A workers’ rights group alleges that Skadden, Arps, Slate, Meagher & Flom improperly interfered with protected employee discussions about the law firm’s deal with President Donald Trump when it restricted email distribution lists.

The National Institute for Workers’ Rights filed an unfair labor practice charge with those allegations last week with the National Labor Relations Board, report Bloomberg Law, Law360 and Reuters.

Skadden’s deal, announced March 28 on Trump’s social media platform Truth Social, calls for the firm to provide $100 million in pro bono legal services to support causes favored by Trump and the firm. The agreement also said Skadden will not engage in illegal discrimination based on equity, diversity and inclusion initiatives.

Skadden reached the deal to prevent becoming a target in a punitive executive order.

The charge said “associates used firm email to discuss these changes, submit resignations, plan coordinated rejections of recruitment activities, and express concerns about the impact on what they do, with whom they work, and their ethical obligations.”

A letter sent to the NLRB, along with the labor charge, cited an anonymous Skadden employee who said the firm “turned off firm email lists to silence people” before announcement of the deal.

Curtailing access to email lists interfered with employees’ ability to engage in mutual aid and protection outside of a union, the letter said.

The National Institute for Workers’ Rights submitted the charge because of its concerns about worker rights and was not acting on behalf of Skadden employees, according to the letter. Generally, the National Labor Relations Act allows anyone to file a charge for unfair labor practices, according to Bloomberg Law.

Jeremy D. London, a Skadden executive partner, did not immediately reply to the ABA Journal’s request for comment.

Human error led lawyers representing MyPillow CEO Mike Lindell to file a draft document with incorrect case citations instead of the final version, according to a response to a federal judge’s order to show cause.

The lawyers didn’t realize that they had filed the wrong document, an early draft without corrections, until questioning 55 days later by the judge, according to their April 25 response.

Law360 has the story.

U.S. District Judge Nina Y. Wang of the District of Colorado had ordered the lawyers on April 23 to show cause why they shouldn’t be referred for discipline. Wang said she identified “nearly 30 defective citations” of cases, including citations to cases that don’t exist, in the lawyers’ Feb. 10 brief.

Lawyer Christopher I. Kachouroff said in a declaration his co-counsel filed the draft document instead of the final version that they “had carefully cite-checked and edited.” At the time, Kachouroff was on a one-week vacation to Mexico, where there were “limitations on internet service.”

But what happened wasn’t clear, Kachouroff said, when he was questioned in court by Wang. Kachouroff was “taken by complete surprise” because he was unaware of the mistake, he said in the declaration.

“In the face of the court’s detailed questioning, I was utterly flustered and embarrassed, and due to my ignorance of what was going on, found myself at a loss for words,” Kachouroff said.

Kachouroff said he routinely uses artificial intelligence to analyze the structure and the logic of legal arguments. He does not, however, rely on AI to do legal research or find cases.

“Regardless of whether I use AI in a particular pleading,” he wrote, “I always conduct verification of citations before filing.”

Kachouroff and his co-counsel, Jennifer T. DeMaster, are seeking leave to replace the draft document with the correct one.

Lindell is being sued for defamation by Eric Coomer, a former executive with Dominion Voting Systems. He alleges that Lindell and his related companies are “among the most prolific vectors of baseless conspiracy theories claiming election fraud in the 2020 election.”

Lindell allegedly amplified false allegations that Coomer may have been involved in a rigged election and a criminal conspiracy, leading to “credible death threats” against him and banishment from the elections industry, Coomer’s second amended complaint alleges.

Attorneys across the country are being targeted with fake electronic filing notifications, in which emails purporting to come from the federal Judiciary’s Case Management/Electronic Case Files (CM/ECF) system lead recipients to a malicious website with computer viruses.

According to the IT Security Office for the Administrative Office of the U.S. Courts, the fake Notices of Electronic Filing prompt recipients to reply immediately. Recipients are then sent an email containing a link to access fake case documents that direct users to a malicious website.

To avoid becoming a victim of the scam, be sure to always validate cases and case documentation directly through your local federal court’s CM/ECF system. Never download attachments or click on links from unofficial or questionable sources.

If you receive a suspicious email regarding a federal court case, contact the federal court in your jurisdiction before opening any attachments or links.

Visit the federal court scams page for more information about scams targeting people who interact with the federal courts.

Lawyers who respond to fake emails purporting to be from PACER’s electronic filing system are being led to malicious websites with computer viruses, the U.S. federal judiciary warned Wednesday.

The emails claim to contain notices of electronic filing from PACER’s Case Management/Electronic Case Files system, known as CM/ECF. Lawyers are told to reply immediately, and when they do, they are sent a link to access the supposed case documents. Instead, the link sends lawyers to the malicious website.

