<p>Jenner &amp; Block has become the fourth BigLaw firm targeted by President Donald Trump in a punitive executive order.</p>
<p>The <a href="https://www.whitehouse.gov/presidential-actions/2025/03/addressing-risks-from-jenner-block/">March 25 order</a> calls for suspension of security clearances held by people at Jenner &amp; Block, limits access to government buildings by Jenner &amp; Block employees, seeks termination of its clients’ government contracts, and bars the federal government from hiring Jenner &amp; Block employees absent a waiver.</p>
<p>Jenner &amp; Block “is yet another law firm that has abandoned the profession’s highest ideals, condoned partisan ‘lawfare’ and abused its pro bono practice to engage in activities that undermine justice and the interests of the United States,” the order declares.</p>
<p>The order criticizes the firm’s diversity practices, its representation in cases involving transgender and immigration issues, and its rehiring of the lead prosecutor working with former special counsel Robert Mueller.</p>
<p>A Jenner &amp; Block spokesperson provided this statement to the ABA Journal: “Jenner &amp; Block has had a long history representing clients, paid and pro bono, in their most difficult matters since 1914. Today, we have been named in an executive order similar to one which has already been declared unconstitutional by a federal court. We remain focused on serving and safeguarding our clients’ interests with the dedication, integrity and expertise that has defined our firm for more than 100 years and will pursue all appropriate remedies.”</p>

<p>The order criticizes Jenner &amp; Block’s <a href="https://www.prnewswire.com/news-releases/andrew-weissmann--former-department-of-justice-fraud-section-chief-fbi-general-counsel-and-special-counsel-lead-prosecutor--to-rejoin-jenner--block-301049514.html">April 2020 rehiring</a> of Andrew Weissmann. He is the former lead prosecutor for what the order calls the “entirely unjustified” investigation by Mueller, who examined coordination between the Russian government and the Trump campaign.</p>
<p>Weissmann left Jenner &amp; Block in 2021 and is <a href="https://its.law.nyu.edu/facultyprofiles/index.cfm?fuseaction=profile.overview&amp;personid=39254">currently listed</a> as a professor at the New York University School of Law.</p>
<p>Mueller’s <a href="https://www.abajournal.com/news/article/special-counsel-robert-muellers-report-is-released-what-are-the-findings">investigation found</a> that Trump did not collude with the Russian government to interfere with the 2016 election and found insufficient evidence to establish that Trump obstructed the special counsel probe.</p>
<p>The order also said Jenner &amp; Block “engages in obvious partisan representations to achieve political ends.” The order appeared to criticize the firm’s involvement in lawsuits against the administration seeking to restore funding for gender-affirming medical care and seeking to allow immigrants to remain in the United States while asylum claims are pending.</p>
<p>Jenner &amp; Block is also accused in the order of using race-based targets in a way that discriminates against its employees.</p>
<p>Three other firms previously targeted in Trump’s executive orders are Covington &amp; Burling; Perkins Coie; and Paul, Weiss, Rifkind, Wharton &amp; Garrison.</p>
<p>Perkins Coie responded with a suit, while Paul Weiss <a href="https://www.abajournal.com/news/article/paul-weiss-leader-cites-potential-existential-crisis-as-one-reason-for-trump-deal-critics-include-141-firm-alumni">reached an agreement</a> with Trump that led to lifting of the order. The agreement requires Paul Weiss to dedicate $40 million in pro bono legal services to support Trump administration initiatives, including projects that include veterans assistance, fairness in the justice system and a presidential task force on antisemitism.</p>
<p>A federal judge <a href="https://www.abajournal.com/web/article/trump-order-targeting-perkins-coie-is-an-affront-to-the-constitution-law-firm-says-in-lawsuit">who entered</a> a temporary restraining order in the Perkins Coie challenge said the firm was likely to succeed on its First Amendment and due process claims.</p>

