<p>Lawyers for the families of two children with U.S. citizenship, including a 4-year-old who has Stage 4 cancer, have accused the Trump administration of deporting the youths to Honduras on the same day <a href="https://lawandcrime.com/high-profile/just-deported-a-u-s-citizen-trump-appointed-judge-gives-admin-the-chance-to-dispel-strong-suspicion-that-louisiana-born-girl-2-was-removed-with-no-meaningful-process/" target="_blank" rel="noopener">another child with citizenship was allegedly sent</a> to the Central American country, which led to an order from a federal judge requiring the government to explain itself.</p>
<p>President Trump’s border czar, Tom Homan, went on CBS’s “<a href="https://www.cbsnews.com/news/tom-homan-border-czar-face-the-nation-04-27-2025/" target="_blank" rel="noopener">Face the Nation</a>” Sunday and insisted that “no U.S. citizen child” had been deported. He claimed that “deported means ordered by an immigration judge” and suggested that the mothers may have chosen to take the children with them, saying: “That’s a parent’s decision. It’s not a government decision, it’s a parent’s decision.”</p>
<p>Reports emerged late Saturday and Sunday from <a href="https://www.washingtonpost.com/immigration/2025/04/27/trump-deportation-citizens-children/" target="_blank" rel="noopener">The Washington Post</a> and <a href="https://www.nytimes.com/2025/04/27/us/politics/us-citizen-children-deported-honduras-trump.html" target="_blank" rel="noopener">New York Times</a> saying the 4-year-old and a 7-year-old had also been shipped out Friday with the child that led to the judge’s memorandum in federal court.</p>
<p>As Law&amp;Crime <a href="https://lawandcrime.com/high-profile/just-deported-a-u-s-citizen-trump-appointed-judge-gives-admin-the-chance-to-dispel-strong-suspicion-that-louisiana-born-girl-2-was-removed-with-no-meaningful-process/" target="_blank" rel="noopener">previously reported</a>, a federal judge in <a href="https://lawandcrime.com/tag/louisiana/" target="_blank" rel="noopener">Louisiana</a> known for his <a href="https://lawandcrime.com/high-profile/louisiana-federal-judge-blocks-mask-and-vaccine-mandate-for-head-start-workers-children-this-case-is-ultimately-about-the-separation-of-powers/" target="_blank" rel="noopener">rulings</a> that tend to <a href="https://lawandcrime.com/first-amendment/orwellian-ministry-of-truth-trump-appointed-judge-smacks-down-biden-administrations-anti-disinformation-efforts/" target="_blank" rel="noopener">align with causes</a> <a href="https://lawandcrime.com/high-profile/trump-appointed-judge-refers-to-regime-change-while-taking-swipe-at-harris-in-social-media-censorship-case/" target="_blank" rel="noopener">championed</a> by Trump issued a <a href="https://www.documentcloud.org/documents/25919908-vml-judge-doughty-memo-order-4-26-25/" target="_blank" rel="noopener">memorandum order Friday</a> setting a hearing to address the apparent deportation of a 2-year-old identified only as V.M.L. According to a petition for a writ of habeas corpus — a request that court determine whether a person’s detention is unlawful — V.M.L. was born in 2023 in Baton Rouge, as indicated on her birth certificate.</p>
<p>Lawyers for the mother of the 2-year-old told the Times that she and the other two kids were all deported to Honduras Friday. The Times reports that the mother of the 2-year-old is pregnant, while the 4-year-old from the other family has a rare form of late-stage cancer. The boy allegedly had no access to his medications or his doctors during the removal process, the lawyers say.</p>
