A woman identified by law enforcement as Guadalupe Zavala Lopez walks into a gas station where an infant was later found dead in the bathroom. (Houston Police Department)

A 27-year-old woman in Texas will spend several years behind bars for leaving a dead infant inside of a gas station toilet in Houston last year. Harris County District Judge Kristin M. Guiney on Monday ordered Diana Guadalupe Zavala Lopez to serve four years in a state correctional facility after she pleaded guilty to one count of tampering with evidence — human corpse as well as one count of tampering/fabricating physical evidence with the intent to impede an investigation, court records reviewed by Law&Crime show.

Guiney also credited Zavala Lopez with 489 days of time already served.

As Law&Crime previously reported, agents with U.S. Customs and Border Protection apprehended Zavala Lopez in August 2023 at a bus station in Brownsville, Texas, which is the largest city in the U.S. portion of the Lower Rio Grande Valley.

In a news release, federal authorities described Zavala Lopez as a Mexican national and “migrant who overstayed her visitor visa and was successfully taken into custody.” The release goes on to describe her as “a homicide suspect attempting to flee to Mexico,” however, homicide charges were never filed against the defendant.

Following her arrest, a spokesperson for the Houston Police Department told Law&Crime that the agency would “likely interview her again to get more details” and stressed that the only charge was the one count of evidence tampering noted on the Twitter account — but that the investigation is currently ongoing.

“We still have to speak with her,” an HPD public information officer said. “Beyond that it depends on the rest of the investigation.”

She was subsequently charged with the additional evidence tampering charge.

According to a probable cause affidavit, a customer on April 2, 2023, went to use the restroom at a Shell gas station in southwest Houston in the middle of the night. There, they found the child inside the toilet. Houston Fire Department paramedics determined the girl had been dead for over an hour by that time.

Police then posted footage to the department’s YouTube page showing a “person of interest” — later determined to be Zavala Lopez — leaving the gas station before the newborn was found dead.

In the footage, which skips around and appears to be edited, the woman can be seen getting out of her car — which is parked at one of the pumps — and then walking through the front door of the filling station. The camera zooms in on her face as she enters the store. The footage then cuts to the same woman getting back in the car and driving away into the night. Finally, the video ends with three different still images of the wanted woman, taken from when she entered.

During a press conference announcing the efforts to obtain the public’s help in the case by releasing the video, HPD Homicide Detective Calab Bowling said the woman on the video was in the gas station for roughly 15 minutes before she left.

“No one else went inside that bathroom, and [the newborn] was not there when she walked in before,” Browning said, clarifying later that witness statements also supported that understanding of events. “It appears that she gave birth in the restroom.”

Authorities have not revealed the child’s name or cause of death.

Colin Kalmbacher contributed to this report.

Witness and police video shows a man acting out at a gas station before striking a cop car with his vehicle, driving off, and fleeing futilely into a restaurant.

The suspect, Jordon Vasquez, 34, is currently locked up in the Bernalillo County Jail in New Mexico for armed robbery, aggravated assault with a deadly weapon, aggravated fleeing a law enforcement officer, and resisting, evading, or obstructing an officer.

In the witness footage from Feb. 7 in Albuquerque, an exasperated employee of the gas station apparently spoke to authorities over the phone offscreen. She said the suspect struck two homeless people with his hands.

More Law&Crime coverage: Mom accidentally shot to death by 2-year-old son with gun that was ‘negligently’ stored, police say

“He’s sitting out there nonchalant like nothing happened,” she said, describing the suspect sitting in a vehicle, his feet up, in the middle of the parking lot.

She said that the man had been trying to get cigarettes, although he did not have money.

“And he was like, ‘I don’t have money. I don’t have ID,” and he went to grab the cigarettes from the counter, and I was quick enough to swipe them back, and he was like, ‘girl, don’t make me go back there,”” she described.

She said he went behind the counter and stole cigarettes.

As seen on footage, the man lounged in the vehicle, arguing with a bystander until cops arrived. The suspect drove off, but before backing his vehicle into a cop car.

“He just hit the freaking cop’s car,” a woman said.

Bodycam shows police soon tracking down the suspect, taking him down, and handcuffing him.

Inset: Amber Adams (Oklahoma County Sheriff’s Office). Background: The 7-Eleven gas station where Adams allegedly tried to abandon her two infants (KWTV).

A mother in Oklahoma is accused of drunkenly trying to leave her infant children at a 7-Eleven gas station so she could drive somewhere to have sex.

