<p>The <a href="https://lawandcrime.com/tag/washington-d-c/">Washington, D.C.,</a> Attorney General’s Office has moved to dismiss — with prejudice — a <a href="https://lawandcrime.com/u-s-capitol-siege/d-c-attorney-general-uses-the-kkk-act-of-1871-to-sue-proud-boys-and-oath-keepers-over-gutless-jan-6-attack/">civil lawsuit against two far-right extremist groups</a> and several other individuals for their participation in the <a href="https://lawandcrime.com/tag/jan-6/">Jan. 6,</a> attack on the Capitol following “long delays” in the case, telling the court that the government no longer believes the case is worth pursuing.</p>
<p>“The Attorney General has determined that, notwithstanding the virtue and propriety of this case, the District’s limited law enforcement resources must now be committed elsewhere in the service of District residents, taking into account both the growing challenges the District faces and the relatively small recoveries the District stands to obtain on its remaining common law causes of action,” the OAG’s office wrote in the <a href="https://www.courtlistener.com/docket/61615125/367/district-of-columbia-v-proud-boys-international-llc/">five-page filing</a> explaining its decision to drop the suit against Proud Boys International, LLC and the Oath Keepers.</p>
<p>As Law&amp;Crime <a href="https://lawandcrime.com/u-s-capitol-siege/d-c-attorney-general-uses-the-kkk-act-of-1871-to-sue-proud-boys-and-oath-keepers-over-gutless-jan-6-attack/">previously reported</a>, the civil complaint was initially filed in the U.S. District Court in Washington in December 2021 and sought millions of dollars in damages from the groups.</p>
<p>Proceedings were held up as many of the defendants were among the thousands of people prosecuted and convicted for their involvement in the Capitol riot. Among the most notable defendants were Oath Keepers founder Stewart Rhodes and Proud Boys leader Enrique Tarrio, both of whom were convicted of seditious conspiracy.</p>

<p>Rhodes was serving 18 years in federal prison before his sentence was commuted by President Donald Trump in January, while Tarrio had been sentenced to 22 years and was given a full and complete pardon by the president.</p>
<p>The onetime highly anticipated lawsuit was announced with gusto by then-Attorney General Karl Racine, who likened the conservative, pro-Trump mob’s attempts to overturn the 2020 election to the al-Qaeda terrorist attacks of Sep. 11, 2001.</p>
<p>“A very different but familiar enemy, inflamed by a sitting president and other elected officials, wearing military fatigues and red, white and blue,” attacked the national seat of legislative government on Jan. 6, Racine said. “It was like 9/11 — a planned terrorist attack, but this time, our own citizens were hellbent on destroying the freedoms and ideals on which our country was founded, and continues to aspire to achieve.”</p>
<p>Calling the incident “gutless” and traumatizing for members of law enforcement, Racine said the taxed-without-representation federal district had “chosen to speak truth through this lawsuit” by targeting the Proud Boys and the Oath Keepers.</p>

<p>The suit was premised on the Ku Klux Klan Act of 1871. It also employs another closely related federal law that increases liability for violations of the act and several common law tort claims.</p>
<p>“[T]he Individual Defendants conspired together and participated in planning, promoting, financing, organizing, and carrying out the January 6th Attack,” the filing reads. “Defendants Proud Boys and Oath Keepers also participated in the conspiracy, playing a key role in the planning, promotion, financing, organizing, and carrying out of the January 6th Attack by lending their experience — and in some cases, organizational resources — to the planned January 6th Attack.”</p>

