<p>A sheriff’s deputy who crashed on body camera lied by omission by initially hiding the fact that he was looking at porn at the time, says the Lake County Sheriff’s Office.</p>
<p>“Gosh darn it,” he said on footage after the crash. “Yeah, that f—ing really sucked.”</p>
<p>The internal affairs report from the Office of Professional Standards determined that he lied, was looking at porn on his phone while driving the patrol vehicle, and also failed to wear his seat belt.</p>
<p>Law&amp;Crime is not naming him because he has not been charged with a crime. The deputy resigned during the investigation, Cpl. Chanel Martin of the Lake County Sheriff’s Office told Law&amp;Crime in an email.</p>
<h3><strong>The crash</strong></h3>
<p>His bodycam from the afternoon of Nov. 6, 2024, shows him with his phone out, though it is unclear what it has on. But what is clear is that the yellow air bag bursts out.</p>
<p>He indicated to at least one passerby he was OK. He walked over to another vehicle that apparently got caught up in the crash. Law&amp;Crime is omitting this encounter because it shows the woman, but in it, the deputy is checking on her.</p>
<p>“Hello, ma’am,” the deputy tells the other driver in the video. “Are you OK? I’m so sorry.”</p>
<p>“It’s OK,” she said.</p>
<p>“My brakes locked up,” he said.</p>
<p>She said she was OK.</p>

<h3><strong>The internal affairs report</strong></h3>
<p>According to the internal affairs report, the deputy allegedly wrote that he ended a phone call when he saw a vehicle stopped in front of his because a school bus was stopped in the opposite lane with lights on.</p>
<p>On top of that, the light for his auto-brake system was on after he left speed calibrations at the IPS range, so his brakes locked up.</p>
<p>But a sergeant who reviewed video footage determined the deputy was looking at images on his phone when the crash happened.</p>
<p>The deputy allegedly described having finished a call with a colleague at the time of the crash.</p>

<p>“He went on to say that he was scrolling through text messages on his phone from a group text with his sector three colleagues just prior to the crash,” the report stated. “He stated he was not sending text messages when the crash occurred.”</p>
<p>But video did not show him scrolling through texts, authorities said. Instead, he was allegedly “viewing a picture or a video at the time of the crash,” the report stated. A supervisor later described there being no videos or pictures in the group chat.</p>
<p>The investigator also determined that the deputy was not wearing a seat belt at the time of the crash.</p>
<p>In an interview on Nov. 20, 2024, the deputy admitted he was, in the report’s words, “looking at inappropriate pictures.” Asked to clarify what he meant, he allegedly “stated pornographic material like boobs or whatnot.”</p>
<p>He reiterated that his bakes did lock up, but he did not have the time to stop when he realized the vehicle was stopped in front of him.</p>
<p>He ultimately admitted “he knew he was looking at inappropriate pictures, which was the leading cause of the crash, and he deliberately left that information out of his report.  He stated that it is called lying by omission.  He further said he knows that one all too well.”</p>

<p>A now-former <a href="https://lawandcrime.com/tag/indiana/" target="_blank" rel="noopener">Indiana</a> sheriff’s deputy was recently arrested after pretending to be a woman on <a href="https://lawandcrime.com/tag/facebook/" target="_blank" rel="noopener">Facebook</a> in order to <a href="https://lawandcrime.com/tag/harassment/" target="_blank" rel="noopener">harass</a> a schoolteacher he once dated, law enforcement in the Hoosier State says.</p>
<p>Derek Joseph Bogenschutz, 36, stands accused of one count of felony identity deception, according to the Indiana State Police.</p>
<p>The defendant previously worked as a deputy with the Jay County Sheriff’s Office — and also as a part-time resource officer at the elementary school where the woman taught.</p>
<p>It is unclear when, exactly, Bogenschutz stopped working for the sheriff’s office.</p>

