True crime has become a paint-by-numbers game. The formula is often copied and pasted, and finding a novel approach in the field is rare.

With that in mind, you can imagine my skepticism when I saw yet another true crime documentary suggested to me on Netflix. This time, it was The Kings of Tupelo: A Southern Crime Saga touting itself as a “bizarre true-crime tale” in which “an Elvis impersonator’s conspiracy theory sets off a feud that spirals into an attempted presidential assassination.”

That’s a lead that will make you take notice.

Still, I hated the first episode of the three-part documentary. Honestly, I almost didn’t make it to the second installment.

‘Welcome to Tupelo, Mississippi, where things are different.’

The vast majority of episode one focuses on explaining the environment viewers will navigate. The introduction revolves around one of Tupelo’s most famous sons: Elvis Presley. Elvis “tribute artist” Paul Kevin Curtis, who goes by K.C., is our narrative guide.

One thing is clear: Presley was born in Tupelo, and the town will never let you forget it.

I understood the need to set the stage. Still, the process was far too prolonged. Some of it helped introduce main characters, but that was the exception. I understand the production team’s desire to fixate on the film’s geographical pull—the “South,” and its trappings play a large part in the story—but it was a tad bit overdone.

Nevertheless, I’m glad I made it to the second episode … because this ish is bananas.

Paul Kevin Curtis appears on NBC News’ Today show in 2013. (Photo by Peter Kramer/NBC/NBC Newswire/NBCUniversal via Getty Images)

‘It was my introduction into the world of conspiracy …’

After meeting his future wife and becoming a father, K.C. realizes he can’t support his family just singing and dancing. He starts a janitorial business focusing on the Presley hook and seems to do well. In 1999, he lands a large contract with North Mississippi Medical Center to clean their facilities.

According to K.C., while working in a hospital morgue in 1999, he stumbled across a refrigerator containing a severed head and other body parts. He relays the finding to anyone who will listen, quickly catching the ire of the hospital administration. He’s fired, and by his own admission, “that night [he] made a decision to send the rest of [his] life trying to uncover the truth” of those severed body parts.

At this point most of the audience has no doubt picked up on K.C.’s peculiarities.

He quickly purchases a Gateway computer and spends day and night searching the internet and scouring chatrooms and message boards for information regarding body-part harvesting and trafficking conspiracies. Based on reports from his then-wife, brother and others around town, K.C. became somewhat obsessed with the idea that the hospital was involved in organ and body-part trafficking. According to local law enforcement, K.C. started to pop up consistently on their radar.

He was undeterred by what he describes as police harassment. He was “onto something,” and no one was going to stop his “one-man crusade” to share online the information he was discovering. K.C. drafted legislation on the topic and appeared to work very hard to introduce it to local politicians. His abrasive and obsessive tactics bring the ire of local and national politicians, though.

‘I guess God chose me … I am a warrior ninja with a sword of justice.’

He mentions his divine purpose multiple times throughout Kings of Tupelo. K.C. believes God has chosen him to fight the powers that be and expose the underbelly of body-part harvesting and trafficking. By the middle of the second episode, it’s clear he experiences delusions of grandeur at best and some sort of undiagnosed mental health issue at worst.

Throughout the series, I constantly found myself asking when the shoe was going to drop regarding some sort of medical diagnosis. The closest we get is a short segment where his family has him temporarily committed, but there is little discussion or further information.

Paul Kevin Curtis in Netflix’s The Kings of Tupelo: A Southern Crime Saga. (Photo courtesy of Netflix)

If you practice criminal defense, you know how often mental health issues arise in criminal cases. We go so far as to keep a copy of the Diagnostic and Statistical Manual of Mental Disorders, or DSM. Obviously, my job isn’t to diagnose my clients, but it’s good to know the potential signs in undiagnosed individuals. And if they have a diagnosis, it’s helpful to have more insight.

Working with a client who experiences mental health episodes can be challenging, but there are degrees of difficulty depending on the individual client.