<p>An Oklahoma lawyer has been suspended for six months for watching real-time jury deliberations on a monitor in a murder case that he prosecuted.</p>
<p>The Oklahoma Supreme Court suspended former assistant district attorney Isaac Seth Brantley Shields in a <a href="https://www.oscn.net/applications/oscn/DeliverDocument.asp?CiteID=547835">March 25 decision</a>.</p>
<p>The Legal Profession Blog <a href="https://lawprofessors.typepad.com/legal_profession/2025/03/a-six-month-suspension-has-been-imposed-by-the-oklahoma-supreme-court-in-june-2022-respondent-was-an-assistant-district-att.html">published highlights</a>.</p>
<p>Shields violated “the inner sanctum of a jury,” which is “a high breach of trust and a serious interference with the administration of justice,” the Oklahoma Supreme Court said. “It is common knowledge that observing jury deliberations is unacceptable.”</p>
<p>Shields was accused of watching the deliberations video July 1, 2022, in the trial of Chouteau, Oklahoma, man Robert Kent Kraft, according to prior coverage by <a href="https://www.kjrh.com/news/local-news/rogers-county-d-as-office-employees-under-investigation-suspended">KJRH.com</a>. There was no audio, according to the Oklahoma Supreme Court.</p>
<p>Shields was an assistant district attorney in Oklahoma’s District 12, which consists of Craig County, Mayes County and Rogers County. He was the lead prosecutor in the trial of Kraft, who claimed that he fatally stabbed another man in self-defense.</p>
<p>Jurors were deliberating in an adjacent courtroom to give them more space during the COVID-19 pandemic. The room was equipped with three security cameras that remained on during deliberations. Facial expressions and hand gestures were visible on the high-quality video, but it was not possible to read words on paper.</p>
<p>Two hours into the deliberations, an officer allowed Shields into the locked security office where the video played. Shields claimed that he was asked to enter because of a security situation involving the defendant’s family trying to enter the courtroom; security personnel said the security incident happened hours later, but they did not know why Shields was allowed in.</p>
<p>Shields said he did not immediately leave because he was curious about what was taking the jurors so long and because he had nothing else to do, the Oklahoma Supreme Court said. He left and returned several times. He later told another assistant district attorney who was the second chair in the trial to come the security room. Shields controlled the cameras to zoom in and zoom out and discussed his observations with security officers and the other prosecutor.</p>
<p>At first, there appeared to be a holdout juror, but Kraft was ultimately convicted of first-degree murder. His case is on appeal after a mistrial was granted because of the prosecutors’ jury observations.</p>
<p>A deputy reported his concerns about the prosecutors watching the video. When asked what happened, Shields told his supervisors that he was in the room for “30 minutes. Maybe a little more, maybe a little less,” according to the Oklahoma Supreme Court. He also said the video was grainy.</p>
<p>Shields actually observed the jury for more than two hours, according to the state supreme court. Shields “misrepresented and was deceitful regarding the reason he entered the security room, the length of time he watched the jury, and what he observed,” the state supreme court concluded.</p>
<p>Shields “not only observed the jury for over two hours, he failed to disclose that he was doing so to the court, or opposing counsel, even when dealing with jury questions. This is egregious behavior,” the Oklahoma Supreme Court said.</p>
<p>Shields and the other prosecutor self-reported the matter to the Oklahoma Bar Association.</p>
<p>Shields agreed to resign and entered into a deferred prosecution agreement in which he acknowledged violating a law that bans observing or recording jurors. He specified, however, that he had no intent to break the law.</p>
<p>Shields argued that he received no advantage by observing the jury, and he had watched others—including judges and prosecutors—listen to juries when deliberations got loud.</p>
<p>The state supreme court cited several mitigating factors. They included Shields’ military service, his acceptance of responsibility for his actions, his self-reporting of the incident to the Oklahoma Bar Association, and his cooperation in the investigation that followed.</p>
<p>He has been “diligent in completing the terms” of the deferred prosecution agreement and has entered into an agreement with Lawyers Helping Lawyers, a referral service for lawyers, the Oklahoma Supreme Court said.</p>
<p>Shields’ lawyer, Sheila Naifeh, told the ABA Journal that she and her client have no comment on the suspension.</p>

<p>Witten’s aim was to reach a general audience and give them an idea about what a life in the law could look like outside the most well-known bounds of a criminal justice, <em>Law &amp; Order</em> career. The result is a series of short, digestible anecdotes from 20 attorneys, talking about memorable cases, clients and conundrums that they had. A reader could flip to any chapter in <em>Legal Briefs</em> and spend an enjoyable five to 10 minutes getting a snapshot from a contributor’s career.</p>

<p>Witten shares how he became an assistant special prosecutor for the Watergate Special Prosecution Force in the 1970s. In this episode of <em>The Modern Law Library</em> podcast, he tells host Lee Rawles about defending a wise guy client code-named Ted, who nicknamed Witten “Witless” and threw a party with a banner reading “Ted &#8211; 1, FBI &#8211; 0” when they reached a successful plea agreement.</p>
<p>Many of the contributors to the book of essays were involved in government litigation and complex corporate matters. Witten was one of the foremost litigators handling Foreign Corrupt Practices Act cases, and before his retirement, he was a senior litigation partner in Wilmer Cutler Pickering Hale and Dorr’s New York office.</p>
<p>In this episode, he also shares his perspective as a former Watergate prosecutor on current events within the federal government since the Trump administration began, and he recounts his experience with the late Sen. John McCain of Arizona while defending campaign finance reforms.</p>

