<p>A 27-year-old woman in <a href="https://lawandcrime.com/tag/texas/">Texas</a> will spend several years behind bars for leaving a dead <a href="https://lawandcrime.com/tag/child-victim/">infant</a> inside of a gas station toilet in Houston last year. Harris County District Judge Kristin M. Guiney on Monday ordered Diana Guadalupe Zavala Lopez to serve four years in a state correctional facility after she pleaded <a href="https://lawandcrime.com/tag/guilty/">guilty</a> to one count of tampering with evidence — human corpse as well as one count of tampering/fabricating physical evidence with the intent to impede an investigation, <a href="https://www.documentcloud.org/documents/25458757-zavala-lopez-order/">court records</a> reviewed by Law&amp;Crime show.</p>
<p>Guiney also credited Zavala Lopez with 489 days of time already served.</p>
<p>As Law&amp;Crime <a href="https://lawandcrime.com/crime/woman-arrested-while-attempting-to-flee-to-mexico-in-connection-with-dead-newborn-girl-found-in-gas-station-toilet/">previously reported</a>, agents with U.S. Customs and Border Protection apprehended Zavala Lopez in August 2023 at a bus station in Brownsville, Texas, which is the largest city in the U.S. portion of the Lower Rio Grande Valley.</p>

<p>In a news release, federal authorities described Zavala Lopez as a Mexican national and “migrant who overstayed her visitor visa and was successfully taken into custody.” The release goes on to describe her as “a homicide suspect attempting to flee to Mexico,” however, homicide charges were never filed against the defendant.</p>
<p>Following her arrest, a spokesperson for the Houston Police Department told Law&amp;Crime that the agency would “likely interview her again to get more details” and stressed that the only charge was the one count of evidence tampering noted on the Twitter account — but that the investigation is currently ongoing.</p>
<p>“We still have to speak with her,” an HPD public information officer said. “Beyond that it depends on the rest of the investigation.”</p>
<p>She was subsequently charged with the additional evidence tampering charge.</p>
<p>According to a probable cause affidavit, a customer on April 2, 2023, went to use the restroom at a Shell gas station in southwest Houston in the middle of the night. There, they found the child inside the toilet. Houston Fire Department paramedics determined the girl had been dead for over an hour by that time.</p>
<p>Police then <a href="https://www.youtube.com/watch?v=WgEfw5_Qmhw">posted footage to the department’s YouTube page</a> showing a “person of interest” — later determined to be Zavala Lopez — leaving the gas station before the newborn was found dead.</p>
<p>In the footage, which skips around and appears to be edited, the woman can be seen getting out of her car — which is parked at one of the pumps — and then walking through the front door of the filling station. The camera zooms in on her face as she enters the store. The footage then cuts to the same woman getting back in the car and driving away into the night. Finally, the video ends with three different still images of the wanted woman, taken from when she entered.</p>
<p>During a press conference announcing the efforts to obtain the public’s help in the case by releasing the video, HPD Homicide Detective Calab Bowling said the woman on the video was in the gas station for roughly 15 minutes before she left.</p>
<p>“No one else went inside that bathroom, and [the newborn] was not there when she walked in before,” Browning said, clarifying later that witness statements also supported that understanding of events. “It appears that she gave birth in the restroom.”</p>
<p>Authorities have not revealed the child’s name or cause of death.</p>

<p>Criminal charges against a 30-year-old nurse in <a href="https://lawandcrime.com/tag/new-york/">New York</a> accused of “<a href="https://lawandcrime.com/crime/new-york-nurse-filmed-violently-slamming-newborn-facedown-into-his-bassinet-arrested-and-charged/">violently slamming</a>” a newborn baby face-down into a bassinet in the neonatal intensive care unit have been dropped just hours before she was scheduled to go to trial on one count of <a href="https://lawandcrime.com/crime/mom-moves-to-new-state-with-boyfriend-and-leaves-child-behind-alone-with-no-heat-or-running-water-for-a-month-cops/">endangering the welfare of a child</a>.</p>
<p>Suffolk County District Court Judge Eric Sachs on Monday formally dismissed the misdemeanor charge against Amanda Burke, her attorney confirmed to Law&amp;Crime.</p>
<p>The Suffolk County District Attorney’s Office had <a href="https://suffolkcountyny.gov/da/Newsroom/Press-Releases/registered-nurse-charged-with-endangering-the-welfare-of-a-child-after-slamming-a-two-day-old-infant-onto-a-bassinet" target="_blank" rel="noopener">previously said</a> that Burke was working at Good Samaritan Hospital’s neonatal ICU on Feb. 6, 2023, and was assigned to care for a 2-day-old baby named Nikko.</p>
<p>While the windows in the neonatal ICU are typically covered for privacy reasons, the covering on the bottom corner of one of the windows had come off, allowing someone outside of the unit to look in and see baby Nikko. The child’s father was recording a video of his son when the incident took place.</p>
<p>“Burke approached the newborn while he was lying in a bassinet, lifted him up, quickly flipped him over, and violently slammed him face down on the bassinet,” prosecutors wrote. “The infant’s father recorded a video of the incident on his cellular telephone through the nursery window. After viewing the recording, the infant’s mother confronted Burke.”</p>
<p>The child’s parents then showed the video of Burke slamming their child into the bassinet to other nurses and staff members at the hospital. Authorities say that the establishment took swift action, directing Burke to leave the hospital and terminating her employment within two hours of the alleged incident taking place.</p>
<p>Burke’s attorney, Robert C. Gottlieb, told Law&amp;Crime that the dismissal of the charge was welcome, but came “a year too late.”</p>