<p>Gracie Willis, a lawyer with the National Immigration Project who is reportedly involved in the case involving the 2-year-old, has condemned the actions of U.S. Immigration and Customs Enforcement officers and local law officials as being both “horrifying and baffling” as the children are all considered “U.S. citizen” children.</p>
<p>Homan, however, says the government sees things differently.</p>
<p>“Having a U.S. citizen child after you enter this country illegally is not a get-out-of-jail free card,” he told “Face the Nation” on Sunday.</p>
<p>“It doesn’t make you immune from our laws,” Homan said. “If that’s the message we sent the entire world, women are gonna keep putting themselves at risk and come to this country. We send a message. You can enter [the] country illegally, which is a crime. That’s okay. You can have due process, great taxpayer expense. Get ordered removed. That’s okay. Don’t leave. But have a U.S. citizen child and you’re immune from removal? That’s not the way it works.”</p>
<p>Speaking to NBC’s “<a href="https://www.state.gov/releases/office-of-the-spokesperson/2025/04/interview-secretary-of-state-marco-rubio-with-kristen-welker-of-nbc-meet-the-press/" target="_blank" rel="noopener">Meet the Press</a>” on Sunday, Secretary of State Marco Rubio said that if the children’s families want them to come back to the U.S. that they will be allowed to “if there’s their father or someone here who wants to assume them” in the United States.</p>
<p>“Ultimately, who was deported … was their mothers, who were here illegally,” Rubio said. “The children just went with their mothers. But it wasn’t like — you guys make it sound like ICE agents kicked down the door and grabbed the 2-year-old and threw him on an airplane. That’s misleading.”</p>
<p>A representative “next friend” of the 2-year-old, who says she has known her since birth, has <a href="https://www.documentcloud.org/documents/25919907-vml-v-harper-tro-request/" target="_blank" rel="noopener">filed a motion</a> for a temporary restraining order (TRO) to block the child’s removal, accusing ICE of engaging in “attempts to disappear” V.M.L. and lying to the child’s family and representatives in the process.</p>
<p>At the time the TRO motion was filed, the girl’s representatives believed she was still in the U.S.</p>
<p>In its <a href="https://www.documentcloud.org/documents/25919905-vml-v-harper-gov-oppo-tro-request/" target="_blank" rel="noopener">opposition to the TRO request</a>, ICE said the girl’s mother wanted to take V.M.L. with her back to Honduras, and provided as proof a <a href="https://www.documentcloud.org/documents/25919906-vml-v-harper-mom-note/" target="_blank" rel="noopener">note written by hand in Spanish</a>. Just like Homan and Rubio, the government also signaled skepticism that the child’s “next friend,” as well as V.M.L.’s father, were indeed who they said they were, saying they have not provided identification to ICE in support of releasing the child into their custody.</p>
<p>In Friday’s order, U.S. District Judge Terry Doughty — appointed by Trump in 2018 — said that V.M.L. is “ostensibly” a 2-year-old United States citizen.</p>
<p>“Of course, ‘It is illegal and unconstitutional to deport, detain for deportation, or recommend deportation of a U.S. citizen,&#8221;” Doughty concluded.</p>

