<p>Police in <a href="https://lawandcrime.com/tag/florida/" target="_blank" rel="noopener">Florida</a> arrested a 29-year-old man after he allegedly stabbed his ex-girlfriend to death in her car in <a href="https://lawandcrime.com/tag/miami/" target="_blank" rel="noopener">Miami</a>.</p>
<p>The Miami-Dade Sheriff’s Office said in a <a href="https://www.miamidade.gov/global/release.page?Mduid_release=rel1745767480110200">press release</a> it began investigating shortly before 4 p.m. Saturday when the grandmother of a 3-year-old flagged a deputy down in the area of Southwest 144th Street and Southwest 134th Avenue. The girl had been walking alone in the residential complex. She had what appeared to be dried blood on her face and clothing, cops said.</p>

<p>Deputies went to the girl’s home in search of her mother but she wasn’t there. During a search of the area, cops found the mother’s vehicle and found her unresponsive with apparent stab wounds. Paramedics responded to the scene and pronounced the woman, later identified as 24-year-old Maria Camila Garcia-Molina, dead.</p>
<p>Through “investigative means,” cops arrested 29-year-old Joy Chandra Nath on charges of second-degree murder and child abuse.</p>
<p>Local <a href="https://www.nbcmiami.com/news/local/man-charged-with-murder-of-woman-in-the-hammocks-mdso/3600893/" target="_blank" rel="noopener">NBC affiliate WTVJ</a> obtained an arrest report that further detailed the incident. It said deputies found Garcia-Molina’s body covered in blankets in the passenger seat of her car. She suffered from stab wounds on her neck, torso and other extremities. Deputies reportedly believe the girl was with her mother at the time of the murder. The girl told deputies that her mother was hit in the head and was sleeping, according to the affidavit. It did not appear the girl suffered any physical injuries in the incident.</p>

<p>Garcia-Molina’s family reportedly said Nath was her ex-boyfriend and she had to obtain a restraining order against him because he was stalking her. There had been an altercation on Friday at a local mall between Nath and Garcia-Molina’s current boyfriend, the affidavit reportedly said.</p>
<p>Deputies arrested Nath after a traffic stop early Sunday morning. He reportedly had scratches on his face, arms and neck. Nath also was allegedly in possession of the victim’s belongings and claimed he was on his way to return them. The suspect reportedly told cops that he, Garcia-Molina and her daughter went to breakfast and the victim gave him her purse and cell phone.</p>
<p>Nath remains at the Miami-Dade County jail without bond. Records show he was out on bond for theft-related charges from last year.</p>

<p>A <a href="https://lawandcrime.com/tag/connecticut/" target="_blank" rel="noopener">Connecticut</a> man is behind bars following the drowning death of his 7-month-old baby boy last fall, authorities say.</p>
<p>Angel Marcus Rodriguez, 29, stands accused of one count of manslaughter in the second degree as well as two counts each of risk of injury to a minor and two counts of second-degree reckless endangerment, according to the East Haven Police Department.</p>
<p>Those charges stem from Angel Josiah Rodriguez’s death — and the alleged harm that could have befallen the boy’s 3-year-old brother.</p>
<p>The incident occurred late in the evening on Oct. 6, 2024, at a house on Redfield Avenue in East Haven — a medium-sized town located a few miles east of New Haven and part of the broader metro area.</p>

<p>Police say the father admittedly left his two children alone in the bathtub while he went to use another bathroom in the residence because the toilet in the children’s bathroom did not flush adequately, according to an arrest warrant obtained by the <a href="https://www.nhregister.com/news/article/east-haven-baby-drowned-manslaughter-warrant-20254705.php" target="_blank" rel="noopener">New Haven Register</a>. Rodriguez did not initially recall how long he was gone, police allege. Later, the defendant allegedly told investigators he was gone for maybe five minutes while the children bathed alone.</p>
<p>The little boy was found by his grandmother, facedown in the tub, while his older brother was playing with toy cars right beside him.</p>

