A California judge who commented on people with brown hair and blond hair and once mimicked the pumping of breast milk has been publicly admonished.

The California Commission on Judicial Performance admonished Judge Julian W. Bailey, a judge of the Orange County Superior Court in California since 2012, in a Feb. 13 decision, report Law360 and the Metropolitan News-Enterprise.

“In 2014, and again in 2022 and 2023, Judge Bailey engaged in a pattern of discourteous, undignified and impatient behavior with female and/or inexperienced attorneys, in 10 separate matters,” the opinion said. “In some instances, the judge also conveyed the appearance of embroilment and bias on the basis of gender, race, national origin or ethnicity.”

Bailey told the commission that underlying medical conditions could provide a partial explanation for some of his behavior.

“He also admitted that, medical conditions notwithstanding, he should not have behaved as he did, and he accepted full responsibility for his misconduct,” the commission’s opinion said.

According to the commission, Bailey:

  • Learned that a deputy public defender who was the assigned public defender in Bailey’s courtroom might need a break at trial to pump breast milk for her baby. In one instance in March 2014, Bailey asked, “Do you need to—,” and then made a gesture with his hands against his chest. He moved his hands up and down in opposite directions while making the sound, “Ch, ch.”

  • Told his clerk to forever ban another deputy public defender from his chambers after she entered during a meeting in March 2014. Bailey complained to meeting participants after the deputy public defender left that she “has no tact” and is “so f- – -ing rude.” A meeting participant—who is white with blond hair—said the deputy public defender entered because she “had made eye contact” with her. “There are two kinds of people in this world—blonds and brunettes,” Bailey replied. The deputy public defender is of South Asian or Indian descent and has brown hair.

  • In March 2023, engaged in a “public beratement” of a deputy public defender who rolled her eyes at the prosecutor. He pointed a finger and raised his voice, telling the deputy public defender that she was “way out of line.” The entire courtroom went silent, but Bailey continued. “Don’t you dare do this in my courtroom. Ma’am, do you understand? Do you understand?”

  • In September 2022, Bailey objected to what he thought was an offensive facial expression by the same deputy public defender. “Counsel, the way you’re looking at me right now, it’s like you’re saying, ‘F- – – you, judge.’” he said. He also said that kind of nonverbal communication won’t be beneficial to her client. Bailey later apologized.

  • Stated that a defendant didn’t have to appear for a September 2022 hearing and then issued a bench warrant for the defendant’s arrest when he didn’t appear.

  • Interrupted a lawyer with an Arabic accent who was trying to clarify which section of the penal code the judge was using to order a mental competency evaluation for his new client. “I understand you’re not sure about a lot of things, but I’d ask you to please answer my question. Why should I not appoint doctors today?” Bailey asked during the January 2023 hearing. At another point, Bailey said, “I’m hoping to kind of bring you up to speed on an area of law about which you don’t seem to be well informed.”

  • In early 2014, said words to the effect that he was lucky “to get to work with beautiful women.” He was referring to a deputy public defender and a prosecutor.

  • Told a juvenile in a delinquency case in early 2014, “Oh, wow, what are you doing in custody? You’re so beautiful,” or said words to that effect. He also said the juvenile “could get a job in the movies playing a Native
American Indian.”

Law360 identified Bailey’s lawyer as Paul S. Meyer. He told the ABA Journal that he and his client have no comment.

Two suspected white supremacists have been charged in connection with the killings of two people, including a mother of five and witness to the first murder, whose bodies were found in bushes by a dog walker who mistook them for trash in Washington state.

Brandon Gerner, 40, was charged with first-degree murder, second-degree murder, and unlawful possession of a firearm in the killings of 57-year-old Robert Riley and 34-year-old Ashley Williams, according to King County prosecutors. He also faces first-degree animal cruelty in the killing of a horse shot point blank in the head in December, according to the King County Sheriff’s Office. Joshua Jones, 34, was charged with rendering criminal assistance, authorities said.

The killing allegedly happened in a “drug deal gone bad, The Seattle Times reported a now-dead suspect reportedly told investigators.

