<p>A <a href="https://lawandcrime.com/crime/woman-wanted-to-pay-her-new-tinder-hookup-to-kill-her-cop-ex-boyfriend-and-his-teenage-daughter-police/" target="_blank" rel="noopener">New Jersey</a> mother says she is taking legal action against a day care that has given her no explanation for how her 2-year-old <a href="https://lawandcrime.com/crime/i-hate-seeing-her-every-day-mom-covered-for-boyfriend-who-beat-infant-daughter-for-more-than-a-month-leading-to-death-cops-say/" target="_blank" rel="noopener">daughter</a> came home last week with one of her “cornrow” hair braids missing from her head — claiming they didn’t know if her child “pulled it out” herself or whether something more nefarious happened.</p>
<p>“You have to use some type of force for a braid to be removed,” Tamara Hemingway told New York ABC station <a href="https://abc7ny.com/post/exclusive-new-jersey-mother-says-2-year-old-daughter-was-missing-braid-when-she-picked-day-care/16145187/?ex_cid=TA_WABC_TW&amp;taid=67f68474175fce0001c14f67&amp;utm_campaign=trueAnthem%3A+Trending+Content&amp;utm_medium=trueAnthem&amp;utm_source=twitter" target="_blank" rel="noopener">WABC</a> about her daughter, Myla, and what happened to her.</p>
<p>“It was a cornrow so it was braided down to her scalp,” Hemingway said. “There’s no way that, I don’t know who could have done it, but I know for a fact she or a kid would not have done that.”</p>

<p>The mom told WABC she was furious after seeing her child come home from the Growing Kids Academy in Ocean Township last week with the missing braid. A worker from the school had notified her that she thought a braid was missing but wasn’t sure, so she sent Hemingway a photo to confirm.</p>
<p>“That’s when I saw the big bald spot on my child’s head with the braid missing,” Hemingway said. “They’re supposed to notify me. Just to even, like, give whatever little information you do have about the incident until you look into it further and confirm. But no one even called me to just let me know that little bit of information.”</p>
<p>Hemingway’s lawyer, Marc Caswell, told WABC that what troubles him most about the case is that the facility allegedly “deflected” and told his client “various different things” about what possibly happened, including placing the blame on Myla.</p>
<p>“They didn’t know if her child pulled it out,” Caswell said. “They didn’t know what happened at first, they said that they had no idea that it even happened.”</p>

<p>Hemingway has since removed her daughter from the day care and says the youngster is now sensitive to people touching her hair after the incident.</p>
<p>“I’m very upset and I’m very frustrated because this is my child,” she told WABC. “She’s not able to let me know what happened. And that’s the concerning part, the fact that they’re just so insensitive. No one even called me to check on her, see how she was doing.”</p>
<p>Caswell and Hemingway did not elaborate on what legal action they would take against Growing Kids Academy and its staff, only that they would file a lawsuit. A day care worker told Law&amp;Crime on Wednesday that no one was available to speak about what’s being alleged.</p>
<p>The female staffer was asked if she knew anything about the situation and said: “All I know is it’s unsubstantiated. That nothing’s been found.”</p>
<p>Attempts by Law&amp;Crime to reach Caswell and Hemingway for comment were unsuccessful.</p>