<p>“He just turned over,” the older boy allegedly told his grandmother when she walked in, according to law enforcement.</p>
<p>At such a young age, the baby could not sit up by himself. Family members said he was propped up in an Angelcare brand “Back Support” bathing chair, which the company describes as “ideal for newborn babies up to six months or 9 kg/20 lbs.,” according to the warrant.</p>
<p>The grandmother allegedly told investigators she grabbed both children out of the tub and ran into her son’s bedroom — where she found him talking on his cellphone. Then, the grandmother said she yelled at her son to dial 911 as she performed CPR on the child.</p>
<p>Those lifesaving efforts were passed onto the children’s aunt, investigators wrote in the warrant, who overheard the shouting upstairs and came running — quickly relieving the grandmother and vainly trying to press life into the baby boy’s chest.</p>

<p>Details about the final moments in the children’s bathroom, different but not necessarily contradictory, would find their way to investigators.</p>
<p>The children’s grandmother allegedly said she had never before seen her son fill the bathtub up so high. Normally, she allegedly said, the water would only reach halfway up the baby’s bathing chair.</p>
<p>Rodriguez himself, speaking to detectives through tears, said he left the water on “just a trickle” but that it was only at the level of the baby’s feet when he left the children by themselves.</p>
<p>Investigators also noted other factors that might have contributed to the water levels in the bathtub. Such factors included: whether or not the plug was in the drain — this was unclear; whether or not the water was still running — the grandmother said it was not; or if the 3-year-old had touched the faucet or the plug — Rodriguez said he told his older boy not to touch either but efforts to interview the surviving child were swiftly abandoned because he could neither understand the questions nor remain focused, police said.</p>

<p>When confronted about allegedly being on the phone while the children bathed, Rodriguez added to his initial recollection, according to the warrant. He said he stopped by his bedroom, after using the second bathroom, to get his phone off the charger. While the defendant told investigators he thought the phone call was brief, the children’s grandmother said she noticed her son on the phone in a hallway for at least 10 minutes, police say.</p>
<p>“The East Haven Police Department extends its deepest condolences to the family of Angel Josiah Rodriguez,” the police department said in a <a href="https://www.facebook.com/easthavenpolice/posts/pfbid02fkD5gZrRBA4XVTNHBxKbajuLE7BUkLfLuphk4U7xeG2kTknGNDQYPamqNaATiDVol" target="_blank" rel="noopener">press release</a>. “We hope this arrest brings some measure of accountability and helps Angel’s family in their pursuit of healing. This heartbreaking loss has deeply affected all involved. We are grateful to our first responders and investigative personnel for their dedication to this case, and we continue to stand with Angel’s family as they grieve.”</p>
<p>Rodriguez was arrested on Monday. He is currently being detained in the New Haven Correctional Center on $200,000 bond.</p>

<p>A <a href="https://lawandcrime.com/tag/michigan/" target="_blank" rel="noopener">Michigan</a> man who accidentally left his 3-year-old son to die inside of a hot car for several hours last summer may, in the end, avoid significant jail time altogether, a judge ruled this week.</p>
<p>In January, Chad Martin, 36, pleaded guilty to one count of leaving a child in a vehicle causing death.</p>
<p>On Thursday, the judge overseeing the case <a href="https://lawandcrime.com/tag/sentenced/" target="_blank" rel="noopener">sentenced</a> Martin to spend nine months in the Kalamazoo County Jail — with two favorable conditions. First, the sentence is delayed to start until February 2026. Second, the judge also scheduled a conference for December of this year that could lead to the sentence being jettisoned entirely.</p>
<p>Regardless of his time behind bars, however, the defendant was sentenced to three years of probation that began this week.</p>

