<p>A mother in <a href="https://lawandcrime.com/crime/wife-of-weezer-bassist-charged-with-attempted-murder-of-police-after-manhunt-suspect-wanders-into-her-backyard-cops-say/" target="_blank" rel="noopener">California</a> has been charged with murder for leaving her 4-year-old daughter to die in a “partially submerged” SUV after she sent the vehicle careening into an irrigation canal during a <a href="https://lawandcrime.com/tag/dui/" target="_blank" rel="noopener">DUI</a> crash, with cops later finding the woman “taking a bath while her daughter remained in peril” at the scene, according to prosecutors.</p>
<p>Juliette Acosta, 26, was originally only charged with felony drunk driving for the <a href="https://lawandcrime.com/crime/there-isnt-a-person-in-this-courtroom-who-wasnt-shocked-man-who-drunkenly-crashed-into-golf-cart-killing-4-members-of-the-same-family-suddenly-changes-plea/" target="_blank" rel="noopener">deadly DUI crash</a> that took the life of her daughter, Reagan Herrin, on the night of March 8 near the town of Hickman. On Friday, the Stanislaus County District Attorney’s Office <a href="https://www.facebook.com/StanislausDistrictAttorney/posts/pfbid027csVVUEwQdDisynYnLKSH82MhJUvgDrydad38V1UQJ7MpjY5YWPgFZ493MNX1i9dl" target="_blank" rel="noopener">reported in a press release</a> that Acosta’s charges had been upgraded to murder; vehicular manslaughter; driving under the influence of alcohol causing injury; permitting a child to suffer under circumstances likely to cause great bodily injury or death; and resisting, delaying or obstructing a public officer, peace officer or emergency medical technician following an investigation.</p>

<p>“According to the criminal complaint, Acosta is alleged to have been driving with a blood alcohol content nearly three times the legal limit of .08%, when the fatal crash occurred,” the DA’s office said. “The charging document includes circumstances in aggravation, alleging that Acosta left her partially submerged car while her daughter remained trapped inside, failing to render aid to her child, being located taking a bath while her daughter remained in peril at the crash scene, and causing the death of a vulnerable victim.”</p>
<p>District Attorney Laugero noted in a statement Friday how the crash and Herrin’s death had a “significant” impact on local community members and the child’s family.</p>
<p>“However, our responsibility to both the victim and the integrity of our legal system requires a thorough investigation based on the evidence and the law,” Laugero said. “This methodical approach ensures that justice is pursued based on accurate information. I appreciate the public’s patience and understanding in protecting the process and ensuring our ethical obligations are met. Justice requires our absolute adherence to these standards.”</p>

<p>A friend who launched an online GoFundMe fundraiser for Gage Herrin, the victim’s father, described the Herrin family as being “overwhelmed with the support” from local residents, saying he “can’t begin to express their gratitude” after folks began reaching out after hearing what happened last month.</p>
<p>“Any remaining money that has been donated after expenses will be donated back to the community on Reagan’s behalf in hopes to prevent incidents like this from happening in the future,” the GoFundMe description says. “Thank you again for all your continued support and we pray that justice is served for Reagan.”</p>
<p>Acosta was caught by cops in San Francisco last week and transported back to Stanislaus County by the California Highway Patrol after she attempted to evade arrest, police say. If convicted on all charges, the DA’s office said Acosta will face a maximum sentence of life in prison. She is currently being held without bail.</p>

<p>Victims of the Washington, D.C., plane crash Jan. 29 include two Wilkinson Stekloff associates and a civil rights lawyer planning to join the faculty of the Howard University School of Law this fall.</p>
<p>The associates were Sarah Lee Best and Elizabeth Keys, according to the <a href="https://www.wilkinsonstekloff.com">Wilkinson Stekloff website</a>. They were both 33 years old; Keys died on her birthday. The civil rights attorney was 30-year-old Kiah Duggins, according to her employer, the <a href="https://civilrightscorps.org/kiah-duggins-attorney">Civil Rights Corps</a>, and an obituary by her alma mater, <a href="https://hls.harvard.edu/today/kiah-was-all-light">Harvard Law School</a>.</p>