<p>The investigation began in February, after the Union City Police Department received a complaint from the teacher, according to the <a href="https://www.thestarpress.com/story/news/crime/2024/09/25/indiana-state-police-accuse-ex-jay-county-deputy-of-identity-deception/75380544007/" target="_blank" rel="noopener">Star Press</a>, citing a press release issued by state troopers.</p>
<p>At the time, she thought a woman named “Katie Morgan” was harassing her and her boyfriend — a Union City police officer.</p>
<p>But the “Katie Morgan” in question did not really exist.</p>
<p>Bogenschutz was allegedly the person posting under that fake profile, state troopers say. Using the feminine nom de plume, the onetime deputy allegedly messaged the teacher and claimed her boyfriend was “playing” both of them, according to court records cited by Fort Wayne-based <a href="https://www.21alivenews.com/2024/09/25/former-indiana-sheriffs-deputy-accused-using-fake-facebook-profile-harass-elementary-school-teacher-he-went-date-with/" target="_blank" rel="noopener">ABC, NBC, and MyNetworkTV affiliate WPTA</a>.</p>

<p>The deception is alleged to have gone a bit further.</p>
<p>Bogenschutz also sent the teacher screenshots of conversations purporting to show “Katie Morgan” and the teacher’s boyfriend arguing about other women, authorities allege.</p>
<p>It is unclear whether or not those fake lover’s quarrels were actual conversations, but, investigators say, Bogenschutz eventually did contact the teacher’s boyfriend as well.</p>
<p>The boyfriend himself also reported the harassment — and told a colleague who also happened to be a Jay County sheriff’s deputy, according to Fort Wayne-based <a href="https://www.wfft.com/news/local/former-jay-county-deputy-arrested-on-warrant/article_28b462ba-7b62-11ef-b089-a7a84ed5f50f.html" target="_blank" rel="noopener">Fox affiliate WFFT</a>.</p>

<p>The other Jay County deputy’s memory was jogged, state troopers said. He recalled that Bogenschutz had once created a fake Facebook profile — for job-related purposes — while he was a sergeant working with the Indiana Crimes Against Children Task Force.</p>
<p>That case work profile’s name, presumably meant to help catch child predators, was “Katie Morgan,” authorities said.</p>
<p>Bogenschutz’s old task force colleague still had access to the work-related fake Facebook account, state troopers said. After his suspicions were sufficiently roused, he checked the message history and allegedly found several messages sent to the teacher and her boyfriend.</p>
<p>Bogenshutz was reprimanded by Jay County in 2019 with five days of unpaid leave and a 30-day suspension of take-home car privileges after a citizen filmed him speeding and a tense interaction ensued, according to Indianapolis-based <a href="https://www.wrtv.com/news/working-for-you/caught-on-camera-man-tapes-deputy-driving-erratically-90-miles-from-home" target="_blank" rel="noopener">ABC affiliate WRTV</a>.</p>
<p>The defendant was arrested for the current charge on Wednesday morning in Miami County. He was expected to be extradited back to Jay County soon thereafter, authorities said. According to state jail records, Bogenschutz was granted “general release” just before Thursday afternoon.</p>
<p>Law&amp;Crime reached out to the Indiana State Police and Jay County Sheriff’s Office for additional details on this story but no responses were immediately forthcoming at the time of publication.</p>

<p>An <a href="https://lawandcrime.com/?s=indiana" target="_blank" rel="noopener">Indiana</a> deputy died after being choked, hit and body-slammed by a training officer in an Ultimate Fighting Championship-style “state-sponsored <a href="https://lawandcrime.com/?s=hazing" target="_blank" rel="noopener">hazing</a> event,” the deputy’s widow alleges in a new lawsuit.</p>
<p>Vanderburgh County Sheriff’s Office Deputy Asson Hacker died in 2023 during Southwest Indiana Law Enforcement Academy (SWILEA) cadet training, which is referred to as “The Big Fight,” according to the lawsuit filed by Hacker’s widow, Kourtney Hacker. The lawsuit, which names The Evansville Police Department, the city, SWILEA and two training instructors, seeks an amount to be determined at trial.</p>