Gerner allegedly instructed that man, Kody Olsen, to shoot Riley before Gerner went into a trailer, found Williams and repeatedly stabbed because she was a witness who prosecutors said was “simply present at the scene,” according to charging documents obtained by Law&Crime.

Local Fox affiliate KCPQ reported Olsen shot her when the knife broke. Gerner later allegedly denied to investigators that he stabbed Williams and fingered Olson as the killer of both victims, Spokane CBS affiliate KREM reported. The suspects also allegedly killed a dog on the property, court documents said.

After, they allegedly drove the bodies elsewhere and ditched them on the side of a road.

The bodies were found near the Rock Creek Natural Area under trash and debris on Nov. 16 after a man walking his dog called 911 about a possible body.

“There is quite a bit of garbage covering the one body we could see,” King County Sheriff’s Office Sgt. Eric White told NBC affiliate King5. “They’re taking a methodical approach to check for evidence in and around before they actually remove the trash to determine closer what we have.”

Mark Bullard told King5 he was walking his dog when he spotted what he initially thought was a pile of trash. When he looked further, he found much more and called 911.

“I’m like looking at it, and I’m like, ‘Huh, is that a mannequin?’ And I looked again, and I was like,’ Huh, no.’ And so I started hollering, you know, thinking, ‘Are they alive?’ Ya know, ‘What’s going on?’” he said.

Williams was the mother of five children. A GoFundMe page set up by the adoptive mother of her two youngest children said she would be deeply missed.

“Ashley was a mom, a sister, a daughter, and a friend to so many,” the page said. “Her sister Angela would be very grateful for any help you can give toward Ashley’s funeral expenses, as Ashley’s family members were not prepared to deal with her untimely death.”

After the double murder, more bloodshed occurred. One of the suspects, Olsen, 45, died in December, about a month after the killings, days after a shootout with Pierce County sheriff’s deputies pursuing him for DUI in Tacoma.

After Olsen’s memorial service, Gerner allegedly shot a horse named LeMon, in what the Times reported was a “sacrifice to Odin,” the Norse god.

LeMon’s owners woke up to find him dead from a gunshot wound. A neighbor’s surveillance video captured a white car driving by shortly before midnight on Dec. 16 and the sound of a possible gunshot. The video did not capture the shooting, officials said.

Embedded below is an emotional Facebook post, a letter to LeMon from his owner posted on Thursday after news about the arrest broke:

Gerner has a history of run-ins with the law, court documents said. He was sentenced on Feb. 14, 2001, after being convicted of attempt to elude, assault in the second degree, burglary in the first degree, assault in the third, and unlawful possession of firearms. He was released on March 20 of last year after serving 22 years, court documents said.

He was reportedly a founder of a white supremacist prison gang called Omerta, King5 reported.

Lawyer Rudy Giuliani, who once represented former President Donald Trump, owes more than $152 million, and that doesn’t include the potential damages that he faces in pending lawsuits, according to his Chapter 11 bankruptcy filing Thursday.

The debts include $1.36 million owed to Davidoff Hutcher & Citron, a law firm that represented Giuliani in criminal cases, and more than $387,000 owed to a firm that represented him in legal ethics proceedings, the New York Times reports.

The largest debt, however, is the $148 million that Giuliani was ordered to pay to two Georgia election workers for defamation and emotional distress for false claims about vote tampering.

Giuliani estimates the value of his assets at $1 million to $10 million in the Dec. 21 petition, filed in the U.S. District Court for the Southern District of New York.

Publications besides the New York Times covering the bankruptcy filing include the Associated Press, Bloomberg Law, Reuters and Law.com.

Ted Goodman, a political adviser and a spokesperson for Giuliani, told the New York Times that the bankruptcy filing will give Giuliani time to pursue an appeal in the election-workers case, provide transparency for his finances, and “ensure all creditors are treated equally and fairly throughout the process.”

Giuliani’s potential liabilities include several pending suits, including two by voting machine companies Dominion Voting Systems and Smartmatic, which sued over stolen-election claims.