<p>While at Harvard Law School, Duggins helped protect families from COVID-19 pandemic evictions as president of the Harvard Legal Aid Bureau. According to John Goldberg, the dean of Harvard Law School, Duggins was known for optimism, kindness and empathy.</p>
<p>“As a student and lawyer, Kiah was known for her boundless enthusiasm for advancing justice for the most vulnerable, and for building community,” Goldberg wrote.</p>
<p>Before joining the Civil Rights Corp, Duggins worked with the American Civil Liberties Union of Northern California and the law firm Neufeld, Scheck &amp; Brustin. At the Civil Rights Corps, Duggins challenged unconstitutional policing and money bail practices.</p>
<p>She was also a former Miss Kansas contestant and a graduate of Wichita State University. During her undergrad years, she was a White House intern working for former first lady Michelle Obama, according to Law.com.</p>
<p>Best and Keys were returning to Washington, D.C., from a deposition when their American Airlines plane crashed with an Army Black Hawk helicopter, according to Original Jurisdiction.</p>
<p>Keys, a graduate of the Georgetown University Law Center, clerked for U.S. District Judge Amy Berman Jackson of the District of Columbia before joining Wilkinson Stekloff in December 2021. During law school, she was the managing editor of the Georgetown Food and Drug Law Journal.</p>
<p>While an undergraduate at Tufts University, Keys was part of the sailing team, her partner, David Seidman, told Law.com.</p>
<p>David A. Super, a professor at the Georgetown University Law Center, told Law360 that Keys was “an extraordinary law student and an even better person.” Keys “was everything a great lawyer should be: meticulous but creative, focused but flexible, professional but kind,” Super said.</p>
<p>Best worked for Teach for America before attending the University of Pennsylvania Carey Law School. She graduated in 2021. She clerked for U.S. District Judge John Cronan of the Southern District of New York, U.S. District Judge Paul S. Diamond of the Eastern District of Pennsylvania and Judge Eugene E. Siler Jr. of the 6th U.S. Circuit Court of Appeals at Cincinnati.</p>
<p>Best began work at Wilkinson Stekloff in November.</p>
<p>Cronan told Law360 that Best would spend hours mentoring law student interns to help them with research and writing.</p>
<p>“She was so caring and thoughtful and generous and had a wonderful sense of humor,” Cronan said.</p>

<p>A <a href="https://lawandcrime.com/high-profile/traitors-get-shot-capitol-rioter-who-lit-the-match-on-jan-6-ordered-to-stay-away-from-son-who-turned-him-in-and-is-terrified-of-his-dad-retaliating/" target="_blank" rel="noopener">Jan. 6</a> rioter from <a href="https://lawandcrime.com/crime/at-first-she-was-very-nice-mom-in-custody-dispute-with-fathers-of-her-children-decides-to-shoot-both-of-them-and-then-turns-herself-in-cops-say/" target="_blank" rel="noopener">Missouri</a> who made headlines for <a href="https://lawandcrime.com/u-s-capitol-siege/missouri-resident-charged-as-woman-who-stole-nancy-pelosis-name-plate/" target="_blank" rel="noopener">swiping Nancy Pelosi’s name plate</a> during the Capitol attack went from pardon to prison this week as she was sentenced Wednesday for <a href="https://lawandcrime.com/u-s-capitol-siege/missouri-woman-22-who-allegedly-stole-pelosis-name-plate-on-jan-6-is-now-charged-in-deadly-drunk-driving-crash/" target="_blank" rel="noopener">causing a fatal crash</a> while driving drunk on the wrong side of the highway.</p>
<p>Emily Hernandez, 25, got hit with a 10-year sentence by Franklin County Judge Ryan Helfrich for the death of 32-year-old Victoria Wilson on Jan. 5, 2022, according to the<a href="https://www.stltoday.com/news/local/crime-courts/emily-hernandez-pardoned-for-capitol-riot-sentenced-to-10-years-in-fatal-dwi-crash/article_bf4def6e-de51-11ef-a3a0-97de6fd4bd53.html" target="_blank" rel="noopener"> St. Louis Post-Dispatch</a> and local NBC affiliate <a href="https://www.ksdk.com/article/news/crime/emily-hernandez-sentenced-deadly-dui-crash/63-0d47bef0-2d31-4eb7-9aec-9a8e77a68b3c" target="_blank" rel="noopener">KSDK</a>. She received 10 years and another seven years for injuring Wilson’s husband, Ryan E. Wilson — who was riding with her that night — with the sentences to be served concurrently.</p>
<p>“No matter how loud I cried out to her, I couldn’t wake her,” Wilson said in court Wednesday, where he reportedly used a cane to walk due to the severity of his injuries, per the Post-Dispatch. “I couldn’t reach her because of the air bags.”</p>