<p>A Washington, D.C., judge has transferred interest in a trademark owned by Proud Boys International, a far-right group, to a church that its members vandalized in December 2020.</p>
<p>The judge’s injunction also banned Proud Boys International from selling or licensing its trademark without court approval or the consent of the Metropolitan African Methodist Episcopal Church, which had sued over the attack.</p>
<p>Judge Tanya M. Jones Bosier of the District of Columbia Superior Court entered the injunction <a href="https://s3.documentcloud.org/documents/25512616/2024-cab-004147.pdf">Feb. 3</a> after the Metropolitan African Methodist Episcopal Church in Washington, D.C., sued to enforce a $2.8 million default judgment against the Proud Boys.</p>
<p>The <a href="https://www.nytimes.com/2025/02/03/us/politics/proud-boys.html">New York Times</a>, the <a href="https://www.the-independent.com/news/world/americas/us-politics/proud-boys-trademark-trump-church-enrique-tarrio-b2691799.html">Independent</a>, the <a href="https://www.theguardian.com/us-news/2025/feb/04/proud-boys-group-lose-name-to-black-church">Guardian</a> and the <a href="https://thehill.com/regulation/court-battles/5124942-proud-boys-trademark-church-vandalized">Hill</a> are among the publications with coverage.</p>
<p>Bosier’s ruling “effectively means that Proud Boys chapters across the country can no longer legally use their own name or the group’s traditional symbols without the permission of the church,” the New York Times reports. “The ruling also clears the way for the church to try to seize any money that the Proud Boys might make by selling merchandise, like hats or T-shirts emblazoned with their name or with any of their familiar logos, including a black and yellow laurel wreath.”</p>
<p>The Metropolitan African Methodist Episcopal Church in Washington, D.C., had obtained the default judgment in <a href="https://s3.documentcloud.org/documents/23865650/metropolitan-ame-v-proud-boys.pdf">a June 2023 decision</a> by Judge Neal E. Kravitz of the District of Columbia Superior Court. He ruled after the church alleged that the Proud Boys trespassed on church property during a march and destroyed its large Black Lives Matter sign.</p>
<p>The church <a href="https://www.paulweiss.com/practices/pro-bono/news/metropolitan-ame-wins-1-million-in-damages-over-proud-boys-attack-on-church?id=47274">was represented by</a> the Lawyers’ Committee for Civil Rights Under Law; the Washington Lawyers’ Committee for Civil Rights and Urban Affairs; and Paul, Weiss, Rifkind, Wharton &amp; Garrison.</p>
<p>One of the defendants in the lawsuits was Enrique Tarrio, a former Proud Boys leader who had been <a href="https://www.justice.gov/usao-dc/pr/proud-boys-leader-sentenced-22-years-prison-seditious-conspiracy-and-other-charges">sentenced to 22 years</a> in prison for seditious conspiracy and other crimes for helping to plan the Jan. 6, 2021, U.S. Capitol attack. Tarrio was not at the Capitol during the attack, however, because he was banned from the city after he was arrested on vandalism charges, the New York Times explains.</p>
<p>Last month, Tarrio received a full pardon of his Capitol attack convictions from President Donald Trump.</p>
<p>Tarrio commented on the trademark injunction in a post <a href="https://x.com/NobleOne/status/1886782313742135707">on X</a>, formerly known as Twitter. He accused the church of engaging “in a campaign of harassment and falsehoods.” The judge’s conduct, he said, “necessitates impeachment and investigation.”</p>

<p>The mother of the Proud Boys leader who helped orchestrate the <a href="https://lawandcrime.com/tag/jan-6/" target="_blank" rel="noopener">Jan. 6</a> attack on the U.S. Capitol went on television to ask President-elect Donald Trump to pardon her son from his 22-year sentence.</p>
<p><a href="https://lawandcrime.com/tag/enrique-tarrio/" target="_blank" rel="noopener">Enrique Tarrio</a> was not in Washington D.C. that day but prosecutors argued he was one of the chief architects of the riot as he was the head of the Proud Boys who led the assault on the Capitol. A jury agreed, convicting him of seditious conspiracy, and a judge handed out the longest sentence of any of the Jan. 6 defendants. Now with Trump set to take office next year, many of the imprisoned rioters are hoping he issues them pardons as he said he would while on the campaign trail.</p>

<p>In an interview with <a href="https://www.nbcmiami.com/news/local/mom-of-ex-proud-boys-leader-imprisoned-over-capitol-riot-hopes-he-will-be-pardoned/3499774/" target="_blank" rel="noopener">South Florida NBC affiliate WTVJ</a>, Tarrio’s mother Zuny Tarrio spoke directly to Trump.</p>
<p>“President Trump, I think my son and most of those J6, if not all, deserve to be home with their families,” she said. “We’ve suffered long enough.”</p>
<p>She said while the riot was unfortunate, the “government” should have prevented it before it happened.</p>
<p>“I don’t think anyone honestly likes what happened January 6th,” Zuny Tarrio said. “I think the way that it happened, shouldn’t have happened. I think the government could have stopped that in a lot of ways.”</p>
<p><a href="https://lawandcrime.com/u-s-capitol-breach/accused-rioter-seen-storming-pelosis-office-asks-judge-dont-let-prosecutors-tell-jury-about-police-who-died-after-jan-6/" target="_blank" rel="noopener">At least five police officers</a> who engaged with the violent mob died after Jan. 6. Dozens more were injured. Zuny Tarrio said when officers took an oath “there’s no guarantees of what happens when you do a job like that.” She also said the idea that her son was a leader of the riot is “far-fetched” because people who weren’t Proud Boys also committed violence.</p>
<p>“Enrique Tarrio wasn’t even there that day. He was not on the [Capitol] grounds,” she said. “He was not in Washington D.C. that day.”</p>
<p>She described the last few years with her son in prison as “horrific.”</p>