The scam targets lawyers across the country, according to the IT Security Office for the Administrative Office of the U.S. Courts.

“To avoid becoming a victim of the scam,” the Administrative Office of the U.S. Courts said, “be sure to always validate cases and case documentation directly through your local federal court’s CM/ECF system. Never download attachments or click on links from unofficial or questionable sources.”

An Oklahoma judge accused in two drive-by shootings has frontotemporal dementia, a disease that can cause “bizarre out-of-character behavior” changes, his lawyers said in an Aug. 28 court filing.

Judge Brian Lovell, 59, of Garfield County, Oklahoma, is seeking medical retirement, according to the court filing by his lawyers, Stephen Jones and William Jewell.

The Enid News & Eagle, the Oklahoman and KWTV News 9 have coverage.

Lovell faces criminal charges in drive-by shootings in Texas and Oklahoma.

Lovell was arrested in an alleged shooting spree in Austin, Texas, in September. He was accused of shooting at eight parked cars from his vehicle and twice rear-ending another driver. Lovell acknowledged rear-ending another car but said he couldn’t remember the alleged shootings and doesn’t know why he would have fired his gun. Two handguns were found in his car.

Lovell is also accused of shooting at his brother-in-law’s home in Bison, Oklahoma, in February 2023. He became a suspect after his Texas arrest. Police say the same gun was used in both shootings, according to the Enid News & Eagle.

The frontotemporal diagnosis was revealed in a court filing seeking to avoid Lovell’s removal from office without a hearing. The removal petition accuses Lovell of bias in his courtroom and affairs with two bailiffs that included courthouse sex, according to the articles.

After Lovell’s September arrest, Jones told the Oklahoman that he remembers the judge as “always congenial, reasonable.”

The court filing said frontotemporal dementia “is progressive until death, and there is no known treatment or cure,” according to the Enid News & Eagle.

The court filing said symptoms of the disease include “loss of memory, irritability, bizarre out-of-character behavior, sudden inappropriate impulses, impaired judgment, … a change in personality, decreased inhibitions, and subtle episodes of apathy.”

According to information cited by the Oklahoman from the Mayo Clinic, symptoms of frontotemporal dementia depend of the portion of the brain affected.

A California lawyer has been accused of filing a class action lawsuit that had been prepared by a lawyer working for his litigation opponent and then collecting attorney fees when the case settled on terms advantageous to the opponent.

The State Bar of California filed a notice of disciplinary charges against California lawyer Michael Jacob Libman in a March 6 complaint, report Law360 and the Los Angeles Times.

The disciplinary charges allege that Libman was a local counsel in the class action suit ostensibly filed on behalf of name plaintiff Antwon Jones, a utility customer, against the Los Angeles Department of Water & Power. The public utility company provides electricity and water to city residents. The suit was based on billing mistakes that happened after the adoption of a new billing system.

In reality, the Jones suit was prepared by Paul Paradis, one of two lawyers hired by the city to sue PricewaterhouseCoopers, which had configured and implemented the billing system, the ethics charges allege. The $67 million settlement agreement in the Jones suit was also prepared Paradis, according to the ethics charges.

Libman was recruited as a local counsel by Paul Kiesel, the other lawyer hired to sue PricewaterhouseCoopers, the charges say. Paradis recruited an Ohio lawyer to be the lead counsel and reached an agreement for the Ohio lawyer to kick back 20% of his attorney fees to Paradis, the ethics complaint alleges. The Ohio lawyer has since died, according to Law360.

Jones wasn’t aware of the alleged collusion in his suit against the city, and neither was the judge who approved a $1.65 million fee for Libman, the suit says. In his fee request, Libman had falsely claimed to have worked on wage-and-hour class actions in the past, according to the charges.

Libman was ordered in March 2021 to forfeit his attorney fees. Libman did not obey court orders to turn over detailed time records for the case and to answer deposition questions, the ethics charges say. He was found in contempt in August 2023, ordered to pay $1,000 for each act of contempt, and ordered to pay a $700 daily fine until he complies with court orders, the ethics charges say. To date, he has not complied.

The notice of charges alleges moral turpitude, conflicts of interest and failure to obey court orders.

The Los Angeles Times called the ethics charges “the latest twist in a DWP corruption saga that largely centered on the role of the [Los Angeles] city attorney’s office and how its lawyers responded to litigation over a faulty billing system.”

The Los Angeles Department of Water & Power scandal led to guilty pleas by four people, including three city employees, the article says. Libman was not charged in the scheme, but Paradis pleaded guilty to bribery, according to a November 2021 U.S. Department of Justice press release.

