<p>An Alabama couple lost custody of their two children for over nine months after they were accused of driving while intoxicated — but there was no evidence that the one behind the wheel was ever intoxicated.</p>
<p>In a <a href="https://lawandcrime.com/lawsuit/your-dad-should-beat-you-police-officers-encouraged-teenagers-father-to-abuse-him-while-calling-him-a-little-brat-attorney-says/" target="_blank" rel="noopener">lawsuit</a> filed on Feb. 25, Nicholas and Elizabeth Frye stated that they took a vacation with their two small children in <a href="https://lawandcrime.com/tag/tennessee/" target="_blank" rel="noopener">Tennessee</a> in February 2024. While at the resort where they were staying, Elizabeth Frye slipped and sustained a minor injury, and Nicholas Frye took the family to a nearby Walmart store for medical supplies. Upon completing their Walmart run and driving back, Nicholas Frye was pulled over by an <a href="https://lawandcrime.com/lawsuit/dont-hurt-us-cops-pointed-assault-rifles-at-terrified-children-in-raid-on-wrong-home-lawsuit-says/" target="_blank" rel="noopener">officer</a> “without reasonable suspicion or probable cause” and accused of DUI. Elizabeth Frye was also arrested, and both were charged with “DUI, public intoxication, child abuse and neglect, and aggravated child abuse and neglect.”</p>
<p>But there was no immediate evidence that either parent was under the influence — and Nicholas Frye’s blood tests later showed an “absence of drugs and alcohol at the time of the arrest.”</p>

<p>The lawsuit, filed in Tennessee’s Eastern District Court, named the City of Sevierville, the Sevierville Police Department, and three Sevierville police officers, including Officer Laura Franklin, who pulled Nicholas Frye over on Feb. 24, 2024. Also named in the suit were the State of Tennessee and the Tennessee Department of Children’s Services and an unnamed official who worked for the agency.</p>
<p>After the Frye parents were arrested, their two children were taken to the Sevierville Police Department, where they remained until their grandmother (who was not named) came from Alabama to pick them up. The Tennessee Department of Children’s Services was notified that the children’s parents were arrested and charged, and the Alabama Department of Human Resources removed the children from the Fryes’ custody.</p>
<p>Elizabeth and Nicholas Frye did not regain custody of their children for over nine months.</p>
<p>The lawsuit stated that there was never any evidence that either parent was under the influence. The Fryes also claimed that the Sevierville Police Department did not perform any “immediate” testing at the time of the arrests that would have proven the absence of any intoxication and provided probable cause for a DUI arrest. Instead, Nicholas Frye underwent blood testing that provided results at a later time. The lawsuit made no mention of whether or not Elizabeth Frye underwent any testing for intoxication.</p>
<p>The Fryes contended that they were arrested “without proper evidentiary basis,” and this resulted in the removal of their children from their custody for nearly a whole year.</p>
<p>The Fryes are claiming that they and their children have suffered “irreparable, permanent, and significant mental and emotional anguish” as well as “deleterious effects to their reputations” and their standing in the community. They are seeking damages of just under $15 million.</p>
<p>Local news outlet Al.com reached out to the City of Sevierville for <a href="https://www.al.com/news/2025/03/alabama-couple-sues-for-15-million-claim-children-wrongly-taken-for-tennessee-dui-child-abuse-charges.html" target="_blank" rel="noopener">comment</a>, and a spokesperson said that the city “does not generally comment in regard to ongoing litigation.”</p>

<p>A <a href="https://lawandcrime.com/tag/georgia/" target="_blank" rel="noopener">Georgia</a> jury this week convicted a man who skipped a court hearing and spent more than a year on the run avoiding charges that he murdered his wife in front of their young children in 2017.</p>
<p>Jonathan Bates was sentenced to life in prison for the <a href="https://lawandcrime.com/tag/murder/" target="_blank" rel="noopener">murder</a> of his wife Cynde Bates, the <a href="https://www.ajc.com/news/crime/paulding-man-who-skipped-previous-trial-convicted-of-wifes-murder-gets-life/PKMQVNCFDRDZFH73CW2NYSNOIQ/" target="_blank" rel="noopener">Atlanta Journal-Constitution</a> and <a href="https://www.wsbtv.com/news/local/paulding-county/paulding-co-man-sentenced-life-prison-killing-his-wife/HC2PMHQZTZHXRERWIA4W2RP2YY/">WSB</a> report. He also was convicted of manslaughter, aggravated assault and cruelty to children.</p>
<p>As Law&amp;Crime <a href="https://lawandcrime.com/crime/man-accused-of-murdering-wife-in-front-of-their-children-arrested-after-more-than-a-year-on-the-run-following-missed-court-hearing/" target="_blank" rel="noopener">previously reported</a>, the Dawson Sheriff’s Office and U.S. Marshals Service arrested Bates <a href="https://www.facebook.com/Dawson.Co.Sheriff/posts/pfbid0LWDFiTKdrWNGrRLjFTsQwG5X367Px3jGGAyakgXSenzNmiDPCrSos6DyniiwJecsl" target="_blank" rel="noopener">in April</a>. A bench warrant has been out for Bates’ arrest ever since he failed to show up to a court hearing in October 2022, records show.</p>
<p>Bates is accused of killing his wife Cynde Bates, 28, at their home in Dallas, Georgia, in May 2017. According to his indictment, he allegedly pushed her, causing her to fall and hit her head on a love seat. The incident allegedly happened in front of the couple’s children, ages 4 and 7.</p>

