<p>A <a href="https://lawandcrime.com/tag/utah/">Utah</a> jury determined a 28-year-old man acted with “depraved indifference” when he drove 120 mph while high on methamphetamine and plowed through horse stables where he hit and killed two toddlers who were playing with toy trucks.</p>
<p>Kent Cody Barlow was convicted Friday of depraved indifference <a href="https://lawandcrime.com/tag/homicide/" target="_blank" rel="noopener">homicide</a> in the deaths of 3-year-olds Odin Ratliff and Hunter Jackson. Barlow on May 2, 2022, was driving recklessly and ignoring his passengers’ repeated pleas for him to slow down as he was sped along Tiffany Lane in Eagle Mountain, which is about 30 miles northwest of Provo. He lost control and crashed into the Cedar Valley Stables, the Utah County Attorney’s Office said in a <a href="https://atty.utahcounty.gov/administration/media/28" target="_blank" rel="noopener">press release</a>.</p>

<p>Michael Starrs, deputy Utah County attorney, told jurors in his closing argument the boys were having a great time playing with each other, picking up chicken eggs and chasing cats, according to a courtroom report from <a href="https://www.ksl.com/article/51301468/jury-finds-man-who-killed-eagle-mountain-boys-guilty-of-murder" target="_blank" rel="noopener">local NBC affiliate KSL</a>. But that fun turned into tragedy when Barlow floored the accelerator, traveling 120 mph in a 45 mph zone and headed toward the stables despite seeing all the activity there.</p>
<p>“The signs of life were there,” Starrs said. “The signs of life were ignored. The signs of life were obvious. They weren’t hidden, they weren’t concealed. We know that Kent Barlow would have seen all those cars.”</p>
<p>Prosecutors also pointed out he had previously been convicted of driving over 100 mph some three years before the fatal crash and ignored a judge’s warning that his speeding could prove deadly.</p>

<p>Barlow’s attorney Justin Morrison conceded that his client was high and behind the wheel, but argued he did not mean to lose control of the car and certainly had no intention of hitting the boys. Barlow is not “a cold-blooded killer,” Morrison said.</p>
<p>But for the families of Odin and Hunter, there was never a question of the defendant’s guilt.</p>
<p>“Hearing the words guilty of depraved indifference murder is what we’ve been fighting for,” Odin’s mother Theresa Ratliff told KSL after the verdict. “That’s what we got because that is what he is guilty of.”</p>
<p>Barlow is slated to be sentenced on June 30. He faces 15 years to life in prison.</p>

