According to a Facebook post by Bernalillo County District Attorney Sam Bregman, 46-year-old Kristina Withrow was convicted by a jury Thursday of second-degree murder with a firearm enhancement, aggravated assault with a firearm enhancement, and tampering with evidence following a jury trial. The verdict marked the end of one chapter of the fallout related to the shooting death of 36-year-old Monique Garcia, who died of gunshot wounds she received at the hands of Kristian Crespin, 20, Withrow’s son, in April 2023.

On April 3, 2023, Withrow saw Garcia in the walkway of her apartment building and told her to leave because she “assumed the victim was homeless,” according to a press release by the Albuquerque Police Department at the time of the shooting. The two women then got into a verbal argument, during which time Withrow retrieved her handgun.

Withrow then handed her gun to Crespin and “told her son to shoot” Garcia. Crespin fired three shots at Garcia, who was then rushed to the hospital. She died the following day from her injuries.

In an interview with police, Withrow said that she had fired at Garcia. But eyewitnesses came forward and reported seeing a male fire shots before fleeing from the scene.

Crespin eventually confessed to the shooting and was charged with an open count of murder, conspiracy to commit murder, and tampering with evidence. He pleaded guilty to both charges in April 2024 and was sentenced to 18 years in prison.

Withrow was also charged with first-degree murder and conspiracy to commit first-degree murder, but was not convicted on those counts. She is set to be sentenced at a later date.

An Orlando, Florida, lawyer accused of client trust account violations has said she used some settlement funds during the COVID-19 pandemic to avoid becoming homeless when she lost her primary job as a schoolteacher.

The Florida Supreme Court placed the lawyer, Natalie Renee Jones of Florida, on emergency suspension in a Sept. 16 order summarized by the Florida Bar News.

The Miami Herald covered the suspension and Jones’ explanation.

Hurricanes Helene and Milton are further compounding Jones’ troubles, Jones said in a motion for an extension of time to comply with the suspension order. The hurricanes have displaced Jones from her home and law office, and she has limited access to essential documents and records, she said.

The ethics investigation began when Bank of America notified the Florida Bar of an overdraft of about $2,400 in Jones’ client trust account in March, according to the Sept. 11 motion for the emergency suspension. The bar determined that the overdraft stemmed from Jones’ payment of fees to herself from trust account money two weeks before she deposited the settlement check.

The bar initiated an audit. It found shortages in the trust account ranging from $3,333 to $37,052 from December 2020 to June 2024, according to the suspension petition.

Jones told disciplinary authorities in a June letter that she used client settlement funds for personal expenses because “the alternative would have rendered my son and me homeless.”

The letter said Jones began working as a schoolteacher a year before the onset of the COVID-19 pandemic. She also began drafting demand letters for attorneys and took on two significant accident cases against Walmart and Lyft, as well as some smaller cases.

After the pandemic shut down schools and courts, Jones wrote, “I was without a steady income and in an exceptionally precarious situation.” Because her “finances were depleted,” she had to refer her two best cases to large litigation law firms.

When smaller cases settled, she said, she did not immediately compensate medical providers and used the money for living expenses.

In her answer to the petition for an emergency suspension, Jones said there was no threat to the public because all clients received their full settlement funds. Medical providers impacted by delayed funds were contacted and informed.

Jones said she is an attorney with a 30-year career that is “devoid of bar violations or complaints.”

Since the bar inquiry began, Jones said, she has taken a continuing legal education course on emotional resiliency, has sought counseling, and has listened to podcasts on managing client trust accounts.

Neither Jones nor her lawyer, Christopher L. Clark of the First Neighborhood Law Firm, immediately responded to an ABA Journal request for comment sent to email addresses used in the disciplinary case.

Footage from area where Shannon Marie Caslin Reeder was found dead stuffed in suitcase (KOMO).

Almost a year after her last confirmed sighting, a homeless woman was found stuffed dead in a suitcase. Now investigators in Seattle, Washington, are working to officially determine how Shannon Marie Caslin Reeder, 37, died and to figure out who put her in the suitcase.