<p>Special counsel <a href="https://lawandcrime.com/tag/jack-smith/">Jack Smith</a> filed court documents on Monday to dismiss the criminal <a href="https://lawandcrime.com/tag/2020-election/">election interference</a> case against President-elect <a href="https://lawandcrime.com/tag/donald-trump/">Donald Trump</a> before he takes office in January, citing long-standing Justice Department policy prohibiting the indictment and prosecution of a sitting president. The request was subsequently granted by U.S. District Judge Tanya Chutkan just a few hours after Smith’s filing, meaning the charges stemming from Trump’s alleged attempt to undermine the 2020 election on Jan. 6 are over.</p>
<p>While the dismissal was inevitable, Smith requested that the case against Trump be dismissed “without prejudice,” meaning there would be nothing barring prosecutors from bringing the same charges again in the future.</p>
<p>In <a href="https://storage.courtlistener.com/recap/gov.uscourts.dcd.258148/gov.uscourts.dcd.258148.282.0.pdf">her order</a> granting the request, Chutkan wrote that “dismissal without prejudice is appropriate here,” noting that Trump’s presidential immunity from prosecution will not be permanent.</p>
<p>“Dismissal without prejudice is also consistent with the Government’s understanding that the immunity afforded to a sitting President is temporary, expiring when they leave office,” Chutkan wrote.</p>

<p>In the <a href="https://storage.courtlistener.com/recap/gov.uscourts.dcd.258149/gov.uscourts.dcd.258149.281.0_4.pdf">six-page motion to dismiss</a> filed in Washington, D.C., federal court, Smith reiterated the DOJ’s policy before emphasizing that his hands were tied. He also emphasized that the department and the country “have never faced the circumstances here,” regarding a private citizen under indictment being elected to the highest office in the land.</p>

<p>“After careful consideration, the Department has determined that OLC’s [Office of Legal Counsel] prior opinions concerning the Constitution’s prohibition on federal indictment and prosecution of a sitting President apply to this situation and that as a result this prosecution must be dismissed before the defendant is inaugurated. That prohibition is categorical and does not turn on the gravity of the crimes charged, the strength of the Government’s proof, or the merits of the prosecution, which the Government stands fully behind. Based on the Department’s interpretation of the Constitution, the Government moves for dismissal without prejudice of the superseding indictment.”</p>

<p>Smith, appointed special counsel two years ago, has spearheaded two federal criminal investigations into Trump. One, in Florida, involving Trump’s alleged mishandling of classified documents following his first term in office, and another, in Washington, D.C., involving his alleged efforts to overturn the results of the 2020 presidential election.</p>
<p>In the D.C. case, Chutkan had been saddled with deciding what aspects of the initial indictment against Trump could remain in light of the U.S. Supreme Court’s <a href="http://-%20https//lawandcrime.com/supreme-court/the-president-is-now-a-king-above-the-law-sotomayor-dissent-in-trump-immunity-case-accuses-majority-of-judicial-activism-in-twisted-opinion-that-has-no-basis-in-law/">sweeping ruling earlier this year</a> that made a sitting president immune from prosecution for any official acts taken while in office. Additionally, evidence of a president’s official acts cannot be used against a president in a criminal case, even where the underlying conduct is personal in nature.</p>
<p>There’s not much chance that the case will result in concrete answers to the presidential immunity questions, as many expect Trump to pardon himself before leaving office.</p>
<p>In addition to seeking dismissal without prejudice, Smith’s memo repeatedly noted that Trump may not be entirely clear of legal trouble once his second stint in office ends.</p>
<p>“OLC explained that because a sitting President’s immunity is ‘temporary,’ extending only so far as his term in office, it ‘would not subvert the important interest in maintaining the ‘rule of law,&#8221;” the memo states, adding that such immunity “would generally result in the delay, but not the forbearance, of any criminal trial.”</p>
<p>The <a href="https://lawandcrime.com/tag/aileen-cannon/">Florida document-hoarding case</a> was dismissed in July by U.S. District Court Judge Aileen Cannon. The Trump-appointed judge reasoned that U.S. Attorney General Merrick Garland unlawfully appointed Smith. As a result, Cannon dismissed the classified documents prosecution, tying the special counsel’s case up in appeals until the election. Smith is similarly seeking to dismiss that case from the appellate court without prejudice.</p>
<p>However, Smith did ask that the court of appeals keep the case against Trump’s co-defendants, Walt Nauta and Carlos De Oliveira, indicating he plans to continue their prosecutions. Nauta and De Olivera have both pleaded not guilty to the election subversion charges.</p>
<p>As Law&amp;Crime <a href="https://lawandcrime.com/high-profile/jack-smith-to-thwart-trumps-plan-to-fire-special-counsel-within-2-seconds-of-taking-office/">previously reported</a>, Smith has reportedly told people involved with the investigation that he will be resigning before Trump takes office on Jan. 20.</p>