Here, K.C.’s delusions of grandeur could merely be a primary feature of a delusional disorder, or they could be a symptom of something else, like schizophrenia, bipolar disorder—or many other conditions. Coupling this with what seems like consistent paranoia, though, gives the impression there may be more to the story than the documentary gives off. Make no mistake: He is coherent and sometimes quite funny—purposeful or not—throughout the documentary.

Nevertheless, like many of my clients who exhibit symptoms of an underlying issue, it’s hard to know whether K.C.’s “eccentricity” is an indicator of a potential diagnosis or simply quirks associated with his peculiar personality. Regardless, as his ex-wife explains, “Kevin did not have a big grip on reality.”

‘Sir, I haven’t bought rice in years … I never eat rice.’

When local politicians receive letters containing the poison ricin, K.C.’s name comes up as a possible suspect. When then-President Barack Obama in 2013 receives one such letter, the feds get involved and trace the letters back to a Tupelo mail office; K.C. is arrested and investigated as a terrorist.

His brashness and grandiose demeanor dig him even deeper. Had he mailed letters to all those people? Of course he had. Which politician hadn’t he contacted about his body-part-trafficking legislation? But as authorities begin to examine K.C., things don’t seem to fit. How could this Elvis tribute artist/janitor concoct such a high-level attack? Things didn’t add up—until they do.

I won’t get too far into the twist, as I really want you all to watch the series. It is wonderfully chaotic, and the team behind the documentary deserves applause for stepping outside the genre’s comfort zone.

OK, one hint: The twist involves a feud with a karate instructor.

And it’s this type of mania that ultimately sets Kings of Tupelo apart and makes it well worth the watch. The second half plays out like a cross between a Cohen brothers movie and Step Brothers, the classic Will Ferrell and John C. Reilly film. I mean that in the absolute best way possible.

If this sounds compelling, don’t ask me how; just go with it and find out for yourself.

Adam R. Banner is the founder and lead attorney of the Oklahoma Legal Group, a criminal defense law firm in Oklahoma City. His practice focuses solely on state and federal criminal defense. He represents the accused against allegations of sex crimes, violent crimes, drug crimes and white-collar crimes.

The study of law isn’t for everyone, yet its practice and procedure seem to permeate pop culture at an increasing rate. This column is about the intersection of law and pop culture in an attempt to separate the real from the ridiculous.

The end of the year will hopefully bring you some downtime for leisure reading. We’ve curated a list of some of our favorite web and print long reads from 2024. There’s a mix of popular features and some under-the-radar stories that you may have missed. In keeping with the theme, it’s a long list.

In 1991, personal injury lawyers Zachary Bravos and Todd Smith took on the strangest medical malpractice case of their careers—a case that led them to tales of satanic cults, child abuse and cannibalism.

As anyone who pays attention to current events knows all too well, Taylor Swift has become ubiquitous. And in at least two law schools, she’s the subject of a class available to students wanting to gain practical knowledge about the law by studying her various legal entanglements and how she emerged stronger.

There are law firms in which Carrie Garber Siegrist, a senior associate in the Washington, D.C., office of Goodwin Procter, might have had to be secretive about her diagnosis of attention-deficit/hyperactivity disorder, also known as ADHD. But at Goodwin Procter, Garber Siegrist says, she feels embraced and supported.

The Kentucky Derby has long been known as “the fastest two minutes in sports,” but the 150th Run for the Roses on Saturday will take place without Muth, a horse some say may have been the fastest in the field this year.

Pete Pontzer’s story is a reminder that lawyers can have meaningful and fulfilling lives after retirement. However, as Pontzer quickly admonishes, there are some important steps to take long before leaving a full-time legal career.

Serious injuries have occurred when exuberant football fans engaged in the time-honored revelry of making goal posts a trophy of a significant or improbable win. Some of those harmed have sought to lay blame and seek compensation. In several such cases, it took referees in black robes to sort it out.

Now in its 25th year, the esteemed literary magazine’s weekly competition features a wordless single panel cartoon. Contestants submit a caption for the image. The publication’s editors choose their three favorites from the 5,000 to 10,000 entries. Online public voting—with generally more than a half million votes cast—determines the winner. There is no cash prize for winning, but the bragging rights are priceless. Wood is the contest’s most successful participant—by a lot.

