<p>An executive order targeting Paul, Weiss, Rifkind, Wharton &amp; Garrison “could easily have destroyed our firm,” the law firm’s chairman, Brad Karp, told employees in a March 23 statement defending the deal that he reached with President Donald Trump.</p>
<p><a href="https://davidlat.substack.com/p/brad-karp-firmwide-email-to-paul-weiss-about-the-trump-administration-deal">Karp’s message</a>, <a href="https://davidlat.substack.com/p/paul-weiss-and-brad-karp-cut-a-deal-with-donald-trump-to-rescind-the-executive-order">printed by</a> Original Jurisdiction, said Paul Weiss was facing an “existential crisis” as a result of <a href="https://www.abajournal.com/news/article/paul-weiss-is-latest-firm-targeted-by-trump-administration">a March 14 executive order</a> by Trump. The <a href="https://www.whitehouse.gov/presidential-actions/2025/03/addressing-risks-from-paul-weiss">order had</a> suspended security clearances held by people at the firm, restricted their access to government buildings, required government contractors to disclose whether they do business with the firm, and required agencies to take steps to terminate contracts with Paul Weiss or its clients.</p>
<p>The executive order is being revoked as a result of the deal, Trump announced in a post <a href="https://truthsocial.com/@realDonaldTrump/posts/114197044617921519">on Truth Social</a>, his social media platform, March 20. According to Trump, the deal provides that Paul Weiss:</p>
<p>  • Will not deny representation to clients because of lawyers’ personal political views.</p>
<p>  • Will take on a wide variety of pro bono matters that represent the full spectrum of political viewpoints.</p>
<p>  • Will dedicate $40 million in pro bono legal services “to support the administration’s initiatives, including: assisting our nation’s veterans, fairness in the justice system, the president’s Task Force to Combat Antisemitism and other mutually agreed projects.”</p>
<p>  • “Affirms its commitment to merit-based hiring, promotion and retention and will not adopt, use or pursue any DEI policies.”</p>
<p>Karp sent a copy of the agreement to firm employees that differs from Trump’s description, the <a href="https://www.nytimes.com/2025/03/21/business/paul-weiss-memo-trump-deal.html">New York Times</a> reports. Karp’s version does not mention DEI, but it did affirm a commitment to merits-based employment practices and to hire an outside expert to audit those practices.</p>
<p>Karp also said under the agreement, “the administration is not dictating what matters we take on, approving our matters or anything like that.”</p>
<p>The Truth Social post also quoted a White House statement that said Karp had “acknowledged the wrongdoing of former Paul Weiss partner Mark Pomerantz,” who <a href="https://www.simonandschuster.com/books/People-vs-Donald-Trump/Mark-Pomerantz/9781668022443">worked on a criminal case</a> against Trump while he was with the New York district attorney’s office. But Karp’s copy of the agreement did not mention Pomerantz, who has denied doing anything wrong, according to the New York Times.</p>
<p>Karp negotiated the agreement just a few months after suffering a heart attack, the <a href="https://www.nytimes.com/2025/03/21/us/politics/paul-weiss-trump.html">New York Times </a>reports in another article. The deal was supported by “the vast majority” of the firm’s partners, the New York Times said, which relied on anonymous sources.</p>
<p>Karp said he was initially “hopeful that the legal industry would rally to our side” after Trump issued the executive order. Instead “certain other firms were seeking to exploit our vulnerabilities by aggressively soliciting our clients and recruiting our attorneys,” he said.</p>
<p>Paul Weiss initially planned to challenge the executive order in a lawsuit, but it soon became clear that a successful legal challenge “would not solve the fundamental problem, which was that clients perceived our firm as being persona non grata with the administration,” Karp said. In reaching a deal, Karp said, “we were guided by our obligation to protect our clients’ interests” and the need to ensure that the firm would survive.</p>
<p>Critics of the deal include 141 Paul Weiss alumni who signed <a href="https://www.commoncause.org/wp-content/uploads/2025/03/Paul-Weiss-alumni-letter.docx.pdf">a March 24 letter</a> protesting the firm’s decision, according to a <a href="https://www.commoncause.org/press/140-paul-weiss-alumni-protest-firms-deal-with-trump">March 24 press release</a>.</p>
