A federal judge appointed to the bench by President Donald Trump is not budging in his demand that the government “facilitate” a deported Venezuelan man’s return to the United States.

In the case, Daniel Lozano-Camargo, 20, was “wrongfully” deported to El Salvador in violation of a legal settlement agreement that was meant to keep him in the country while his pending asylum claim was litigated with U.S. Citizenship and Immigration Services (USCIS).

Notably, the plaintiff has filed his case under the pseudonym “Cristian,” but Politico reported his full identity on Tuesday. Meanwhile, the court itself, in line with a prior order binding the parties, is continuing to use the pseudonym.

Last week, U.S. District Judge Stephanie Gallagher, who was appointed by Trump during his first term, cited contract law principles in a 19-page opinion directing the government to try and get Lozano-Camargo back stateside “so that he can receive the process he was entitled to under the parties’ binding Settlement Agreement.”

On Monday, the government filed sealed arguments in an attempt to convince the judge to vacate her order. Along with those mysterious legal arguments, the government publicly filed a heavily redacted “Indicative Asylum Decision.”

The government’s public formal document explains why the Trump administration believes Lozano-Camargo’s underlying asylum claim will fail.

During a hearing on Tuesday, however, the judge said the asylum case is too far removed from the current legal dispute to be dispositive.

“I don’t think that this is a case about whether or not Cristian is going to eventually get asylum,” Gallagher said, according to a courtroom report by Politico. “Whether he ultimately receives asylum is not the issue. The issue is, and has always been, one of process.”

The issue, rather, is a 2024 settlement that limits how people who came to the country as unaccompanied minors can be deported, according to the judge. In Lozano-Camargo’s case, because he came to the U.S. when he was 17, that court-approved agreement means the government must wait until his asylum claim is extinguished.

“It is an axiomatic principle of contract law that when a defendant breaches a contract, that defendant must restore the situation that existed before the breach,” Gallagher wrote. “In the case of Cristian, this requires putting him in the position ‘to ensure that his case is handled as it would have been had he not been improperly sent to El Salvador.’ In other words, under contract law principles, Cristian, and any other Class Member who has been removed in violation of the Settlement Agreement, must be returned to the United States to await adjudication of his asylum application on the merits by USCIS.”

An accompanying April 23 order explains, in relevant part:

Defendants are hereby ORDERED to facilitate Class Member Cristian’s return to the United States to await the adjudication of his asylum application on the merits by USCIS under the terms of the Settlement Agreement. Facilitation includes, but is not limited to, a good faith request by Defendants to the government of El Salvador to release Cristian to U.S. custody for transport back to the United States.

A woman was recently arrested in Florida after attacking a man with a can of Pringles and possibly causing him “permanent disfigurement,” law enforcement in the Sunshine State say.

But thanks to good detective work, Keirans decades-long scheme is over. A federal judge in the Northern District of Iowa sentenced Keirans to 12 years in prison after he pleaded guilty to one count each of aggravated identity theft and false statement to a national credit union administration, the Department of Justice said Friday.

An Oklahoma woman was arrested after she allegedly threatened a senior center resident with a knife and tried to blow up his oxygen machine.

Marketta Bates, 33, was taken into custody on Jan. 20 after an incident the same day at the Jeltz Senior Center in Oklahoma City. According to a police report obtained by KOKH, a local Fox affiliate, officers responded to calls about an assault at the center. When they arrived, they found Bates in a common area where a chaotic scene was taking place. The alleged victim, who was not named, told police that Bates pointed a knife at him after she threatened to light his oxygen tank on fire. Police saw the alleged victim’s oxygen tank on the ground near him, leaking liquid.

A 71-year-old man in Texas with a dangerous habit of getting behind the wheel while drunk will likely spend the rest of his days behind bars after being convicted of driving while intoxicated for the sixth time.

A jury in Comal County last month ordered Joseph Haren to serve a sentence of life in a state correctional facility for his repeated offenses, authorities announced. Under state law, an individual convicted of three or more DWI offenses and two prior prison sentences from those offenses is subject to 25 years to life in prison and a fine of up to $10,000.

A 42-year-old caregiver in Tennessee has been arrested for allegedly throwing boiling water on an elderly patient in her care, leaving the victim with second and third-degree burns on his face, neck, and back.

Tina M. Vaughn was taken into custody on Monday and charged with one felony count of aggravated abuse of a vulnerable adult and one misdemeanor count of simple assault, court records reviewed by Law&Crime show.

According to a probable cause affidavit, an officer with the Memphis Police Department at about 4:30 p.m. on Jan. 24, 2024, responded to a call at the Regional One Burn Center in the 800 block of Jefferson Avenue.

The patient suffered second and third-degree burns “to the right side of his face, shoulder, and right side of his back,” the affidavit states. The document notes that the victim — who is deaf — lives in a group home and has “intellectual and developmental disabilities,” which include schizophrenia and attention deficit hyperactivity disorder, commonly referred to as ADHD.

A sign language interpreter was required for police to take the victim’s statement.

The victim told the officer that at about 10:30 p.m. on Jan. 21, he was at his group home in the 600 block of Gookin Place along with his caregiver, whom he identified as Tina Vaughn. According to the victim, Vaughn was “responsible” for his well-being.