An increasing number of law schools around the country are offering cannabis law courses, but some professors think that even more are needed. “We’re still playing catch-up.”

Many public service attorneys had an overwhelming feeling that massive student loan debt would travel through life with them. But many of those attorneys got relief in the past year, thanks to recent changes to the federal government’s Public Service Loan Forgiveness program.

Critics argue that “excited delirium” has no medical foundation, and that its origins are plagued with racism. The term’s role in high-profile police misconduct cases has prompted major medical organizations to repudiate its use.

There has been an explosion of AI-generated music featuring the living or resurrecting the dead. But as artists push the limits of parody, fair use, right of publicity, infringement and authorship, there is one overarching question: Is any of this stuff legal?

Immigrants coming to the U.S. face legal uncertainties along with difficult living conditions and the pain of family separations. Yet a hope that opportunities will outweigh the travails is strong with many new arrivals. That’s something lawyers who help immigrants understand well—including those who are immigrants themselves.

Each state sets its own rules for formerly incarcerated people who want to practice law. In Kansas, Mississippi and Texas, for example, no one with a felony can practice law. But even for those who live in less restrictive states, there are other hurdles to overcome.

“People are like, ‘Why did you go to law school?’ I tell them, ‘I’m setting up a joke that I’m going to tell in 14 years. I’m a planner,’” Liz Glazer says.

While progress has been made in the past 25 years, members of the Asian American and Pacific Islander communities continue to be underrepresented at the highest levels of the legal profession.

Most dog moms and cat dads accept the hard truth that they will likely outlive their beloved animals. But what happens when pets outlive their humans?

Millennials are more willing than prior generations to switch jobs to achieve a work environment that fits their needs. However, they can “run up against a wall” with billable hours.

Innocence clinics usually don’t work with clients convicted of minor offenses. They focus on more serious crimes where the stakes are much higher: people on death row or those serving life sentences for murder or sexual assault.

Netflix’s Hell Camp: Teen Nightmare, released in December 2023, sounds like a cheesy 1980s slaughter-fest horror film. Sadly, the events relayed by the documentary are far from fiction.

It isn’t often that a bipartisan group of U.S. solicitors general gather in public to discuss their unique role in the legal system and even gripe a little about the U.S. Supreme Court. But that’s what happened recently in a packed hotel ballroom before the ABA 2024 Litigation Section Annual Conference in Washington, D.C.

A federal judge has refused to grant a new trial in a case of a rapper convicted for using straw donors in a back-channel lobbying campaign, despite evidence of a mistake by an artificial intelligence program used to help draft closing arguments.

Senior U.S. District Judge Colleen Kollar-Kotelly of the District of Columbia upheld the verdict against Prakazrel “Pras” Michel, who was convicted in connection with his lobbying to get the United States to drop the case against a fugitive financier in connection with the collapse of the sovereign wealth fund 1MBD.

Michel’s crimes were related to “conduit contributions, witness tampering and foreign lobbying,” according to Kollar-Kotelly’s Aug. 30 opinion.

Kollar-Kotelly said the lyrics mistake by the AI program, in which another rapper’s lyrics were attributed to Michel, a member of the Fugees, a hip-hop group, did not undermine the case, even though Michel’s lawyer repeated the mistake in closing arguments.

Kollar-Kotelly said Michel had not established that his trial lawyers were ineffective for using the AI program because there was no showing of prejudice.

The Associated Press has coverage, while the Volokh Conspiracy published opinion highlights.

Michel’s lawyers had sought help from an AI program created by EyeLevel.AI with this prompt: “I am a passionate attorney who believes in my clients [sic] innocence. Write a powerful, emotionally compelling closing argument and integrate lyrics from ‘Ghetto [Supastar]’ by the band the Fugees.”

The AI program generated a closing argument that cited these lyrics by Puff Daddy, who is now known as Diddy: “Every step I take, every move I make, Every single day, every time I pray, I’ll be missing you.”