<p>“We expected the firm to be a leader in standing up for the legal profession, the adversary system and the right to counsel,” the letter said. “Instead of a ringing defense of the values of democracy, we witnessed a craven surrender to, and thus complicity in, what is perhaps the gravest threat to the independence of the legal profession since at least the days of Sen. Joseph McCarthy.”</p>
<p>Taking the other side is Stephen Gillers, a professor at the New York University School of Law, who <a href="https://www.law.com/americanlawyer/2025/03/21/paul-weiss-deal-with-trump-raises-fears-but-some-praise-practical-solution">told Law.com</a> that Paul Weiss “had no obligation to fight Trump in court.”</p>
<p>The firm “has obligations to its clients, who must deal with the federal government regularly as an adversary or a regulator, and to its thousands of employees, including lawyers,” he said.</p>

<p>President Donald Trump signed an executive order Monday that that generally pauses enforcement of a law that bars companies operating in the United States from bribing foreign officials.</p>
<p>The <a href="https://www.whitehouse.gov/presidential-actions/2025/02/pausing-foreign-corrupt-practices-act-enforcement-to-further-american-economic-and-national-security">Feb. 10 order</a> requires U.S. Attorney General Pam Bondi to formulate updated guidelines for enforcing the Foreign Corrupt Practices Act that “prioritize American interests, American economic competitiveness with respect to other nations, and the efficient use of federal law enforcement resources.”</p>
<p>Bondi has 180 days to work on the guidelines and has the option of extending the period for another 180 days, the order said. During that time, Bondi should stop new Foreign Corrupt Practices Act investigations or enforcement actions, the order said. She is also required to review existing investigations and actions, taking action to restore proper bounds on enforcement. Bondi can determine whether an exception to the pause should be made in individual cases, however.</p>
<p>A White House <a href="https://www.whitehouse.gov/fact-sheets/2025/02/fact-sheet-president-donald-j-trump-restores-american-competitiveness-and-security-in-fcpa-enforcement">fact sheet</a> said “unpredictable FCPA enforcement” makes American companies less competitive. Overenforcement of the law also interferes with Trump’s authority to conduct foreign affairs under Article II of the Constitution, the document said.</p>
<p>Bondi issued <a href="https://www.justice.gov/ag/media/1388546/dl?inline">a memo</a> Feb. 5 that directs Department of Justice lawyers to prioritize Foreign Corrupt Practices Act prosecutions in which foreign bribery facilitated crimes of cartels and transnational criminal organizations, according to an <a href="https://www.arnoldporter.com/en/perspectives/blogs/enforcement-edge/2025/02/president-trump-presses-pause-on-fcpa-enforcement">analysis by Arnold &amp; Porter Kaye Scholer</a>. The law firm also said the statute of limitations in Foreign Corrupt Practices Act cases “outruns the Trump administration,” meaning that a prosecution could be fair game after Trump leaves office.</p>

<p>Attorneys for President-elect <a href="https://lawandcrime.com/tag/donald-trump/" target="_blank" rel="noopener">Donald Trump</a> on Monday asked the judge overseeing his New York City-based <a href="https://lawandcrime.com/tag/hush-money/" target="_blank" rel="noopener">hush-money</a> case to dismiss the indictment and vacate the jury’s guilty verdicts.</p>
<p>In an <a href="https://www.documentcloud.org/documents/25431782-trump-dismiss-hush-money/" target="_blank" rel="noopener">80-page filing</a>, attorneys Todd Blanche and Emil Bove say three distinct sources of federal law “require” the defense’s requested “result” and those legal sources “require it immediately.”</p>
<p>But <a href="https://lawandcrime.com/high-profile/hush-money-judge-gives-trump-one-final-twist-of-the-knife-by-rejecting-lengthy-deadlines-in-favor-of-das-quick-turnaround-and-deals-jack-smith-one-final-card-to-play/" target="_blank" rel="noopener">the penultimate filing in the case</a> actually begins with an invocation of current events: President Joe Biden’s pardon of his adult son Hunter Biden’s felony gun conviction and any would-be crimes.</p>
<p>“Yesterday, in issuing a 10-year pardon to Hunter Biden that covers any and all crimes whether charged or uncharged, President Biden asserted that his son was ‘selectively, and unfairly, prosecuted,’ and ‘treated differently,&#8221;” the filing, docketed Tuesday, reads.</p>
<aside class="o-callout__recirculate o-callout"/>
<p>Trump’s attorneys do not only crib language from the 46th president’s perfidious bout of patrimonial clemency, they also echo the elder Biden’s words targeting the work of federal prosecutors.</p>