Amber Adams was taken into custody earlier this year and charged with two counts of felony child neglect, court records reviewed by Law&Crime show.

A witness at the Oklahoma City 7-Eleven on June 6, 2024, called 911 and reported seeing Adams, who appeared to be very intoxicated, pull into the station and stop at one of the gas pumps, according to a report from Oklahoma City CBS affiliate KWTV.

The caller reportedly told the 911 dispatcher that Adams got out of the car and opened the passenger door. She then reached in and “grabbed a baby” by the arm as if the child “was a rag doll.” Adams then reportedly “tossed the baby to the ground.”

Afterward, she was allegedly trying to get a second child out of the vehicle when a friend who had been in the car with Adams intervened and put the first child back in the car, Oklahoma City Fox affiliate KOKH reported.

While it was unclear which child was removed from the car, KOKH reported that one of the kids was 4 months old while the other was 11 months old.

Once both kids were back in the car, the caller reportedly said Adams drove away from the station. The witness provided police with a description of her vehicle and officers were able to locate her and conduct a traffic stop a few miles away.

In an interview with police, Adams allegedly admitted that she had been drinking wine and tequila that evening. She also said that she had been trying to get in touch with the children’s father to set up a custody exchange but was unable to reach him.

Police said her plan was to leave the kids at the gas station and drop a pin, the location of which she was going to send to the father so he could “come and pick up the children,” KWTV reported.

Adams further explained to the officer that she was leaving the kids behind so she could get some “slingy sling,” KOKH reported. When pressed about what she meant by the phrase “slingy sling,” Adams allegedly responded that she was going to another person’s house to “f—.”

Adams’ friend was reportedly still in the car and told police that he had only known the woman for about two months. He also told officers that on one occasion, he watched as Adams downed four shots of tequila while she and both of the kids were in her car, per KOKH.

According to KWTV, Adams was so intoxicated that she told police her third child, a 6-year-old, had jumped out of the car that evening, prompting a frantic search. One neighbor told the station there were about 12 police vehicles in the area and officers with flashlights searching for the child. However, authorities said they later located the 6-year-old who was safe and staying with a family member.

Adams was initially released without being formally charged. Immediately following her release, she posted on social media that she was going to sell T-shirts depicting her mug shot for $10 each, KWTV reported.

A warrant for Adams’ arrest was issued on July 17, 2024. She is no longer in custody after a judge set her bond at $50,000.

Cops in Florida have arrested a 27-year-old man for allegedly shooting a U.S. Army veteran to death after a dispute at a gas station last year.

Kendrick Jerrod Anderson is facing a second-degree murder charge for the November 2023 slaying of 60-year-old Gregory C. Reed in Ocoee, a suburb of Orlando. Ocoee police announced Friday in a press release that detectives arrested Anderson after a year-long investigation.

According to a probable cause arrest affidavit, a Publix grocery store employee called 911 around 8:30 p.m. on Nov. 9, 2023, to report an accident involving a Ford SUV where someone died. Officers and paramedics responded to the scene and found that the driver, later identified as Reed, had been shot several times. First responders rushed him to the hospital, where he was pronounced dead.

More from Law&Crime: ‘He felt he had no choice’: Driver acquitted in third trial for road rage shooting in ‘minor traffic collision’

Publix surveillance video showed the SUV coming from the adjoining BP/Circle K gas station before making an abrupt right turn and crashing into a parked vehicle. A witness at the gas station said he and his girlfriend were sitting in front of the gas station when he saw the SUV and a Mercedes enter the parking lot about the same time. The driver of the Mercedes was trying to pull into a pump, but nearly collided with Reed’s SUV. In response, Reed honked his horn, the witness reportedly told cops. According to the witness, Reed and the two people in the Mercedes were shouting “what, what” back and forth, allegedly sizing each other up.

After the Mercedes parked at the pump, Reed went to the exit to leave the gas station. That’s when the passenger of the Mercedes got out of the car, walked up to Reed’s SUV and allegedly fired five shots, striking Reed multiple times. The Mercedes then drove away.

Reed was wearing a Domino’s Pizza T-shirt at the time of his death and his boss told detectives he had just gotten off his shift as a delivery driver prior to the murder.

In the days following the shooting, Ocoee police released surveillance photos of the Mercedes in question to the public. The vehicle’s owners saw news coverage and contacted police. They said they rented the car to Anderson on Oct. 27 for a two-week period. Anderson’s friends told detectives he would commonly let his buddy drive the vehicle while he was in the passenger seats. Street cameras confirmed this, according to police.