<p>The scene inside a <a href="https://lawandcrime.com/tag/colorado/" target="_blank" rel="noopener">Colorado</a> courtroom looked a grim picture of human action on Friday as a young and condemned man testified to his onetime best friend’s alleged glee in violence.</p>
<p>Joseph Edwin Koenig, 20, was a high school senior, but 18 years old, when he and two friends were charged with “<a href="https://lawandcrime.com/crime/teens-under-arrest-after-alexa-bartell-death-from-rock-throwing/" target="_blank" rel="noopener">extreme indifference</a>” murder over the April 19, 2023, death of <a href="https://lawandcrime.com/crime/20-year-old-driver-killed-while-on-phone-with-friend-as-landscaping-rock-larger-than-a-softball-smashes-through-her-windshield/" target="_blank" rel="noopener">Alexa Bartell</a>, 20.</p>
<p>On the day in question, the windshield of the victim’s Chevy Spark was struck and smashed by what authorities termed a “large landscaping rock.” The impact sent the young woman’s car careening “off the roadway” on a remote stretch of road in Jefferson County.</p>
<p>Bartell died a horrible death in the ensuing crash; <a href="https://www.youtube.com/watch?v=-AFEwxpueSk" target="_blank" rel="noopener">prosecutors previously testified</a> the victim’s brain was found in her backseat.</p>
<aside class="o-callout__recirculate o-callout"/>
<p>“There was biological matter on the roadway,” a deputy sheriff who led the murder probe testified during a hearing in <a href="https://lawandcrime.com/crime/there-was-biological-matter-on-the-roadway-investigator-testifies-20-year-old-driver-died-from-massive-trauma-to-the-head-but-doesnt-know-which-high-schooler-threw-landscaping-rock/" target="_blank" rel="noopener">October 2023</a>.</p>
<p>In May 2024, two codefendants in the case, <a href="https://lawandcrime.com/crime/rock-throwing-high-school-student-admits-murdering-alexa-bartell-second-domino-to-fall-in-the-case/" target="_blank" rel="noopener">Nicholas “Mitch” James Karol-Chik</a>, and <a href="https://firstda.co/news-update/zachary-kwak-pleads-guilty-in-rock-throwing-attacks/" target="_blank" rel="noopener">Zachary Kwak</a>, pleaded guilty to lesser crimes, and substantially lesser crimes, respectively. They both agreed to testify against Koenig during his jury trial in Jefferson County District Court.</p>
<p>Each of <a href="https://lawandcrime.com/crime/our-first-look-at-the-high-school-seniors-accused-of-reckless-indifference-murder-in-rock-throwing-death-of-20-year-old-alexa-bartell/" target="_blank" rel="noopener">the codefendants</a>, to varying degrees, played instrumental parts in the rock-throwing that night. But Karol-Chik was admittedly more culpable than Kwak, having also taken part in additional such attacks in February 2023 and even days before in early April 2023.</p>
<p>On Friday, Karol-Chik told jurors Koenig let out an excited whoop as he saw Bartell’s compact car drive off Indiana Street and through a fence in a field near the Rocky Flats National Wildlife Refuge, according to a courtroom report by the <a href="https://www.denverpost.com/2025/04/18/alexa-bartell-rock-throwing-trial-murder-joseph-koenig/" target="_blank" rel="noopener">Denver Post</a>.</p>
<p>“He was excited,” the witness told the jury, referring to the defendant. “He would just look at us with this big smile on his face.”</p>
<p>On that fateful night, several landscaping rocks were thrown at other cars, both in motion and parked. But some claimed details are mixed.</p>
<p>Kwak maintains he did not throw any of the rocks at all that night, according to the <a href="https://www.denverpost.com/2025/04/17/colorado-jeffco-rock-throwing-spree-alexa-bartell-trial/" target="_blank" rel="noopener">Post</a>. Instead, Kwak earlier testified he only collected the rocks from multiple parking lots and then handed them over to the two front-seat passengers, who threw them.</p>
<p>The speedometer in the teenagers’ vehicle was 103 mph just before the 9.3-pound rock was thrown that took Bartell’s life, Kwak also previously testified. Karol-Chik, however, said the car was doing 80 mph. Both men said Koenig sped up before the final, fatal attack.</p>
<p>Karol-Chik went on to say the celebratory whooping and smiles were in line with how the trio had generally acted over the thrown rocks that night; when a rock struck a car, they would express delight; when a rock missed a car, they would express disappointment.</p>
<p>“We only thought of them as cars,” the witness continued. “But we never thought of who may be driving them.”</p>
<p>Each of the defendants was initially charged with first-degree murder, attempted murder, assault in the second degree, and attempted second-degree assault. Kwak took a plea deal on three assault charges: one count of first-degree assault on Bartell and two counts of second-degree assault for attacks on three other victims. Karol-Chik pleaded guilty to one count of second-degree murder.</p>
<p>Even with plea deals, Karol-Chik and Kwak face decades behind bars; they are slated to be sentenced on May 1 and May 2, respectively.</p>
<p>Koenig, for his part, has conceded some responsibility. His lawyers insist he should only be convicted of manslaughter because none of the rock-throwers had the intent to kill, or even harm, anyone else.</p>
<p>The defense is also hinging some hopes on long-inconsistent statements from Karol-Chik, who for several months told prosecutors that Kwak was the one who threw the rock that killed Bartell.</p>
<p>Only during a fourth and final proffer interview — an interview in service of a plea deal — did Karol-Chik finally tell investigators Koenig was the person responsible for the woman’s death.</p>
<p>At the time, he and Koenig were best friends and “almost close enough to be brothers,” Karol-Chik reportedly told the jury. The lies came during three out of four proffer interviews, because Koenig and Karol-Chik agreed to pin the crime on Kwak, who they barely knew, during a discussion after seeing emergency vehicles later that night.</p>
<p>“We went over everything that happened and it was at that time that Joe said to me that we wouldn’t have to worry about it, we’ll just say that Zach did it,” Karol-Chik testified on Friday.</p>
<p>On cross-examination, however, Karol-Chik also said he long believed Kwak had actually thrown the rock, according to the <a href="https://www.denverpost.com/2025/04/18/alexa-bartell-rock-throwing-trial-murder-joseph-koenig/" target="_blank" rel="noopener">Post</a>.</p>
<p>The witness testified he remembered remarking on the sheer size of the rock, recalling he told Kwak it was too big to throw and being rebuffed. Karol-Chik went on to say he remembered Kwak saying he would throw the rock if Karol-Chik would not.</p>
<p>Then, the state worked to clean things up a bit.</p>
<p>“Was the truth that Joseph Koenig threw the rock that killed Alexa Bartell?” a prosecutor asked on redirect.</p>
<p>Karol-Chik replied in the affirmative.</p>
<p>This coming week, jurors will decide who and what to believe. Closing arguments are scheduled to end by April 21.</p>

<p>Michael Dietz was not shy about his alleged actions when <a href="https://lawandcrime.com/tag/ohio/" target="_blank" rel="noopener">Ohio</a> cops asked him about the <a href="https://lawandcrime.com/tag/vandalism/" target="_blank" rel="noopener">vandalism</a> at the home of a woman with whom he was involved in a car crash over a year ago.</p>
<p>“I f—ing spray painted a—hole on her house,” Dietz told Westlake cops, according to body camera video viewed by Law&amp;Crime.</p>
<p>“Why?” asked the cop.</p>
<p>“Because she’s an a—hole,” he retorted.</p>