<p>The incident occurred on Aug. 16, 2023, when Martin left home with his two children in tow. The defendant dropped his daughter off at her day care, but forgot about his son, he would later tell investigators. Instead, Martin drove straight to work where he stayed from roughly 7 a.m. to 3 p.m. before getting back in the car to go grocery shopping.</p>
<p>The boy was discovered, lifeless, outside of a Family Fare supermarket in Vicksburg — a small village located just a few miles south of Kalamazoo — when his father arrived at the store. In sum, the boy was strapped into his car seat in the back for about nine hours.</p>
<p>The outside temperature peaked at 84 degrees that day in western Michigan, but the inside temperature of the vehicle was likely closer to 120 degrees because of the rolled-up windows, police said.</p>

<p>“The day that happened was the worst day of my life,” Martin said during the sentencing hearing, according to a courtroom report by Kalamazoo-based <a href="https://wwmt.com/news/arc/chad-martin-vicksburg-family-fare-toddler-death-court-crime-police-sentencing-kalamazoo-county-west-michigan" target="_blank" rel="noopener">CBS affiliate WWMT</a>. “I deserve whatever punishment I get.”</p>
<p>The Wolverine State, for its part, did not have an issue with the relatively lenient sentencing meted out to the father in this case.</p>
<p>“The Kalamazoo County Sheriff’s Office conducted a very thorough investigation so that we could feel confident in saying that this truly was an accident,” Kalamazoo County Prosecutor Jeff Getting told Grand Rapids-based <a href="https://www.wzzm13.com/article/news/local/vicksburg-father-who-went-work-found-toddler-dead-backseat-learns-sentence/69-22fa362f-a220-4685-a3f6-1b5a913cf293" target="_blank" rel="noopener">ABC affiliate WZZM</a>. “And I think it’s also important that we recognize that the child’s mother was supportive of this outcome, that the defendant not be sentenced to prison because of this. And I think that those are important distinguishing factors.”</p>
<p>The father explained that his daughter, who is a bit older, walks herself into her own day care while the boy would need to be carried in, according to court documents obtained by WZZM. Martin also said he “never checks the backseat when he gets to work” and that the children “always sleep in the vehicle en route to daycare.”</p>
<p>“I guess I went straight to work,” Martin told investigators.</p>

<p>The boy’s mother also spoke at the sentencing hearing — explaining the turmoil caused by a loss she knows was accidental but avoidable and admitting that she struggled with what Martin’s sentence should be.</p>
<p>“You will never know the true depth of the pain you caused,” Samantha Brown haltingly said through tears, according to WWMT. “There is no justice for my son or daughter or for me.”</p>

<p>A 22-year-old <a href="https://lawandcrime.com/tag/new-hampshire/" target="_blank" rel="noopener">New Hampshire</a> man stands accused of beating his girlfriend’s 23-month-old son to death when he was alone with the boy and she was grocery shopping.</p>
<p>Annthoni Bliss is charged with second-degree <a href="https://lawandcrime.com/tag/murder/" target="_blank" rel="noopener">murder</a> in the January 2024 death of Luca Hudson, the New Hampshire Attorney General’s Office said in a <a href="https://www.doj.nh.gov/news-and-media/arrest-annthoni-bliss-murder-luca-hudson-keene-new-hampshire" target="_blank" rel="noopener">statement</a>. The Keene Police Department and medical personnel responded the morning of Jan. 14, 2024, to an apartment for a young child in medical distress. They arrived to find Luca unconscious and not breathing. Paramedics rushed him to the hospital where he died three days later, just a month shy of his second birthday.</p>

<p>A year-plus long investigation led to charges being filed against Bliss, who had started dating Luca’s mother about a month prior to the incident after knowing each other for several years, a probable cause arrest affidavit said. The medical examiner determined the cause of death to be blunt force trauma to the head and the manner of death homicide.</p>
<p>Bliss and the boy’s mother denied doing anything to hurt Luca. Bliss had been staying at his girlfriend’s apartment along with Luca and the boy’s older brother, cops said. Detectives noted that Luca showed no signs of injury in the days leading up to his death.</p>
<p>Through interviews and reviewing surveillance footage, investigators believe the abuse happened the night before cops responded to the apartment when Luca’s mother made a nearly hour-long trip to the grocery store, according to the affidavit. In text messages between her and Bliss while she was out, the defendant made no mention that anything may have been amiss. He said Luca’s older brother had fallen asleep.</p>
<p>“How’s shopping baby,” Bliss allegedly texted her.</p>
<p>“going to check out now,” she responded.</p>
<p>“Okay my love,” Bliss texted.</p>