Detectives also obtained a search warrant for Anderson’s phone, which allegedly placed him in the area at the time of the murder. A further search of his phone showed he took a picture of a TV station’s live coverage from the murder scene and sent several text messages asking for “prayers” after Reed’s family met with the media to plead for information in the shooting, per police.

Cops arrested Anderson on Nov. 4, 2023, and took him to the Orange County Jail. However, because prosecutors did not move forward with an order for pretrial detention, a judge gave him a $50,000 bond, which he has since posted.

According to Reed’s obituary, he served in the U.S. Army from 1981 to 1984 following his graduation from high school. He worked in the food industry and at one point opened his own restaurant.

“Greg was truly a beautiful soul. He was very caring and committed father, son, brother, uncle, and cousin. He always made time for his children and family and never missed an opportunity to spend quality time,” the obituary said.

Alabama is ready to help other states carry out “humane” nitrogen gas executions after using it for the first time Thursday to kill inmate Kenneth Smith, the state’s attorney general has said.

Republican Alabama Attorney General Steve Marshall called the execution “humane” in a Jan. 25 press release, even though a report by a reporter from the Associated Press said Smith “began to shake and writhe violently, in thrashing spasms and seizure-like movements” after the execution began. The shaking continued for at least two minutes.

The U.N. Human Rights Office and the European Union criticized the execution method, USA Today reports.

In a press conference Friday, Marshall said Alabama stands ready to help other states with nitrogen hypoxia executions, Reuters reports.

“Alabama has done it, and now so can you,” he said.

Oklahoma and Mississippi have approved nitrogen gas executions, according to Reuters.

Marshall also indicated that 43 other Alabama inmates have sought nitrogen gas executions.

Smith was executed for his role in the 1988 murder-for-hire killing of Elizabeth Dorlene Sennett, a pastor’s wife. The pastor, who later killed himself, allegedly sought the murder to collect on an insurance policy.

Smith was initially scheduled for execution in November 2022, but executioners were unable to insert an intravenous line before the death warrant expired.

The U.S. Supreme Court had twice declined to stop the execution, in decisions Jan. 24 and 25, the New York Times reports.

On Jan. 24, the Supreme Court refused to block the execution based on the argument that the second try constituted cruel and unusual punishment.

On Jan. 25, the high court refused to act based on an argument that Alabama wasn’t ready to try the untested execution method, subjecting him to an unconstitutional risk of cruel and unusual punishment. The Supreme Court’s three liberal justices dissented.

“Having failed to kill Smith on its first attempt, Alabama has selected him as its ‘guinea pig’ to test a method of execution never attempted before,” Justice Sonia Sotomayor wrote in her dissent.

The U.S. Supreme Court on Wednesday refused to block the execution of a death row inmate who claims that he would be subjected to cruel and unusual punishment if Alabama tries to execute him again—this time using nitrogen hypoxia.

The Supreme Court declined to intervene in the execution of Kenneth Eugene Smith in one of two pending appeals. The Eighth Amendment argument before the high court was based on Alabama’s second attempt to kill the convicted murderer after executioners were unable to insert an intravenous line in November 2022, the New York Times reports here and here.

Smith’s lawyers say the experience caused trauma and post-traumatic stress disorder.

A second appeal claims that Alabama isn’t ready to try the untested nitrogen hypoxia execution method, and that the mask that it is using to deliver the nitrogen could let in oxygen, prolonging the death process, according to the New York Times.

Smith’s lawyers planned to take that issue to the Supreme Court after the 11th U.S. Circuit Court of Appeals at Atlanta denied his injunction request Wednesday.

Other publications covering the case, besides the New York Times, include Reuters, the Washington Post and Law Dork.

Smith’s execution was scheduled for Thursday evening. He was convicted for his role in the 1988 murder-for-hire killing of Elizabeth Dorlene Sennett, a pastor’s wife.

The state of Alabama has tried to kill Kenneth Eugene Smith before. Now, with the U.S. Supreme Court’s tacit approval, executioners will have their chance once again on Thursday. This time using nitrogen gas.

On Wednesday, with no recorded dissents, the nine justices on the nation’s highest court declined to pause what will be the first of its kind: an experimental execution enacted by nitrogen hypoxia.

The court declined to say why it allowed the execution to go forward.

“The application for stay of execution of sentence of death presented to Justice Thomas and by him referred to the Court is denied,” the terse order reads. “The petition for a writ of certiorari is denied.”

The Yellowhammer State’s chosen method to kill Smith is supposed to work by the death row inmate inhaling nitrogen to the point that he does not receive enough oxygen to his tissues and eventually dies.

