts could order the United States to successfully negotiate the return of other removed aliens anywhere in the world by close of business. Under that logic, district courts would effectively have extraterritorial jurisdiction over the United States’ diplomatic relations with the whole world.”

Xinis, a Barack Obama appointee, dismissed the DOJ’s claim that the Trump administration had its hands tied with Abrego Garcia in her Sunday filing. She said the U.S. can’t prop up the prison in El Salvador as “one of the tools” in the government’s deportation shed — as Xinis said Noem has previously claimed — and then try to act like nothing can be done.

Xinis noted Sunday how the U.S. government and administration officials have repeatedly claimed “without any evidence” that Abrego Garcia is a member of the gang MS-13, which it continued to do on Monday in the Supreme Court application. Even if that were true, Xinis pointed out Sunday how he was given legal protection to live in the United States because he wanted out of El Salvador due to the threat of retaliation and attacks from MS-13’s “chief rival gang,” identified by Xinis as Barrio 18. She noted how the Trump administration was housing Abrego Garcia with inmates belonging to Barrio 18.

“Abrego Garcia will suffer irreparably were he not accorded his requested relief,” Xinis said. “The risk of harm shocks the conscience. Defendants have forcibly put him in a facility that intentionally mixes rival gang members without any regard for protecting the detainees from harm at the hands of the gangs.”

More from Law&Crime: ‘Pretty sketchy looking’: Judge takes DOJ lawyer to the woodshed over Trump’s mass deportations and whether federal court orders are being ignored

Abrego Garcia’s lawyers said Monday in their response to Roberts’ order that they believed the government was unlikely to succeed on the merits of the case.

“Its application to this Court is built on a series of strawmen,” they said. “First, that ordering the Government to facilitate Abrego Garcia’s return requires ‘compel[ling] El Salvador to follow a federal judge’s bidding.’ Second, that the district court lacks jurisdiction over this case … based on a ‘decision or action by the Attorney General to … execute removal orders against any alien.’ And third, that complying with the order requires letting ‘a member of a foreign terrorist organization into America tonight.’

“None of this is true,” the lawyers insisted.

To support their case, Abrego Garcia’s lawyers filed an amicus curiae brief with the 4th Circuit on Sunday, showing support from “world-renowned scholars of constitutional law” who say Abrego Garcia’s removal was “extreme” and legally unprecedented. “Not surprisingly, amici are not aware of any precedent or recognized constitutional principle supporting the government’s argument,” the statement of amicus curiae says, with it being filed by law professors Erwin Chemerinsky, Martha Minow and Laurence Tribe on Sunday night.

“If this court were to adopt the government’s position here, it would dramatically expand the Executive Branch’s power at the expense of fundamental individual liberties, and diminish both the Legislative Branch’s and the Judicial Branch’s power in unprecedented and dangerous ways,” the trio concluded. “If the government’s argument were correct, the Executive Branch would possess a shuddering degree of power — power that the President could wield in extreme and extraordinary ways, including against American citizens that the President simply disfavors.”

The disgraced former CEO derisively known as “Pharma Bro” will not get to plead his case before the nation’s highest court.

Listed among dozens of pages of single-line orders issued Monday was the U.S. Supreme Court’s denial of Martin Shkreli‘s appeal of a lower court ruling banning him for life from the pharmaceutical industry and ordering him to pay $64.6 million. As Law&Crime has previously reported, Shkreli — a convicted felon who served over five years in prison for defrauding hedge fund investors — became a household name after inflating the price of AIDS drug Daraprim by 5,000%. At the time, Daraprim was the only FDA-approved drug for the treatment of toxoplasmosis, a parasitic disease that poses serious and often life-threatening consequences for those with compromised immune systems, including babies born to women infected with the disease and individuals with HIV.

“The high price and distribution changes Shkreli made limited access to the drug, forcing many patients and physicians to make difficult and risky decisions for the treatment of a life-threatening disease,” James said in the statement.