<p>Cynde Bates was later declared brain-dead and died at a hospital, court documents say.</p>
<p>Jonathan Bates allegedly told a police officer that he pushed her when she tried to hug him. She had previously accused him of domestic violence and told family members she was planning to file for divorce.</p>
<p>Cops arrested him, but in June 2017, a judge said there was not enough evidence for the case to move forward on the murder charges and only bound over the case for simple battery. The decision outraged Cynthia Bates’ family members.</p>
<p>“Her kids are lost without her,” Bates’ sister Sandy Dement <a href="https://www.wsbtv.com/news/local/judges-throws-out-murder-charge-against-man-accused-of-killing-wife/531377263/" target="_blank" rel="noopener">told Atlanta’s WSB</a>. “Her family is lost without her. We don’t get to talk to her anymore.”</p>
<p>WSB <a href="https://www.wsbtv.com/news/local/paulding-county/man-accused-killing-wife-arrested-after-not-showing-up-murder-trial/FTAB5MX3SVF2LHAW5XWNHPBIZ4/" target="_blank" rel="noopener">reported</a> the judge had ties to Jonathan Bates’ family. He later recused himself.</p>
<p>A grand jury later indicted Jonathan Bates, reinstating the murder charges. He posted a $16,500 bond, which led to him skipping the October 2022 court hearing. His lawyers claim his wife’s death was an accident.</p>

<p>A <a href="https://lawandcrime.com/tag/jan-6/" target="_blank" rel="noopener">Jan. 6</a> rioter from <a href="https://lawandcrime.com/tag/illinois/" target="_blank" rel="noopener">Illinois</a> who cursed out cops and used a flagpole to smash up a window — shouting “f—ing traitors” and “f—ing communist scum” while storming in and out of the U.S. Capitol building — is <a href="https://lawandcrime.com/high-profile/ill-f-you-up-motherf-er-strip-club-bouncer-who-helped-lead-trump-supporters-breach-u-s-capitol-on-jan-6-headed-to-prison/" target="_blank" rel="noopener">heading to prison</a> and paying for the damages.</p>
<p>Justin LaGesse, 37, of McLeansboro, was sentenced Friday to 11 months in prison and ordered to pay $43,315 in restitution by U.S. District Judge James E. Boasberg, according to the <a href="https://www.justice.gov/usao-dc/pr/illinois-man-sentenced-prison-felony-destruction-property-during-jan-6-capitol-breach" target="_blank" rel="noopener">Department of Justice</a>. He also got hit with 12 months of supervised release.</p>
<p>LaGesse, who <a href="https://www.justice.gov/usao-dc/pr/illinois-man-pleads-guilty-felony-destruction-property-during-jan-6-capitol-breach" target="_blank" rel="noopener">pleaded guilty</a> to a felony charge of destruction of government property last September, was accused of storming the Capitol with another defendant, Theodore Middendorf, who also pleaded guilty to destruction of government property and is awaiting sentencing. The pair allegedly smashed up a window near the “North Door” of the Capitol after attempting to get inside, according to court documents.</p>