<p>“President Biden argued that ‘raw politics has infected this process and it led to a miscarriage of justice,&#8217;” the motion goes on. “These comments amounted to an extraordinary condemnation of President Biden’s own DOJ. This is the same DOJ that coordinated and oversaw the politically-motivated, election-interference witch hunts targeting President Trump.”</p>
<p>The filing accuses Manhattan District Attorney <a href="https://lawandcrime.com/tag/alvin-bragg/" target="_blank" rel="noopener">Alvin Bragg</a>, a Democrat, of having engaged in “precisely the type of political theater” the president rubbished when he issued his son’s pardon.</p>
<p>Late <a href="https://lawandcrime.com/high-profile/competing-constitutional-interests-bragg-fights-trump-hush-money-dismissal-says-presidential-immunity-cannot-thwart-the-publics-interest-in-enforcing-sentence/" target="_blank" rel="noopener">last month</a>, Bragg’s office made it clear prosecutors intend to push forward and ask for Trump to be sentenced in connection with his 34 felony convictions on charges of falsifying business documents — after he finishes his second term as president in January 2029.</p>
<p>The Damocletian nature of that option is mentioned in the motion.</p>
<p>“With respect to Presidential immunity, it would be egregious and unlawful for this Court to hold the prospect of a 2029 sentencing over President Trump’s head while he continues his service to this Country,” the filing reads. “President Trump would be required to operate ‘under an apprehension that the motives that control his official conduct may, at any time, become. the subject of inquiry’ at a future sentencing.”</p>
<p>Trump’s attorneys go on to say the prospect of a president working under such conditions would “seriously cripple the proper and effective administration of public affairs as entrusted to the executive branch of the government.”</p>
<p>And, so the argument goes, simply putting the sentencing of the case on a shelf in a legal freezer would violate the presidential immunity doctrine created by the U.S. Supreme Court earlier this year.</p>
<p>In the filing, Trump’s attorneys tear into Bragg for having “ignored” the recent vintage immunity doctrine — saying the district attorney’s “hubris on that topic” and “stubborn insistence on offering official acts evidence in grand jury proceedings and at trial resulted in damage to the institution of the Presidency.”</p>
<p>The motion also criticizes the court itself for rushing ahead with the case “despite obviously relevant Supreme Court proceedings.”</p>
<p>The motion then lists a direct quote from Justice Clarence Thomas’s influential concurrence to the majority opinion: “Few things would threaten our constitutional order more than criminally prosecuting a former President for his official acts.”</p>
<p>Presidential immunity, the motion argues, dovetails with arguments for dismissal sourced from the Supremacy Clause of the U.S. Constitution.</p>
<p>“Local elected officials such as DA Bragg have no valid basis to cause such disruptions, which also violate the Supremacy Clause,” the filing goes on. “Consequently, the federal Constitution is an absolute ‘legal impediment’ to further proceedings, and the case must be immediately dismissed.”</p>
<p>The motion elaborates on this point, at length:</p>
<blockquote>
<p>As relevant here, “the Supremacy Clause prohibits state judges and prosecutors from interfering with a President’s official duties.” The Supreme Court has applied the Supremacy Clause in that fashion to federal employees since the 1800s.</p>
<p>…</p>
<p>The Supremacy Clause adds additional urgency to the need for immediate dismissal because DANY has created the nightmare scenario where a local, biased prosecutor is seeking to interfere with the outcome of the national election by encumbering the people’s choice of a leader with unacceptable burdens and distractions.</p>
</blockquote>
<p>The third source of federal law cited by the defense is a statute: the <a href="https://www.govinfo.gov/content/pkg/COMPS-1612/pdf/COMPS-1612.pdf" target="_blank" rel="noopener">Presidential Transition Act of 1963</a>.</p>
<p>“The Presidential Transition Act applies to President Trump,” the motion goes on. “The Act’s legislative history makes clear that there is no material distinction between the President-elect and the post-inauguration sitting President for these purposes.”</p>
<p>Trump’s attorneys, citing precedent, say a presidential transition is effectively part of an incoming administration that implicates the “national interest” as well as the “public function” of the presidency.</p>
<p>This is essentially an argument that as president-elect, Trump is no longer a private citizen because his job already “includes evaluation of sensitive national security issues and associated grave risks.”</p>
