A Georgia man has been indicted on murder charges after his wife died after being diagnosed with AIDS — and prosecutors say he knew he was HIV-positive and never told her.

Cleveland Broadie, who is in his early 60s, was previously charged with reckless conduct after his wife, Denise Broadie, died in April 2022, two days after she was diagnosed with having AIDS. Now, a grand jury has indicted him for malice murder and felony murder in connection to Denise Broadie’s death.

After she passed away, Denise Broadie’s family members suspected that their stepfather knew full well he was HIV-positive when he married their mother in 2014 and neglected to tell her about his status. WAGA, a local Fox affiliate, spoke to the family, who hired a private investigator to look into the life Cleveland Broadie had before he joined their family.

Denise Broadie was also battling cancer in the last years of her life. She had first been diagnosed in 2017, according to WANF, a local CBS affiliate, then went into remission. The cancer returned in 2019, and Denise Broadie beat it again.

But she reportedly remained ill. When she went to a different hospital for treatment, new tests were administered, revealing that she had AIDS. According to an arrest warrant reviewed by Law&Crime, Denise Broadie was diagnosed with AIDS on March 31, 2022, “which resulted in her death” on April 2, 2022.

Her family says she may have been living with AIDS for years without knowing it, years during which she could have been treated for the disease.

But according to her daughter, Karen Young, Cleveland Broadie never gave her the truth.

Young told WAGA, “There was malice in what he did. At any time, he could have told her and given her the right to make the decision to stay with him. Not that she would have.”

Court records showed that Cleveland Broadie faced three charges of reckless conduct related to his wife’s death, all filed in 2023. Prosecutors alleged at the time that he had known of his HIV-positive status since 2006 and never informed his sexual partners.

According to WANF, another woman came forward, sparking a second reckless conduct charge. A third charge soon followed when yet another woman came forward. The station reported that “multiple women” had come forward in response to its story.

Cleveland Broadie was arrested and taken into custody on July 8, 2023. He pleaded not guilty to the three reckless conduct charges. It was not immediately clear as of Friday whether he had entered a plea to the murder charges.

Judge gave ‘reasonable impression’ she was letting immigrant evade ICE, ethics charges say

A Massachusetts judge who allegedly gave a “reasonable impression” that she was allowing an immigrant to evade federal custody was “less than fully candid” when asked about the incident, according to an ethics complaint filed Monday.

The judge, Judge Shelley M. Richmond Joseph of Massachusetts, is accused of willful misconduct in the ethics complaint.

Joseph maintains, however, that she was not aware of a plan to let Jose Medina-Perez escape custody, and she was cooperative and truthful in the investigation by supervisors and disciplinary authorities. She “committed no misconduct and certainly no willful judicial misconduct,” her lawyers said in the written response to the charges.

“Judge Joseph looks forward to a hearing where all the circumstances finally become public,” said Thomas Hoopes, her lawyer, in a statement published by Reuters.

Joseph had once faced federal charges of conspiracy to obstruct justice over the April 2018 incident in the Newton, Massachusetts, courthouse.

Prosecutors had alleged that Joseph allowed Medina-Perez to go downstairs to the lockup, supposedly to retrieve property. The immigrant was then allowed to leave through a back door by a court officer. The charges were dropped in September 2022 after Joseph agreed to report herself to the Massachusetts Commission on Judicial Conduct.

The ethics complaint recounted the alleged sequence of events.

Medina-Perez was in court on a Pennsylvania warrant and two controlled-substance violations. A U.S. Immigration and Customs Enforcement agent was in the courtroom, and Joseph asked him to wait outside in accord with district court policy. At some point before a reconvened hearing, the defense attorney “formulated a plan with the court officer” to avoid ICE agents in which Medina-Perez would be returned to the lockup and let out of a door by the court officer.

The prosecutor later advised Joseph and the defense attorney that she no longer thought that Medina-Perez was the subject of the Pennsylvania warrant, and she would not seek bail on the misdemeanor charges. During a recorded sidebar conference, the defense lawyer said, “ICE is going to pick him up if he walks out the front door. But I think the best thing for us to do is to clear the fugitive issue, release him on a personal, … and hope that we can avoid ICE.”

Joseph allegedy replied, “The other alternative is if you need more time to figure this out—hold until tomorrow.” The defense lawyer responded that ICE would pick up Medina-Perez if he was bailed out. Joseph allegedly responded, “ICE is gonna get him?” and, “What if we detain him?”

