Dad who allegedly stabbed son claimed he ‘fell on a knife’

A Nevada man is being held without bail after being arrested for the alleged fatal stabbing of his own son, who he claimed “fell on a knife.”

Las Vegas Metropolitan Police reported to a call on Dec. 22 at around 1:00 p.m. that a man was suffering from stab wounds to the chest in an apartment on Pebble Road near Maryland Parkway in Las Vegas. The man was Nelson Garcia-Leon, whose age was not provided, and he was pronounced dead at the scene by first responders. Near the apartment where Garcia-Leon was found, police recovered a bloody, 15-inch knife, “hastily hidden behind an ice cooler.”

According to court documents obtained by KLAS, a local CBS affiliate, LVMPD homicide detectives began their investigation with a woman whom they referred to as Garcia-Leon’s “girlfriend,” even though they’d only known each other for about a month. She stated that she was more acquainted with Garcia-Leon’s father, Juan Garcia-Hernandez, 81, and that the father and son shared the Pebble Road apartment.

When the woman came back to the apartment after shopping, she observed Garcia-Leon acting unusual and eventually saw blood on his chest. She also reportedly saw a knife on the ground. When she asked Garcia-Hernandez what happened, he allegedly claimed that his son fell on the knife.

As she struggled to dial 911 — apparently dialing extra numbers — she told police that the father “was doing nothing to help” his injured son. When she asked him to go get help, he left the apartment.

Police also interviewed Garcia-Hernandez, who stated that he and his son had gotten into a “verbal altercation” over his son’s drinking. When Garcia-Leon collapsed, the father said that he went looking for help from his neighbors, who helped him move his son into the bedroom. One of the neighbors ended up calling 911, telling dispatchers that the victim’s father said “his son fell on a knife and was bleeding,” noting that the father “didn’t seem stressed at all.”

Once police realized that Garcia-Hernandez’s story kept changing, they started to suspect that he may have been responsible for his son’s injury. Eventually, they found the alleged weapon “hastily hidden behind an ice cooler.” Police records obtained by KLAS showed that Garcia-Hernandez had a number of arrests involving his allegedly threatening others with knives, one as recently as May.

Garcia-Hernandez was arrested and charged with open murder. He is being held at the Clark County Jail without bail. His next court date is scheduled for Jan. 9.

Driver fled after friend fell from car, died

A 24-year-old woman in Michigan who drove away after a friend fell out of her moving car and died in the middle of the road will be going to jail. An Oakland County judge ordered Kentia M. Fearn to spend ninety days in jail for her role in the death of Mia Kanu, court records reviewed by Law&Crime show.

Fearn pleaded no contest in October to one count of leaving the scene of an accident resulting in death as well as one count of operating a motor vehicle while intoxicated. In addition to her incarceration, Fearn was also sentenced to three years of probation.

The deadly incident took place shortly after Fearn and Kanu left a party in the early morning hours of June 3, 2023, in a car that Fearn was driving.

As Law&Crime previously reported, officers with the Southfield Police Department at about 4:32 a.m. on June 3 responded to a strip of road in front of the Coach House Apartments on Providence Drive, about 15 miles northwest of Detroit, in regards to a report about an adult female lying motionless in the street, the Detroit Free Press reported. The female — later identified as Kanu — was transported to Ascension Providence Hospital in Southfield, where medical personnel said she had suffered severe head trauma and admitted her into the intensive care unit and placed her on life support.

The person who called 911 was a passerby who did not know Kanu.

Kanu remained in the hospital for two days before she was declared dead on June 5, but remained on life support for an additional three days because she was an organ donor. According to the Free Press, staffers at Ascension Providence honored Kanu with a “walk of life” ceremony as she was brought to the operating room.

“There was no brain activity. Her liver went to a baby, her kidneys went to a recipient and her tissues and muscles were donated to the Gift of Life,” her mother, Bianca Vanmeter, told the newspaper. “She just looked like a beautiful angel laying in bed.”

Vanmeter reportedly said she saw her daughter before she went to work at the Green Lantern restaurant in Berkley on the morning of June 2. When Kanu finished her shift at the restaurant, her mother said she was picked up by a female friend who was staying at her house, along with her daughter, and the two went with friends to a house party.

Prosecutors in Oakland County said that after leaving the party, Kanu fell out of Fearn’s vehicle onto the road. Fearn allegedly did not stop. Instead, she left the area and did not alert anyone or call 911, authorities said.

“The law requires anyone involved in an accident to stop and immediately report the accident to authorities,” Oakland County Prosecutor Karen McDonald said. “Leaving the scene when someone is seriously injured or dies is a felony. My office will hold those who do so accountable.”

Fearn was arrested and charged in Kanu’s death about three months after the incident.

Kanu’s obituary said she was “a treasure to all those who loved her.”

“Mia, was a wonderful daughter, granddaughter, sister, niece, cousin and friend who touched the lives of all those around her,” the tribute stated. “Mia dedicated her life to God, her family and friends. To all those that she encountered, Mia was kind, loving, sweet and funny. She was a team leader in all that she did and was a very active team player in volleyball and school activities.”

Former general counsel John Goggins, 63, of Chatham, New Jersey, was sentenced Oct. 24 after pleading guilty to willfully failing to pay tax returns during a four-year period. He has already paid court-ordered restitution of $3.11 million and faces an additional fine of $40,000, according to an Oct. 24 press release from the Department of Justice.

Law360 had coverage of the sentencing hearing before U.S. Magistrate Judge Andre M. Espinosa of the District of New Jersey.

Trial attorney Kenneth Vert of the DOJ’s Tax Division argued that Goggins deserved 22 months in prison, according to Law360. Vert said Goggins “only filed returns where the tax authority caught him for not filing,” and his behavior amounted to “deliberate defiance of the tax law.”

The lawyer for Goggins, Sharon L. McCarthy, sought probation for her client, Law360 reported. She acknowledged that the case was “puzzling.” Goggins was able to perform well in his job while his personal life “all fell apart,” she said.

His problems included failing to renew his law license and failing to make car payments, resulting in the vehicle being repossessed twice.

Goggins was stressed by a difficult marriage, memory impairment and the 2015 death of his daughter, according to courtroom remarks cited by Law360. He is now getting mental health treatment.

Goggins “regrets and accepts full responsibility” for failing to file tax returns, according to a statement provided to Law.com and Law.360.

“He is grateful to the court for considering the comprehensive measures of accountability and restitution he has taken in connection with his misdemeanor offenses,” the statement said. “He looks forward to putting this matter behind him and will be timely filing all tax returns going forward.”

Updated Oct. 29 at 2:05 p.m. to correct the amount of the fine and a misattribution.