In 2022, the federal District Court for the Southern District of New York issued the ban and the fine, which was later upheld by the Second U.S. Circuit Court of Appeals.

New York Attorney General Letitia James said in a statement Monday that Shkreli should not be able to avoid responsibility.

“Martin Shkreli tried to profit off of vulnerable people by jacking up lifesaving medicine to ludicrous prices and preventing cheaper generic drugs from launching,” James said in the statement. “His selfishness had consequences, and that is why I joined with the FTC and my fellow attorneys general to hold Shkreli accountable and to stop his outrageous actions.”

James added that the legal win “reinforces how our state’s tough anti-fraud laws help protect New Yorkers and ensure bad actors cannot abuse their power, wealth, or influence.”

Shkreli’s legal issues are note yet over, however. He allegedly made copies of a rare Wu-Tang album that he sold in order to satisfy a $7.4 million forfeiture order and played it on a livestream, in contravention of rules regarding the album’s sale and was threatened with a contempt charge.

“Yeah, that’s the Wu-Tang album for all you crazy streamer people,” he allegedly said during a June 18, 2022, livestream of the album — one of three alleged instances of sharing the highly-prized album with the public.

Have a tip we should know? [email protected]

Former president Donald Trump on Tuesday afternoon pressed his case before the U.S. Supreme Court for immunity from criminal prosecution over the riots at the U.S. Capitol on Jan. 6, 2021.

“From 1789 to 2023, no former, or current, President faced criminal charges for his official acts— for good reason,” the former president’s 67-page brief begins. “The President cannot function, and the Presidency itself cannot retain its vital independence, if the President faces criminal prosecution for official acts once he leaves office.”

In late February, the 45th president convinced at least five justices to take up his case – appealing an order from the U.S. Court of Appeals for the District of Columbia finding Trump does not have presidential immunity from prosecution on charges alleging he criminally conspired to overturn the results of the 2020 presidential election.

Key to the arguments advanced on Tuesday are both forward-looking concerns and long-past considerations of constitutional law.

The 45th president’s brief boils down to a policy argument that allowing criminal prosecution for anything that occurred while he was in office would irreparably harm and hamstring the presidency itself.

“A denial of criminal immunity would incapacitate every future President with de facto blackmail and extortion while in office, and condemn him to years of post-office trauma at the hands of political opponents,” the brief reads. “The threat of future prosecution and imprisonment would become a political cudgel to influence the most sensitive and controversial Presidential decisions, taking away the strength, authority, and decisiveness of the Presidency.”

In terms of legal arguments, Trump’s attorneys claim the concept of “absolute” criminal immunity for the U.S. president can be sourced to the Executive Vesting Clause and the separation of powers.

Under such an understanding of the U.S. Constitution, “courts lack authority to sit in judgment directly over the President’s official acts,” the filing argues – citing both precedent and a concurrence by former Supreme Court Justice Antonin Scalia. Their argument goes on to encapsulate the idea that “no court has authority to direct the President to take an official act” and “that the President enjoys absolute immunity from civil liability for his official acts.”

Trump’s attorneys say an “unbroken line of authority reaffirms” their argument and makes the application of presidential immunity all the more stronger when applied to criminal charges.

“Article III courts cannot sit in criminal judgment over a President’s official acts,” the brief argues. “Because the courts cannot examine the President’s official acts, they cannot entertain charges, impose judgment, and imprison him on the basis of those official acts. They cannot conduct a jury trial based on his official acts.”

This wide power, Trump argues, even extends to a former president.

A secondary legal argument advanced by Trump is that the Impeachment Judgment Clause confirms “that current and former Presidents are immune from criminal prosecution for official acts.”

In this version of constitutional law, Trump argues, the clause “dictates” that a U.S. president, or former president, “cannot be prosecuted unless he is first impeached and convicted by the Senate.”