<p>Representatives from the Evansville Police Department declined to comment, citing department policy surrounding pending litigation, <a href="https://www.courierpress.com/story/news/local/2024/09/09/estate-of-deputy-asson-hacker-who-died-in-training-sues-evansville-and-police-department/75144815007/" target="_blank" rel="noopener">The Evansville Courier &amp; Press</a> reported. A representative from SWILEA also declined to comment when reached by Law&amp;Crime.</p>
<p>The Vanderburgh County Sheriff’s Office said in a statement that the office “continues to mourn the tragic and untimely passing of Deputy Asson Hacker,” the newspaper reported.</p>
<p>“While the sheriff’s office is not a named party in the lawsuit filed by Deputy Hacker’s estate, we are closely monitoring the developments in this case,” the statement said. “We believe many of the allegations contained within the complaint are either inaccurate or misleading.”</p>
<p>Hacker, who worked as a <a href="https://www.boonefuneralhome.net/obituary/DeputyAsson-Hacker" target="_blank" rel="noopener">coal miner</a> before joining the sheriff’s office in December 2022, was required to undergo the training like all other cadets, according to the <a href="https://s3.documentcloud.org/documents/25107826/complaint-080824pdf.pdf" target="_blank" rel="noopener">complaint</a> that outlines the allegations leading to his death.</p>
<p>On March 2, 2023, Hacker was among other cadets participating in the department’s mandatory training program for male recruits called the “Big Fight,” set up in a fighting circle similar to that of mixed martial arts or UFC-style fight at Club Bushido, a martial arts training center in Evansville, Indiana.</p>
<p>Each cadet was paired with a veteran police officer for their fight.</p>
<p>Hacker was paired in his “Big Fight” with a “substantially larger” instructor, the lawsuit said.</p>
<p>The fight was filmed, and spectators looked on as the instructor proceeded to “choke, strangle, hit, punch, kick, and body slam Hacker,” the lawsuit alleges.</p>
<p>The trainer “impeded Hacker’s ability to breathe” multiple times, using physical tactics that would be deemed an excessive use of force by department standards, court documents said.</p>
<p>A second instructor, acting as a “coach,” was supposed to stop the fight after 5 minutes but didn’t stop the fight and instead encouraged the fight to continue, the lawsuit alleges, adding that the fight lasted more than seven minutes.</p>
<p>When it was over, Hacker lay motionless on the floor.</p>
<p>“Despite obvious signs that Hacker needed immediate medical assistance, no meaningful assistance was provided to Hacker for a significant period of time,” court documents said.</p>
<p>Hacker struggled to breathe, and his medical condition worsened, the lawsuit said. Hacker was finally taken to the hospital after several more fights between cadets and instructors took place. He was declared dead at 4:03 p.m. The coroner listed Hacker’s cause of death as “exertional sickling” due to sickle cell trait, the <a href="https://www.courierpress.com/story/news/local/2023/04/18/coroner-releases-cause-of-death-for-vanderburgh-county-sheriff-deputy-asson-hacker/70127470007/" target="_blank" rel="noopener">Courier &amp; Press</a> reported.</p>
<p>The lawsuit called the instructors’ conduct “willful and wanton and/or criminally reckless.”</p>
<p>“The ‘Big Fight’ was not a legitimate training exercise but rather a state sponsored hazing event that created an obviously dangerous situation,” the lawsuit said.</p>

<p>A former sheriff’s deputy from Tennessee who wore reinforced knuckle gloves during the <a href="https://lawandcrime.com/?s=capitol" target="_blank" rel="noopener">Capitol</a> riots on <a href="https://lawandcrime.com/?s=jan.+6" target="_blank" rel="noopener">Jan. 6</a> was sentenced to prison for assaulting officers. He pleaded guilty to two crimes in September and was convicted of five other counts after a trial last year. He was also ordered to pay $32,165 in restitution.</p>