<p>“While police officers attempted to stop these rioters, Middendorf and LaGesse approached a large window to the left of the North Door,” their criminal complaint says. “The two then used their flagpoles to strike the window numerous times and damaged the window in several places.”</p>
<p>The pair allegedly went in and out of the Capitol, harassing cops along the way, according to DOJ prosecutors. They spent some time in the “Senate Wing Door” lobby area after entering through a broken window, per the complaint, and were caught on surveillance video carrying flags and waving them while chanting “U.S.A.” repeatedly.</p>
<p>“After leaving the U.S. Capitol, LaGesse and Middendorf approached a line of Metropolitan Police Department officers standing behind a bicycle rack barricade,” the complaint says. “As they get near the officers, LaGesse called the officers ‘f—ing traitors” and ‘f—ing communist scum.’ For several minutes, LaGesse continues to lob insults at the officers while Middendorf stands nearby.”</p>
<p>DOJ prosecutors say that after the riot, the Architect of the Capitol determined that the total cost of the damage to the window was $41,315.25. LaGesse was arrested by the FBI in January 2024.</p>
<p>“In the 48 months since Jan. 6, 2021, more than 1,583 individuals have been charged in nearly all 50 states for crimes related to the breach of the U.S. Capitol, including more than 600 individuals charged with assaulting or impeding law enforcement,” DOJ officials said Saturday in a press release.</p>
<p>President-elect Trump has said repeatedly he plans to pardon Jan. 6 rioters once in office, but he’s kept details under wraps.</p>
<p>Vice President-elect <a href="https://lawandcrime.com/high-profile/lacked-judicial-authority-trump-and-jd-vance-got-special-treatment-when-judges-dismissed-complaint-over-eating-the-cats-rhetoric-lawsuit-says/" target="_blank" rel="noopener">JD Vance</a> on Sunday <a href="https://lawandcrime.com/high-profile/obviously-you-shouldnt-be-pardoned-jd-vance-breaks-from-trumps-had-no-choice-claims-about-jan-6-rioters-and-says-violent-offenders-should-stay-locked-up-and-charged/" target="_blank" rel="noopener">provided the clearest explanation yet</a> of the plans to <a href="https://lawandcrime.com/high-profile/weve-suffered-long-enough-mother-of-proud-boys-leader-asks-trump-to-pardon-her-son-serving-22-year-sentence-for-jan-6-seditious-conspiracy/" target="_blank" rel="noopener">pardon defendants</a> such as LaGesse, telling “Fox News Sunday” that while there’s “a little bit of a gray area there,” those who <a href="https://lawandcrime.com/crime/jan-6-rioter-who-assaulted-d-c-cops-gets-another-conviction-for-planning-assassination-missions-on-fbi-agents/" target="_blank" rel="noopener">committed violence</a> during the 2021 U.S. Capitol attack “obviously” shouldn’t be pardoned. Those who protested “peacefully,” however, can expect to <a href="https://lawandcrime.com/high-profile/pardon-is-almost-a-certainty-lawyer-tries-to-name-drop-trump-get-out-of-jail-free-card-in-failed-bid-to-delay-jan-6-defendants-case/" target="_blank" rel="noopener">have their records wiped clean</a>.</p>
<p>“I think it’s very simple,” the former Ohio senator <a href="https://x.com/FoxNewsSunday/status/1878219107239080187" target="_blank" rel="noopener">said</a>. “If you protested peacefully on Jan. 6 and you’ve had Merrick Garland’s Department of Justice treat you like a gang member, you should be pardoned. If you committed violence on that day, obviously you shouldn’t be pardoned.”</p>

<p>A brother-sister pair from <a href="https://lawandcrime.com/tag/arizona/" target="_blank" rel="noopener">Arizona</a> who joined a group of <a href="https://lawandcrime.com/tag/proud-boys/" target="_blank" rel="noopener">Proud Boys</a> from <a href="https://lawandcrime.com/tag/kansas/" target="_blank" rel="noopener">Kansas</a> to overrun police guarding the U.S. Capitol on Jan. 6 deserve to spend months behind bars, according to federal prosecutors.</p>
<p>Felicia Konold, 29, and her younger brother Cory Konold, 28, have admitted to joining a surging crowd of <a href="https://lawandcrime.com/high-profile/our-first-look-at-trumps-iconic-mug-shot-after-surrendering-on-rico-charges-for-trying-to-overturn-2020-election/" target="_blank" rel="noopener">Donald Trump</a> supporters facing off against a line of U.S. Capitol Police officers. The force of that crowd overwhelmed the police line, and the siblings made their way to the front of the crowd and were among the first to climb over toppled barricades at the Lower West Plaza. They refused to leave despite being told by cops to disperse and joined with other rioters in pushing a series of barricades against police at the base of scaffolding set up for President Joe Biden’s inauguration.</p>