Libman’s legal counsel provided a statement on his behalf to Law360.

“I am disappointed that the state bar filed charges against me in this politicized [Los Angeles Department of Water & Power] case driven by vindictive, corrupt and connected lawyers bent on railroading me because I have been exposing their corruption for the past few years,” Libman said.

“If I will get a fair trial that allows me to present all the evidence, I will be fully vindicated and the true scale of the layers of corruption further exposed,” Libman said. “I look forward to the public trial, and I invite members of the media, bench and bar to come watch.”

Fulton County District Attorney Fani Willis has asked a judge to ignore a recent court filing purporting to show a series of cellphone “interactions” between herself and the special prosecutor overseeing the racketeering (RICO) case against former President Donald Trump.

Early on Friday, Trump attorney Steven Sadow filed a supplemental exhibit allegedly based on an analysis of cellphone records indicating that special prosecutor Nathan Wade was in physical proximity to Willis before the time in 2021 when he was hired to work on the case — well before Willis and Wade have testified their relationship began.

Later on Friday, Willis sought to rubbish that filing as in violation of the court’s standing order on how evidence will be admitted in the case, the Georgia rules of evidence, and U.S. Supreme Court precedent.

“The Court’s Standing Case Management Order for Criminal cases was specifically intended to prevent parties from ambushing opposing counsel with purported expert evidence without allowing opposing counsel a meaningful opportunity to review the evidence, review the purported expert’s report and qualifications, and obtain its own expert in rebuttal,” the state’s objection reads. “The Court cannot now allow Defendant Trump to bypass this protective procedure when, in other cases, it has excluded expert evidence for a party’s failure to follow the Standing Case Management Order for Criminal Cases.”

In the Trump filing, investigator Charles Mittelstadt argues that AT&T records “revealed over 2000 voice calls” and “just under 12,000 interactions” exchanged by Wade and Willis over 11 months in 2021.

The investigator hired by Trump’s defense attorney also claims the data shows “specialized location data” for Wade’s cellphone number which puts him near Willis’ address on two days — during the early morning hours — in September and November 2021.

On Nov. 1, 2021, Wade was hired to work the RICO case. Both Willis and Wade, however, have testified (and averred in court documents) that their relationship did not become romantic until 2022.

Defense attorneys led by those representing co-defendant Michael Roman, a former Trump 2020 staffer, have alleged that Willis appointed Wade and then reaped something of a financial windfall in the form of various destination vacations, gift-like dinners and excursions during those trips, and other purchases. The prosecutors, conversely, say they more or less split their travel expenses equally.

There is a very scant — admittedly almost nonexistent — paper trail to substantiate the state’s claims that Willis reimbursed Wade. But, the basic facts of the relationship and when it began are also key to the judge’s ultimate determination over whether or not the DA, along with her entire office and prosecutorial team, will be tossed from the case.

More Law&Crime coverage: The Trump Docket: Jack Smith and Mar-a-Lago judge set for major showdown over protecting witnesses in documents case

“Mittelstadt, the author of Exhibit 38, is available to testify at the Court’s convenience,” the Trump filing reads — an attempt to piggyback on recent hearings over the Wade-Willis relationship.

The district attorney’s office, in their objection, disputes what Mittelstadt suggests: that Wade was calling on Willis late at night.

A bolded and underlined section in the latest filing reads:

The records do not prove, in any way, the content of the communications between Special Prosecutor Wade and District Attorney Willis; they do not prove that Special Prosecutor Wade was ever at any particular location or address; they do not prove that Special Prosecutor Wade and District Attorney Willis were ever in the same place during any of the times listed in Supplemental Exhibit 38; and, in fact, on multiple relevant dates and times, evidence clearly demonstrates that District Attorney Willis was elsewhere, including at work at the Fulton County District Attorney’s Office AND VISTING [sic] THE THREE CRIME SCENES WHERE A MASS MURDER MOTIVATED BY RACE AND GENDER BIAS HAD TAKEN PLACE.

Willis has previously called the effort to remove her from the case “absurd” and said that it reflects a “basic misunderstanding” of “rudimentary” rules. Still, Fulton County Superior Court Judge Scott McAfee has said the issues raised by the defense are serious and could warrant disqualification.

The state’s late Friday salvo largely sticks to the evidentiary issues — arguing Trump’s filing cannot satisfy numerous obligations under the court’s, the state’s, and the constitution’s procedural rules for the admission of evidence. Willis argues the judge should not consider the Mittelstadt data when ruling on the motion to disqualify.

Tucked into the tail-end of the state’s objection is also a quick bit of musing about where the Wade cellphone data came from.

“Moreover, the State questions whether Defendant Trump legally obtained cell site location information, which is generally only obtainable after a finding of probable cause and issuance of a search warrant,” the district attorney’s office writes.