<p>“It’s a terrible feeling to have a child in federal prison without a real reason,” she said.</p>
<p>As Law&amp;Crime <a href="https://lawandcrime.com/u-s-capitol-breach/proud-boys-leader-enrique-tarrio-gets-longest-sentence-of-any-jan-6-defendant-for-plot-to-attack-capitol/" target="_blank" rel="noopener">previously reported</a>, Tarrio and his four co-defendants faced a raft of other charges in addition to seditious conspiracy, widely considered to be the most serious charge to date against rioters who stormed the Capitol building on Jan. 6. The mob, <a href="https://lawandcrime.com/u-s-capitol-breach/brian-sicknicks-estate-sues-donald-trump-for-inciting-men-charged-with-pepper-spray-attack-on-fallen-officer-on-jan-6/" target="_blank" rel="noopener">spurred on</a> by then-President Donald Trump’s repeated false statements that fraud affected the outcome of the 2020 presidential election, overwhelmed police trying to beat back the crowd and violently breached the building as Congress had begun to certify Joe Biden’s 2020 electoral win. Lawmakers were forced to evacuate or <a href="https://lawandcrime.com/u-s-capitol-breach/everyone-stayed-nancy-pelosis-right-hand-woman-shares-harrowing-jan-6-details-at-trial-of-man-who-kicked-up-his-feet-on-office-desk/" target="_blank" rel="noopener">shelter in place</a> for several harrowing hours.</p>
<p>The trial of the top leadership of the self-described “Western Chauvinist” group was a rocky road from the start, with nearly three weeks of contentious jury selection. Opening arguments from prosecutors reminded jurors of Trump’s “<a href="https://apnews.com/article/election-2020-joe-biden-race-and-ethnicity-donald-trump-chris-wallace-0b32339da25fbc9e8b7c7c7066a1db0f" target="_blank" rel="noopener">stand back and stand by</a>” edict to the Proud Boys — issued during a September 2020 presidential debate — and said that the extremist group was prepared to engage in violence in order disrupt the peaceful transition of presidential power and keep Trump in office.</p>
<p>“These men did not stand back,” Assistant U.S. Attorney Jason McCullough <a href="https://lawandcrime.com/live-trials/proud-boys/they-did-not-stand-by-proud-boys-jan-6-seditious-conspiracy-trial-kicks-off-with-opening-statements/" target="_blank" rel="noopener">said in opening statements</a>. “They did not stand by. Instead, they mobilized.”</p>
<p>Prosecutors had alleged that Tarrio created the group’s so-called “Ministry of Self Defense” (MOSD) chapter in order to plan for violence on Jan. 6 and used encrypted messaging to organize and coordinate the Proud Boys’ role in the attack. While Tarrio himself was not in Washington that day — having recently been ordered to leave the city after being arrested for burning a stolen Black Lives Matter flag in front of a historically Black D.C. church — he encouraged his followers to stay the course at the Capitol.</p>
<p>Similarly, the House committee investigating the Jan. 6 attack found that <a href="https://lawandcrime.com/jan-6-committee/their-plan-is-to-literally-kill-people-top-5-bombshells-from-secret-service-communications-obtained-by-the-jan-6-committee/" target="_blank" rel="noopener">the Proud Boys “did lead the assault”</a> on the Capitol building that day.</p>
<p>The defense teams, meanwhile, argued that there wasn’t enough evidence to show that the defendants had all mutually agreed to carry out the attack.</p>
<p>Attorneys for the defendants also argued that Trump — who earlier that day told his supporters at the so-called “Stop the Steal rally” to march to the Capitol and “<a href="https://lawandcrime.com/jan-6-committee/that-is-an-insurrection-jan-6th-committee-releases-massive-final-report-on-unprecedented-attack-on-u-s-capitol/" target="_blank" rel="noopener">fight like hell</a>” — was the real culprit.</p>