“It was absolutely one of the most heinous, disgusting things that I’ve ever heard,” Tim Emerson, program director for We Heart Seattle, a homeless outreach group, according to Seattle ABC affiliate KOMO. “It’s hard to believe that a human being could do something like that to another human.”

More Law&Crime coverage: Teenager who murdered homeless woman said he was going ‘hobo hunting,’ prosecutor says

The discovery happened amid a separate incident in which in which a man was shot and injured near a homeless encampment in the area of Dr. Jose Rizal Park in Seattle. Law enforcement and outreach workers moved to clear out the encampment, but on Sept. 27, those workers discovered the suitcase and the horrifying remains in a trash pile.

Emerson reportedly said violence was not unusual in the area.

“There’s always a worry and a concern,” he said. “You always just have to be smart, watch your backs and know who you’re dealing with and when to walk away.”

Investigators are reportedly establishing a timeline leading up to Reeder’s death, and they are seeking anyone who saw her or had contact with her in the last 12 months. Washington State Patrol reportedly said the last confirmed sighting was November 2023.

“Anyone with information, that might be helpful in finding out what happened to Shannon, or who might have knowledge of who may have been involved in her untimely death and the callous disposal of her remains are asked to call Detective John Ford at 425-401-7742 or Detective Ivan Sergeev at 425-401-771,” authorities wrote.

The King County Medical Examiner’s Office is working to figure out her cause of death, according to The Seattle Times.

An Idaho man who livestreamed himself shooting a homeless man in downtown Spokane, Washington, will serve a little over three years in jail after making a plea deal.

Hoyt Webb, 36, will spend 37 months in custody for the shooting of Thomas Hatch, 47. Webb pleaded guilty to second-degree assault.

The victim’s brother, Eric Kessler, was unhappy about the punishment, local Fox and MyNetworkTV affiliate KAYU reported.

“I still don’t believe what he got was fair,” he told the outlet.

Hatch was shot on June 7 near a 7-Eleven in an area of downtown Spokane that the mayor declared to be in a state of emergency in response to the opioid crisis.

The “Trump 2024” hat-wearing, selfie stick-carrying Webb, with a gun strapped to his chest, was livestreaming the “homeless epidemic” on his “Kootenai County Press” YouTube page when he shot Hatch. The stream is no longer his site, but local ABC affiliate KXLY aired clips.

Webb’s YouTube page says he’s a credentialed reporter and photographer with the Constitution First Amendment Press Association (CFAPA). On its website, the CFAPA says it provides credentials “free of charge to any adult American Citizen who accepts the constitutional Journalist’s Pledge and who agrees to CFAPA’s Member Terms and Conditions.”

The bloodshed happened after Webb claimed he saw someone with a machete and went to his car to get his gun, KXLY reported.

“It’d be a bad idea if they pull anything out on me ’cause I’m pro-Second Amendment,” Webb can be heard saying in the livestream, the Lewiston Tribune newspaper reported.

At one point, Webb yelled at someone to drop a rock, local NBC affiliate KGW reported, citing court documents.

“Back the f— up!” Webb can be heard repeatedly yelling. “He just attacked me. Y’all did!” he also yelled, adding: “I’m constitutionally protected!”

Hatch was holding an iced coffee in his hand when he was shot, the outlet reported.

Hatch survived but lost a kidney and half his bowels and suffered damage to a coronary artery, his brother told local NBC affiliate KHQ.

Webb was arrested and later told police he felt his life was in danger, regretted being there and getting into an argument, Portland, Oregon, NBC affiliate KGW reported, citing court documents.

At Webb’s first court appearance, Spokane Superior Court Commissioner Eugene Cruz dressed the defendant down for antagonizing people experiencing homelessness, saying, “You went to this location for your own entertainment,” the Spokesman-Review reported.

The victim’s brother, Kessler, was shattered after watching the video.

“I heard that slide hammer cocked back,” he told local Fox and MyNetworkTV affiliate KAYU. “I stopped the video right there for a second, gained my senses, and then pressed play.”