<p>An argument about a bottle of hot sauce in <a href="https://lawandcrime.com/tag/colorado/" target="_blank" rel="noopener">Colorado</a> elicited a fiery and ultimately fatal rage over the weekend that left one man dead and another behind bars, police in the Mile High State say.</p>
<p>George Vigil, 19, stands accused of one count of <a href="https://lawandcrime.com/tag/2nd-degree-murder/" target="_blank" rel="noopener">murder in the second degree</a>, the Denver Police Department said in a relatively sparse <a href="https://x.com/DenverPolice/status/1838292858417119352" target="_blank" rel="noopener">press release</a> issued on Monday afternoon.</p>
<p>Several aspects of the case are shrouded in mystery, but, in the end, someone the defendant knows was <a href="https://lawandcrime.com/tag/fatal-stabbing/" target="_blank" rel="noopener">stabbed to death</a>, according to an affidavit of probable cause obtained by Law&amp;Crime.</p>

<p>The incident occurred at a residence on Federal Boulevard near Empower Field at Mile High Stadium, the home of the Denver Broncos football team in the National Football League. On Sunday evening, just before 5:22 p.m., 911 dispatchers received a call about the stabbing.</p>
<p>“Hello, I have someone stabbed,” a woman on the other end said.</p>
<p>“In the background of the call voices could be heard yelling,” the affidavit reads.</p>
<p>The woman told the dispatcher she was with “two gentlemen and a female, and one gentleman with a knife.” She described the injury as having impacted: “the gentleman on the left side of his ribs.”</p>
<p>“I just need somebody here right away,” the 911 caller continued — by now pleading for help. “We need an ambulance here right away. Right now. Right now. He’s bleeding to death, please.”</p>
<p>The dispatcher then asked: “Who did this to him.”</p>
<p>The woman replied with the defendant’s full name.</p>
<p>“George Vigil,” she said.</p>
<p>Responding officers assessed the scene while medical crews attended to the victim, according to the affidavit.</p>
<p>The victim was described as having “two separate sharp force injuries,” police wrote. The man suffered one stab wound to his left rib cage and another stab wound to his left back.</p>
<p>He was then rushed to the Denver Health Medical Center, where he succumbed to his injuries and was pronounced dead at 5:59 p.m.</p>
<p>In the heavily redacted court document, police suggest Vigil made an unprompted statement of some sort to police as he was being arrested — the entirety of that sentence, however, is censored.</p>
<p>“George VIGIL’s hands and clothing were stained with apparent fresh blood,” the law enforcement narrative picks up. “He had no visible open or bleeding injuries to his person. As officers took him into custody and were walking him to the vehicle, he asked for an attorney.”</p>
<p>A witness whose identity is also redacted in the affidavit told police that the victim has some sort of relationship with Vigil and earlier that same evening had “arrived to visit as he usually does more than one time per week” to “check on” something or someone there.</p>
<p>The witness then described the argument and resulting violence as explicitly about the location of a bottle of hot sauce.</p>
<p>“[The man] wanted to make a sandwich and asked where the hot sauce was,” the affidavit reads. “George VIGIL stated that the bottle was in his bedroom upstairs. An argument erupted between family members over the bottle of hot sauce, which resulted in both [redacted] and [redacted] physically separating [the man] and George VIGIL away from each other. [The man] verbally challenged George VIGIL to fight by making statements to the effect of ‘Let’s take this outside,’ and began approaching him again.”</p>
<p>When the man approached, the witness said, she saw the defendant “swing an arm,” police wrote — believing this to be one of the fatal blows. The witness told police Vigil “often carried a switchblade type knife in his front pants pocket.”</p>
<p>Then, the man “fell to the ground and began bleeding profusely,” prompting the 911 call, the affidavit notes.</p>
<p>Vigil first appeared in court on Monday and was ordered to be detained without bond. While police provided the defendant’s booking photo, he is not publicly listed on the Denver County Jail’s list of inmates. Other information about the case is also presently scarce.</p>
<p>One local member of law enforcement suggested the judge overseeing the prosecution sealed the case.</p>
<p>“When a case has been sealed in Colorado, and a request is made for the records, my office is required to respond that ‘no such records exist,&#8221;” a spokesperson for the Denver District Attorney’s Office told Law&amp;Crime in an email.</p>