<p>“[Bragg’s] insistence on continuing with these unlawful, failed proceedings intensifies the risk associated with that vulnerability,” the motion goes on. “President Trump has already commenced this complex. sensitive, and intensely time-consuming process. which is a ‘monumental undertaking.’ These proceedings are interfering with that process and must therefore be terminated immediately.”</p>
<p>The district attorney’s office has until Dec. 9, to file their response.</p>

<p>Attorneys for former President Donald Trump on Thursday moved to dismiss the Jan. 6 case on the basis that special counsel <a href="https://lawandcrime.com/tag/jack-smith/" target="_blank" rel="noopener">Jack Smith</a> was unlawfully appointed and has unlawfully spent tens of millions of dollars “on his unjust and unwarranted prosecutions.”</p>
<p>The <a href="https://storage.courtlistener.com/recap/gov.uscourts.dcd.258149/gov.uscourts.dcd.258149.270.0_1.pdf" target="_blank" rel="noopener">30-page proposed motion to dismiss and for injunctive relief</a> is premised on arguments that previously held the day in the Southern District of Florida. Namely, Trump’s attorneys argue the prosecutor in charge of the case was given his authority in violation of the U.S. Constitution’s appointments and appropriations clauses.</p>
<p>While those arguments did prove successful in one courtroom, in the Mar-a-Lago documents case, U.S. District Judge Tanya Chutkan has, so far, appeared disdainful of the idea that U.S. District Judge Aileen Cannon’s summer decision might be cited as controlling precedent.</p>
<p>That’s no problem for the 45th president — his latest motion largely relies on U.S. Supreme Court Justice Clarence Thomas.</p>
<aside class="o-callout__recirculate o-callout"/>
<p>“In an intervening opinion issued while this case was stayed, Justice Thomas observed that ‘there are serious questions whether the Attorney General has violated [our Constitutional] structure by creating an office of the Special Counsel that has not been established by law,’ and he instructed that ‘[t]hose questions must be answered before this prosecution can proceed,&#8221;” the filing reads. “In another intervening decision, a District Court issued a thorough and well-reasoned opinion that relied in part on Justice Thomas’s concurrence, credited many of the arguments raised in President Trump’s proposed motion, and dismissed charges unlawfully filed.”</p>
<p>The analysis offered by Thomas, of course, came as a concurrence — not the majority opinion — in the landmark case where Chief Justice John Roberts issued a broad grant of <a href="https://lawandcrime.com/supreme-court/the-president-is-now-a-king-above-the-law-sotomayor-dissent-in-trump-immunity-case-accuses-majority-of-judicial-activism-in-twisted-opinion-that-has-no-basis-in-law/" target="_blank" rel="noopener">presidential immunity</a> to Trump. Cannon would go on to famously <a href="https://lawandcrime.com/high-profile/judge-cannon-repeatedly-cites-clarence-thomas-and-his-solo-concurrence-in-scotus-presidential-immunity-to-justify-dismissing-trumps-mar-a-lago-indictment/" target="_blank" rel="noopener">use the concurrence</a> to that opinion <a href="https://lawandcrime.com/high-profile/after-careful-study-judge-cannon-throws-out-trumps-mar-a-lago-indictment-and-finds-ag-merrick-garland-unlawfully-appointed-jack-smith-as-special-counsel/" target="_blank" rel="noopener">to squelch</a> special Smith’s authority and dismiss the case.</p>
<p>Thomas was the only justice to cite the long-simmering Appointments Clause issue in an unfavorable light for the government in any of the opinions attached to Trump v. United States. <a href="https://www.supremecourt.gov/opinions/23pdf/23-939_e2pg.pdf" target="_blank" rel="noopener">The majority opinion</a> actually lists, offhandedly, several ways in which the appointments power inures to the executive’s benefit. Thomas was also the only justice to mention the phrase “Appointments Clause” directly.</p>
<p>Thomas’ concurrence largely echoed arguments made by conservative amici curiae (Latin for “friends of the court”) on the Mar-a-Lago case docket. Somewhat controversially, Cannon recently heard oral arguments from several groups of amici regarding the legality of Smith’s appointment as special counsel.</p>
<p>Those <a href="https://lawandcrime.com/high-profile/judge-aileen-cannon-allows-lawyers-to-support-and-oppose-trump-motion-to-dismiss-at-hearing-on-jack-smiths-authority/" target="_blank" rel="noopener">amici asserted “private citizen” Smith’s appointment</a> by U.S. Attorney General Merrick Garland violated the Constitution because he was neither confirmed by the Senate nor sufficiently “authorized” by statute. Trump and his co-defendants, for their part, made similar objections to Smith’s role and funding in various defense motions.</p>