<p>Under the turbulent glare of national attention, a federal district judge on Thursday made comity the informal order of the day — while also promising to issue a restraining order against several members of President Donald Trump’s cabinet over the Signal group chat scandal.</p>
<p>But first he sought to set the record straight.</p>
<p>“Some questions have been raised regarding this court’s random assignment,” U.S. District Chief <a href="https://lawandcrime.com/high-profile/judge-stymied-by-state-secrets-claim-in-deportation-case-will-oversee-lawsuit-against-trump-admin-over-group-chat-where-cabinet-members-divulged-military-plans/" target="_blank" rel="noopener">Judge James E. Boasberg</a> intoned — emphasizing the penultimate word. “All cases are randomly assigned.”</p>
<p>The jurist is, as of late, unusually well-known — largely due to being the target of <a href="https://lawandcrime.com/high-profile/a-troublemaker-and-agitator-trump-calls-for-impeachment-of-judge-who-put-stop-to-deportations-under-obscure-wartime-authority/" target="_blank" rel="noopener">Trumpworld ire</a> over <a href="https://lawandcrime.com/high-profile/you-felt-you-could-disregard-it-judge-grills-trump-doj-over-white-house-ignoring-court-order-because-it-was-oral-quips-his-verbal-rulings-dont-seem-to-carry-much-weight-anymore/">a series</a> of <a href="https://lawandcrime.com/high-profile/the-government-again-evaded-its-obligations-judge-upbraids-trump-admins-woefully-insufficient-explanation-for-flouting-court-order/" target="_blank" rel="noopener">anti-government</a> <a href="https://lawandcrime.com/high-profile/unlawful-judge-says-trumps-summary-deportation-of-migrants-without-due-process-likely-illegal/" target="_blank" rel="noopener">court rulings</a> and concomitant <a href="https://lawandcrime.com/high-profile/intemperate-and-disrespectful-language-federal-judge-fed-up-with-tone-of-trump-admin-filings-promises-consequences-for-officials-who-violated-deportation-order/" target="_blank" rel="noopener">dressings-down</a> of government lawyers in the <a href="https://lawandcrime.com/high-profile/administrations-most-extreme-measure-yet-judge-hits-trump-with-restraining-order-for-planning-to-use-obscure-wartime-law-to-ramp-up-deportations/" target="_blank" rel="noopener">Alien Enemies Act case</a>. Seemingly aware of the consternation, the judge explained in detail the “automated” process that put him in charge of <a href="https://lawandcrime.com/high-profile/unlawful-destruction-of-federal-records-hegseth-rubio-and-others-broke-multiple-laws-by-using-disappearing-messaging-app-to-discuss-military-strikes-watchdog-says/" target="_blank" rel="noopener">another high-profile case</a> against the Trump administration.</p>
<aside class="o-callout__recirculate o-callout"/>
<p>When it came to the issues raised in <a href="https://www.documentcloud.org/documents/25868850-american-oversight-v-hegseth/" target="_blank" rel="noopener">the lawsuit</a> over the multiple-day group chat about how to plan “military strikes in Yemen,” the judge pushed for clarity again — this time in service of an agreed-upon resolution that both sides would be able to live with.</p>
<p>“The plaintiff here is not asking me to disclose the Signal communications,” Boasberg said. “Discovery is not part of the suit.”</p>
<p>Boasberg went on to describe the basis of the lawsuit as, rather, sounding in a Federal Records Act (FRA) claim — a federal law with a series of mandatory record-keeping requirements with tentacles reaching into other laws like the Freedom of Information Act.</p>
<p>The judge said the contours of the litigation offer “a real chance to reach common ground” and that based on what the U.S. Department of Justice has filed in the case so far, he believes “the government is moving toward implementing what the plaintiffs seek.”</p>
<p>The lawsuit filed by nonprofit government transparency organization American Oversight specifically requests a bevy of declaratory judgments that the group chat participants violated federal law, that the messages in question are subject to the FRA, and that failure to maintain the messages violated the FRA. The plaintiffs also asked for a broad injunction that orders the defendants to comply with their duties under federal laws, and that might lead to an investigation by the U.S. Attorney General keyed toward “the recovery or restoration of any deleted or destroyed materials to the extent possible.”</p>
<p>All of that hardly seemed necessary, the judge suggested.</p>
<p>Boasberg said “preservation and possible recovery” are the key issues for the plaintiffs. He then mused that maybe the plaintiffs could reach an agreement for less relief than their lawsuit requests — if the defense is prepared to agree to such preservation efforts.</p>
<p>When asked what the government is willing to do here, a DOJ lawyer suggested the court credit a series of declarations filed that suggest the sued agencies are working to preserve what they can. She added that the government was “still in the process of working with the agencies to see what records they have.”</p>
<p>When pressed by the judge on the disappearing nature of some Signal messages, the government lawyer demurred about those details but said “the agencies are certainly looking to fulfill their obligations.”</p>
<p>A more sure answer came when the judge asked the DOJ lawyer about the Signal chats in question from the dates in question — and if the government was willing to preserve them.</p>
<p>“Yes, the agencies are working to preserve what they have,” the government’s attorney told Boasberg.</p>
<p>The judge and the DOJ’s lawyer ultimately agreed that preserving what the government has was an achievable goal, while recovering deleted messages might be a more thorny issue. And, when asked if a formal restraining order outlining such obligations would be too much of a burden, the government’s attorney did not answer in the negative.</p>
<p>During a much briefer time at the dais, American Oversight’s attorney generally appreciated what had earlier been agreed to but noted that the Signal group chat references other conversations.</p>
<p>The attorney said his client, as a regular FOIA requester, has “serious concerns about the use of the Signal messaging system.”</p>
<p>The judge acknowledged those concerns as valid, but steered the hearing toward issues of accord in line with the complaint.</p>
<p>“What I’m hearing from the government is they agree they can’t have record-keeping that violates the FRA,” Boasberg said.</p>