<p>Gottlieb explained that the essential element of the endangering charge prosecutors would have to show is that Burke’s actions were “likely to cause physical injury” to Nikko. He said that nine months ago, he provided prosecutors with an expert report stating that Burke’s conduct, which was recorded, was not likely to cause Nikko injury.</p>
<p>However, prosecutors waited until four days before the trial was slated to begin before they spoke to their own expert, Gottlieb said. It was only when the DA’s expert also agreed that Burke’s actions were not likely to cause physical injury to Nikko that prosecutors called Gottlieb and advised they would be dropping the charges.</p>
<p>In their explanation to dismiss the charges, prosecutors also referenced Burke’s nurse’s licensing agency, which investigated the allegations and determined that her conduct “did not even rise to the level of gross negligence and did not warrant any action against her nurse’s license,” Gottlieb continued, noting that the DA’s office had already been informed of the agency’s decision well in advance of the decision to drop charges.</p>
<p>Suffolk County District Attorney Ray Tierney issued the following statement to News 12 indicating that the nurse’s licensing agency’s decision played a crucial role in his office’s decision to dismiss the charge against Burke.</p>
<p>“Unfortunately, despite the disturbing video which captured the incident in this case, the New York State Department of Licensing found the defendant did not act with gross negligence,” he said. “As such, we could not prove the charge beyond a reasonable doubt at trial.”</p>

<p>A 24-year-old father in <a href="https://lawandcrime.com/tag/idaho/">Idaho</a> will spend decades behind bars after he admitted to <a href="https://lawandcrime.com/tag/murder/">killing</a> his newborn daughter, “violently” <a href="https://lawandcrime.com/tag/beating/">beating</a> and shaking the infant to death in 2021. Kootenai County District Judge Barbara Duggan on Tuesday ordered Dyllan Dwight Towles to serve a sentence of 50 years in a state correctional facility for slaying the little girl, authorities announced.</p>
<p>Court records show that Towles last year pleaded guilty to one lesser count of second-degree murder in his daughter’s death. He will be eligible for parole after serving at least 25 years of his sentence.</p>
<p>According to a <a href="https://www.facebook.com/permalink.php?story_fbid=pfbid02P6mLhkcwvsqLpgbx45tLG6SNNSS4dULokvmV74ENsUm8TTmLr9ZEpuFXeqzpp3hdl&amp;id=100079202030906">news release</a> from the Kootenai County Prosecuting Attorney’s Office, Towles on Saturday, Sept. 18, 2021, called 911 and told the dispatcher his 2-month-old child was not breathing. Upon arriving at the scene, first responders found the child “laying face up and unresponsive on the floor.”</p>
<p>While attempting lifesaving measures, officers said they observed visible injuries on the child, which included” a large circular bruise on her cheek, a bruise on her right leg, and bite marks on her left forearm, left ankle, and below her knee.”</p>
<p>The victim was rushed to the hospital where she was pronounced dead.</p>
<p>In response to questions about the events leading up to him calling 911, Towles said on Thursday everything was normal. On Friday his daughter slept excessively and on Saturday morning everything seemed fine. But later on Saturday, the victim began “to look off to the side and not respond when he (Towles) snapped his fingers,” the release states.</p>
<p>“When asked about the observed injuries, Towles claimed that he bit the child, ‘shook’ her ‘pretty violently’ approximately 20 times, and ‘played with her legs’ in an attempt to gain a response from the child after she suddenly became unresponsive,” prosecutors wrote.</p>