<p>And, though Trump v. United States was not about the Mar-a-Lago case, Smith and his office were implicated because he is the special counsel who brought and led both prosecutions.</p>
<p>In the present motion, the former president’s attorneys figured that one successful shot might as well be tried again by echoing the arguments highlighted by Thomas. The Thursday effort to dismiss the indictment mentions Thomas by name no less than 19 times.</p>
<p>From the filing, at length:</p>
<blockquote>
<p>Justice Thomas instructed that the “essential questions” raised in the proposed motion “must be answered before this prosecution can proceed.” … Equally important is the fact that Justice Thomas’s concurrence and Judge Cannon’s thorough intervening decision present important and thoughtful reasons — many of which have not been addressed in this Circuit — supporting President Trump’s position that Smith’s appointment and work have violated the Appointments and Appropriations Clauses.</p>
</blockquote>
<p>Calling the appointment clause issue a “fatal Constitutional defect” that is “causing irreparable harm,” Trump’s motion argues the superseding indictment filed by Smith — which was rewritten and refiled to comply with the high court’s presidential immunity decision — “must be dismissed.”</p>
<p>The filing ominously casts Smith’s grant of authority as a political effort by President Joe Biden to hamstring his greatest rival.</p>
<p>Again, the motion, at length:</p>
<blockquote>
<p>The proposed motion establishes that this unjust case was dead on arrival — unconstitutional even before its inception. In November 2022, the Attorney General violated the Appointments Clause by naming private-citizen Smith to target President Trump, while President Trump was campaigning to take back the Oval Office from the Attorney General’s boss, without a statutory basis for doing so. Garland did so following improper public urging from President Biden to target President Trump, as reported at the time in 2022, and repeated recently by President Biden through his inappropriate instruction to “lock him up” while Smith presses forward with the case unlawfully as the Presidential election rapidly approaches. Everything that Smith did since Attorney General Garland’s appointment, as President Trump continued his leading campaign against President Biden and then Vice President Harris, was unlawful and unconstitutional.</p>
</blockquote>
<p>As for the appropriations clause issue, Trump’s legal team offers something not entirely unlike a sticker shock argument.</p>
<p>“Between November 2022 and March 2024, Smith spent almost $20 million on his unjust and unwarranted prosecutions targeting President Trump,” the motion reads. “He has almost certainly spent many more untold millions more between March 2024 and today. In addition to the $20 million spent directly by Smith and his Special Counsel’s Office prior to March 2024, other unspecified ‘components’ of the Biden-Harris administration have spent more than $16 million on the same unlawful project. All of that money was spent in violation of the Appropriations Clause.”</p>
<p>To that end, the defense argues, “the Court should enjoin Smith and the Special Counsel’s Office from spending additional public funds in furtherance of the invalid Appointment Order.”</p>
<p>Technically, Trump’s filing is stylized as a motion requesting leave — an effort to get permission from Chutkan to make a more formal argument for dismissal and to enjoin Smith from spending any more money on the Jan. 6 case. Still, the filing advances the request for both forms of relief in a combined bid for leave by arguing that Trump has shown statutory “good cause” to raise the issues around Smith’s authority and funding.</p>
<p>“Smith’s lack of standing cannot be ignored,” the motion goes on. “The Court does not have jurisdiction over a criminal prosecution maintained by someone other than an attorney for the United States, and so must address this issue.”</p>

<p>Former Alaska Gov. Sarah Palin, a Republican, is entitled to a new trial in her defamation case against the New York Times, partly because a jury finding of no liability was marred by push notifications received by jurors, a federal appeals court ruled Wednesday.</p>