Working in the law firm’s Washington, D.C., and New York offices, Witten’s practice focused on litigation that had international and/or public policy aspects; white-collar law enforcement matters; and internal investigations, which often related to the Foreign Corrupt Practices Act. He was also a devoted advocate of campaign finance reform. He was the chair of WilmerHale’s litigation group and was a member of the firm’s management committee. He is now retired. <em>Legal Briefs: The Ups and Downs of Life in the Law</em> is his first book.</p>

<p>A former prosecutor in Colorado should be disbarred for faking four texts that she attributed to a co-worker, including one referring to her as a “sex doll,” according to a Dec. 31 hearing board opinion.</p>
<p>Yujin Choi of Denver fabricated the texts in October 2022 to make it appear that the co-worker was harassing her and then “doubled down on that deceit” by intentionally altering evidence, according to the hearing board, which is part of the Colorado Supreme Court’s Office of the Presiding Disciplinary Judge.</p>
<p>Choi allegedly doctored cellphone records and repeatedly deleted the texts. She claimed that her cellphone stopped working when she accidentally dropped it in the bathtub and asserted that her laptop also broke when she accidentally spilled water on it.</p>
<p>“In our view, this narrative is not plausible,” <a href="https://cdn.arstechnica.net/wp-content/uploads/2025/01/2419-OPINION-IMPOSING-SANCTIONS-UNDER-C.R.C.P.-242.31-2.pdf">the opinion</a> said.</p>
<p>Choi “pursued a personal vendetta” against the co-worker, criminal investigator Dan Hines, “by launching an informal smear campaign” for reasons “that remain opaque to us,” the hearing board said.</p>
<p>The <a href="https://www.nytimes.com/2025/01/06/us/denver-prosecutor-fired-disbarred-harassment.html">New York Times</a>, <a href="https://www.law360.com/legalethics/articles/2280859">Law360</a>, the <a href="https://www.denverpost.com/2025/01/03/denver-district-atorney-disbarred-false-sexual-harassment-yujin-choi">Denver Post</a> and <a href="https://arstechnica.com/tech-policy/2025/01/dirty-deeds-in-denver-ex-prosecutor-faked-texts-destroyed-devices-to-frame-colleague">Ars Technica</a> (via the <a href="https://www.law360.com/legalethics/articles/2280859">Legal Profession  Blog</a>) have coverage.</p>
<p>Choi, who was admitted to practice in May 2019, can appeal the decision. She was a deputy district attorney in the Denver district attorney’s family violence unit before she was fired for the alleged misconduct.</p>
<p>Choi sent the four texts to herself, changing the name in her cellphone to make it appear the co-worker was the sender, the hearing board concluded. It was the second time that she had accused Hines.</p>
<p>The first time, in 2021, Choi claimed that Hines had made an inappropriate remark in June 2021, and that he later sent a text that she considered to be harassing. An investigation was closed as unsubstantiated. Hines was nonetheless transferred within the office and told to avoid contact with Choi.</p>
<p>The texts at issue in the ethics opinion surfaced in October 2022. Choi was at a bar with friends when she showed them a text. It read: “Yujin, please stop talking about what I didn’t do to our colleagues. You are using your looks against innocent people. If you want to act like a sex doll to get a sugar daddy … fine, but that will not be me.”</p>
<p>Choi claimed that there were three more texts, all from Hines. They read, “Don’t be stupid,” “Let’s talk,” and “I’m sorry, hope you have a nice weekend.”</p>
<p>By disseminating the texts to co-workers and supervisors, Choi “perpetrated a false and harmful narrative that Hines had sexually harassed her by sending her these messages,” the opinion said.</p>
<p>Choi said she didn’t want the matter investigated, but her supervisors felt a duty to do so and required cooperation. When Hines was confronted with the texts, he logged in to his Verizon account to provide cellphone records and offered his iPhone for investigation. There was no indication that Hines sent the texts, the hearing board said.</p>
<p>Official records obtained directly from Verizon indicated that Choi sent and received the fourth text message in the Hines text thread at the time that she claimed to have received it, leading the hearing board to conclude that she also sent the first three messages. The first text displayed a time stamp indicating that it was sent more than 40 minutes after Choi texted a supervisor about it.</p>
<p>The damage included harm to Hines’ reputation and betrayal of co-workers who advocated for her during the investigation, the decision said.</p>
<p>Choi “poisoned the morale of the DA’s office, contributing to an environment in which victims feared they might be disbelieved and others feared they might be wrongly accused,” the hearing board said. “Further, her actions called into question whether the evidence in the criminal cases she prosecuted was genuine,” tarnished the reputation of prosecutors, and potentially undermined the credibility of sexual harassment victims.</p>
<p>A counselor had diagnosed Choi with post-traumatic stress disorder and vicarious trauma caused by Choi’s emotionally taxing work in the family violence unit. Her lawyers did not immediately respond to ABA Journal emails seeking comment.</p>
<p>Hines told the Denver Post that he “wouldn’t wish this upon anybody,” and he was “living in hell” after Choi’s first accusation. He has sued the Denver district attorney over the handling of the investigation.</p>
<p>The district attorney’s office later determined that Choi’s casework was in “excellent order” with no evidence of fabrication, a spokesperson told the New York Times. The office also thinks that the investigation was properly handled, the spokesperson said.</p>