<p>According to her <a href="https://extremism.gwu.edu/sites/g/files/zaxdzs5746/files/Emily%20Hernandez%20Statement%20of%20Facts.pdf" target="_blank" rel="noopener">criminal complaint</a>, Hernandez was driving drunk on the wrong side of the highway during the fatal crash that killed Wilson and injured her husband. The crash happened just after 7 p.m., with their cars colliding in the eastbound lane of I-44.</p>
<p>Hernandez had a blood-alcohol content of .20% when tested after the crash, more than double the legal limit.</p>
<p>“What I did was ungodly and I will live with that shame for the rest of my life,” Hernandez said at her sentencing, according to the Post-Dispatch. “I am sorry for what I did and if I could take it all back, I would.”</p>
<p>Victoria Wilson’s family told KSDK after the court proceeding that while it’s nice to see justice be served, there’s “an empty hole” in their hearts that will never be filled.</p>
<p>“Nothing will bring her back,” said Victoria’s mom, Tonie Donaldson. “It was some relief to be able to turn and look her in her eyes and tell her how much harm she had really done to us … that’s a choice she made, she has to live with it.”</p>
<p>Hernandez, who pleaded guilty to the drunk driving incident, was pardoned by President Donald Trump last week on his first day in office — along with other rioters — after she <a href="https://lawandcrime.com/u-s-capitol-breach/missouri-woman-accused-in-fatal-drunk-driving-collision-pleads-guilty-to-jan-6-misdemeanor/" target="_blank" rel="noopener">pleaded guilty</a> in January 2022 to a misdemeanor for entering the U.S. Capitol building on Jan. 6.</p>

<p>After the attack, Hernandez was seen in pictures and on video grinning while holding a fragment of a sign appearing to identify Pelosi’s office. She pleaded guilty to one count of entering and remaining in a restricted building after originally being charged with disorderly conduct, disruptive conduct in the Capitol, one count of parading, demonstrating, or picketing in the Capitol building, and “steal[ing], sell[ing], convey[ing] or dispos[ing] of any thing of value of the United States.”</p>
<p>The fatal crash that claimed Victoria Wilson’s life happened just six days before Hernandez was scheduled to plead guilty. She was given a 30-day jail sentence for the Jan. 6 charge.</p>

<p>A sheriff’s deputy who crashed on body camera lied by omission by initially hiding the fact that he was looking at porn at the time, says the Lake County Sheriff’s Office.</p>
<p>“Gosh darn it,” he said on footage after the crash. “Yeah, that f—ing really sucked.”</p>
<p>The internal affairs report from the Office of Professional Standards determined that he lied, was looking at porn on his phone while driving the patrol vehicle, and also failed to wear his seat belt.</p>
<p>Law&amp;Crime is not naming him because he has not been charged with a crime. The deputy resigned during the investigation, Cpl. Chanel Martin of the Lake County Sheriff’s Office told Law&amp;Crime in an email.</p>
<h3><strong>The crash</strong></h3>
<p>His bodycam from the afternoon of Nov. 6, 2024, shows him with his phone out, though it is unclear what it has on. But what is clear is that the yellow air bag bursts out.</p>
<p>He indicated to at least one passerby he was OK. He walked over to another vehicle that apparently got caught up in the crash. Law&amp;Crime is omitting this encounter because it shows the woman, but in it, the deputy is checking on her.</p>
<p>“Hello, ma’am,” the deputy tells the other driver in the video. “Are you OK? I’m so sorry.”</p>
<p>“It’s OK,” she said.</p>
<p>“My brakes locked up,” he said.</p>
<p>She said she was OK.</p>

<h3><strong>The internal affairs report</strong></h3>
<p>According to the internal affairs report, the deputy allegedly wrote that he ended a phone call when he saw a vehicle stopped in front of his because a school bus was stopped in the opposite lane with lights on.</p>
<p>On top of that, the light for his auto-brake system was on after he left speed calibrations at the IPS range, so his brakes locked up.</p>
<p>But a sergeant who reviewed video footage determined the deputy was looking at images on his phone when the crash happened.</p>
<p>The deputy allegedly described having finished a call with a colleague at the time of the crash.</p>

<p>“He went on to say that he was scrolling through text messages on his phone from a group text with his sector three colleagues just prior to the crash,” the report stated. “He stated he was not sending text messages when the crash occurred.”</p>
<p>But video did not show him scrolling through texts, authorities said. Instead, he was allegedly “viewing a picture or a video at the time of the crash,” the report stated. A supervisor later described there being no videos or pictures in the group chat.</p>
<p>The investigator also determined that the deputy was not wearing a seat belt at the time of the crash.</p>
<p>In an interview on Nov. 20, 2024, the deputy admitted he was, in the report’s words, “looking at inappropriate pictures.” Asked to clarify what he meant, he allegedly “stated pornographic material like boobs or whatnot.”</p>
<p>He reiterated that his bakes did lock up, but he did not have the time to stop when he realized the vehicle was stopped in front of him.</p>
<p>He ultimately admitted “he knew he was looking at inappropriate pictures, which was the leading cause of the crash, and he deliberately left that information out of his report.  He stated that it is called lying by omission.  He further said he knows that one all too well.”</p>