<p>The 2nd U.S. Circuit Court of Appeals at New York said U.S. District Judge Jed Rakoff of the Southern District of New York wrongly intruded on the province of the jury <a href="https://www.abajournal.com/news/article/judge-says-he-will-toss-sarah-palins-defamation-suit-against-the-new-york-times-after-jury-verdict">when he ruled</a> during deliberations that the case should be dismissed because of insufficient evidence that the newspaper and one of its editors acted with actual malice.</p>
<p>Rakoff allowed the jury to issue a verdict anyway, and it found no liability. But the verdict was marred by some of Rakoff’s decisions and by push notifications that some jurors received about Rakoff’s finding of no actual malice, the appeals court said in its <a href="https://ww3.ca2.uscourts.gov/decisions/isysquery/02aff5e8-1f8a-439f-8de7-f010e2bda04f/4/doc/22-558_opn.pdf">Aug. 28 opinion</a>.</p>
<p><a href="https://www.law360.com/publicpolicy/articles/1874263">Law360</a> covered the 2nd Circuit’s decision in favor of Palin, a Republican who was the 2008 vice presidential candidate. She had sued over a June 2017 editorial linking the shooting of a Democratic congresswoman with a digital crosshairs graphic published by Palin’s political action committee.</p>
<p>Rakoff’s law clerk had learned about the push notifications when interviewing jurors following the verdict to see whether they had problems understanding the legal instructions.</p>
<p>A push notification from a news application can appear at the top of a cellphone or on a lockscreen even when the app is closed, the 2nd Circuit explained.</p>
<p>Jurors said they were not prejudiced by the push notifications, which were “an unfortunate surprise” to Rakoff, the appeals court said. But Rakoff was wrong in concluding that the jury verdict was not prejudiced, the appeals court concluded.</p>
<p>“Given a judge’s special position of influence with a jury, we think a jury’s verdict reached with the knowledge of the judge’s already-announced disposition of the case will rarely be untainted, no matter what the jurors say upon subsequent inquiry,” the 2nd Circuit said. “We therefore conclude that a new trial is warranted on this basis.”</p>
<p>The 2nd Circuit panel also said Rakoff erred by excluding some evidence offered by Palin and by improper jury instructions.</p>
<p>The New York Times editorial had linked a 2011 shooting that wounded then-U.S. Rep. Gabby Giffords, a Democrat from Arizona, to a map by Palin’s political action committee showing targeted electoral districts in a crosshairs. Six people were killed in the shooting, including a federal judge.</p>
<p>The New York Times had declared that “the link to political incitement was clear,” even though the attack was viewed as stemming from the perpetrator’s mental illness, according to the 2nd Circuit.</p>
<p>The New York Times later issued corrections saying the crosshairs were placed over targeted electoral districts, not photos of politicians, and saying there was no established link between political rhetoric and the shooting.</p>
<p>Palin sued the New York Times and James Bennet, then the editorial page editor, who had written the sentence about the link to political incitement being clear.</p>
<p>The 2nd Circuit said Rakoff should have allowed evidence that Bennet’s brother, Michael Bennet, was a Colorado Democratic U.S. senator, that Bennet was involved in his brother’s 2010 reelection bid, that the crosshairs map targeted the districts of two Democrats in the House of Representatives who endorsed Bennet’s brother, and that Palin had endorsed the person running against Sen. Bennet.</p>
<p>The appeals court said the evidence was relevant, and it could lead a reasonable juror to infer that Bennet had “a reason to personally dislike Palin, and that it was therefore more likely that he intentionally or recklessly, rather than inadvertently, connected her” to the shooter who wounded Giffords.</p>
<p>Rakoff should also have allowed introduction of three prior New York Times opinion articles that could “be plausibly read” as casting significant doubt on links between the shooting and the crosshairs map, the 2nd Circuit said. Bennet had testified that he “must have read” the prior articles.</p>
<p>Judge John M. Walker Jr., an appointee of former President George H.W. Bush, wrote the panel opinion. It was the second time that the 2nd Circuit ruled in the case. Rakoff had previously tossed the case without a trial, but the appeals court <a href="https://www.abajournal.com/news/article/2nd-circuit-reinstates-sarah-palins-defamation-suit-against-the-new-york-times">ruled in 2019</a> that he followed the wrong procedure and reinstated the lawsuit.</p>
<p>The case is <em>Palin v. New York Times Co</em>.</p>