“Thus, the Constitution provides for impeachment and conviction by the political branches—vitally requiring a two-thirds majority of the Senate, and therefore requiring a nationwide political consensus—as the principal structural check against Presidential misfeasance,” the brief goes on. “The Clause’s plain language presupposes that an unimpeached and un-convicted President is immune from prosecution. By specifying the consequences of only one of two possible outcomes of impeachment— i.e., “the Party convicted” — the Clause entails that those consequences do not apply to the other outcome.”

Trump also argues that “our political history” counsels against formally charging a president – despite the prevalence of rhetorically charging a president with engaging in “criminal” behavior.

The brief offers a brief but sweeping history lesson of examples:

For example, John Quincy Adams was accused of a “corrupt bargain” in appointing Henry Clay as Secretary of State after Clay delivered the 1824 election to him in the House. Andrew Jackson disregarded this Court’s rulings and forced the resettlement of many people, resulting in the infamous “Trail of Tears.” President Roosevelt imprisoned over 100,000 Japanese Americans during World War II. President Clinton repeatedly launched military strikes in the Middle East on the eve of critical developments in the Monica Lewinsky scandal, with the likely goal of deflecting media attention from his political travails. President Clinton also pardoned fugitive financier Marc Rich, resulting in widespread accusations of criminal corruption, including illegal quid pro quo. President George W. Bush was accused of knowingly providing false information to Congress about Saddam Hussein’s “weapons of mass destruction” in order to launch the Iraq War on false pretenses, leading to the deaths of over 4,400 Americans, with almost 32,000 wounded. President Obama targeted and killed U.S. citizens abroad by drone strike without due process.

The brief goes on to reference Obama’s drone strikes a second time – in a section alleging special counsel Jack Smith has opened the door to at least some defense based on criminal immunity.

“[T]he Special Counsel admitted in the D.C. Circuit that criminal immunity likely applies to at least some official acts of the President,” the brief argues before explaining in a parenthetical: “Special Counsel admitting that President Obama’s ‘drone strike’ where U.S. ‘civilians were killed … might be the kind of place in which the Court would properly recognize some kind of immunity.’”

The Tuesday brief is the latest volley in a long-running debate on the reach of presidential immunity – both in Trump’s case on a basic level; and in terms of being confronted by the nation’s high court itself.

In Trump’s early February application for a stay pending the filing of a petition for writ of certiorari, the former president referenced an earlier failed effort by Smith to force the nine justices’ hands and issue a preemptive decision on “absolute immunity” claims before the D.C. appellate court could even review and rule on the issue.

While the prosecutorial bite at the apple failed to even put teeth marks into the skin, Trump scored a series of dilatory victories with his last-minute appeal, and the court later decided to hold off on hearing oral arguments on the immunity issue until the very last day of the current session. The upshot is two-fold: the Supreme Court’s opinion likely won’t be coming until late June; any potential criminal trial likely would not begin until the end of summer or early fall.

“The Court should reverse the D.C. Circuit and order the dismissal of the indictment,” Trump’s brief concludes. “If the Court finds further fact-finding necessary, it should remand to the district court to apply the doctrine in the first instance.”

Early voting in Colorado has been well underway and Super Tuesday is only days away with presidential primaries opening in 16 states and Donald Trump as the front-runner and presumptive nominee for the Republican Party. Despite this, the U.S. Supreme Court is still silent on whether it will remove the former president from the ballot in Colorado or keep him on despite findings from two lower courts that he engaged in insurrection.

The high court heard arguments over three weeks ago, fielding questions on the balance between state and federal powers and with Chief Justice John Roberts — and several other justices — expressing skepticism over whether a national election could “come down to just a handful of states.”

It seems unlikely that the court will rule in favor of Colorado voters who argue Trump’s conduct leading up to and on the Jan. 6 attack on the Capitol should disqualify him under Section III of the Fourteenth Amendment. The statute states that no person having previously taken an oath as an “officer of the United States” and is found to have engaged in insurrection is qualified to hold office.

As a decision that could drastically shape the rest of the 2024 election season lurks just out of sight, the legal drama was otherwise unabated in Trump’s world for yet another week.