Alabama announced the first system of its kind in August 2023, according to the Death Penalty Information Center. State Gov. Kay Ivey, a Republican, announced that Smith would be the first person subject to nitrogen hypoxia in November 2023.

The 58-year-old was convicted of killing a reverend’s wife in a murder-for-hire plot in 1988. He was first sentenced to life in prison by jurors. Then, the trial judge overruled the jury and sentenced Smith to death. He has been on death row since 1996 and confessed to his role in the brutal beating and stabbing death of Elizabeth Sennett, 45.

Alabama initially tried to execute Smith in November 2022. For nearly two hours, medical executioners repeatedly tried to find the proper place to attach the intravenous lines needed. Eventually, the clock ran out on the warrant to execute him. The state moved ahead with plans to execute Smith again, which, in turn, prompted a lawsuit.

The second execution was paused by a federal appeals court in 2023 but a district court finally gave the go-ahead earlier this month.

In that order, U.S. District Judge Austin Huffaker noted that Smith himself requested execution by nitrogen hypoxia as an alternative method — highlighting the agony of the botched lethal injection.

Huffaker mused that the inmate asked to be executed this way simply because he was trying to delay his punishment as the state worked out its final protocols for death by nitrogen hypoxia.

Once that was done, Huffaker noted, Smith then changed course and argued that method would not be appropriate either.

“Now that Alabama is prepared to carry out his sentence using the method of execution he has consistently declared he prefers, the circumstances have changed,” the judge wrote. “And what was once highly unlikely is now a certainty. With that change, Smith now seeks to enjoin the Defendants from carrying out his death sentence using the Protocol, arguing it unconstitutionally superadds pain such that the court should order the Defendants to amend it or execute him by firing squad, a ‘relatively uncommon and archaic’ method.”

In his denied petition to the U.S. Supreme Court, Smith took note of the newness of the planned method of death — as well as the rare instance of a state trying to kill the same person twice.

“For its second attempt, the State obtained permission from the Alabama Supreme Court to employ nitrogen hypoxia — a novel method of execution that has never been attempted by any state or the federal government — using a recently-released and untested protocol,” defense attorneys wrote. “States have failed at executions before. But upon information and belief, if Alabama proceeds with its planned execution attempt, it will be only the second time in U.S. history that a state follows through with a second execution attempt after a previous, failed attempt.”

Anti-death penalty advocates are protesting on Wednesday night. At least some activists believe the discourse surrounding the experimental nature of the execution is a bit of a sideshow.

“The discussion that is missing in all of this hubbub around nitrogen hypoxia is the mental torture of a second execution attempt,” Death Penalty Action Executive Director Abraham Bonowitz said in a statement provided to Law&Crime. “That, and the fact that if Kenny Smith were on trial today, he could not be sentenced to death at all because his jury was not unanimous regarding his sentence, and jury overrides were outlawed in Alabama in 2017. Alabama’s capital punishment system as a whole is broken and cannot be trusted to get it right.”

NEEDLES, Calif. – The Bureau of Land Management today approved the assignment of an existing Mineral Leasing Act right-of-way grant held for a natural gas pipeline by El Paso Natural Gas Company (EPNG) to Cadiz Real Estate, LLC (Cadiz) as part of a change of ownership. The assignment involves a 71-mile portion of an existing 30-inch diameter, buried gas pipeline extending 217 miles between Cadiz Valley in San Bernardino County and Wheeler Ridge, near Bakersfield, in Kern County.

“The BLM carefully reviewed public comments and used that input to shape the decision,” said BLM Needles Field Manager Mike Ahrens. “The BLM added terms and conditions to make clear this decision is limited to the assignment of EPNG’s existing rights and may not be used for transporting anything other than natural gas.”

Approval of the assignment follows a 15-day public comment period and formalizes the change in ownership, authorizing ongoing pipeline maintenance and the transport of natural gas consistent with the Mineral Leasing Act of 1920 without conveying any additional rights.

The segment of the existing oil and gas pipeline has not been used for more than 10 years. Although Cadiz previously expressed an interest in converting the pipeline to convey water, this assignment would not give Cadiz any future right or guarantee to utilize the right-of-way for such a purpose. Any future proposal to convert the pipeline for other uses would need to be considered under the <a href="https://www.blm.gov/programs/planning-and-nepa/what-informs-our-plans/nepa" target="_blank" title="Original URL: https://www.blm.gov/programs/planning-and-nepa/what-informs-our-plans/nepa.