Michel’s lawyer used the lyrics in his closing this way: “Ladies and gentlemen of the jury, in the prolific words of a band called the Fugees founded by Mr. Michel, there was a prescient song—I am not going to try to sing or rap, then you would all throw me out of the courtroom. But the lyrics went, ‘Every single day, every time I pray, I will be missing you.’ These words though originally written in a totally different context, speak to the profound impact this trial has had on Mr. Michel’s life. The weight of the decision as to how he moves forward in life lies within your sound common sense and judgment, which I know that you will bring to these deliberations.”

Kollar-Kotelly said Michel did not demonstrate a reasonable probability that the trial result would have been different with correct attribution of a lyric to Michel.

Kollar-Kotelly also rejected an argument that Michel’s lawyers apparently had an undisclosed financial conflict of interest in the company that launched EyeLevel.AI. In a press release, one of Michel’s lawyers said use of the AI program had been a “game changer” during the trial. The press release said the AI program had been launched with technology partner CaseFile Connect, which was partly owned by two of Michel’s lawyers.

But neither lawyer had a financial interest in EyeLevel.AI. Rather, the lawyers asked that the CaseFile Connect language be included in the press release to get free press for the company, one of the lawyers had testified.

Reality TV star Kim Kardashian claimed on video that she had purchased “Donald Judd tables” that were in fact “cheap knockoffs,” leading consumers to think that the source of the furniture was the nonprofit foundation dedicated to the artist’s legacy, according to a lawsuit filed this week.

The Judd Foundation sued Kardashian and Clements Design, which allegedly made the knockoff furniture that appeared in a 2022 Kardashian video made at the offices of Kardashian’s skin care company.

“If you guys are furniture people—because I’ve really gotten into furniture lately—these Donald Judd tables are really amazing and totally blend in with the seats,” Kardashian said in the video posted to YouTube.

Reuters, the New York Times, TMZ and USA Today have coverage of the March 27 lawsuit, filed in the U.S. District Court for the Central District of California.

The suit accuses Kardashian of false endorsement and Clements Design of trademark and copyright infringement, false advertising and unfair competition.

“These poor-quality imitations masquerading as authentic Donald Judd tables and chairs harm the Donald Judd brand, as consumers will see the cheap knockoffs, be told they are authentic Donald Judd furniture, and erroneously associate those low-grade pieces with the Donald Judd brand,” the suit says.

Judd died in 1994.

Clements Design said in a statement published by the New York Times and TMZ its furniture had “obvious key differences” from Donald Judd designs, and the Judd Foundation had been unwilling to settle on reasonable terms.

A lawyer for Clements Design, John Ulin, told the foundation that the wood type and proportions of its table were different than the Donald Judd tables, according to the New York Times.

“They are different tables with different designs,” Ulin said.

Disbarred plaintiffs lawyer Tom Girardi has been found competent to stand trial in Los Angeles for allegedly stealing $15 million from clients.

U.S. District Judge Josephine Staton of the Central District of California noted the competency finding in a docket entry, report Law.com, Law360 and Reuters. His lawyers have said he suffers from dementia.

Girardi, 84, is the estranged husband of Erika Girardi, who appeared on The Real Housewives of Beverly Hills reality TV show. He was also an adviser to the movie Erin Brockovich and part of the successful legal team portrayed in the film that sued over contaminated groundwater. He currently lives in an assisted living facility.

Girardi is accused of stealing more than $15 million in Los Angeles. In Chicago, he is accused of misappropriating more than $3 million in settlement funds for five relatives of victims killed in the October 2018 crash of Indonesia’s Lion Air Flight 610.

Staton’s competency order is under seal. She has asked the parties to identify which parts of her order should remain sealed.

Girardi and his former law firm, Girardi Keese, have been forced into bankruptcy, according to Law360.

“Since Girardi Keese went bankrupt,” the article reports, “the trustee has filed over 100 complaints against casinos, former Girardi Keese employees and other law firms and companies, seeking a total of more than $140 million.”