The defense lawyer then asked whether the sidebar conference was on the record. Joseph directed the court clerk to turn off the recording equipment. The unrecorded remarks lasted 52 seconds.

Joseph’s recorded statements “would give a reasonable observer the impression that she sought to assist defense counsel in identifying a means for the defendant to avoid ICE,” the ethics complaint says. “Judge Joseph’s willingness to conduct an unrecorded sidebar conversation with counsel, in violation of [a district court rule], added to the basis for that impression.”

The defense lawyer allegedly asked Joseph in the unrecorded conference to allow him to accompany Medina-Perez to return to the lockup area after he was released from state custody. The defense lawyer also allegedly said Medina-Perez could be released through a rear door, according to the ethics complaint. Joseph allegedly agreed to the request with the knowledge that ICE agents were waiting in a different area of the courthouse.

When the recorder was turned back on, the defense lawyer said he thought that the defendant had property downstairs, and he would like to speak with him with an interpreter. “That’s fine. Of course,” Joseph said. After their arrival downstairs, the court officer released the defendant from the rear door, unbeknownst to the ICE agent.

Joseph failed to disclose the unrecorded session to the first justice of the Newton District Court, and when asked about it by a regional administrative judge, she said her unfamiliarity with courtroom equipment may have caused a portion of the hearing not to be recorded, the ethics complaint said.

She mentioned an experience in another courtroom in which she disconnected the recording system after learning that it was amplifying a sidebar conversation. In a conversation with the chief justice of the district court, she denied having anything to do with the defendant’s release.

In her response, Joseph denied that the defense lawyer told her of a plan to release the defendant through the rear door. In addition, she had no knowledge where the ICE agents were waiting outside the courtroom, the response said.

In her response, Joseph said she suggested detaining Medina-Perez to give the defense lawyer time to investigate his belief that ICE had issued a detainer for the wrong person. Because prosecutors were not seeking bail, she thought that the defendant would be released to ICE after his lawyer spoke with him, she said.

As for the unrecorded sidebar, her experiences as a practicing lawyer “led her to believe that this was an occurrence with no sinister meaning,” her response said.

Joseph was suspended in April 2019 as a result of the federal indictment but was reinstated after the federal charges were dropped in 2022, according to Boston.com. She is currently a judge for the Boston Municipal Court.

Man allegedly gave woman lethal fentanyl dose: Cops

A 26-year-old man in Texas has been arrested for allegedly killing a 24-year-old woman by allegedly giving her a lethal dose of fentanyl. Eric Sembera was taken into custody last week and charged with one count of fentanyl murder by delivery in the death of Erica Russell, court documents reviewed by Law&Crime show.

According to a probable cause affidavit, officers with the Tomball Police Department on the morning of Aug. 4, responded to a request for a welfare check on Russell at her apartment in the 29000 block of Tomball Parkway. The caller said that Russell had not been answering her phone.

Investigators learned that Russell went out with Sembera on the night of Aug. 2, and failed to show up for work the following day. A co-worker told police that Russell had overdosed in the early morning hours of Aug. 3 and went to the emergency room at HCA Houston Health Care — Tomball for “an apparent fentanyl overdose.”

Sembera accompanied Russell to the hospital, police wrote in the affidavit, describing him as a “known narcotics user.”

Police made contact with Sembera, who informed them that after the emergency room, he brought Russell back to her apartment sometime in the early morning hours of Aug. 3.

In an interview with police, Sembera allegedly said that after work, he, Russell, and another female co-worker were driving to a bar, and he explained to Russell that he previously had “an addiction problem” involving “Oxy,” according to the affidavit. He then did a “bump” of a white powder narcotic and offered some to Russell, who was hesitant at first.

“Sembera stated ‘[Russell] finally was Just like, okay whatever, do it,”” per the affidavit. “And so I pulled out a little bit and dropped it on her phone,” he allegedly continued, adding it was “straight Fentanyl” that was in “rock and powder form.”

Sembera said they left the bar at around 2 a.m. and went back to Russell’s apartment, where they engaged in sexual intercourse. Afterward, Sembera said they went back out to his car, where Russell suddenly “just stopped talking” and began nodding off until he realized she had become unresponsive. He then said he went into “freak out mode,” performing CPR before driving to the emergency room.

Russell reportedly received treatment, including an IV. When Russell woke up a few hours later, she said, “I don’t want to be here anymore,” and “asked the doctors if she could leave.”