<p>A <a href="https://lawandcrime.com/tag/washington-d.c./" target="_blank" rel="noopener">Washington, D.C.,</a> police officer worked as a “double agent” ahead of the Jan. 6 Capitol riot, once tipping off the head of the Proud Boys about his impending arrest for burning a Black Lives Matter flag, prosecutors reportedly said Monday during opening statements at his trial.</p>
<p>Former D.C. Metro Police Department Lt. Shane Lamond also kept in close contact with <a href="https://lawandcrime.com/tag/proud-boys/">Proud Boys</a> leader <a href="https://lawandcrime.com/tag/enrique-tarrio/" target="_blank" rel="noopener">Henry “Enrique” Tarrio</a> in the lead-up to the Jan. 6 riot that interrupted the certification of Joe Biden as the winner of the 2020 presidential election, prosecutors allege. Lamond is charged with obstruction of justice and three counts of making false statements to police about his conversations with Tarrio, who is now <a href="https://lawandcrime.com/u-s-capitol-breach/proud-boys-leader-enrique-tarrio-gets-longest-sentence-of-any-jan-6-defendant-for-plot-to-attack-capitol/" target="_blank" rel="noopener">serving a 22-year prison sentence</a> for his role in organizing the riot. Lamond is undergoing a bench trial on the charges in front of U.S. District Judge Amy Berman Jackson.</p>

<p>“Lamond leaked sensitive police information to a criminal suspect, and lied about it to investigators,” Assistant U.S. Attorney Joshua Rothstein told Berman, according to <a href="https://www.washingtonpost.com/dc-md-va/2024/12/02/lamond-trial-proud-boys/" target="_blank" rel="noopener">The Washington Post</a>. “The evidence will show that the defendant was a Proud Boys sympathizer. The defendant became a double agent.”</p>
<p>Per the <a href="https://lawandcrime.com/crime/someone-called-in-an-anonymous-tip-d-c-lieutenant-leaked-info-to-proud-boys-leader-about-impending-arrest-for-burning-blm-banner-feds-say/" target="_blank" rel="noopener">March 2023 indictment</a>, Lamond was the head of MPD’s intelligence branch that monitored upcoming protests and rallies in D.C. when he and Tarrio started communicating regularly using the encrypted messaging app Telegram.</p>
<p>After Joe Biden was declared the winner of the 2020 presidential election, Lamond allegedly sent a text message to Tarrio that said “Hey brother, sad, sad news today. You guys planning anything?” Lamond also allegedly tipped Tarrio off that law enforcement had been hearing chatter of Proud Boys saying they were “mobilizing” and planning on “taking back the country.” Lamond also allegedly kept Tarrio apprised of cops possibly shutting down a bar that was a Proud Boys hangout.</p>

<p>Tarrio and the Proud Boys held a rally on Dec. 12, 2020. That night, Tarrio stole a Black Lives Matter banner, burned it and later boasted about the feat on social media. Prosecutors said Tarrio and Lamond were in “regular contact” after the incident and spoke about the investigation. Tarrio allegedly spoke with fellow Proud Boys members about his “contact” with MPD. Lamond told Tarrio that cops were trying to obtain a warrant for his arrest, cops say.</p>
<p>On Jan. 4, 2021, Tarrio was flying from Florida to D.C. when Lamond allegedly changed his settings on Telegram so that messages would delete 10 seconds after being opened. Prosecutors believe the now disgraced cop told the Proud Boys leader that there had been a warrant signed for his arrest and that he would be taken into custody once in D.C. Lamond continued messaging Tarrio before and after the Jan. 6 riots about the police investigation, prosecutors said.</p>
<p>Lamond allegedly told Tarrio “Of course I can’t say it officially, but personally I support you all and don’t want to see your group’s reputation dragged through the mud.”</p>
<p>The U.S. Attorney’s Office began investigating Lamond’s association with the Proud Boys in June 2021. Prosecutors claim Lamond lied about the way he communicated with Tarrio and denied feeding Tarrio confidential information about the banner burning investigation.</p>
<p>During Monday’s opening statements, Lamond’s attorney Ana Jara said describing her client as a Proud Boys sympathizer is “simply not true” and that prosecutors have “cherry-picked” messages between him and Tarrio. Lamond was simply working a source as a law enforcement officer, she said.</p>
<p>“Context matters, especially in conversations,” Jara said, according to <a href="https://www.nbcwashington.com/news/local/dc-police-officer-became-double-agent-for-proud-boys-prosecutor-says/3781404/" target="_blank" rel="noopener">The Associated Press</a>.</p>
<p>The trial is expected to last three days.</p>