<p>The judge told the parties he would issue a temporary restraining order enjoining the defendants “to preserve all Signal communications between March 11 and March 15 and then we’ll go forward from here.”</p>
<p>In what appeared to be another callback to the headwinds of his newfound national stature, Boasberg added, perhaps jokingly for the government’s benefit: “Don’t worry, it’ll be in writing.”</p>
<p>By Monday, the parties will have to provide a status report and declaration regarding steps taken to implement such preservation, the judge said. The temporary restraining order will last for an initial 14 days — but may be renewed as the court sees fit.</p>

<p>Members of President <a href="https://lawandcrime.com/high-profile/dangerous-and-wholly-unwarranted-trump-admin-invokes-privilege-in-denying-judge-info-on-deportation-flights-calling-inquiry-dubious-and-trivial/" target="_blank" rel="noopener">Donald Trump</a>‘s cabinet violated federal law by using the encrypted Signal messaging app to discuss military actions in the Middle East, a lawsuit filed Tuesday in Washington, D.C., alleges.</p>
<p>In a <a href="https://www.documentcloud.org/documents/25868850-american-oversight-v-hegseth/" target="_blank" rel="noopener">16-page filing</a>, nonprofit government transparency organization American Oversight alleges Secretary of Defense Pete Hegseth and various other Trump administration officials violated the Federal Records Act (FRA) during a multiple-day group chat about how to plan and “coordinate imminent U.S. military strikes in Yemen.”</p>
<p>The conversations in question occurred between March 11 and March 15, according to the lawsuit. The government’s use of the popular messaging app was first reported this week when the editor-in-chief of The Atlantic, Jeffrey Goldberg, <a href="https://www.theatlantic.com/politics/archive/2025/03/trump-administration-accidentally-texted-me-its-war-plans/682151/" target="_blank" rel="noopener">reported that he was accidentally added to the group chat</a> by national security adviser Michael Waltz.</p>
<p>Signal is widely used for its encryption functions. The app is also well-known for its ability to automatically delete messages after a certain period of time, subject to user specifications. The use of the auto-delete feature in the chat, the plaintiffs say, runs afoul of federal law.</p>

<p>“According to the Atlantic Article, at least one participant in the Signal chat enabled the function that makes messages disappear after set time limits,” the lawsuit claims. “Defendant Waltz set at least some messages to disappear after one week, and at least some messages to disappear after four weeks.”</p>
<p>So far, the plaintiffs allege, at least one message in the chat was already deleted by the time Goldberg reported on his experience.</p>
<p>That lone deletion — and the likelihood of other potentially more forthcoming — violates several federal laws and implicates the Freedom of Information Act (FOIA) as well, according to the lawsuit.</p>
<p>“Defendants, as members of the Signal chat, know or reasonably should know that one or more messages in the Signal chat were or remain subject to automatic deletion in violation of the FRA and implementing rules and regulations of Defendants’ respective agencies, the lawsuit reads. “Defendants have failed and continue to fail to implement measures to prevent the automatic deletion of messages in the Signal chat, which violates their obligations under the FRA.”</p>
<p>The filing goes on, at length:</p>

<p>American Oversight has regularly requested DoD’s communications through FOIA, including Signal messages, and it will continue to do so in the future. Upon information and belief, under current DoD recordkeeping rules and practices, officials do not forward Signal messages, including messages from the Signal chat, to their official email accounts, thereby barring American Oversight and other FOIA requesters from obtaining responsive records to which they are otherwise entitled under FOIA, particularly if such Signal messages have enabled the disappearing function.</p>

<p>To hear the plaintiffs tell it, the use of Signal by federal agencies violates the FRA and the Administrative Procedure Act (APA), a statute that broadly governs administrative agencies. The alleged APA violation is due to the “final” nature of the deleted messages, in question, the lawsuit claims.</p>
<p>“Signal is not an authorized system for preserving federal records and does not comply with recordkeeping requirements,” the filing goes on. “Messages in the Signal chat about official government actions, including, but not limited to, national security deliberations, are federal records and must be preserved in accordance with federal statutes, and agency directives, rules, and regulations.”</p>
<p>The lawsuit also lays out a specific set of allegations against Secretary of State Marco Rubio, due to his current dual role as the acting Archivist of the United States and therefore the head of the National Archives. The use of Signal is at least a double whammy against Rubio because he has “an independent non-discretionary duty under the FRA to initiate a recovery action” under the NARA under the present circumstances, the plaintiffs allege.</p>
<p>And, at least so far, Rubio has failed to exercise his mandatory duties under NARA, the lawsuit claims. This alleged failure, according to American Oversight, also violates the APA for various reasons.</p>

<p>The filing generally purports to be an effort “to prevent the unlawful destruction of federal records and to compel Defendants to fulfill their legal obligations to preserve and recover federal records created through unauthorized use of Signal for sensitive national security decision-making.”</p>
<p>The lawsuit specifically requests a bevy of declaratory judgments that the group chat participants violated federal law, that the messages in question are subject to FRA, and that failure to maintain the messages violated the FRA. The plaintiffs are also seeking an injunction that orders the defendants to comply with their duties under federal records laws, and that might lead to “the recovery or restoration of any deleted or destroyed materials to the extent possible.”</p>