<p>Ronald Colton McAbee, 30, was sentenced to five years and 10 months in federal prison, less than the 12 years and seven months in prison prosecutors recommended.</p>
<p>U.S. District Judge Rudolph Contreras took him to task.</p>
<p>“I take attacks on law enforcement very seriously,” said Contreras, a Barack Obama appointee. “Which I suspect you did too before that day.”</p>
<p>McAbee said he wished he could apologize to the officers, who did not attend the hearing on Thursday, <a href="https://apnews.com/article/ronald-mcabee-sheriffs-deputy-capitol-riot-9ec6b70f0af0c722c8d3aa83902ebf17" target="_blank" rel="noopener">The Associated Press</a> reported.</p>
<p>“I wish they were here so I can tell them I’m sorry,” McAbee said, the AP reported.</p>
<p>“I’m sorry for all the families that lost someone,” he added.</p>
<p>McAbee was among thousands who participated in the attack on the Capitol that interrupted the certification of the 2020 Electoral College vote count and threatened the peaceful transfer of power after the 2020 Presidential election.</p>
<p>Days earlier, McAbee texted a friend about their plans to travel to Washington, including bringing weapons and other gear, his <a href="https://s3.documentcloud.org/documents/24453501/mcabee-doc.pdf" target="_blank" rel="noopener">sentencing memo</a> said.</p>
<p>McAbee had been on medical leave at the time from his job as a sheriff’s deputy after he hurt his shoulder in a car crash.</p>
<p>“How can I get some knuckles?” McAbee texted his friend.</p>
<p>He also said he had a tire repair kit.</p>
<p>“The t handle tire puncture is a great tool,” he texted, according to court documents.</p>
<p>“Lol this is true!” the friend replied.</p>
<p>McAbee asked his friend to order him a pair of “Steel Outdoor Reinforced Brass Knuckle Motorcycle Motorbike Powersports Racing Textile Safety Gloves” the friend had just purchased.</p>
<p>He also bought a shirt his friend had designed, with the messages, “SAME BLOODLINE DIFFERENT GENERATION,” “WE WILL NOT COMPLY WE WILL NOT DISARM.” It was adorned with the term “Three Percent,” a phrase authorities say is based on the myth that only 3% of American colonists took up arms against the British during the American Revolution. They believe that a small force with a just cause can overthrow the government if armed and prepared, officials said.</p>
<p>McAbee assured his friend, “I will rise and fall along side you. This is for future generations.”</p>
<p>McAbee dressed for battle, wearing reinforced brass knuckle gloves that Roberts had ordered for him and a bulletproof vest with two patches. One patch announced his position as a law enforcement officer, reading “SHERIFF.” The other bore the Three Percenter insignia, a “III” circled with thirteen stars. He also wore the shirt he had purchased from Roberts, a red “Make America Great Again” baseball cap.</p>
<p>McAbee stood upright, yelled obscenities, and hit the officer’s face twice with his hands before turning his attention back to Wayte, grabbing him, and lifting him.</p>
<p>The two slid down steps as Wayte struggled to push McAbee off of him. McAbee shoved Wayte’s arms and hands away and held Wayte down as other rioters hit the officer. At one point, rioters ripped off Wayte’s gas mask and sprayed him in the face with a chemical irritant before Wayte eventually rolled over and made his way back to the police line.</p>
<p>At one point, McAbee and others turned their attention to a woman who lay unconscious amid the chaos and tried performing CPR on her before carrying her to the police line, where officers continued CPR but were unable to revive her.</p>
<p>Later testifying at trial, Officer Wayte said injuries kept him out of work for months. He had a concussion and a cut on his head that required staples, among other injuries.</p>
<p>He described being sprayed with chemicals as “blinding,” “painful,” a “searing hot sensation,” and what he imagined asthma felt like.</p>
<p>A day after the deadly riots, McAbee celebrated, smiling in a photo with his friend, holding a newspaper with the headline: “INSURRECTION.”</p>
<p>“I’ve shed blood for my country,” he texted someone. “By the hands of the swamp. I will shed much more in the days to come. But I will not forget the Oath I swore years ago to protect the America I once knew. / necisque libertas [liberty or death].”</p>
<p>McAbee was arrested on Aug. 17, 2021, in Nashville, Tennessee, when tipsters provided information about him after the FBI put out an alert to “be on the lookout for him.</p>