Former President Donald Trump issued a broadside attack against special counsel Jack Smith and the broader Biden administration in a late Friday motion filed in the Mar-a-Lago classified documents case.

Stylized as a reply to the government’s response over extended discovery schedules requested by the defense, the 37-page brief obtained by Law&Crime aims at prosecutors and politicians alike. The focus of the filing is the Thursday special counsel report declining to criminally charge President Joe Biden despite finding he likely violated the law by retaining and sharing classified documents.

“Yesterday, the U.S. Department of Justice released a report issued by Special Counsel Robert Hur, finding that President Biden has ‘willfully retained and disclosed classified materials after his vice presidency when he was a private citizen,’ over the course of his decades-long career,” Trump’s reply brief reads. “President Biden will not be charged, and President Trump should not have been either.”

“Based on this evidence, the Defendants are entitled to discovery and a hearing concerning selective and vindictive prosecution, and they will ultimately demonstrate that the Superseding Indictment must be dismissed,” the filing reads.

Citing “ongoing discovery abuses” by the government, the 45th president and his co-defendants, Waltine Nauta, Trump’s longtime butler, and Carlos De Oliveira, Mar-a-Lago’s property manager, allege the decision not to charge Biden over his own unlawful retention of classified documents is “prima facie” evidence of a “selective and vindictive prosecution.”

More Law&Crime coverage: The Trump Docket: Victory appears likely at SCOTUS, but immunity is a much tougher hill to climb

The controversial decision not to charge Biden over what special counsel Robert Hur said he believed was, in fact, a violation of federal law, came down to several factors. One factor cited in the 388-page report is the belief that prosecutors simply would not be able to make their case because Biden would sell himself to a potential jury as an “elderly man with a poor memory” who did not know he was breaking the law. Hur also noted, in passages on multiple pages throughout the report, that the allegations against Trump are far worse.

“The Hur Report is the latest entry on a long list of similarly situated government officials not being charged with a crime in connection with allegations relating to the handling of classified information,” Trump’s motion continues. “There is also significant evidence that this prosecution is motivated by impermissible considerations concerning President Trump’s status as the leading candidate in the 2024 election and President Biden’s chief political rival. Dating back to April 2022, the Biden Administration has urged prosecutors to coopt the criminal justice system to try and accomplish what President Biden cannot do on the campaign trial [sic], defeat President Trump.”

While pushing for the indictment to be dismissed, the criticism leveled by Trump against Smith, U.S. Attorney General Merrick Garland, Biden and others comes in a motion that argues for more expansive discovery and more time to conduct such discovery. Prosecutors have been adamant that extended discovery deadlines are just an effort to stall and push the trial date past the 2024 election.

The argument advanced by Trump’s attorneys, which is also joined by Nauta’s and Oliveira’s attorneys in the motion, is that the non-charging decision over Biden’s retention of the documents shows not only selective and vindictive prosecution but also clear evidence of “political animus.”

Each of those theories, the motion notes, are akin to terms of art under federal law — and each has its own discovery standards.

In other words, because the U.S. Department of Justice did not charge Biden, the Mar-a-Lago co-defendants are entitled to increase the scope of their discovery requests substantially, the motion argues.

“In light of the decision not to prosecute President Biden for his ‘willful’ violation of the Espionage Act, the Special Counsel’s Office can no longer avoid discovery on a selective and vindictive prosecution theories,” the motion reads. “This discovery includes all materials within the possession of the prosecution team that ‘might corroborate’ President Trump’s motion to dismiss on behalf of the Defendants.”

The motion cites several pieces of case law to bolster their argument — while musing that most prior court decisions have dealt with whether discovery can be used during trial proceedings in instances where the state had provided such discovery.

More Law&Crime coverage: Jack Smith must immediately provide Trump and Mar-a-Lago co-defendants with sensitive document the government claims ‘risks disrupting’ an ongoing investigation

“[T]he defense seeks information and evidence demonstrating that participants in the investigation were biased against President Trump and motivated to reach false and inaccurate conclusions based on political animus,” the motion goes on. “Materiality is the standard, and it is a low bar. Relevance and admissibility are for another day — if this case survives that long.”

But, the motion also says, the government has not been complying with their already-in-place discovery demands.

“In discovery letters and motion papers, the Special Counsel’s Office has sought to avoid their discovery obligations by claiming that otherwise-discoverable materials are not in the possession of the prosecution team,” the motion continues. “In fact, other than by seeking to exclude the possessors of the evidence from the prosecution team’s scope, the Office largely declined to address the specific types of political-animus and bias evidence President Trump is seeking.”