<p>A 10-count indictment has been unsealed in a <a href="https://lawandcrime.com/crime/couple-charged-with-murdering-government-witness-in-massive-fake-car-crash-scam/" target="_blank" rel="noopener">murder and insurance fraud</a> case out of <a href="https://lawandcrime.com/tag/new-orleans/" target="_blank" rel="noopener">New Orleans</a>, in which lawyers and residents are accused of orchestrating “staged collisions” around the Crescent City for money — with paid “spotters,” “slammers” and “runners” in on the take — and one of the alleged schemers being killed off for talking to cops, according to federal prosecutors.</p>
<p>The <a href="https://lawandcrime.com/tag/u-s-attorneys-office/" target="_blank" rel="noopener">U.S. Attorney’s Office</a> unsealed the indictment this week and listed charges for New Orleans residents Ryan “Red” Harris, 36; Sean Alfortish, 57; Vanessa Motta, 43; Jason Giles, 45; Leon “Chunky” Parker, 51; Diaminike Stalbert, 34; Carl Morgan, 66; and Timara Lawrence, 34; as well as the local law firms Motta Law, LLC, and The King Firm, LLC.</p>
<p>Giles and Motta are both attorneys based in the Big Easy, while Alfortish — Motta’s fiance — is disbarred.</p>
<p>Charges were first filed in the homicide and insurance fraud case back in May against Harris and his girlfriend, Jovanna Gardner, 39, of Chalmette, <a href="https://lawandcrime.com/?s=Louisiana" target="_blank" rel="noopener">Louisiana</a> for first-degree <a href="https://lawandcrime.com/?s=murder" target="_blank" rel="noopener">murder</a> of a government cooperator after the alleged widespread fraud conspiracy was uncovered. Several others who were involved have pleaded guilty and agreed to cooperate with prosecutors, including convicted “slammer” Damian Labeaud, who is scheduled to be sentenced in January, and his partner Roderick Hickam. Prosecutors initially declined to release the identities of the lawyers and firms that were allegedly involved.</p>
<aside class="o-callout__recirculate o-callout"/>
<p>“From approximately 2011 through approximately 2017, Labeaud, Hickman, and others staged numerous collisions for Giles, The King Firm, Keating, and others,” the complaint for the unsealed indictment says, listing seven new defendants that weren’t named in May.</p>
<p>Prosecutors accuse the group of “conspiring to file and pursue” fraudulent lawsuits based on the staged collisions they allegedly carried out. The defendants used “coded language,” including fishing terms, to disguise conversations about their illegal “scheme,” according to DOJ officials.</p>
<p>“The scheme included individuals who rode in automobiles as passengers knowing they would be part of staged collisions,” the agency said in a <a href="https://www.justice.gov/usao-edla/pr/ten-count-indictment-unsealed-charging-eight-individuals-and-two-law-firms-offenses" target="_blank" rel="noopener">statement</a> Monday, the day the full indictment was unsealed. “Those individuals later lied as part of fraudulent insurance claims and fraudulent lawsuits based on the staged collisions. Additionally, the scheme included individuals who drove automobiles and intentionally collided with 18-wheeler tractor-trailers and other commercial vehicles, in order to stage collisions (‘slammers’). After the staged collisions, the slammers would flee the scene and a passenger would falsely claim to have been driving at the time of the collision.”</p>
<p>According to the complaint, “runners” were in charge of referring individuals involved in automobile collisions to the lawyers and law firms for money.</p>
<p>One of the group’s members, Cornelius Garrison, started “covertly cooperating” with federal agents in October 2019 and they allegedly found out about it, according to the <a href="https://www.justice.gov/usao-edla/pr/five-count-indictment-unsealed-charging-local-pair-conspiracy-commit-murder-federal" target="_blank" rel="noopener">DOJ investigators.</a> He had worked for both Harris and Gardner in the alleged scam and was serving as both a “slammer” and a “spotter” for the couple, which are described as positions that require theatrics.</p>
<p>Prosecutors say the group planted passengers in cars or semi-trucks after hitting them with vehicles and then those people filed bogus insurance claims. After the crash occurred, slammers would flee and spotters communicated with them on whether police were in pursuit or nearby. Oftentimes, spotters are tasked with pretending to be witnesses and required to flag down commercial vehicles. Once a person pulls over to help, the people involved would start blaming them for the collision, according to court documents.</p>
<p>The Justice Department believes Garrison was murdered by Harris and Gardner in September 2020 after he was federally indicted on conspiracy to commit mail fraud and other charges associated with the bogus wrecks that same week. He was indicted on Sept. 18 and found dead on Sept. 22 inside his home — shot multiple times, according to prosecutors.</p>
<aside class="o-callout__recirculate o-callout"/>
<p>Harris and Gardner were charged with conspiracy to commit mail and wire fraud, conspiracy to commit witness tampering through murder, conspiracy to retaliate against a witness through murder and other crimes.</p>
<p>Gardner has since pleaded guilty to a reduced charge of witness tampering, while claiming that Harris admitted to her that he killed Garrison.</p>
<p>Each defendant in the newly unsealed indictment faces a charge of conspiring to commit mail and wire fraud, which carries a prison sentence of up to 20 years upon conviction.</p>
<p>Motta, Giles and Alfortish also face witness tampering and obstruction of justice charges, which carry maximum sentences of 20 years and 10 years, if convicted, respectively. Harris faces three additional counts of retaliation against a witness through murder, causing death through use of a firearm and witness tampering through murder.</p>
<p>Attempts by Law&amp;Crime to reach the King Firm and Motta Law for comment were unsuccessful Thursday.</p>