<p>Luca’s mother, who has not been charged with a crime, and Bliss initially did not tell cops that the suspect was alone with the boy. In December, he told cops that he was on the phone with his sister while his girlfriend was away, but detectives could find no evidence the two ever spoke, the affidavit said. While his sister at first said she was on the phone with Bliss, she stopped talking to law enforcement, cops said. Investigators also talked to a neighbor who lived next door who said he heard Luca crying for up to an hour around the time the boy’s mother was shopping, according to the affidavit.</p>
<p>After the mother returned from the store, she and Bliss spent time in their bedroom. He didn’t say anything about Luca being injured, cops said. A couple hours later, Bliss walked by Luca’s room and heard vomiting. Luca had thrown up in the crib and on his pajamas. After a shower, the boy stayed with his mother and Bliss in their bed where he complained of a headache, according to cops. His mother told cops he seemed fine otherwise.</p>
<p>But Bliss later said in an interview with detectives that Luca’s head felt “soft” and “squishy” to him after the shower. Investigators later found he made two internet searches around that time: “2 year old, head squishy” and “2 year old head head now swollen head squishy,” the affidavit said. Despite his concerns, he never called 911; his girlfriend did so a couple of hours later, per cops.</p>

<p>Doctors noted Luca showed little signs of external injury, however internally he suffered “substantial internal bleeding” on his brain, the affidavit stated. He also suffered from hemorrhaging in both of his eyes. His brain swelled which ultimately led to his death, doctors said. Medical examiners determined there was a “complete absence of any alternative accidental explanation,” the affidavit stated. They were able to whittle down the timing of the infliction of injury to when Bliss was alone with Luca when the mother was at the store.</p>
<p>Cops arrested Bliss on Wednesday evening. His next court date is scheduled for April 3. He remains at the Cheshire County Jail.</p>
<p>Luca’s <a href="https://www.keenesentinel.com/news/obituaries/luca-e-hudson/article_c3ceb05c-94f0-5c57-af41-77edb549669e.html" target="_blank" rel="noopener">obituary</a> described the boy.</p>
<p>“Luca loved turtles, dogs, coloring and watching his favorite TV show, Mickey Mouse. He also enjoyed making a lot of noise, playing catch with balls and spending time playing with his brother,” the obituary said.</p>

<p>Almost a year after a <a href="https://lawandcrime.com/tag/north-carolina/" target="_blank" rel="noopener">North Carolina</a> woman was found <a href="https://lawandcrime.com/crime/if-i-cant-have-her-nobody-can-man-stabbed-ex-wife-95-times-after-learning-she-met-someone-new-claiming-in-court-he-loved-her-very-much/" target="_blank" rel="noopener">stabbed</a> to death in her home, one of her former classmates allegedly confessed to the crime while in jail.</p>
<p>According to an affidavit filed on March 20, Brandon Braxton, 33, was charged with the murder of Whitney Hurd, 32, who was found <a href="https://lawandcrime.com/crime/man-slept-by-the-dead-body-of-girlfriend-for-a-month-claimed-he-thought-she-was-joking-when-he-found-her-lying-on-the-floor-covered-in-blood-police/" target="_blank" rel="noopener">dead</a> in her home on July 14, 2024. Braxton, who was in custody at the Mecklenburg County Jail on an unrelated charge, reportedly submitted a grievance on March 3 with a note that read, “I killed Whitney Hurd.” Detectives confirmed through video surveillance that it was Braxton who wrote the note. Braxton, who has a long list of arrests in North Carolina, was named as a person of interest in the case and has now been formally charged.</p>