<p>An assistant U.S. attorney in Alaska said she felt “completely powerless” when then-U.S. District Judge Joshua M. Kindred of the District of Alaska asked for nude photos around the same time that he allegedly texted her about holding grudges and his power to help her win a nomination to the federal bench, according to documents unsealed Monday.</p>
<p>The assistant U.S. attorney’s allegations were revealed after Senior U.S. District Judge Marco A. Hernández of the District of Oregon unsealed <a href="https://storage.courtlistener.com/recap/gov.uscourts.akd.66905/gov.uscourts.akd.66905.406.0_1.pdf">his September order</a> granting a new trial to a cyberstalking defendant. Kindred presided in the case, and the assistant U.S. attorney described as “AUSA 1” had some prosecution involvement.</p>
<p>“The specific, unusual and highly troubling facts of Judge Kindred’s interactions and relationship with AUSA 1 give rise to at least the appearance of impropriety,” Hernández wrote when he granted the new trial.</p>
<p>Hernández also unsealed <a href="https://fingfx.thomsonreuters.com/gfx/legaldocs/akpeejgzbpr/12102024kindred1.pdf">a defense brief</a> that cited the prosecutor’s August letter detailing her relationship with Kindred. The brief does not indicate the recipient of the letter but says it appears to be in response to Kindred’s July resignation and the filing of motions by the defense counsel.</p>

<p><a href="https://www.reuters.com/legal/government/prosecutor-says-former-alaska-judge-trapped-her-into-sending-nude-photos-2024-12-10">Reuters</a> and <a href="https://www.law360.com/legalindustry/articles/2271710/ex-judge-accused-of-abusive-relationship-with-prosecutor">Law360</a> have coverage, while the <a href="https://reason.com/volokh/2024/12/10/new-trial-in-case-where-judge-had-sexting-relationship-with-one-of-the-prosecutors/?comments=true">Volokh Conspiracy</a> published part of the opinion.</p>
<p>Kindred abruptly resigned from the federal bench <a href="https://www.abajournal.com/news/article/federal-judge-who-abruptly-resigned-had-been-referred-for-possible-impeachment-recommendation">in July</a> after he was referred to the U.S. Judicial Conference for possible impeachment. The judicial council of the 9th U.S. Circuit Court of Appeals at San Francisco had requested the resignation after concluding that Kindred created a hostile work environment for his law clerks and had a “sexualized relationship” with one of them.</p>
<p>The May judicial council <a href="https://cdn.ca9.uscourts.gov/datastore/uploads/misconduct/22-90121.pdf">report</a> also mentioned the federal prosecutor who sent nude photos to the judge.</p>
<p>A defense motion for a new trial in the cyberstalking case included information said to have been in the letter from “AUSA 1.” The redacted letter was disclosed to the defense by a federal prosecutor <a href="https://news.bloomberglaw.com/us-law-week/doj-deploys-veteran-fixer-to-alaska-to-unwind-judges-conflicts">tapped to review</a> Kindred’s cases and whether recusal might have been required.</p>
<p>Before she sent the photos, “AUSA 1” said, Kindred sent texts saying he found her attractive, and he had recommended her for a federal judgeship. Shortly before that, Kindred allegedly texted “AUSA 1” about anger issues and holding grudges.</p>
<p>Her letter said she felt pressured to send the photos, according to the defense motion.</p>
<p>“I felt trapped and believed I had no choice,” she wrote. She thought that she “had no other option because he has the power to ruin not only my career but my personal life, as well.”</p>
<p>The prosecutor made the accusations after saying in an earlier letter that her relationship with Kindred was purely professional, according to Hernández’s order.</p>
<p>The cyberstalking defendant was tried and convicted a second time last month, according to a <a href="https://www.justice.gov/usao-ak/pr/anchorage-man-sentenced-45-years-cyberstalking">Dec. 6 press release</a>.</p>