<p>Add Proud Boys member and <a href="https://lawandcrime.com/tag/florida/" target="_blank" rel="noopener">Florida</a> man Joseph Biggs — convicted of seditious conspiracy and sentenced to one of the longest prison terms for his role in the Jan. 6 riot at the U.S. Capitol, to the growing list of felons seeking a pardon from President-elect Donald Trump.</p>
<p>U.S. District Judge Timothy Kelly, a Trump appointee, last year <a href="https://lawandcrime.com/u-s-capitol-breach/first-proud-boys-members-sentenced-for-seditious-conspiracy-in-jan-6-capitol-attack/" target="_blank" rel="noopener">sentenced the 40-year-old Biggs</a> to 17 years behind bars after a jury <a href="https://lawandcrime.com/live-trials/proud-boys/proud-boys-leader-enrique-tarrio-and-his-top-lieutenants-convicted-in-historic-jan-6-seditious-conspiracy-case/" target="_blank" rel="noopener">convicted him of seditious conspiracy</a>, among other charges, in May 2023. Now his camp is hoping the prison sentence will soon end with Trump headed back to the White House.</p>
<p>Biggs’ attorney Norm Pattis, known for <a href="https://lawandcrime.com/live-trials/live-trials-current/alex-jones/alex-jones-files-for-personal-bankruptcy-protection-after-massive-sandy-hook-judgments/" target="_blank" rel="noopener">representing Alex Jones and Infowars employees</a>, told <a href="https://www.fox35orlando.com/news/proud-boys-organizer-from-florida-seeking-pardon-from-president-elect-donald-trump-attorney-says" target="_blank" rel="noopener">Orlando Fox affiliate WOFL</a> that he is writing Trump a letter urging him to give his client a pardon. Pattis said releasing Biggs from prison is in the public’s interest.</p>

<p>“The notion that Mr. Biggs is some sort of domestic terrorist that should sit behind bars for 17 years is a chilling message to everyone,” Pattis told the TV station. “And that is you ought not to write patriotic hyperbole and then attend a protest, because if you do, an ambitious prosecutor is going to turn your words into circumstantial evidence of intent to commit a crime. And that’s just un-American.”</p>
<p>Pattis told the <a href="https://www.news-journalonline.com/story/news/courts/2024/11/11/volusia-county-proud-boys-leader-joe-biggs-to-seek-pardon-from-trump/76125908007/" target="_blank" rel="noopener">Daytona Beach News-Journal</a> that Biggs is “excited and hopeful about the prospects of a pardon.” As the News-Journal pointed out, Biggs was confident about receiving a pardon even before Trump’s election. He expressed that sentiment in a jailhouse interview with Infowars last year. MSNBC’s “All In with Chris Hayes” <a href="https://www.youtube.com/watch?v=_vQmTy0y-wo">played a clip</a> of the interview.</p>

<p>Trump has said he would pardon Jan. 6 defendants but has not been specific on who among the roughly 1,500 rioters arrested would receive one. He <a href="https://apnews.com/article/trump-day-1-priorities-deportations-drilling-ukraine-6747c6e64b0440978f59450b928f61d1" target="_blank" rel="noopener">said on his social media platform</a> that he would pardon “many of them” but not the ones who “got out of control.”</p>

<p>Since the election, many Jan. 6 defendants have filed requests to delay hearings on their cases until after Trump is inaugurated on Jan. 20.</p>
<p>“Ultimately, my jury was the entire American public, and they voted for a mandate to set me free,” wrote one alleged rioter from Kansas, <a href="https://lawandcrime.com/u-s-capitol-breach/kansas-man-who-denies-turning-himself-in-to-the-fbi-after-jan-6-gets-permission-to-represent-himself/" target="_blank" rel="noopener">Will Pope</a>, in a motion filed Friday. “If there should be a jury trial in my case, it should happen after emotions have had time to cool.”</p>
<p>The Justice Department wasn’t having it with that excuse.</p>
<p>“No continuance is warranted here,” prosecutors said in an opposition filing on Saturday. “At this time, the defendant’s expectation of a pardon is mere speculation, and the Court should proceed as it would in any other prosecution.”</p>