<p>A teenager and two parents are facing felonies for their alleged roles in a crash that killed another 18-year-old woman in <a href="https://lawandcrime.com/tag/georgia/" target="_blank" rel="noopener">Georgia</a>.</p>
<p>The driver of the vehicle involved in the crash, 18-year-old Hannah Hackemeyer, is charged with three counts of <a href="https://lawandcrime.com/tag/homicide/" target="_blank" rel="noopener">homicide</a> by vehicle and driving under the influence, among other crimes, DeKalb County District Attorney Sherry Boston said in a press release. Her friend’s parents, Sumanth Rao, 50, and Anindita Rao, 49, are facing <a href="https://lawandcrime.com/tag/involuntary-manslaughter/" target="_blank" rel="noopener">involuntary manslaughter</a> charges for allegedly allowing the teens to drink before the fateful crash that killed Sophia Lekiachvili.</p>
<p>Prosecutors say Hackemeyer, Lekiachvili, and the Rao’s daughter were drinking at the Rao household the night of Feb. 23 and into Feb. 24. The underage teens were drinking with the blessing of Sumanth Rao and Anindita Rao. Boston told reporters Wednesday at a <a href="https://www.youtube.com/watch?v=4Zb0J2MQBS8" target="_blank" rel="noopener">press conference</a> the Rao home was known as the “party house” where underage drinking was the norm.</p>

<p class="text | article-text">“Halloween, Homecoming, the last day of school,” Boston said. “It is a miracle that nothing happened prior to Feb. 24. Mr. and Mrs. Rao’s choices that night led to the death of a teenage girl.”</p>
<p>According to prosecutors, the teens had just polished off a bottle of wine when they decided to go for a drive shortly before midnight. With Hackemeyer driving, Lekiachvili sat in the front passenger seat while the Rao girl rode in the back seat. They had an open bottle of wine in the car. Hackemeyer allegedly was driving the Mazda CX-5 nearly 100 mph — more than 60 mph over the speed limit — when she lost control and crashed, causing the car to roll over.</p>
<p>Hackemeyer and the Rao girl crawled out of the car. First responders rushed to the scene where they found Lekiachvili trapped in the passenger seat. They extricated her and rushed the teen to the hospital where she died from her injuries.</p>
<p>An investigation unveiled that Hackemeyer allegedly had a Blood Alcohol Concentration of 0.046, which is more than twice the legal limit for someone under the age of 21.</p>

<p>A man from <a href="https://lawandcrime.com/?s=%22New+Mexico%22" target="_blank" rel="noopener">New Mexico</a> who admitted to smoking meth and marijuana before he crashed through a home, killing a grandfather sitting in a recliner watching TV, will spend 10 years in prison.</p>
<p>Mark Castello, 63, learned his fate on Wednesday in the death of Brian Peterson, 74. Castello pleaded guilty to <a href="https://lawandcrime.com/?s=homicide" target="_blank" rel="noopener">homicide</a> by vehicle.</p>