He spoke of the defendant to KHQ, saying: “You’re evil. You went out seeking your 15 minutes of fame … Now you’re getting more than your 15 minutes of fame.”

A pastor slapped with over a dozen criminal zoning charges after he insisted on keeping his church doors open to the homeless has sued a city in Ohio alleging religious discrimination is behind efforts to shudder his sanctuary.

Pastor Chris Avell vows under his Christian faith he is bound to help the hungry and house those without homes at his 24-hour ministry in Bryan, Ohio, known as Dad’s Place.

But officials in the small city outside of Toledo say Dad’s Place turned into a hot spot for “transient” crime starting last spring and allege that Avell had failed for months to adhere to numerous local fire ordinances as well as residential-use rules for his property.

The first floor, Bryan officials said in a press release reviewed by Law&Crime, was not permitted for residential use; the “lives and safety of those in the building” were in potential jeopardy due to things like “improper installation of laundry facilities, inadequate or unsafe exit areas” and more, according to officials.

Avell was arraigned on Jan. 11 and pleaded not guilty. Eleven days later, the pastor decided he wouldn’t take the charges lying down and with his attorney and lawyers at the religious liberty group First Liberty Institute now aiding him, he filed a claim against Bryan officials urging a federal court to issue a temporary restraining order and preliminary injunction barring the mayor and his officers from enforcing city ordinances.

By doing this, it would allow those who need shelter and food in the cold Ohio winter to be protected and would, moreover, allow the church to continue “using the entirety of its property for religious purposes,” the motion requesting the restraining order argues.

City officials contend Avell has been warned repeatedly about the zoning violations but has ignored them and the offenses have steadily increased since he turned Dad’s Place into a 24/7 facility this past March.

In his lawsuit against the city, the pastor’s attorneys however say that there was a growing disdain toward religious establishments in downtown Bryan since 2020.

Until that year, according to Avell, “the city’s practice had been to provide police support to the sanctuary if it ever housed an unruly guest who refused to leave when asked to do so.”

Avell claims that changed “without warning” and the city “refused to continue providing police support, knowing that its refusal to do so would put the sanctuary in a dire financial state if it were forced to go through civil eviction proceedings every time it asked someone to leave.”

A local sheriff’s office ended up “filling the gap,” Avell’s lawsuit states, but as other ministries showed up, the city allegedly cracked down with ordinance enforcement and according to the pastor, ignored or denied his requests for a conditional use permit.

When he was told in November 2023 that he would have to cease-and-desist housing those who sought shelter at his ministry 24-7, Avell said he refused under a “religious obligation to care for the ‘least of these’ in its community.”

The city retaliated with its 18 separate criminal charges “for the work he performed on behalf of the Church,” the complaint states.

Avell also claims police visited the church “under false pretenses” including claims congregants were “panhandling or using illicit drugs.”

“On another occasion, two members of the City’s fire department and a police officer visited the Property and demanded entry because of the Property’s front door being locked and the public view into the Property being obstructed,” attorneys for Avell wrote in the 50-page filing.

Avell’s lawyers say their client didn’t learn he was charged until it was reported in the press in early December. He retained a lawyer for the church a day after Christmas, the lawsuit notes.

“Counsel for the City refused to agree to any kind of extension of the arraignment, even to allow for time to process pro hac vice applications, and repeatedly attempted to pressure Pastor Avell to appear for his arraignment without the presence of legal counsel,” the pastor alleges.

In a statement to NBC, Bryan City attorney Marc Fishel stood behind the mayor and local fire department for its enforcement efforts, noting there are private apartments one floor above Dad’s Place and that the alleged violations posed a “clear and immediate danger” to all inhabitants including visitors.

Bryan officials have defended claims from Avell that the city has ignored those in need of shelter year-round.

“Nothing could be further from the truth,” a city spokesman told NBC this week, noting that there is another facility, the Sanctuary Homeless Shelter, “next to Dad’s Place” that “fully complies” with local rules.