<p>Others have tried to slip in under special counsel Jack Smith’s <a href="https://lawandcrime.com/high-profile/as-a-result-of-the-election-jack-smith-is-calling-it-quits-in-jan-6-case-against-trump-cites-department-of-justice-policy/" target="_blank" rel="noopener">decision to call it quits</a> in the Washington, D.C., criminal case against Trump, as a sitting U.S. president cannot be prosecuted.</p>
<p>But the DOJ, at least under President Joe Biden, has signaled that prosecution of individual Jan. 6 defendants will move forward.</p>
<p>“The defendant’s citation to Special Counsel Jack Smith’s motion to vacate a briefing schedule in the matter of United States v. Trump, is inapposite,” DOJ prosecutors argued in a filing opposing accused Jan. 6 rioter Stephen Baker‘s <a href="https://lawandcrime.com/high-profile/unprecedented-circumstance-justice-department-says-accused-jan-6-rioters-wont-be-getting-the-jack-smith-special/" target="_blank" rel="noopener">request to continue his case</a> — a motion that U.S. District Judge Christopher Cooper, a Barack Obama appointee, promptly denied.</p>

Lawmakers were forced to evacuate or <a href="https://lawandcrime.com/u-s-capitol-breach/everyone-stayed-nancy-pelosis-right-hand-woman-shares-harrowing-jan-6-details-at-trial-of-man-who-kicked-up-his-feet-on-office-desk/" target="_blank" rel="noopener">shelter in place</a> for several harrowing hours.</p>
<p>Biggs, along with other members of the right-wing Proud Boys and Oath Keepers groups, were accused of being among the first people to illegally enter the Capitol and the chief organizers of the riot. At his sentencing hearing, Biggs reportedly told the judge that he has spent a lot of time thinking about the kind of person he wants to be and that the only organization he wants to be a part of going forward is his daughter’s PTA. He also said he’s tired of being in the so-called “<a href="https://lawandcrime.com/u-s-capitol-breach/new-jersey-man-charged-with-assaulting-police-officer-caught-in-doorway-crush-on-jan-6-sues-doj-over-mistreatment-in-d-c-jail/" target="_blank" rel="noopener">Patriot Pod</a>” at the Washington jail where several Jan. 6 defendants are being held.</p>
<p>Biggs and co-defendant Zachary Rehl were convicted of seditious conspiracy, obstruction of an official proceeding of Congress, and other crimes in connection with the Jan. 6 attack. Rehl received a 15-year sentence. Biggs is currently at a federal prison in Alabama.</p>

<p>The <a href="https://lawandcrime.com/tag/pennsylvania/" target="_blank" rel="noopener">Pennsylvania</a> Proud Boys member widely seen as the tip of the spear that first broke through a police barrier at the U.S. Capitol on Jan. 6 has been convicted of felonies and misdemeanors in connection with the riot but acquitted of trespassing charges.</p>
<p>In a mixed verdict handed down Friday, U.S. District Judge Jia Cobb convicted <a href="https://lawandcrime.com/tag/ryan-samsel/" target="_blank" rel="noopener">Ryan Samsel</a> and co-defendants James Grant, Paul Johnson, Steven Randolph, and Jason Blythe of civil disorder and assault on police with a dangerous weapon, both felonies, as well as an act of physical violence in the Capitol grounds or buildings, a misdemeanor, Washington, D.C., CBS affiliate <a href="https://twitter.com/JordanOnRecord/status/1753462802314833920" target="_blank" rel="noopener">WUSA</a> reported. Samsel, Grant, and Johnson were additionally convicted of obstruction of an official proceeding, a 20-year felony, and misdemeanor disorderly conduct in a Capitol building or grounds.</p>
<p>Only Samsel was convicted of additional counts of civil disorder and assaulting police, both with and without a dangerous weapon.</p>
<p>As Law&amp;Crime previously reported, Samsel was accused of facing off against police officers over barriers at the Peace Circle on Jan. 6. During that <a href="https://lawandcrime.com/u-s-capitol-siege/officer-assaulted-on-jan-6-urges-judge-to-keep-alleged-attacker-in-jail-no-more-women-should-have-to-fear-injury-at-his-hands/">confrontation</a>, Officer Caroline Edwards was thrown to the ground, hitting her head on a concrete step and suffering a concussion.</p>
<p>That confrontation preceded “hours and hours of hand-to-hand combat,” Edwards said in her June 9 <a href="https://lawandcrime.com/jan-6-committee/jan-6-committee-outlines-anatomy-of-trump-led-attempted-coup-reveals-45th-president-said-supporters-calls-for-pences-hanging-may-be-the-right-idea/">testimony</a> before the House Select Committee to Investigate the Jan. 6 Attack on the U.S. Capitol.</p>