Law&Crime takes a look at those developments and others in Trump’s cases in Florida, Georgia, Washington, D.C., and New York.

FLORIDA

CRIMINAL

In his classified documents case before U.S. District Judge Aileen Cannon, a trial date was not yet set as of Friday.

Special counsel Jack Smith pushed back against claims from Trump’s defense lawyers that his prosecution for allegedly retaining hundreds of classified documents was improper because it was too close to the 2024 election.

Smith told her department rules are clear: procedure on protecting government integrity by avoiding “Actions that May Have an Impact on an Election” — does not apply to Trump since he was indicted back in June 2023, well outside of the timeline of the so-called “60-day rule.”

Trump wants the trial to play out after the election — if at all — while Smith is gunning for July 8, which Cannon reportedly referred to as “unrealistic.”

Smith also tore into the defendant this week for his ceaseless quest to name “all of the witnesses” in the prosecution’s case regardless of potential threats to their personal safety. Trump called that premise “absurd.” It’s been tense all week: the special counsel had earlier slammed Trump for his spewing of conspiracy theory about the case.

Smith also reiterated his position to presiding Judge Cannon early in the week that she needed to correct her “clear error” in the case. Cannon reportedly expressed skepticism about that from the bench on Friday.

Meanwhile, former Trump White House senior adviser Stephen Miller wants to be tagged in. He asked the court this week if he could participate in the case as an “amicus curiae” or a friend of the court. Miller thinks this would be a good fit because of his “expertise” in what he deems are abuses of the Presidential Records Act by the National Archives.

The proposed jury questionnaire is also firming up in Florida.

OF NOTE: Speaking of presidential records, another Trump aide, former trade adviser Peter Navarro, is still looking for a way to avoid going to prison.

Prosecutors have said the attempt to remove Willis is being done for no other reason than to harass and embarrass her.

As Colorado voters await a ruling from the U.S. Supreme Court, in Illinois this week, a judge removed Trump from that state’s presidential primary ballot.

Cook County Circuit Court Judge Tracie Porter issued the ruling, writing that a “preponderance of evidence” convinced her Trump had “engaged in insurrection.”

With the U.S. Supreme Court’s ruling on Trump’s disqualification hanging in the balance, it is possible that the appeals court could extend a stay. Trump’s legal team has already asked for the hold.

With special counsel Jack Smith on ice in Washington, D.C. and a ruling from the high court required before he can go forward, it could be midsummer before the Supreme Court issues a ruling. The term ends in June.

Chutkan indicated at prior hearings early on that she could tweak the schedule depending on the course of appeals but she has expressed little to no sympathy over the rigors of Trump’s political schedule.
This week, as Donald Trump‘s legal sagas plod ahead — and Super Tuesday fast approaches on March 5 — both he and special counsel Jack Smith are on tenterhooks as they await significant rulings that could shape the fate of Trump’s many criminal indictments. But anticipation — and tension — reached particularly new heights in Florida where U.S. District Judge Aileen Cannon and Smith went head-to-head.

Law&Crime takes a look at those developments and others in Trump’s cases in Florida, Georgia, Washington, D.C., and New York.

FLORIDA

CRIMINAL

Things started out curiously at the federal courthouse in West Palm Beach when Trump’s attorneys asked to file a motion to dismiss all charges in one time-saving brief that would hit every argument, namely: his claim to “absolute immunity” from criminal prosecution, allegations of “vindictive” prosecution, “constitutional vagueness” in the charges, Smith’s “improper” appointment and his contention that any retention of top secret and classified documents was proper under terms of the Presidential Records Act.

Cannon denied the request and instead, ordered motions to be filed piecemeal, citing concerns over “clarity” in the record. Notably, this decision came mere days after Smith entered a motion to reconsider where he called out her “clear error” in setting lax restrictions around sensitive filings in discovery.

Chiefly, Smith expressed concern about the intimidation of witnesses if their names are unsealed on the record as Cannon has decided. For now, the parties are still tangling over that very question so the judge has opted to keep them under wraps.