<p>Hurd was discovered in the early afternoon of July 14, 2024, and just hours before that, one of her neighbors told police that she saw a man driving Hurd’s white BMW X3 away from her home with no one in the passenger’s seat. She reportedly told police that Hurd “never let other people drive her car.”</p>
<p>The affidavit stated that the vehicle was later found using cellphone data from Hurd’s phone, which was never recovered.</p>
<p>Law&amp;Crime’s “<a href="https://www.youtube.com/watch?v=ENS6oFhM0ks" target="_blank" rel="noopener">Sidebar with Jesse Weber</a>” recently delved into Braxton’s criminal past and his history with Hurd, a former classmate from high school. According to the affidavit, Braxton was interviewed by police on Aug. 8, 2024, a couple of weeks after Hurd was found dead. At the time, police said that Braxton confirmed they used to “hang out” in high school and that he had been inside her residence. He denied to police that he had ever been in her vehicle. Braxton, who had just been signed out of jail after being arrested for an unrelated crime on July 24, 2024, reportedly acknowledged that he was aware of what had just happened to Hurd.</p>
<p>When police asked Braxton about the last time he saw Hurd, he reportedly said, “she looked petrified.” He also allegedly told police that he “would not provide further details” when asked if he knew where she was.</p>
<p>The affidavit stated that during interviews with Hurd’s friends and family, they said that while Hurd and Braxton “used to be friends” in high school, the two lost touch over the years. They also said that Braxton “began showing up at her residence,” and recounted an incident during which he “had fallen asleep intoxicated” in Hurd’s driveway “when she wouldn’t let him in.”</p>
<p>At some point, per the affidavit, Braxton allegedly <a href="https://lawandcrime.com/crime/nothing-is-ever-going-to-stop-me-former-state-trooper-dumped-by-girlfriend-after-1-month-kills-her-new-boyfriend-following-barrage-of-texts-begging-her-to-come-back-police-say/" target="_blank" rel="noopener">broke into</a> Hurd’s home, which prompted Hurd to call the police and inform her friends.</p>
<p>Police said in the affidavit that fingerprints found at the crime scene and in Hurd’s SUV matched Braxton’s. Phone records also allegedly showed that Braxton was in the area at the estimated time of the crime.</p>
<p>Braxton remains in custody at the Mecklenberg County Jail without bond after being charged with first-degree murder and robbery with a dangerous weapon.</p>

<p>A 67-year-old grandmother in <a href="https://lawandcrime.com/tag/hawaii/">Hawaii</a> will not be going to jail in connection with the death of her 9-year-old granddaughter, who weighed only 45 pounds when she <a href="https://lawandcrime.com/crime/under-the-first-percentile-for-their-age-neglected-premature-newborn-twins-were-dangerously-malnourished-authorities-say/">starved</a> in 2016 while in the woman’s care.</p>
<p>Hilo Circuit Court Judge Henry Nakamoto on Thursday ordered Henrietta Stone to serve a sentence of 10 years of <a href="https://lawandcrime.com/tag/probation/">probation</a> over the death of young Shaelynn Lehano-Stone, authorities announced. Nakamoto handed down the sentence over the staunch objection of the Hawaii Office of the Prosecuting Attorney, who sought the maximum sentence of 20 years for Stone.</p>
<p>“There aren’t words to describe my disappointment and frustration in the outcome of this case. Shaelynn and our community deserved much better. Her death was caused by the three people, who she should have been able to trust the most,” Prosecuting Attorney Kelden Waltjen said in a statement released after the sentencing hearing. “We will not let this result discourage our ongoing efforts to protect our keiki.”</p>
<p>“Keiki” is a Hawaiian word that <a href="https://wehewehe.org/gsdl2.85/cgi-bin/hdict?d=D7631&amp;l=en&amp;e=d-11000-00---off-0hdict--00-1----0-10-0---0---0direct-10-ED--4--textpukuielbert%2Ctextmamaka-----0-1l--11-en-Zz-1---Zz-1-home-keiki--00-4-1-00-0--4----0-0-11-00-0utfZz-8-00#:~:text=%5BHawaiian%20Dictionary%20(1986)%20(,be%20or%20become%20a%20child.">means</a> “child.”</p>
<p>Stone in February 2024 pleaded no contest to one count of manslaughter for her role in Shaelynn’s death. She had originally been charged with one count of second-degree murder.</p>
<p>Shaelynn’s parents, Kevin Lehano and Tiffany K. Stone, also previously pleaded guilty to manslaughter and were sentenced to 10 years of probation, records show. Notably, the victim’s grandmother was her legal guardian at the time of her death.</p>