<p>All the men were acquitted of entering and remaining in a restricted building or grounds with a dangerous weapon, disorderly and disruptive conduct in a restricted building or grounds with a dangerous weapon, and engaging in physical violence in a restricted building or grounds with a dangerous weapon.</p>
<p>Those acquittals reflect Cobb’s conclusion that a trespassing conviction under the circumstances requires defendants to know that a Secret Service protectee — such as then-Vice President Mike Pence — was present on Capitol grounds, Politico <a href="https://twitter.com/kyledcheney/status/1753460138713715175" target="_blank" rel="noopener">reported</a>.</p>
<p>Samsel has been linked to another high-profile Jan. 6 defendant, <a href="https://lawandcrime.com/u-s-capitol-breach/first-proud-boys-members-sentenced-for-seditious-conspiracy-in-jan-6-capitol-attack/" target="_blank" rel="noopener">Joseph R. Biggs</a>, a member of the Proud Boys who was convicted of seditious conspiracy in the Jan. 6 Capitol attack. Biggs and Samsel allegedly spoke briefly before Samsel moved forward with the assault on Edwards and other officers; Samsel has denied that such an exchange ever occurred.</p>
<p>The House committee investigating the Jan. 6 Capitol attack has said that the assault on police at the Peace Circle was the first of multiple breaches at the Capitol that day, and was the result of reconnaissance by the Proud Boys, looking for vulnerabilities in Capitol security.</p>
<p>Samsel, who has been detained since his arrest in January 2021, has made <a href="https://lawandcrime.com/u-s-capitol-breach/pa-man-accused-in-jan-6-attack-on-cop-who-suffered-a-concussion-demands-medical-treatment-for-a-condition-deemed-not-urgent-by-jail-doctor/">multiple complaints</a> about what he says is a lack of effective — and necessary — medical treatment. According to medical records, Samsel suffers from several health problems, including blood clots causing circulation issues in his arms, and a condition called gynecomastia, or overdevelopment of breast tissue in men.</p>
<p>The verdict comes more than a month after the trial, which started in late October, and concluded in December.</p>
<p>It was not immediately clear when sentencing would be held.</p>

<p>Federal prosecutors have asked a judge to increase the pending prison sentence for a <a href="https://lawandcrime.com/tag/florida/" target="_blank" rel="noopener">Florida</a> man who fled ahead of his sentencing hearing for felony convictions stemming from the Jan. 6 attack on the U.S. Capitol.</p>
<p>As Law&amp;Crime previously reported, <a href="https://lawandcrime.com/tag/christopher-worrell/" target="_blank" rel="noopener">Christopher Worrell</a> <a href="https://lawandcrime.com/u-s-capitol-breach/florida-man-on-house-arrest-disappears-days-before-sentencing-for-spraying-capitol-police-with-pepper-gel-on-jan-6/" target="_blank" rel="noopener">went missing in August</a> days before he was supposed to report to court in Washington, D.C., for sentencing before U.S. District Judge Royce Lamberth. Lamberth, a Ronald Reagan appointee, had convicted Worrell in May of seven felonies, including obstructing an official proceeding of Congress, civil disorder, and assaulting officers using a dangerous weapon.</p>
<p>Worrell <a href="https://lawandcrime.com/u-s-capitol-breach/proud-boy-who-assaulted-police-on-jan-6-and-skipped-out-on-sentencing-hearing-found-unconscious-in-home-with-sur" target="_blank" rel="noopener">was finally caught</a> weeks later, in late September — and according to a memo filed by federal prosecutors on Tuesday, he pretended to overdose on drugs in an attempt to further delay facing his fate.</p>
<p>“He apparently had no intention of ever turning himself in,” the DOJ’s supplemental sentencing memorandum says. “Worrell was recaptured, however, when he attempted to covertly return to his residence. Worrell then faked a drug overdose prior to his arrest, and maintained that lie during a five-day hospital stay, wasting the time and money of both medical staff and the Collier County Sheriff’s Office, which provided deputies to watch Worrell 24/7 in a non-secure hospital location and was left to foot the bill for Worrell’s unnecessary medical care.”</p>