<p>A <a href="https://lawandcrime.com/tag/kentucky/" target="_blank" rel="noopener">Kentucky</a> man is behind bars after <a href="https://lawandcrime.com/tag/threat/" target="_blank" rel="noopener">threatening</a> to kill a local judge and prosecutor, authorities in the Bluegrass State say.</p>
<p>Brian Tucker, 48, stands accused of retaliating against participants in a legal process, according to Boone County court records.</p>
<p>The arrest occurred on Nov. 27. The criminal case stems from a long-ago fire at the home of one of the defendant’s friends. The knock-on effects of that blaze have plagued Tucker’s life for several years.</p>

<p>In 2016, the fire destroyed the home in question, according to court records obtained by <a href="https://www.cincinnati.com/story/news/crime/2024/11/29/nky-man-accused-of-threating-judge-kenton-countys-top-prosecutor/76657973007/" target="_blank" rel="noopener">The Cincinnati Enquirer</a> — which serves as the daily paper for much of the northern Kentucky region.</p>
<p>In 2018, Tucker was indicted on counts of complicity to commit <a href="https://lawandcrime.com/tag/arson/" target="_blank" rel="noopener">arson</a> and insurance fraud. The man, however, was innocent — a jury of his peers acquitted Tucker of all the charges against him in 2019.</p>
<p>Then came a <a href="https://lawandcrime.com/tag/lawsuit/" target="_blank" rel="noopener">lawsuit</a>.</p>
<p>After being vindicated by the criminal justice system, Tucker looked for relief in civil law. He sued Kentucky Farm Bureau Mutual Insurance Company and Green Light Fire Investigations — alleging the companies provided false evidence to law enforcement that led to his indictment.</p>
<p>In July of this year, a judge dismissed Tucker’s civil lawsuit with prejudice, according to court records cited by the newspaper.</p>
<p>Recently, one of Tucker’s friends reached out to police.</p>
<p>When making that tip, the friend allegedly said the defendant had been threatening to violently kill both 16th Judicial District Commonwealth’s Attorney Rob Sanders and a female judge.</p>
<p>“[He] specified the gym where Sanders works out and articulated plans to either sneak up behind Sanders and slit his throat or hide in the woods and ‘snipe’ Sanders with a rifle,” according to a criminal complaint filed in the case.</p>
<p>Sanders himself spoke with investigators, said he knew Tucker, and that he and Tucker go to the same gym, police say.</p>
<p>The jurist was later identified as Kenton County Circuit Judge Kathy Lape by the prosecutor, according to the complaint. Sanders allegedly told police that she oversaw Tucker’s criminal trial. The Enquirer, on the other hand, said Kenton County Chief Circuit Judge Patricia Summe oversaw both Tucker’s criminal trial and civil case.</p>
<p>Interviews with the defendant’s loved ones followed — and authorities did not seem to like what they heard.</p>
<p>Tucker’s brother and girlfriend both allegedly gave some version of a story where he had recently been acting out of sorts.</p>
<p>The defendant’s girlfriend allegedly said he had not been home for days. Tucker’s brother allegedly said he was “suffering from a mental break and going through violent mood swings,” according to the complaint.</p>
<p>The defendant’s brother also advised caution for investigators, allegedly telling them to be careful because he hates law enforcement and has violent tendencies, according to a copy of the complaint obtained by Newport, Kentucky-based <a href="https://www.fox19.com/2024/11/29/man-arrested-plotting-kill-nky-attorney-judge-court-records/" target="_blank" rel="noopener">Fox affiliate WXIX</a>.</p>
<p>In the end, the friend said they decided to report Tucker to law enforcement because they had also become subject to the threats. The friend allegedly attributed the diffusion of blame to Tucker consuming large amounts of cocaine.</p>
<p>Tucker is currently being detained in the Boone County Jail on $500,000 cash bond.</p>
<p>The defendant does not currently have an attorney of record or a scheduled court appearance, Boone County records show.</p>