<p>Prosecutors also emphasized that several of Shaelynn’s teachers and the emergency medical personnel who first treated the victim submitted victim impact statements encouraging the court to sentence Stone to prison. A pre-sentence investigation report also called for the grandmother to serve the maximum sentence.</p>
<p>“Manslaughter carries a penalty of either a twenty-year prison term or ten years probation and up to two years in jail,” the prosecuting attorney’s office said in a <a href="https://www.facebook.com/HawaiiProsecutors/posts/pfbid0kKEbwNv4BwUSP5e3MEdW7mnTgipm1J9NSi8oriz897tB2Ce7igjgSuqHPWLg6Vokl">news release</a>. “Prosecutors argued for the maximum twenty-year prison penalty.”</p>
<p>Following her initial arrest in 2016, Stone remained in jail until July 2024 when she was released after posting bond of $100,000.</p>
<p>According to a <a href="https://www.hawaiipolice.com/07-14-17-kona-murder-arrests">release</a> from the Hawaii Police Department, officers and firefighters on June 28, 2016, responded to a call about an unconscious child at Stone’s home on Kino’ole Street home in Hilo, Hawaii.</p>
<p>“First responders were confronted with what appeared to be a severely malnourished and unconscious young girl lying on the floor within the home,” police said. “She was transported to the Hilo Medical Center where she died a few hours later.”</p>
<p>The Associated Press <a href="https://apnews.com/article/hi-state-wire-hawaii-b3e4e36677311e2d56aecc979ecfa28f">reported</a> that in the months leading up to Shaelynn’s death, her grandmother had removed her from Hilo Union Elementary so the child could be homeschooled. Additionally, authorities said Stone kept alarms on the refrigerator door to prevent access and noted that Shaelynn’s weight at the time of her death was the same she weighed when she was only 4 years old.</p>
<p>“The cause of death was listed as malnutrition with contributory causes being acute pneumonia and acute pyelonephritis (severe kidney infection),” prosecutors said. “She weighed 45 pounds and was 53 inches tall at the time of her death.”</p>

<p>A 17-year-old <a href="https://lawandcrime.com/tag/florida/" target="_blank" rel="noopener">Florida</a> girl is behind bars after she allegedly stabbed her boyfriend to death just days before Christmas while they were allegedly “horseplaying” with a knife in a parking garage.</p>
<p>Court records show Jahara Malik is facing a charge of <a href="https://lawandcrime.com/tag/manslaughter/" target="_blank" rel="noopener">manslaughter</a> with a deadly weapon in the Dec. 20 death of 17-year-old Yahkeim Lollar in Miami. She’s at the Miami-Dade County jail on a $50,000 bond. According to an arrest affidavit obtained by local <a href="https://www.local10.com/news/local/2025/02/01/teen-girl-accused-of-stabbing-17-year-old-boyfriend-outside-miami-apartment-faces-judge/" target="_blank" rel="noopener">ABC affiliate WPLG</a>, Miami police responded to a report of a stabbing in the parking garage at Lollar’s apartment complex in the 6100 block of Northwest Sixth Court. Paramedics rushed him to a hospital where he died.</p>

<p>Per the affidavit, Malik was set to go shopping with a friend on the day in question. Before she left, she was looking for the pepper spray she typically used for protection but could not find it so she grabbed a knife instead, the affidavit reportedly said. After shopping she went to meet with Lollar in the parking garage. The two were “horseplaying” and she somehow ended up stabbing him in the chest.</p>
<p>Surveillance video allegedly shows Malik dropping the knife in the parking garage. A portion of Malik’s statement to police was reportedly redacted from the affidavit. A medical examiner deemed the death a homicide a few weeks later.</p>