In her new position, Meyer-Shields will oversee resource and sustainable use programs for 15 million acres of public lands in California.</p>
<p>“I am thrilled to have Liz join our leadership team at the California State Office,” said Acting State Director for BLM California Gordon R. Toevs. “Her expertise and guidance will be critical to fulfilling our mission to manage important natural resources on public lands.”</p>
<p>Meyer-Shields started her federal career in 2009 in the BLM Washington Office as a Presidential Management Fellow in the Division of Decision Support, Planning and NEPA, and in 2011, moved to Sacramento as a Planning and Environmental Coordinator in the California State Office. In 2018, she moved up the hill to the Mother Lode Field Office as field manager. In 2022, Meyer-Shields returned to the California State Office as the Branch Chief for Lands, Planning, Recreation, and Cultural.</p>
<p>Meyer-Shields will oversee programs including wildlife, aquatics, special status species, wild horse and burro, hydrology, ecology, air, range, vegetation management, botany, cultural/paleontological resources, soils, recreation, lands and realty, National Conservation Lands/Wilderness/Wild and Scenic Rivers, land use planning, National Environmental Policy Act compliance, renewable energy (solar and wind), and partnerships.</p>
<p>Meyer-Shields grew up in Anchorage, Alaska, where she fell in love with public lands, hiking, skiing, fishing, and camping.  She attended Oregon State University, where she received a B.S. in Environmental Science and the University of Denver School of Law. In her spare time, Meyer-Shields enjoys watercolor painting and spending time outside with her family.</p>

<p><a href="https://lawandcrime.com/?s=fulton" target="_blank" rel="noopener">Fulton</a> County District Attorney <a href="https://lawandcrime.com/?s=%22fani+willis%22" target="_blank" rel="noopener">Fani Willis</a> is alleging the estranged wife of one of her deputies, with whom Willis is accused of having an affair, of interfering with former President Donald Trump’s Georgia election interference case.</p>
<p><a href="https://s3.documentcloud.org/documents/24367259/fani-willis-emergency-motion-to-quash.pdf" target="_blank" rel="noopener">In court filings</a>, Willis said a “defective subpoena” seeking to depose her was “conspicuously coordinated with pleadings in the election interference case” the same day and within hours of Joycelyn Wade’s public request to depose Willis as part of the divorce proceedings involving Fulton County Special Prosecutor Nathan Wade.</p>
<p>“The subpoena for the deposition of District Attorney Willis is being sought in an attempt to harass and damage her professional reputation,” Willis’ lawyer, Cinque Axam, wrote in the court documents. “It is also being sought in an unreasonable manner to annoy, embarrass, and oppress the deponent.</p>
<p>“Defendant Joycelyn Wade has conspired with interested parties in the criminal Election Interference Case to use the civil discovery process to annoy, embarrass, and oppress District Attorney Willis,” documents said.</p>