<p>The Konolds eventually entered the building via the Senate Wing Door around 10 minutes after the initial <a href="https://lawandcrime.com/live-trials/proud-boys/our-situation-here-is-dire-radio-dispatches-reveal-police-scrambling-as-jan-6-rioters-break-into-building/" target="_blank" rel="noopener">violent breach</a>. The presence of rioters in the Capitol brought the certification of Biden’s electoral win to a temporary halt, <a href="https://lawandcrime.com/u-s-capitol-breach/everyone-stayed-nancy-pelosis-right-hand-woman-shares-harrowing-jan-6-details-at-trial-of-man-who-kicked-up-his-feet-on-office-desk/" target="_blank" rel="noopener">forcing lawmakers and staffers to flee or shelter in place</a> for hours.</p>
<p>The siblings went to the Crypt and the Capitol Visitor Center, eventually exiting the building through the Senate Wing Door. While inside, Cory Konold stole a USCP riot helmet and, according to the DOJ, brought it home with him, although he later told a family member to hand it over to law enforcement.</p>
<p>The Konolds <a href="https://www.justice.gov/usao-dc/pr/arizona-siblings-plead-guilty-felony-charge-actions-during-jan-6-capitol-breach" target="_blank" rel="noopener">pleaded guilty</a> in November to one count each of felony obstruction of law enforcement during a civil disorder and aiding and abetting. They each faced up to five years in prison. Prosecutors think that they deserve significantly less than that.</p>
<p>In a sentencing memo filed Wednesday, the government requested that U.S. District Judge Timothy Kelly, a Trump appointee, send Cory Konold to prison for three months, and Felicia Konold to prison for six months. Prosecutors want both siblings to serve three years of supervised release and pay $2,000 in restitution toward the estimated $2.9 million in losses and damage resulting from the riot.</p>
<p>The government’s sentencing memo notes that Felicia Konold’s own diary entries reflect a degree of preparation for the riot and that her “pre-planning notes” show that she “fully anticipated that she would be engaged in violence.”</p>
<p>Indeed, Felicia Konold’s list of items to bring to the capital include bear spray, gauze, bandages, pain medications, Vaseline, and “quick clot,” an apparent reference to a stop-bleeding aid.</p>
<p>Notably, that itemized list followed a diary entry of an entirely different sort: a recipe for what she called “3 x 3” chili.</p>
<p>A combination of spices and vegetables — including “low sodium” canned corn — plus “a little tiny bit of habanero peppers” combined to become what she calls her “3 Day chili, AKA: 3×3.”</p>
<p>“3 days to make! 3 days to EAT!” she wrote, according to the government’s filing.</p>

<p>In the following pages, Felicia Konold was contemplating her place in history as she prepared to join the disgruntled masses in the nation’s capital.</p>
<p>“I do not want to leave my son, or my brother, its tearing my heart, but i must protect the future,” she wrote in what the government says was her last diary entry before Jan. 6. “For all of humanities sake … This is what my life purpose is, to make sure good TRUMPS Evil.”</p>
<p>“I’ve been missing my life purpose as far back as i can remember,” she wrote. “I have that now.”</p>

<p>After Jan. 6, Felicia Konold took to social media and bragged about her role in the riot.</p>
<p>“I never could have imagined having that much of an influence on the events that unfolded today,” she posted, according to prosecutors. “Dude, people were willing to follow. You f—— lead, and everyone had my back, dude … We f—— did it.”</p>
<p>Prosecutors say that Cory Konold’s wrongdoing at the Capitol that day was in large part due to the influence of his older sister.</p>
<p>“Cory’s actions at the Capitol, as compared to Felicia’s, were less egregious and appear more akin to those of someone tagging along with his sister, the driving force of the pair,” the government said of the man who took home a police riot helmet after the melee.</p>
<p>Federal evaluators recommend a sentencing guidelines range of zero to six months for both siblings. The Konolds’ sentencing is set for Jan. 24.</p>
<p>The Konold siblings’ codefendants included William Chrestman, who was <a href="https://lawandcrime.com/high-profile/take-your-house-proud-boys-member-who-threateningly-brandished-ax-handle-at-police-on-jan-6-learns-his-fate/" target="_blank" rel="noopener">recently ordered</a> to serve more than four years behind bars for wielding a wooden ax handle and stopping a barrier gate from lowering at the Capitol, and <a href="https://lawandcrime.com/u-s-capitol-breach/kansas-man-described-as-first-degree-member-of-the-proud-boys-pleads-guilty-to-jan-6-charge/" target="_blank" rel="noopener">Ryan Ashlock</a>, who faced off against police on Capitol grounds but did not go into the building itself.</p>