<p>Stunned neighbors in Orange, Texas, awoke to the news on New Year’s Day that four people were found dead in a home, each of them shot and killed in a tragic case that appears to be a murder-suicide.</p>
<p>The Orange Police Department at 7:50 a.m. responded to the scene on North 8th Street and found 53-year-old Bobby Kiel, 34-year-old Porsha Kiel, 33-year-old Lester Lewis and 17-year-old Janiya Lewis fatally shot in what was deemed an “isolated incident” with no broader threat to the community.</p>
<p>The reason for that investigative conclusion became clearer when a relative of Porsha Kiel’s told local <a href="https://kfdm.com/news/local/police-in-orange-investigating-deaths-of-four-people-in-home?fbclid=IwAR1rX1Cm2-EvCggE-jAKiCdeU645oxe3G0v9anNx_aG57CfllrTlDq_el3w" target="_blank" rel="noopener">CBS affiliate KFDM reported</a> that authorities were operating under the belief that Lester Lewis shot the Kiels and Janiya Lewis before taking his own life.</p>

<p>While it is not clear what led to the early morning New Year’s Day shooting, it is clear that neighbors were shaken by the deaths of victims they were “friendly” with.</p>
<p>“Definitely sad. And I feel bad because that’s my neighbor and we’ve been here a long time. We are very friendly,” one anonymous neighbor told KFDM interview, before offering help. “If they need help, definitely I’m going to step in there and help them out. Anything they want.”</p>

<p>Neighbor Chris Enard separately told <a href="https://www.12newsnow.com/article/news/crime/police-investigating-deaths-of-four-at-home-in-orange/502-0c43390c-c5f4-4760-9b5d-e2b50f9f90ac" target="_blank" rel="noopener">local ABC and NBC affiliate KBMT</a> that he was speechless that Bobby Kiel, someone he has known for two decades and saw barbecuing on Sundays, was killed at the very start of the new year.</p>
<p>“I don’t have words right now. I came off of work about 2′ o clock in the morning and cop knocked on my door,” he said. “He was like did you hear any gunshots at like 8′ o clock in the morning. I was like yeah I’ve been hearing fire crackers and stuff go off.”</p>
<p>“About 9′ o clock I saw the yellow tape and I was like man what the hell happened,” Enard added, tearing up.</p>

<p>Enard then stated that the shooting was “not a good way to start the new year off.”</p>
<p>Last year <a href="https://www.businessinsider.com/murder-suicides-across-us-december-problem-getting-worse-2023-12" target="_blank" rel="noopener">ended with numerous murder-suicides</a> during the holiday season across the country, even <a href="https://www.fox4now.com/naples/two-dead-following-hotel-shooting-in-naples" target="_blank" rel="noopener">on New Year’s Eve</a>.</p>
<p>On New Year’s Day <a href="https://www.hawaiipolice.com/1-01-24-police-investigating-murder-suicide-in-kealakekua" target="_blank" rel="noopener">in Hawaii</a>, a 71-year-old man discovered his daughter shot to death by her ex-boyfriend. Cops said a rifle was found near the suspected shooter’s body.</p>