<p>At a bond hearing, her attorney noted that Malik stayed behind to render aid after the stabbing. Malik has not been arrested before this incident, the lawyer said. The attorney told <a href="https://www.cbsnews.com/miami/news/miami-teen-accused-of-stabbing-boyfriend-to-death-faced-judge-saturday/" target="_blank" rel="noopener">CBS affiliate WFOR</a> that the stabbing was not intentional. <a href="https://www.nbcmiami.com/news/local/miami-teen-charged-over-a-month-after-boyfriend-was-stabbed-and-killed/3531898/" target="_blank" rel="noopener">NBC affiliate WTVJ</a> reports that Malik will be tried as an adult.</p>
<p>The victim’s father, Darveed Lollar, said the stabbing didn’t have to happen.</p>
<p class="dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text">“By somebody just playing, they took my boy’s life,” he told WPLG. “That’s what they said. They was playing.”</p>
<p>The family has been frustrated that it took so long to put Malik behind bars, despite knowing she was the one responsible for the homicide.</p>
<p>“They couldn’t find something to charge her with the night of when there was no question as to what happened or who done this, so I mean it’s, right now, it’s a little bittersweet,” his mother Darveed Lollar said.</p>

<p>The parents of a young <a href="https://lawandcrime.com/tag/wisconsin/" target="_blank" rel="noopener">Wisconsin</a> man have <a href="https://www.documentcloud.org/documents/25508107-asthma-lawsuit/">sued</a> Walgreens and pharmacy benefit manager OptumRx over their son’s death from an <a href="https://lawandcrime.com/crime/they-tried-home-remedies-mom-let-9-year-old-daughter-die-from-asthma-attack-gave-her-a-steam-bath-instead-of-taking-her-to-the-hospital/">asthma</a> attack after his medication price rose from $66 to $539.</p>
<p>Cole Schmidtknecht, 22, had lived with chronic asthma since he was an infant, his parents Shanon and William “Bil” Schmidtknecht said in a lawsuit filed in federal court. To combat the condition, Cole used a daily steroid inhaler as preventive medication. However, when the cost of his inhaler unexpectedly rose beyond what Cole was able to afford, he went without the medication for several days, according to the lawsuit.</p>
<p>Cole then suffered a severe asthma attack and died.</p>
<p>In the 35-page complaint filed on Jan. 21 against OptumRx, Inc., Walgreens Boots Alliance, Inc., and Walgreens Pharmacy, Cole’s parents explain that OptumRx is a “Pharmacy Benefit Manager” or “PBM”— one of a number of entities “that act as middlemen between health insurers, prescription drug companies, and pharmacies.”</p>
<p>The family further alleged that Optum is one of the nation’s three largest PBMs and is responsible for servicing drug prescription claims for over 66 million Americans.</p>