Trump ended up filing seven motions late on Thursday; four public and three under seal. Additional motions are expected and he filed a motion Friday seeking hearings on nearly a dozen distinct issues.

OF NOTE: Motions to reconsider are quite rare. But Cannon has twice been overturned by a higher court when Smith has pushed back. She must either uphold her ruling or acknowledge the error Smith says she made. If she stays the course, then Smith could appeal and seek a reversal on the ruling. The window to request her dismissal or recusal from the case altogether would fly open at this point, too.

WASHINGTON, D.C.

CRIMINAL

Things are quiet in the federal venue where Trump faces charges that he criminally conspired to overturn the results of the 2020 election and defrauded the United States in the process. Trump’s motions to dismiss the case — and the subsequent appeals that followed — squashed the March 4 trial date set by U.S. District Judge Tanya Chutkan.

Trump filed an application with the Supreme Court to stay the trial two weeks ago so it is the high court’s move next. The wait may not be a matter of mere mulling of the question. It can also take time for justices to write opinions — especially if they deny the stay and choose to explain their dissents or concurrences. But that’s not the only possibility, as longtime prosecutor Steve Vladeck opined Friday on X.com.

OF NOTE: If the Supreme Court declines to hear the question at all, then the ball would go right back to Chutkan to rule on the immunity question. With time factored in for Trump’s pretrial preparations, that could mean the trial in Washington, D.C., gets underway in the summer. That may be wishful thinking as there is also a chance the court could agree to weigh the case but wait until the end of its term to issue a decision. The term ends on Oct. 7 — less than a month before the general election on Nov. 5.

The Supreme Court did, however, agree to set an important hearing on April 16. The justices will hear Fischer v. United States. The question has the potential to upend Trump’s obstruction charge in his case in Washington, D.C., as well as hundreds of other rioters.

CONSTITUTIONAL

The Supreme Court has still not issued a ruling on whether Donald Trump is disqualified from appearing on the presidential primary ballot in Colorado under Section III of the Fourteenth Amendment, also known as the Constitution’s insurrection clause.

Things looked dubious for the petitioners who sued to remove Trump during oral arguments on Feb. 8.

CIVIL

Trump missed a deadline at the U.S. Supreme Court to fight off civil immunity claims stemming from Jan. 6 lawsuits.

NEW YORK

CIVIL

New York State Supreme Court Justice Arthur Engoron slapped away Trump’s attempt to stay the order issued last week directing him to pay $354 million — plus interest — in penalties for lying about Trump Organization finances for years.

Trump offered to make a “counter-judgment.”

But Engoron did not bite.

“You have failed to explain, much less justify, any basis for a stay. I am confident that the Appellate Division will protect your appellate rights,” he wrote in an email to Trump’s defense attorney.

New York State Attorney General Letita James is ready to start collecting what is owed to state taxpayers tout-suite. In an interview with this past week, she said she eyeball’s Trump’s building at 40 Wall Street “each and every day.”

CRIMINAL

For now, Trump’s election interference and hush-money case is still on course for March 25. Trump faces 34 charges brought by Manhattan District Attorney Alvin Bragg.

Bragg has emphasized that the trial is about more than hush-money payments Trump is accused of giving to porn star Stormy Daniels. He has argued that this fraud misled voters about their candidate in the run-up to the 2016 election. Michael Cohen, once Trump’s fixer, is expected to testify.

GEORGIA

CRIMINAL

In Fulton County on Friday, where Trump and more than a dozen co-defendants face racketeering charges, Judge Scott McAfee scheduled closing arguments for District Attorney Fani Willis’ disqualification hearing for March 1.

Willis and special prosecutor Nathan Wade were under intense scrutiny for two days last week as allegations emerged from Trump’s co-defendants that the DA was having an inappropriate romantic relationship with Wade.

If Willis is disqualified, the Georgia trial would likely not go to trial until after the general election in November.