<p>“We will carry this pain for the rest of our lives. Our family will never be the same. There is no true healing from an event like this,” Peterson’s daughter, Tiffany Saiz, said at the court hearing, local CBS and Fox affiliate <a href="https://www.krqe.com/news/crime/man-sentenced-for-driving-drunk-into-albuquerque-home-killing-74-year-old/" target="_blank" rel="noopener">KRQE reported</a>.</p>
<p>From the stand, Castello said, “I am aware of the tragic situation that I have put the Peterson family in and what they are about to go through. It was not my intention at all.”</p>
<p>The incident happened on Dec. 28, 2023, <a href="https://www.cabq.gov/police/news/apd-charges-man-for-crash-into-house-killing-homeowner" target="_blank" rel="noopener">authorities said</a>.</p>
<p>Castello drove a white Ford Expedition through a stop sign and crashed through the garage door of a home in Albuquerque, officials said.</p>
<p>The Expedition struck a parked car in the garage, pushing that car into the residence. The second vehicle struck Peterson.</p>
<p>“My dad was trapped in his recliner,” <a href="https://www.krqe.com/news/crime/man-sentenced-for-driving-drunk-into-albuquerque-home-killing-74-year-old/" target="_blank" rel="noopener">Saiz said</a>. “The wheel of my parent’s car was in the center of his chest. He remained trapped for over 30 minutes as we stood outside, completely helpless.”</p>
<p>Albuquerque police and rescue personnel responded around 12:40 p.m. Peterson died at a hospital.</p>
<p>Castello was also hospitalized for minor injuries and later charged with <a href="https://lawandcrime.com/?s=DWI" target="_blank" rel="noopener">DWI</a> resulting in death, driving with a revoked license, open container, possession of drug paraphernalia, and possession of controlled substance.</p>
<p>He admitted to smoking meth and marijuana before driving, officials said, local NBC affiliate <a href="https://www.kob.com/new-mexico/court-hearing-delayed-for-man-accused-of-crashing-into-house-killing-homeowner/" target="_blank" rel="noopener">KOB reported</a>. Authorities said they found several open alcohol containers in his vehicle.</p>
<p>Castello’s criminal history includes convictions for DWI, domestic violence, embezzlement, and forgery, <a href="https://www.kob.com/new-mexico/court-hearing-delayed-for-man-accused-of-crashing-into-house-killing-homeowner/" target="_blank" rel="noopener">the outlet reported</a>.</p>
<p>Peterson’s wife, Jean, <a href="https://www.koat.com/article/albuquerque-family-mourns-loved-one-killed-drunk-driver-plows-into-home/46254026" target="_blank" rel="noopener">told local ABC affiliate KOAT</a> that she was in another room when the crash happened as her husband sat in his favorite chair.</p>
<p>“I heard a horrendous crash, almost like I would have expected a bomb to sound,” she said. “And I thought, ‘What in the world?’ And then I looked over to the left and I saw my car sitting in the living room. I just saw the car sitting where I knew his chair was. I didn’t see him because I couldn’t see over.”</p>
<p>“I went and spoke to him, and he answered me,” she continued. “I heard his voice, but I couldn’t see him.”</p>
<p>She said she spent the night reliving what happened.</p>
<p>“All I could think about was Brian pinned under that car,” she said.</p>
<p>Brian Peterson’s <a href="https://www.gofundme.com/f/drunk-driver-takes-father-husband-and-grandfather?utm_campaign=p_cp+share-sheet&amp;utm_medium=copy_link_all&amp;utm_source=customer" target="_blank" rel="noopener">GoFundMe page</a> said he has 10 grandchildren.</p>
<p>His wife, the page said, “is the glue that holds the family together, but Brian was Jean’s rock and a source of support to the family.”</p>