“Sembera stated that Russell was waiting for a while and finally she just jumped out of bed and pulled the IV out of her arm,” per the affidavit. “Sembera stated that Russell said, ‘let’s go.’”

Afterward, Sembera said he dropped Russell back off at her apartment and went straight home, authorities said. He also allegedly confessed that he normally smokes fentanyl two or three times per day with his live-in girlfriend. Police said they found white rocks and powder in Sembera’s car that they believed to be fentanyl.

In a statement to Houston NBC affiliate KPRC, Sembera’s defense attorney, Mark Thering, said the charge against his client is ridiculous.

“This is a tragic accident, not a crime,” Thering said. “Unfortunately, he has had troubles with addiction, and he’s currently inpatient therapy and has been diagnosed with addiction disorder.”

Sembera was arrested on Nov. 26 and was released from custody after posting bond of $100,000. He is scheduled to appear in court again on March 4, records show.

Man attacks college student after she gave him ride: Cops

A good Samaritan interrupted the attempted sexual assault of a South Carolina college student by a convicted sex offender recently released from prison, authorities said.

Darrell Scott Brooks, 57, is facing a litany of charges including kidnapping, grand larceny and assault with the intent to commit criminal sexual conduct, the Anderson County Sheriff’s Office said. Deputies say Brooks asked the Clemson University student for a ride at an off-campus apartment complex late Tuesday, telling her he worked at the school and his car had “broken down.”

As she drove the man toward campus, Brooks allegedly forced her to pull into a church parking lot where he attacked her with a “folding razor blade knife” before pinning her down. A good Samaritan happened to be driving by and heard the woman yelling for help. The woman was able to escape with the help of the good Samarian. Brooks then allegedly stole the woman’s vehicle and took off.

Deputies from the neighboring Oconee County Sheriff’s Office saw Brooks crash in the Seneca area after fleeing from them when they tried to conduct a traffic stop, authorities said. They then took him to the Oconee County Detention Center. Clemson University officials are in contact with the student to make sure she has the resources she needs during the recovery process.

Lawsuit alleges nurse gave man lethal dose of insulin: Suit

A Pennsylvania nurse, already facing charges that she administered excessive doses of insulin to dozens of patients, including 17 who died, is accused of giving a 43-year-old “brittle diabetic” patient a lethal dose after she routinely insulted, berated, bullied, and abused him, according to a wrongful-death lawsuit filed by the man’s family this week.

Heather Pressdee is accused of injecting Nicholas Cymbol with an excessive and lethal dose of insulin last May at Sunnyview Nursing and Rehabilitation Center in Butler, Pennsylvania, according to the lawsuit.

The lawsuit documents the events leading up to Cymbol’s death after the suspicious death of another patient on April 17 when, the lawsuit said, “Pressdee set her sights on Nick Cymbol,” a “brittle diabetic” who often experienced large swings in his blood glucose levels and required routine insulin administration to maintain his blood sugar.

“Though Mr. Cymbol was well-liked by the staff at Sunnyview Nursing and Rehabilitation Center, Pressdee routinely insulted, berated, bullied, and abused Mr. Cymbol, just as she had done to other residents,” court documents said. “Staff at Sunnyview Nursing and Rehabilitation Center were aware that Pressdee disliked Mr. Cymbol and that she held the belief that people with a quality of life like Mr. Cymbol did not deserve to live.”

Once Pressdee yelled at Cymbol, in earshot of other Sunnyview staff members, to “get away from [Pressdee’s] f—— desk” when he approached the nurse’s station, court documents said.

She also routinely called him derogatory names such as “retarded” about his anoxic brain injury in earshot of Sunnyview staff members, court documents alleged.

She’s also accused of preventing other nurses at Sunnyview from feeding or providing water to Cymbol several times. The lawsuit said that days before Cymbol died, Pressdee allegedly said he “was going to be the next one to die and that even though staff complained to administrators about it, nothing was done. After nursing staff confronted Sunnyview administration with their concerns about the Pressdee’s “erratic and troubling behavior,” Sunnyview allowed her to continue as unit manager.

“It is absolutely beyond the pale that no one did anything after Pressdee made this promise regarding Mr. Cymbol,” court documents said.

Rob Peirce, the managing partner of Robert Peirce & Associates, said in a statement he’s hoping to get answers as to how she was permitted to continue working in these facilities despite her “erratic, disturbing, and abusive behavior.”

“The more our office has investigated, the more questions we have as to why these facilities allowed these tragedies to occur,” he said.