<p>Prosecutors wanted to “put these new, aggravating facts” before Lamberth, who the government said should “increase the sentence [the judge] was previously going to impose on Worrell to account for this new misconduct.”</p>
<p>Prosecutors say that on Aug. 14, 2023, Worrell “cut off his GPS ankle monitor in a Walmart parking lot and fled his residence.” Prosecutors say he left behind a note “making clear he had fled.”</p>
<p>Investigators staked out Worrell’s home, where the defendant “attempted to covertly return” on Sept. 28. That’s when the FBI made its move — and discovered Worrell inside, “seemingly unresponsive, with an opened bottle of opioid prescription medication in his hand.”</p>
<p>Agents performed “what they thought were lifesaving procedures” on Worrell and got him to the hospital, the memo says.</p>
<p>It was all for naught.</p>
<p>“This was, the government later learned, all a ruse — Worrell pretended to have a medical emergency as a ‘delay tactic’ to stall the government’s investigation,” prosecutors said. It seemed to have worked, at least temporarily: according to the government, Worrell spent five days in the hospital before being cleared by doctors who believed he had overdosed on opioids. Local sheriff’s deputies kept constant watch, paying thousands in overtime.</p>
<p>“The entire time, Worrell knew he was fine,” prosecutors wrote.</p>
<p>Worrell himself appeared to acknowledge as much. Prosecutors attached an email exchange between Worrell and someone identified only as “B.S.” in which Worrell seems to acknowledge that the “overdose” wasn’t real.</p>

<p>“I need to know the truth bro did you try to kill your self I hope you didn’t I need the truth,” wrote B.S. in an email.</p>
<p>“I did not!!” Worrell replied moments later. “Will explain more when we talk. I already told you some of it[.]”</p>
<p>“OK I believe you,” B.S. wrote back.</p>
<p>“I have never and will never lie to you,” Worrell insisted in his reply. “It was a stupid delay tactic. Will tell you more when we talk.”</p>

<p>Worrell’s alleged actions may stretch the patience of Lamberth, who previously had extended sympathy to Worrell over ongoing health issues: In October 2021, Lamberth <a href="https://lawandcrime.com/u-s-capitol-siege/after-proud-boys-complaints-judge-calls-out-jail-warden-and-asks-ag-garland-to-investigate-potential-civil-rights-violations-of-jan-6-defendants/" target="_blank" rel="noopener">found two D.C. jail officials in contempt of court</a> for failing to comply with an order to provide notes about <a href="https://lawandcrime.com/u-s-capitol-breach/judge-wants-answers-after-report-that-proud-boy-violated-conditions-of-release-from-jail-in-jan-6-case/" target="_blank" rel="noopener">Worrell’s medical care while in detention</a>. Worrell suffered from non-Hodgkin’s lymphoma, a type of cancer that generally develops in the lymph nodes. With appropriate treatment, it is curable in many cases. Lamberth had <a href="https://lawandcrime.com/u-s-capitol-breach/judge-wants-answers-after-report-that-proud-boy-violated-conditions-of-release-from-jail-in-jan-6-case/" target="_blank" rel="noopener">allowed Worrell to remain on pretrial release</a> and pursue medical treatment.</p>
<p>Indeed, the DOJ noted in its initial sentencing memo that it was seeking a low-end sentence “only because of Worrell’s ongoing medical conditions.” In that August sentencing memo filed before Worrell’s disappearance, prosecutors had requested a sentence of 168 months — the shortest term possible out of an anticipated 168-210 month guidelines range.</p>
<p>Now, it seems, the government has run out of sympathy.</p>
<p>“Worrell has now admitted faking a drug overdose for strategic reasons,” the memo says. “And as the government has documented at length elsewhere, some of Worrell’s claims as to his medical treatment or conditions have been unsubstantiated by, or directly refuted by, medical records from at least a half-dozen different medical providers.”</p>
<p>Prosecutors remind Lamberth that Worrell “repeatedly lied under oath” at trial, and provided what the judge called “the most ridiculous explanation” the judge “had ever heard in [its] life” in an attempt to excuse his <a href="https://lawandcrime.com/u-s-capitol-breach/judge-wants-answers-after-report-that-proud-boy-violated-conditions-of-release-from-jail-in-jan-6-case/" target="_blank" rel="noopener">2022 bond violation</a>.</p>
<p>“At this point, Worrell’s claims of past medical mistreatment while in custody should be viewed as suspect,” prosecutors concluded.</p>
<p>In addition, Worrell’s flight, and subsequent fake overdose, “demonstrates contempt for this judicial proceeding and an attempt by Worrell to evade all consequences for his misconduct on January 6, 2021 and his perjury during trial.” Worrell remains “unremorseful,” prosecutors say, and his actions resulted in an “enormous waste of government resources.”</p>
<p>The DOJ lawyers do not specify how much time they now believe Worrell should spend behind bars; the statutory maximum he could face for the obstruction charge is 20 years in prison.</p>