<p>A deputy prosecutor in <a href="https://lawandcrime.com/tag/indiana/" target="_blank" rel="noopener">Indiana</a> has been fired for voicing her disdain with <a href="https://lawandcrime.com/tag/donald-trump/" target="_blank" rel="noopener">Donald Trump</a> voters on social media — writing on Facebook after the election that they “disgust” her and “clearly don’t respect” human beings — in addition to sharing posts about them being Nazis, according to her boss.</p>
<p>“If you voted for Trump, please unfriend me,” wrote Jordan Stroh, former deputy prosecuting attorney for the <a href="https://www.facebook.com/prosecutingattorney/" target="_blank" rel="noopener">Hancock County District Attorney’s Office</a>, in a Facebook post cited by District Attorney Brent Eaton this week in her termination letter, which was obtained by local CBS affiliate <a href="https://cbs4indy.com/news/you-disgust-me-deputy-prosecutor-fired-for-equating-trump-voters-to-nazis-on-facebook/" target="_blank" rel="noopener">WTTV</a> and local Fox affiliate <a href="https://fox59.com/indiana-news/you-disgust-me-deputy-prosecutor-fired-for-equating-trump-voters-to-nazis-on-facebook/" target="_blank" rel="noopener">WXIN</a>.</p>

<p>“You disgust me and clearly don’t respect me or other human beings,” she added.</p>
<p>A post that Stroh shared from the <a href="https://www.facebook.com/photo/?fbid=10160485815071545&amp;set=g.250107691125" target="_blank" rel="noopener">Relegalize Indiana PAC’s Facebook page</a> was said to have contained a quote attributed to novelist and essayist A.R. Moxon, author of the book “Very Fine People.”</p>

<p>“[The post] in context, seemed to clearly be referring to the election and voters who supported the now President-Elect,” Eaton noted in Stroh’s Nov. 12 termination letter, adding that the post was shared “with the clear intent to communicate a belief that those who voted for the now President-Elect were NAZIS in the same manner as those who were members of one of the twentieth centuries most homicidal, anti-semitic, genocidal death cults.”</p>
<p>Speaking to the <a href="https://www.indystar.com/story/news/2024/11/14/hancock-county-prosecutor-fires-deputy-for-anti-trump-online-posts/76254946007/" target="_blank" rel="noopener">Indianapolis Star</a> while on her honeymoon, Stroh claimed her posts were in reference to people in her personal life, not individuals she meets and works with as a deputy prosecutor. She believes she shouldn’t have been fired by Eaton.</p>
<p>“Prior to this current election, my opinions remained the same,” Stroh said by text. “At no point did my personal opinions prevent me from being fair and impartial in the execution of my duties. This especially rings true whenever my opinions were posted to my private Facebook page with no public ties to the Prosecutor’s Office.”</p>
<p>Eaton told Stroh in his letter that as a prosecutor, she should have known better, regardless of how she felt.</p>

<p>“You are charged with being a minister of justice,” he said. “Unfortunately, the decisions you made to post content to your social media page call into question your ability to be a fair and impartial minister of justice equitably, to all that you serve in this community. They have irreparably tarnished the credibility and trust people have in HCPO. Therefore, your employment with HCPO is terminated.”</p>
<p>Eaton told Stroh that he probed her Facebook page and found her posts to be “problematic” after receiving “multiple complaints” from people, including county staffers.</p>

<p>“HCPO can only be successful if we have public trust,” Eaton said. “Public trust is very difficult to acquire and very easy to lose. It is my expectation that all people who enter our office or interact with our team firmly believe that the decisions we make daily are based upon an unbiased and common-sense reading of the law and interpretation of the facts. It is critical that all people firmly know that, no matter their political preferences, HCPO will always interact and serve them with respect.”</p>

<p>Eaton told the Indy Star on Wednesday that members of Hancock County’s law enforcement community were mainly upset about Stroh’s Nazi post, explaining that he sees their point.</p>
<p>“How many times can you refer to large swaths of people as Nazis?” Eaton said. “I think the answer zero. The answer should be zero.”</p>
<p>Attempts to reach Stroh for comment on Thursday were unsuccessful.</p>

<p>Longtime Miami-Dade County, Florida, prosecutor Michael Von Zamft has resigned after a judge disqualified him and a colleague from the resentencing of an alleged gang leader convicted of four murders.</p>
<p>Judge Andrea Ricker Wolfson of the 11th Judicial Circuit Court of Florida in Miami-Dade County said newly discovered evidence suggested that witness testimony had been manipulated in the prosecution of gang leader Corey Smith, and that jailed witnesses had been granted favors, including conjugal visits, for their cooperation.</p>
<p>Wolfson also cited a recorded phone call between Von Zamft and a jailed witness that could be viewed as a “cryptic message” about eliminating an unreliable witness, although the judge did not accept that interpretation.</p>