<p>“Their market share has been steadily rising over the past decade as the industry has consolidated into a powerful oligopoly,” say the plaintiffs, who argued that PBMs “artificially drive up healthcare costs for Americans in a myriad of ways.”</p>
<p>According to the Schmidtknechts, OptumRx forces patients to fill <a href="https://lawandcrime.com/federal-court/10th-circuit-refuses-to-revive-antitrust-lawsuit-against-epipen-distributor/">prescriptions</a> with expensive brand-name drugs when cheaper alternatives exist. They also allege the company sets artificial requirements whereby patients are required to try more expensive drugs before cheaper alternatives — all to pad the company’s own pockets.</p>
<p>Cole Schmidtknecht took daily doses of a corticosteroid inhaler Advair Diskus to manage his asthma, the lawsuit said. The medication was covered by Cole’s employer-provided health insurance under a United Health-OptumRx Plan, at a cost ranging from $35 to $66.86. However, plaintiffs said that when Cole went to a Walgreens pharmacy in Appleton to fill a prescription on Jan. 10, 2024, he was told that the medication was no longer covered by his insurance and would cost a massive $539.19 out of pocket.</p>
<p>According to the complaint, OptumRx did not give Cole a 30-day notice of any change, as is required under Wisconsin law.</p>
<p>“As a result, he did not have the opportunity to ask for an exception to the OptumRx’s re-classification of the medication under its formulary that suddenly made his normal medication prohibitively expensive,” the lawsuit said.</p>
<p>According to the lawsuit, OptumRx excluded Advair Diskus and its generic equivalents, but would cover Advair HFA or Breo Ellipta, two newer brand drugs whose manufacturer “had paid OptumRx substantial kickbacks (euphemistically called ‘rebates’ and/or ‘compensation’).”</p>
<p>The Schmidtknechts argue that this practice, called “non-medical switching,” is made in the financial interests of PBMs, and is not in the best medical interests of patients. Further, they say, Wisconsin law would have allowed a pharmacist to substitute a generic equivalent for a brand-name drug, but would not have allowed a substitution of one brand for another brand without prescriber approval. Further, they said, because Advair Diskus is an inhaler, it was not available in a short-term supply such that Cole might have been able to purchase a small amount while he secured prior authorization for a drug substitution.</p>
<p>The plaintiffs said that the Walgreens pharmacist should have contacted Cole’s prescribing physician about drug alternatives to Advair HFA, but that the pharmacist failed to do so. Neither, they say, did the pharmacist contact OptumRx or Cole’s doctor to request an exception, provide Cole with a free sample or discounted inhaler, or do anything meaningful to help the situation.</p>
<p>Unable to cover the unexpected drug cost, Cole left the pharmacy without his medication.</p>
<p>“The insurance company changed the formulary, raised the price of it to over $500,” Cole’s father <a href="https://www.wmtv15news.com/2024/11/14/wisconsin-parents-push-reform-pbms-powerful-prescription-middleman-companies/">said</a>. “He walked out. Chose rent over his medicine.”</p>
<p>A generic version of <a href="https://www.fda.gov/news-events/press-announcements/fda-approves-first-generic-advair-diskus">Advair Diskus</a> has been available since 2019 and is typically available to patients for $20 or less.</p>
<p>The complaint detailed the circumstances of Cole’s death from a resulting asthma attack:</p>

<p>Over the next five days, Cole repeatedly struggled to breathe, relying solely on his old “rescue” (emergency) inhaler to limit his symptoms, because he did not have a preventive inhaler designed for daily use. On January 15, 2024, five days after visiting the OptumRx-Walgreens pharmacy, Cole had a severe asthma attack and began to asphyxiate. His roommate, Mitchell Huiting, immediately drove him to the Emergency Room at ThedaCare Regional Medical Center-Appleton, located at 1818 North Meade Street, Appleton, Wisconsin 54911. Cole became unresponsive and pulseless in the car, about two minutes before they arrived. When he presented to the ER, practitioners recorded that Cole was unconscious, pulseless, and appeared blue. Emergency medical staff immediately gave Cole two rounds of epinephrin and performed two rounds of Cardiopulmonary Resuscitation, lasting over four minutes, to try to get him to regain consciousness. Despite their best efforts, Cole never woke up again.</p>

<p>Cole’s parents raised claims for negligence and wrongful death, and they seek compensatory and punitive damages from all defendants.</p>
<p>The case is proceeding before U.S. District Judge Byron Browning Conway, a Joe Biden appointee.</p>
<p>The Schmidtknechts’ attorney <a href="https://www.wmtv15news.com/2024/11/14/wisconsin-parents-push-reform-pbms-powerful-prescription-middleman-companies/">told</a> local NBC and CW affiliate WMTV, “Our hope is that this lawsuit and Cole’s death will lead them to kind of introspect on their own policies and change their policies going forward.”</p>
<p>Walgreens and OptumRx did not immediately respond to request for comment.</p>