<p>“An autopsy of the child conducted by the Spokane County Medical Examiner’s Office determined that there were blunt force injuries on the child’s head, neck, torso, and extremities,” officials said. “Specifically, fractures were found on the child’s rib, arm, shoulder, and both of her femurs. A spinal cord injury was also found on the child in addition to bleeding and swelling of the brain.”</p>
<p>Authorities said the injuries were in different states of healing — a telltale sign of prolonged abuse.</p>
<p>Following the autopsy, prosecutors consulted with pediatric professionals and forensic pathologists from the Washington State University of Medicine and the University of Utah School of Medicine regarding the findings. The experts said the newborn’s death was “definitely due to abusive head trauma inflicted on the child,” per the release.</p>
<p>A grand jury subsequently returned a true bill indicting Towles on the charge of first-degree murder and he was arrested on July 6, 2023.</p>
<p>“Later that evening, officers from the Post Falls Police Department located Towles and arrested him on the warrant. Following the arrest, Detective Neil Uhrig (formerly of the Post Falls Police Department) interviewed Towles. At first, Towles repeated his original story to Detective Uhrig. However, Towles eventually broke down and admitted to shaking his infant child out of frustration because she would not eat and would not stop crying.”</p>
<p>Prosecutors said Towles in 2019 was convicted of felony injury to a child after originally being charged with statutory rape. Authorities said a then-19-year-old Towles was having a sexual contact with a 15-year-old girl. He was still on probation for this charge at the time of the murder.</p>

<p>A 26-year-old mother in <a href="https://lawandcrime.com/tag/pennsylvania/">Pennsylvania</a> has been arrested for allegedly <a href="https://lawandcrime.com/tag/murder/">killing</a> her 3-month-old son, beating the child to death and then <a href="https://lawandcrime.com/crime/dad-who-beat-infant-to-death-and-blamed-her-catastrophic-injuries-on-familys-cat-will-spend-less-than-a-decade-in-prison/">blaming the fatal injuries</a> on her 3-year-old daughter, saying the toddler was jealous of the newborn.</p>
<p>Alisha Parker was taken into custody on Sunday and charged with one count of criminal homicide and one count of endangering the welfare of a child, authorities announced.</p>
<p>According to a <a href="https://www.facebook.com/AlleghenyCountyPolice/">press release</a> from the Allegheny County Police Department, officers with Duquesne Police responded to a home at about 1:57 a.m. on Sunday in the 300 block of Hemlock Alley in regards to a report about an unresponsive male infant. Upon arriving at the scene, first responders said they immediately began to perform CPR on the victim and rushed him to a hospital, where he died.</p>
<p>Parker reportedly told police her toddler daughter fatally injured the infant, imploring authorities to “evaluate” her.</p>
<p>“If there’s anything that happened out of the ordinary, my 3-year-old child did it and ya’ll need to do something about that,” she told detectives, according to a probable cause affidavit <a href="https://www.post-gazette.com/news/crime-courts/2024/01/10/allegheny-county-duquesne-infant-homicide/stories/202401100097">obtained by</a> the Pittsburgh Post-Gazette. “She’s the last person to see him alive and she’s been doing little jealousy, little things — evaluate that girl.”</p>
<p>According to the affidavit, Parker and her two kids had recently moved in with Parker’s cousin and the cousin’s 18-month-old child before the victim’s death.</p>
<p>The cousin reportedly told police that she left the house to go to work at about 5 that evening and got home at about 1 the following morning, having called Parker several times to ask her to check on her 18-month-old. The cousin said at about 11:20 p.m., she called Parker and heard the victim crying in the background.</p>

<p>Parker reportedly responded that the children were both doing fine and that she was drinking alcohol.</p>
<p>When the cousin arrived back at the home, she reportedly told police she checked on her child and then had a drink downstairs with Parker, who started vomiting soon after. The cousin told police she had a “bad feeling” about the situation and decided to check on Parker’s two kids.</p>
<p>The cousin reportedly started searching for the infant, who was not in his crib and then found him not breathing and “stiff to the touch and purple in color” between his older sister and the wall air-conditioning unit.</p>
<p>During questioning, Parker reportedly said she immediately thought her daughter harmed the infant.</p>
<p>“When he was found, he was found on the bed with her, so I’m like, ‘Did you grab him and try to put him on the bed with you?’ Like what was going on?” she reportedly told police.</p>
<p>Parker then allegedly said her daughter would “have to go” if she had harmed the victim.</p>
<p>“(The victim) was smiling before he went to bed, and that’s why I feel like that little (expletive) girl had something to do with it,” she said. “I’m sorry to say, that’s my kid and all, but if she did something to my son, she gotta go.”</p>
<p>She also said, “If there’s anything that happened out of the ordinary, my 3-year-old child did it and ya’ll need to do something about that,” The Patriot-News <a href="https://www.pennlive.com/crime/2024/01/pa-mother-charged-in-death-of-3-month-old-son.html">reported</a>.</p>
<p>As she left the interview with police, Parker allegedly stated, “Guess what, I’m gonna go home and [expletive] drink more.”</p>
<p>Police said an autopsy determined that the child’s injuries “were inflicted by an adult” and could not have been done by her daughter. Following the release of the autopsy report, Parker was taken into custody and charged with her son’s death.</p>
<p>She is being held in the Allegheny County Jail without bond awaiting her arraignment.</p>