<p>A 24-year-old man in <a href="https://lawandcrime.com/tag/minnesota/">Minnesota</a> will spend several years behind bars for causing a fatal <a href="https://lawandcrime.com/tag/crash/">car crash</a> just moments after he posted an image to <a href="https://lawandcrime.com/tag/social-media/">social media</a> showing that he was driving 150 mph, which he said was a “new record.”</p>
<p>Tenth Judicial District Court Judge Kristi Stanislawski on Monday ordered Hunter M. Buckentine to serve just under 10 years — 116 months — in a state correctional facility for causing the death of 34-year-old Jordan Kramer, <a href="https://publicaccess.courts.state.mn.us/">court records</a> reviewed by Law&amp;Crime show. Under Minnesota law, Buckentine will likely serve two-thirds of the sentence in prison and the final third on supervised release.</p>
<p>The sentence was handed down after Buckentine pleaded guilty to one count of criminal vehicular homicide while operating a motor vehicle in a grossly negligent manner and one count of criminal vehicular operation causing substantial bodily harm</p>
<p>According to a probable cause affidavit, a state trooper at about 1:11 a.m. on Aug. 19, 2023, was driving on U.S. Highway 10 in Sherburne County when they saw Buckentine’s black Infiniti driving in the opposite direction going 132 mph in a 60 mph zone. The trooper attempted to catch up to Buckentine, but the vehicle “kept pulling away until he was barely able to see it.” The trooper was going 116 mph when Buckentine pulled completely out of sight.</p>
<p>A short while later, the trooper came across the scene of a severe accident where he was flagged down by a female in the road who said she was driving a Chevy Cobalt with two passengers when they were struck from behind and the passengers were thrown from the vehicle. The Cobalt was in a ditch and “severely damaged in all places” with an adult male — later identified as Kramer — laying motionless nearby.</p>
<p>“[The driver] was driving and going the speed limit. [Kramer] was in the front passenger seat and [a female passenger] was sitting behind [Kramer],” the affidavit states. “[The driver] stated the other vehicle came up on her so fast, she saw the lights flash behind her and she did not have any time to react. All she saw was the headlights behind her and the next thing that happened was impact. She stated the Infiniti hit the back end of her vehicle, which spun it around and she thought they rolled in the ditch, but did not know how many times. [The driver] estimated the other vehicle’s speed to be at 150 miles per hour.</p>
<p>Buckentine’s Infiniti was about 200 yards from the other car and began to catch fire. Authorities said there was no indication that he attempted to brake before hitting the other vehicle.</p>
<p>An adult male, who had been Buckentine’s passenger, was located near the scene of the crash. He said he and Buckentine had gone to a bar hours earlier, and Buckentine had at least two shots before they left at around 1 a.m., at which point Buckentine seemed able to drive.</p>
<p>At some point while driving from the bar, the passenger said Buckentine “sped up to 150 mph, took his phone out and took a SnapChat picture of his speed.” The passenger said that when he looked up again, he saw taillights “approximately a foot in front of them” before crashing.</p>
<p>Following the crash, the passenger said Buckentine “began running away and making suicidal comments.” While running, Buckentine began taking off his clothes and ran into a corn field,</p>
<p>The following afternoon, Buckentine called state troopers saying he’d woken up on a baseball field wearing someone else’s clothing. He later admitted to being the owner of the Infiniti involved in the crash, but said he didn’t remember anything about a crash. He also claimed that the fastest he had ever driven his car was 145 mph while at the Brainerd International Raceway.</p>
<p>“The defendant identified his SnapChat name for law enforcement. [The passenger] provided law enforcement a copy of the Snap Chat sent by the defendant just prior to the crash,” the affidavit states. “The SnapChat shows a speedometer with a reading of 150 miles per hour with a text stating ‘new record.&#8221;”</p>

<p>A <a href="https://lawandcrime.com/?s=michigan" target="_blank" rel="noopener">Michigan</a> woman faces charges in a crash at nearly 100 mph in a 45 mph zone that killed a 22-year-old woman and her dog and critically injured her boyfriend during a Thanksgiving holiday visit with family.</p>
<p>Nyra Whitelow, 23, is accused in the crash that killed Audrey Hensley. She faces charges of second-degree <a href="https://lawandcrime.com/?s=murder" target="_blank" rel="noopener">murder</a> and reckless driving, causing serious impairment of body function. She was free on a $50,000 bond with a court date set for April 26, online court records show.</p>