<p><a href="https://apnews.com/article/willis-wade-relationship-allegations-trump-election-indictment-aef1b2b7fca5bb03d4886cee4c5fee3b" target="_blank" rel="noopener">The Associated Press</a> reported that Joycelyn Wade’s lawyer, Andrea Hastings, said they want to help her “resolve her divorce fairly and privately” and that any response to Willis’ motion will come in a filing with the court.</p>
<p>The same day that Joycelyn Wade tried to subpoena Willis, an attorney for Michael Roman, a defendant in the election interference case, filed two court motions, one to unseal the Wades’ divorce matter and the other to disqualify Willis and Nathan Wade from the election interference case, alleging a “conflict of interest” among the lawyers.</p>
<p><a href="https://www.nytimes.com/2024/01/18/us/fani-willis-trump-georgia-prosecutors.html" target="_blank" rel="noopener">The New York Times</a> reported that Roman’s lawyer has said that sealed court records in the pending divorce case contain documentation of Wade’s relationship with Willis.</p>
<p>Willis sought to quash the deposition notice, saying the deposition “is not reasonably calculated to lead to the discovery of relevant or admissible evidence.”</p>
<p>She also cited a Georgia ordinance that says, “‘Protective orders for certain high-ranking members of a governmental body or public or private entity, provides that ‘good cause for a protective order to prohibit the deposition of an officer may be shown by proof that such person is an officer and lacks unique personal knowledge of any matter that is relevant to the subject matter involved in the pending action.&#8221;”</p>
<p>“More importantly, District Attorney Willis ‘lacks unique personal knowledge of any matter that is relevant to the subject matter involved in the pending action’ and Defendant Joycelyn Wade has not alleged otherwise,” the motion reads. “Indeed, the deposition of District Attorney Fani T. Willis cannot provide unique personal knowledge of any matter that is relevant to Defendant Wade’s divorce; because on Information and belief, the Plaintiff filed for divorce on November 2, 2021, on the grounds the marriage was irretrievably broken, and on November 30, 2021, the Defendant answered and agreed the marriage was irretrievably broken.”</p>
<p>Willis also said the subpoena for the deposition notice was improperly served and “fails to indicate topics, dates, or subjects which the deposition is to cover. It further fails to state the means by which the deposition shall be recorded.”</p>
<p>Willis said that the defendant made no specific request for information from her but added, “If, however, media reports are any indication, the defendant may intend to ask questions regarding the nature of any relationship with the Plaintiff. Because the parties agree that the marriage is irretrievably broken and the concept of fault is not at issue, there is no information that District Attorney Willis could provide that might prove relevant to granting or denying the divorce. Thus, any information sought from District Attorney Willis would be irrelevant to the divorce proceedings pending in this Court.”</p>
<p>She said the sought-after deposition is “outside the scope” of the pending divorce action and the scope of discovery.</p>
<p>“On information and belief, defendant is using discovery as a vehicle to harass non-party Deponent Willis,” court documents said. “The sought-after deposition of District Attorney Willis is not relevant to the subject matter involved in the pending action and should not be permitted. Defendant Joyce Wade’s failure to identify a relevant purpose for the sought-after deposition suggests that it is intended to harass.”</p>
<p>Willis said that as early as 2017, before Nathan J. Wade met Willis, he and Joycelyn Wade agreed that their marriage was “irretrievably broken after the defendant Joycelyn Wade confessed to an adulterous relationship with the plaintiff’s longtime friend,” the motion said. “The Defendant Joycelyn Wade’s adultery precluded any chance of reconciliation.”</p>

<p>SACRAMENTO, Calif. — The Bureau of Land Management welcomes Jeremiah Karuzas as the new Deputy State Director, Energy and Minerals. In his new position, Karuzas will oversee project and programs that impact the management of 47 million acres of subsurface mineral estates, which includes oil, gas, and geothermal resources on BLM-managed public lands in California. Karuzas will also oversee hard rock mining for metallic and industrial minerals and programs responsible for managing hazardous materials and abandoned mine lands.</p>
<p>“I am thrilled to have Jeremiah join our BLM California leadership team,” said Gordon R. Toevs, Acting State Director for BLM California. “Jeremiah’s institutional knowledge about natural resources will be critical to managing energy and minerals development on public lands.” </p>
<p>Karuzas began his permanent federal career more than 20 years ago in Arizona with the U.S. Forest Service and has lived in the Sacramento area since 2007. Karuzas started working at the BLM California State Office in 2014, and like many that have made a career with the BLM, he continues to strive to help fulfill BLM&#8217;s multi-use mission. Karuzas also served as a Branch Chief in the California State Office Division of Natural Resources, acting BLM Palm Springs-South Coast Field Manager, and led numerous high-profile projects as a wildlife biologist, project manager, and renewable energy program lead. Karuzas also holds a master’s degree from Binghamton University in New York State.</p>
<p>In his personal time, Karuzas enjoys the outdoors and exploring our amazing public lands.</p>