<p>“On television, Perry Mason, defense attorney extraordinaire, always managed to find the smoking gun at the end of every episode,” Wolfson wrote. “In real life, this happens very rarely. It happened here.”</p>
<p>Wolfson tossed Von Zamft from the case, saying he had a “prosecutorial philosophy of winning at all costs.” She also disqualified a second prosecutor who “emphatically argued” that no unethical conduct had happened, she wrote. But she rejected a request to disqualify the entire Miami-Dade state attorney’s office.</p>
<p>Smith was being resentenced because he was sentenced to death in two of the murders based on less-than-unanimous juror votes, a practice that was banned in a 2017 Florida law.</p>
<p>Wolfson cited evidence supporting disqualification presented in a multiple day hearing “regarding over 20 years of allegations of misconduct” in the case.</p>
<p>Wolfson said the state’s treatment of discovery in the case “has been questionable throughout the litigation process.” Multiple representations by Von Zamft regarding discovery “can best be described as the continuous movement of the goal line away from the defense team,” she said.</p>
<p>She also cited evidence of witness coordination.</p>
<p>Three cooperating witnesses had testified that they had been taken to the Miami Police Department’s homicide unit to coordinate testimony in the Smith case. One of those witnesses had first made the claim in a January 2023 affidavit, but he changed his story after meeting with two prosecution investigators allegedly sent by Von Zamft.</p>
<p>Further evidence included a recorded August 2022 phone call between Von Zamft and a co-defendant, Latravis Gallashaw, who became a cooperating witness. During the call, they discussed problems with witnesses in the Smith case.</p>
<p>Gallashaw asked whether Von Zamft had considered “rehabilitating” an inmate named Jones. Von Zamft said there had been a problem with Jones’ contradictory statements. Von Zamft said he was trying to arrange a prison courtyard meeting between Gallashaw, Jones and an inmate who was a witness in another case, but his request was turned down.</p>
<p>“But the gun did not stop smoking there,” Wolfson said, carrying on her Perry Mason reference.</p>
<p>In the call, Von Zamft complained that Tricia Geter, a cooperating witness and Smith’s former girlfriend, was unpredictable. She gave full and complete testimony in the prior trial, however, he said.</p>
<p>“If I call her and she refuses, then I will find a way to make her unavailable, and then I can read her whole testimony,” Von Zamft said.</p>
<p>“You would want to do that?” Gallashaw asked.</p>
<p>Von Zamft replied that he didn’t want to do it.</p>
<p>“I’d rather she testified and did a good job. But can I count on it? No,” Von Zamft said.</p>
<p>Wolfson said the phone call “totally and completely corroborates Ms. Geter’s testimony that she got mad at Mr. Von Zamft in 2023 after he told her that if she was dead, he would simply read her prior testimony into the record.”</p>
<p>“It is important to reiterate the context of the interaction between Mr. Von Zamft and Mr. Gallashaw,” Wolfson wrote. “Mr. Gallashaw is a convicted murderer in a case that involves witness elimination. Mr. Von Zamft, a highly trained lawyer, knew who he was talking to. At best, Mr. Von Zamft’s use of the words ‘make her unavailable’ is reckless considering the audience.</p>
<p>“To be clear, this court does not believe that Mr. Von Zamft was sending a cryptic message to Mr. Gallashaw to eliminate Ms. Geter. However, reasonable minds may reach a different conclusion based on the totality of circumstances in this case.”</p>
<p>Geter told the Miami Herald that she fears for her life because of threatening messages that she has received. She learned of the phone call about making her unavailable about two weeks ago.</p>
<p>“Why would you tell him you don’t want me available?” Geter asked in a newspaper interview with the Miami Herald. “It’s unethical that this officer of the state attorney’s office would be conspiring with a known killer.”</p>
<p>Wolfson sent a copy of her opinion to the Florida Bar. Von Zamft told the ABA Journal that because the matter has been referred to the bar, his attorney has instructed him not to comment.</p>