<p>One day after federal prosecutors <a href="https://lawandcrime.com/high-profile/this-argument-is-footless-feds-slam-bannons-attempt-to-read-tea-leaves-and-get-out-of-prison-early/" target="_blank" rel="noopener">said his arguments in favor</a> of an early prison exit were “footless,” former White House chief strategist <a href="https://lawandcrime.com/?s=steve+bannon" target="_blank" rel="noopener">Steve Bannon</a> is trying to “take advantage” of the First Step Act, criminal justice reform signed into law and “<a href="https://trumpwhitehouse.archives.gov/briefings-statements/president-donald-j-trump-championed-reforms-providing-hope-forgotten-americans/" target="_blank" rel="noopener">championed</a>” by then President <a href="https://lawandcrime.com/?s=donald+trump" target="_blank" rel="noopener">Donald Trump</a>, in a bid for some leniency on his punishment for the “non-violent” offense of stonewalling the Jan. 6 Committee.</p>
<p>The Friday <a href="https://storage.courtlistener.com/recap/gov.uscourts.dcd.237437/gov.uscourts.dcd.237437.203.0.pdf" target="_blank" rel="noopener">reply from</a> Bannon, which <a href="https://lawandcrime.com/high-profile/steve-bannon-asks-trump-appointed-judge-to-get-him-out-of-prison-by-reinstating-bail-or-via-supervised-release-citing-recent-developments-and-significant-events/" target="_blank" rel="noopener">comes weeks after</a> he asked U.S. District Judge Carl Nichols to reimpose bail pending appeal based on “significant events,” reiterated that the federal inmate’s contempt of Congress stint behind bars should end <a href="https://lawandcrime.com/high-profile/steve-bannon-reports-to-prison-release-expected-just-ahead-of-election-day/" target="_blank" rel="noopener">before Election Day</a>.</p>

<p>But in the event that Nichols doesn’t want to go that far, Bannon alternatively proposed a “brief period of supervised release, in conjunction with a brief sentence reduction if necessary,” so he “could take advantage of First Step Act earned-time credits available to nearly every other inmate serving time for non-violent offenses.”</p>
<p>“Having to wait thirty days for the BOP to refuse to seek such relief, as the government insists here, would force Mr. Bannon to wait for nearly the entirety of the remainder of his sentence—time that he could otherwise serve on supervised release under the First Step Act,” the reply said. “Having to wait to exhaust BOP remedies would thus effectively preclude Mr. Bannon from being able to obtain any meaningful relief from this Court.”</p>
<p>Bannon was convicted by a jury in July 2022 on two counts of contempt of Congress for defying a subpoena for documents and a deposition, and he was subsequently sentenced to four months in prison. At first, Nichols allowed Bannon to remain free as he appealed his sentence and conviction. When the <a href="https://lawandcrime.com/high-profile/supreme-court-rejects-steve-bannons-last-ditch-attempt-to-stay-out-of-prison-he-must-report-monday/" target="_blank" rel="noopener">Supreme Court declined </a>to stop Bannon’s incarceration, however, Bannon spoke outside of prison walls in Connecticut on July 1 and <a href="https://www.youtube.com/watch?v=DI1E4TNPM8g" target="_blank" rel="noopener">declared</a>, “I’m proud to go to prison.”</p>
<p>On Thursday, federal prosecutors called the bail or supervised release asks baseless.</p>
<p>“The defendant shows no basis for the Court to reverse its earlier ruling lifting the stay of his sentence, a ruling that both the D.C. Circuit and the Supreme Court have effectively endorsed,” prosecutors said. “He also fails to justify modifying his sentence to impose a period of supervised release.”</p>
<p>Prosecutors, writing that Bannon “fails to overcome the presumption of detention pending appeal” and provided Nichols no reason to disturb his prior ruling based on the hope that maybe the whole U.S. Court of Appeals for the D.C. Circuit will rehear Bannon’s case.</p>
<p>“There is no basis to conclude from the pendency of the defendant’s rehearing petition that it is ‘very likely’ the D. C. Circuit will either grant rehearing en banc or deny rehearing with a dissent,” the government said. “The defendant shows no basis to assume that the D.C. Circuit is not simply dealing with a heavy workload after a summer recess and certainly offers no support for his speculation that he will receive rehearing en banc.”</p>
<p>“At bottom, the defendant’s attempt to ‘read tea leaves’ does not establish any basis for the Court to release a defendant whom this Court, the D.C. Circuit, and the Supreme Court have ruled must be detained,” prosecutors added.</p>
<p>Bureau of Prison records show that Bannon, 70, is slated to be released from <a href="https://www.newstimes.com/news/article/famous-inmates-danbury-prison-ct-bannon-19519943.php" target="_blank" rel="noopener">FCI Danbury </a> on Oct. 29.</p>