Sunnyview did not immediately respond to a request for comment from Law&Crime.

As Law&Crime has reported, Pressdee is accused of intentionally administering excessive doses of insulin to 22 patients between 2020 and her arrest last May, according to the state attorney general’s office.

In a news release, Pennsylvania Attorney General Michelle Henry accused her of poisoning 19 patients. In total, 17 of those 19 patients died while in Pressdee’s care, authorities said. Some of the patients — spanning five different care facilities — required insulin to treat diabetes, while some of them did not have diabetes.

She faces one count each of murder of the first and third degree, three counts of criminal homicide, two counts of criminal attempt — murder in the first degree, and charges of aggravated assault, neglect of a care-dependent person, and recklessly endangering another person, court records show. Pressdee remains in custody at Butler County Prison without bail. She has another court hearing set for May 2, according to the court docket.

Pressdee allegedly admitted to some of the incidents but said “she felt bad for their quality of life and she had hoped that they would just slip into a coma and pass away,” according to the initial criminal complaint filed in the case.

Phil DiLucente, one of her attorneys, did not immediately respond to a request for comment from Law&Crime.

But in an interview with CBS Pittsburgh affiliate WPXI in November, DiLucente said his client has expressed remorse.

“She has remorse, yes. I know that sounds trite, but as crazy as the whole thing is, she does express remorse, and I think her expression of remorse is sincere,” DePasquale said, the station reported.

Dentist rushed procedures, gave too much anesthesia: Suit

A dentist in Minnesota allegedly performed dozens of procedures on a patient in one day, overdosed her with anesthesia, and falsified medical records — and now that patient wants the dentist to pay.

Kathleen Wilson says Dr. Kevin Molldrem and his dental practice, Molldrem Family Dentistry, negligently performed more than 30 procedures in a single day, leaving her disfigured and seriously injured. According to a lawsuit filed in Hennepin County, Wilson “has endured and will continue to endure pain and suffering, embarrassment, emotional distress, and disfigurement as a direct result of Dr. Molldrem’s negligence.”

Specifically, Wilson alleges that on July 14, 2020, Molldrem “attempt[ed] to provide 8 crowns, 4 root canals, and 20 restorations in a single visit, and perform[ed] this work improperly.”

An expert dentist hired by Wilson’s attorneys said that it is simply impossible for Molldrem to have done all of this work in one day, especially considering that Wilson had a “very rare” condition in which many of her teeth were susceptible to decay.

“[Wilson’s] required a slow, thoughtful, careful and measured response to her disease,” wrote Dr. Avrum Goldstein, a dentist retained by Wilson’s lawyers to provide an expert opinion about Molldrem’s alleged negligence and the cause of Wilson’s injuries. “Trying to fill every hole in every tooth in her mouth in one visit is not only the antithesis of what was indicated, it is not humanly possible to achieve in an effective or constructive manner.”

“It is inconceivable that Dr. Molldrem could have prepared and placed 8 crowns under these circumstances in the time allotted, not to mention the additional 20 restorations,” Goldstein also said in his report.

In addition, Goldstein’s report says, Molldrem dosed Wilson with unsafe levels of anesthesia for her procedures, during which she was under IV sedation while also receiving local anesthetic.

“There are finite amounts of anesthetic that can be administered over a 5- or 6-hour period, and exceeding that amount places the patient at risk for an overdose of anesthetic and potential harmful effects,” Goldstein wrote. Records show that Molldrem nearly doubled the standard number of units of anesthesia — in just under three hours, the lawsuit alleges.

In doing so, Goldstein concluded, Molldrem “grossly exceed[ed] what would be considered safe,” the report said. “Any negative cardiovascular or central nervous system outcomes could be tied to the local anesthetic overdose. While Ms. Wilson may have been fortunate to not experience these side effects, that does not absolve Dr. Molldrem from administering an overdose of medication.”

According to Wilson’s complaint, Molldrem falsified medical records regarding how much anesthesia Wilson received for the procedures.

Within a year, Goldstein says, nearly all of Molldrem’s work needed to be repaired.

Wilson says that since the procedures, she has had to seek treatment from other providers “to examine and repair the negligent work performed by Dr. Molldrem.” She also says her injuries and medical costs are ongoing, and she has lost income and the capacity to work due to the treatments. She alleges more than $50,000 in damages.

Lawyers for Wilson declined to comment to Law&Crime. Molldrem’s office did not immediately respond to a request for comment.