<p>“We’re private people,” special prosecutor Nathan Wade testified during <a href="https://www.youtube.com/watch?v=rnqaqNiBons" target="_blank" rel="noopener">a hearing</a> examining several aspects of his disputed romance with Fulton County District Attorney Fani Willis early Thursday afternoon. “Our relationship wasn’t a secret, it was just private.”</p>
<p>The dispute, however, is not about the existence of that relationship — the basic fact was <a href="https://lawandcrime.com/high-profile/in-a-word-absurd-fani-willis-filing-rubbishes-motion-to-disqualify-her-and-special-prosecutor-in-trump-rico-case-as-a-basic-misunderstanding-of-rudimentary-rules/" target="_blank" rel="noopener">acknowledged</a> by the pair in court filings earlier this month. The judge overseeing the case, rather, is concerned largely with when the relationship went from platonic to amorous. And, on that question, there are now two starkly contradictory accounts.</p>
<p>Wade, for his part, insisted under oath on Thursday that he and Willis did not become romantically entangled until 2022.</p>
<p>But Wade, the lead prosecutor in the racketeering (RICO) and election subversion <a href="https://lawandcrime.com/trump/fulton-county-da-indicts-former-president-donald-trump-for-interfering-with-georgia-2020-election-results/" target="_blank" rel="noopener">case against Donald Trump</a> and others, taking the stand at all was a significant procedural victory for co-defendant Michael Roman and his attorney, Ashleigh Merchant. As the state has roundly complained in both the courtroom and court filings, opposing counsel being forced to testify by the defense is considered something of an anomaly and rarity for a criminal proceeding in the United States.</p>
<aside class="o-callout__recirculate o-callout"/>
<p>Roman previously worked as a staff member for Trump’s 2020 reelection campaign — he faces seven charges in the underlying, 41-count RICO indictment. In <a href="https://lawandcrime.com/high-profile/this-type-of-nepotism-might-be-forgiven-in-the-abstract-trump-co-defendant-demands-da-be-disqualified-over-allegedly-improper-romantic-relationship-with-rico-special-prosecutor/" target="_blank" rel="noopener">early January</a>, the defendant and his attorney raised <a href="https://lawandcrime.com/high-profile/patently-false-co-defendant-in-trump-rico-case-accuses-fani-willis-and-special-prosecutor-of-lying-about-when-their-self-dealing-romantic-relationship-began/" target="_blank" rel="noopener">the prosecutorial romance</a> in an effort to dismiss the indictment and disqualify the two prosecutors from the case.</p>
<p>Under a lengthy direct examination by Merchant, Wade mostly discussed his spending habits during the relationship, offered insight into how Willis often reimbursed him — but always in cash — for various vacations and day trips, pored over receipts, and took issue with other bits of minutiae related to their lodging, spending, and travel.</p>
<p>“She is going to pay her own way,” Wade testified at one point — stressing that Willis is a strong and independent woman.</p>
<p>Bookending the mostly dollars-and-cents-centered testimony was a shorter series of questions related to Wade and Willis’ relationship.</p>
<p>Early on, Wade attempted to add caveats to dueling answers he gave in response to two different interrogatories about extramarital affairs.</p>
<p>In the first court filing, Wade said he had not had sexual relationships with anyone outside of marriage up to May 30, 2023. In the second and later court filing, Wade admitted to entertaining someone other than his wife.</p>
<p>To try and bridge that admitted divide, Wade said, he considered his marriage “irretrievably broken” as of some time in 2015 — Wade and his estranged wife, however, remain legally married.</p>
<p>“I was free to have a relationship,” Wade added.</p>
<p>Later on, and just before a lunch break, Merchant asked twice in a row: “Did you discuss your relationship with Ms. Willis in social settings?”</p>
<p>Wade said he didn’t understand the question after the second ask, prompting a quick defense clarification.</p>
<p>“Did you discuss your personal relationship — your private, personal, romantic relationship with Ms. Willis — in social settings?” Merchant asked.</p>
<p>To which the witness replied: “No, ma’am.”</p>
<p>The defense attorney then asked Wade if he ever discussed their relationship in front of Robin Yeartie, a former member of the district attorney’s office, and a longtime former friend of Willis.</p>
<p>Again, Wade answered in the negative.</p>
<p><a href="https://lawandcrime.com/high-profile/hugging-kissing-being-affectionate-fani-williss-onetime-friend-says-das-romantic-relationship-with-lead-trump-rico-prosecutor-began-several-years-before-they-claimed/" target="_blank" rel="noopener">Earlier in the day</a>, Yeartie testified that Willis and Wade began their romance in late 2019. Her testimony was what convinced Superior Court Judge Scott McAfee to enforce the defense subpoena on Wade.</p>
<p>After lunch, the defense planned to grill the special prosecutor again over a series of documents recently admitted into evidence.</p>
<p>Before that, an attorney representing another defendant in the RICO case revisited Wade’s divorce interrogatories. This time, over a series of numerous objections and clarifications, Wade admitted on the stand that he and Willis had sexual relations by May 30, 2023 — directly contradicting the earlier averred statement that he had not had sexual relationships with anyone outside of marriage up to May 30, 2023.</p>