<p>“There is tremendous loss, for the loved ones, the family there is loss to the community,” Kalamazoo County Prosecutor Jeff Getting said, local CBS affiliate <a href="https://wwmt.com/news/local/kalamazoo-county-sheriff-gavin-vinstra-audrey-hensley-nyra-whitelow-michigan-crash-stadium-drive-murder-charge-arrest-bronson" target="_blank" rel="noopener">WWMT</a> reported. “We end up charging reckless driving causing serious injury, but that hardly seems sufficient when someone has had these life-altering injuries and is going to be dealing with the impact not for just the next few months but for the rest of their lives. Not only are they doing something that they know or should know is dangerous for someone else … but it’s so dangerous that the likelihood of those actions is that someone is going to be severely hurt or killed.”</p>
<p>The three-vehicle crash happened on Nov. 24, 2023, in Kalamazoo, in southwest Michigan. Whitelow’s Dodge Charger attained speeds of nearly 100 mph within five seconds of the crash and slowed to 86 mph just before impact, local <a href="https://www.mlive.com/news/kalamazoo/2024/04/woman-going-97-mph-twice-the-limit-charged-with-murder-in-black-friday-crash.html" target="_blank" rel="noopener">MLive Media Group</a> news outlet reported, citing a probable cause affidavit by Kalamazoo Department of Public Safety Detective Tim Knight.</p>
<p>“Upon an interview with the at-fault driver Nyra Whitelow, she informed she was running late to drop off items to a friend at Bronson Hospital, which was why she was speeding,” a detective wrote in the document, the news outlet reported.</p>
<p>The officer wrote the defendant “disregarded everyone else’s safety” by traveling at an “extremely excessive speed.”</p>
<p>Hensley graduated from Michigan State University and was working to get her master’s degree in dietetics at Ball State University at the time of her death, her <a href="https://betzlerlifestory.com/obituaries/audrey-hensley.144990" target="_blank" rel="noopener">obituary</a> said.</p>
<p>“We were blessed to have spent a wonderful Thanksgiving with them and we will cherish that last holiday with her forever,” her mother wrote on <a href="https://www.facebook.com/corry.lockardhensley/posts/pfbid0kFk8BhPgeMd6uvRBBybkRbVzKPpwN36H9Qyy8PfdkqzFgULnJsmPYZ2BmbKtEipl" target="_blank" rel="noopener">Facebook</a>, accompanying the last picture they took together from a walk on Thanksgiving morning and the family Christmas tree. “Our tree can flip to colored lights with the push of a button,” her mother wrote. “Right before Audrey and Gavin left yesterday she flipped it to colored to see if I would notice. 30 minutes later she was gone. 30 minutes. I noticed, baby girl, and I’m leaving them. Maybe forever. Mommy loves you, Audrey, and I’ll miss you until we meet again.”</p>

<p>The concrete truck driver who crashed into a school bus which caused the death of a 5-year-old boy and a man in another vehicle allegedly told cops he took cocaine and smoked marijuana in the hours before the accident.</p>
<p>Harrowing <a href="https://apnews.com/article/texas-school-bus-crash-62b15440d34d1a230dc94e8cceadc66b" target="_blank" rel="noopener">dashcam video</a> of the crash showed Jerry Hernandez’s concrete truck drifting over the centerline and hitting the bus head on along the rural <a href="https://lawandcrime.com/tag/texas/" target="_blank" rel="noopener">Texas</a> road outside of Austin around 2 p.m. March 22. The bus flipped several times before coming to a stop. An SUV also was involved in crash, killing its driver.</p>

<p>Court records show Hernandez, 42, is facing a criminally negligent homicide charge. <a href="https://www.kxan.com/news/local/bastrop-county/affidavit-concrete-truck-driver-admits-to-consuming-cocaine-before-fatal-school-bus-crash/" target="_blank" rel="noopener">Multiple</a> <a href="https://cbsaustin.com/news/local/cement-pump-truck-driver-in-fatal-bastrop-crash-has-lengthy-criminal-history" target="_blank" rel="noopener">local media</a> outlets, citing an arrest affidavit, reported Hernandez admitted to police that he had smoked marijuana around 10 p.m. the day before and took cocaine around 1 a.m. the day of the crash. He had only had about three hours of sleep.</p>
<p>Hernandez allegedly tried to claim that an SUV about two lengths in front of him suddenly braked, causing him to swerve, however video from the bus dash cam showed there were no cars in front of him. Cops arrested Hernandez on Friday and took him to the Bastrop County Jail.</p>
<p>The school bus from the Hays Consolidated Independent School District was carrying more than 40 pre-K students and 10 adults who were returning from a field trip at the Capital of Texas Zoo. There were no seat belts for the people aboard the bus.</p>

<p>Several children suffered serious injuries. Ulises Rodriguez Montoya, 5, died. Authorities with the Texas Department of Public Safety identified the man who died in the SUV as 33-year-old Ryan Wallace. Local <a href="https://www.kxan.com/news/local/hays/hays-cisd-identifies-student-who-died-in-friday-bus-crash/" target="_blank" rel="noopener">NBC affiliate KXAN</a> reported that Wallace was a journalism student at the University of Texas at Austin.</p>
<p>“Ulises was a child who was filled with a lot of happiness and he often shared it with others,” Naira (Dina) Solís Shears, his pre-K bilingual teacher from Tom Green Elementary told KXAN. “He had a talent for drawing and his favorite thing to draw was dinosaurs. He could almost completely spell the word dinosaur, which demonstrates how smart he was. He always had a dinosaur drawn on all of the assignments he turned in. He liked to tell stories and shared many with his friends and family. Above all — he was a loving child.”</p>