<p>A mother and father in <a href="https://lawandcrime.com/tag/indiana/">Indiana</a> have been arrested for allegedly <a href="https://lawandcrime.com/tag/infanticide/">killing</a> their 1-month-old daughter, violently beating and shaking the newborn and then <a href="https://lawandcrime.com/tag/child-neglect/">not seeking medical attention</a> for nearly a week as the victim slowly died in the home.</p>
<p>Gerard Dante Coger, 21, and Janaya Kimberly Hobson, 19, were taken into custody last week and charged with a spate of felonies, including two counts each of neglect of a dependent resulting in death, three counts of neglect of a dependent resulting in serious bodily injury, and depriving a dependent of necessary support in the slaying of Royal Coger, <a href="https://public.courts.in.gov/mycase/#/vw/CaseSummary/eyJ2Ijp7IkNhc2VUb2tlbiI6IjdYa3dQSG51Y2JPa1oxcTNodE9GNG92LW55MkhqMDRzdnhYUVRJeDRSNEkxIn19">court</a> <a href="https://public.courts.in.gov/mycase/#/vw/CaseSummary/eyJ2Ijp7IkNhc2VUb2tlbiI6IjdsMWJhUFYyQ0Y3bHpnVk5uMzhPdDk3ZGk1YWZTQXV4UF9sek9iZE9IdTQxIn19">records</a> reviewed by Law&amp;Crime show.</p>
<p>Additionally, Coger is facing one count of murder and one count of aggravated battery in his son’s horrific death.</p>
<p>According to a probable cause affidavit <a href="https://www.chicagotribune.com/suburbs/post-tribune/ct-ptb-infant-death-charges-st-1227-20231226-sdwpgmus6zf6biqchrfjirf2zm-story.html">obtained by</a> the Chicago Tribune, the couple showed up at Methodist Hospital’s Northlake campus on Dec. 15 carrying young Royal who “appeared to have been suffering from abusive head trauma.” The couple had walked about a mile with the baby to arrive at the facility.</p>
<p>Unfortunately, the child succumbed to her injuries and was pronounced dead on Dec. 18.</p>
<p>A caseworker with the Indiana Department of Child Services then reportedly contacted the Gary, Indiana Police Department to report the child’s suspicious injuries.</p>
<p>The doctor who first spoke with Coger and Hobson on Dec. 15 and explained that the newborn was likely going to die because she’d been violently shaken, said the couple responded by staring back at her “like a deer in headlights,” per the Tribune. As the conversation continued, the doctor noted it was Coger who “did most of the talking” and described Hobson as appearing “flat.” She said “neither were angry” and both denied ever shaking Royal.</p>

<p>In a follow-up interview with police detectives, Coger reportedly said that Royal on Dec. 4 fell out of a baby carrier and struck her head on concrete, resulting in a “grapefruit-sized” bump that he covered with a hat. Coger allegedly said he chose not to tell Hobson about the fall, opting instead to wait another 11 days until Royal had a scheduled doctor’s appointment. After the fall, Royal reportedly cried more and ate less</p>
<p>As authorities continued to press Coger as to how Royal suffered her fatal injuries, he allegedly confessed that on Dec. 12 he became so frustrated with his daughter’s crying that he grabbed the newborn and shook her violently while “asking Royal Coger why she was crying as he did so,” The Times of Northwest Indiana <a href="https://www.nwitimes.com/news/local/crime-courts/gerald-coger-kimberly-hobson-murder-shaken-baby-syndrome-gary-police/article_d58deb18-a409-11ee-aec9-dfb94f7334da.html">reported</a>.</p>
<p>Hobson, however, reportedly denied knowing about Royal suffering any injuries after she bumped her head on the sink in late November.</p>
<p>When asked why they had walked to the hospital instead of calling 911, the parents provided authorities with different answers.</p>
<p>Per the Tribune, Coger said they decided to walk because they thought it would be the fastest way to get Royal to the hospital. However, Hobson reportedly told detectives that “both she and Gerard Coger decided not to call 911 because the Police and Fire Department would ask too many questions and Royal Coger ‘was dead anyways.&#8221;”</p>
<p>Coger and Hobson are both being held in the Lake County Jail. Coger is being held without bond while Hobson’s bond was set at $100,000. They are scheduled to appear in court again on Jan. 2 before Judge Samuel L. Cappas.</p>