<p>While in the patrol car on the way to jail, Dietz went further.</p>
<p>“That b— is lucky I didn’t go over with a .357 and start shooting the place up,” he proclaimed.</p>
<p>Now Dietz, 64, is facing charges of vandalism and aggravated menacing.</p>
<p>Officers in Westlake, a suburb of Cleveland, responded to the victim’s home on Thursday morning after she saw the damage to her home and vehicle. Ring camera footage showed a man arrive shortly before 5 a.m. and try to pour sugar down a SUV parked in her driveway, a criminal complaint said. He proceed to spray paint the word “a—hole” several times, though it was misspelled, police said.</p>
<p>While tagging the home, Dietz apparently saw the camera and spray painted over it, a video showed. Not even the University of Alabama flag in the front yard was spared.</p>
<p>When asked who may want to vandalize the property, the woman and her husband suggested Dietz. She and the suspect had been involved in a car accident in August 2023.</p>

<p>After Dietz allegedly admitted to being the perpetrator, he told cops he was “not happy” with how the crash was handled and he intended to sue the victim. He said he was still suffering from back pain.</p>
<p>Officers noticed a black backpack the suspect used at the scene as they were interviewing Dietz at his house.</p>
<p>“Upon inspection, the bag contained clear plastic gloves, a reusable Giant Eagle grocery bag, sugar residue, and a blue funnel. These items are consistent with the tools and evidence left at the scene,” cops wrote.</p>
<p>Police arrested Dietz without further incident. It’s unclear if he has a lawyer or when he is next scheduled to appear in court. The case will be sent to a grand jury where he may face additional charges.</p>
<p>Westlake cops were incredulous that a man of Dietz’s age would allegedly commit such an act.</p>
<p>“You would expect maybe a kid or a young young adult would do something like this. Not thinking things through fully. But this was a 64-year-old man who should definitely know better,” Capt. <p>A mother in <a href="https://lawandcrime.com/crime/i-shot-him-in-the-head-dude-man-tells-911-dispatcher-to-come-look-after-murdering-roommate-with-shotgun-blast/" target="_blank" rel="noopener">Minnesota</a> is heading to prison for murdering her 23-month-old son by slamming his head repeatedly into a bedroom wall and then lying to police about what happened, claiming he was run over by his father — who happened to have his car in the shop at the time.</p>
<p>“She took my baby’s life,” said Robert Ortez, father of Aaryan, who was killed by his mom Larena Jackson in August 2023. “I still don’t know, to this day, what really happened because she isn’t saying anything,” Ortez told <a href="https://www.valleynewslive.com/2025/02/17/she-deserves-life-prison-father-toddler-murdered-by-cass-lake-woman-speaks-out/" target="_blank" rel="noopener">Valley News Live</a>. “I’m still trying to figure out why she did it. I don’t know why[.]”</p>

<p>Jackson, 31, was sentenced Monday to nearly 20 years in prison after she pleaded guilty in February to <a href="https://lawandcrime.com/tag/2nd-degree-murder/" target="_blank" rel="noopener">second-degree murder</a> for her son’s death. She claimed in her written plea petition that she was intoxicated the day she fatally injured Aaryan by way of blunt force trauma.</p>
<p>“I was so under the influence of drugs, I did not know what was doing at the time of the crime and am entering this plea on Norgaard basis,” Jackson said, according to Valley News Live. A Norgaard plea allows Minnesota defendants to admit to a crime and to the strength of the prosecution’s case while also admitting that they cannot remember specific facts due to intoxication or other memory loss.</p>
<p>On the day Aaryan was fatally injured, the Cass County Sheriff’s Office got a report of a child who had been run over by a car. Jackson had called police and claimed it was Ortez who murdered the boy, not knowing that his car was being worked on.</p>

<p>“I had a car in the shop that I supposedly ran over Aaryan with, but I had a different car I was driving,” Ortez told Valley News Live.</p>
<p>A search of Jackson’s home turned up large amounts of blood scattered throughout her Cass Lake residence and investigators also reported finding large holes in the wall consistent with the shape of a toddler’s head. Aaryan died in the hospital five days later.</p>
<p>In addition to murder, Jackson was also charged with first-degree assault, malicious punishment of a child and fleeing a peace officer. She was sentenced to serve at least 17 1/2 years with credit for 581 days served.</p>
<p>“She deserves life in prison,” Ortez concluded.</p>

<p>A <a href="https://lawandcrime.com/tag/michigan/" target="_blank" rel="noopener">Michigan</a> man who accidentally left his 3-year-old son to die inside of a hot car for several hours last summer may, in the end, avoid significant jail time altogether, a judge ruled this week.</p>
<p>In January, Chad Martin, 36, pleaded guilty to one count of leaving a child in a vehicle causing death.</p>
<p>On Thursday, the judge overseeing the case <a href="https://lawandcrime.com/tag/sentenced/" target="_blank" rel="noopener">sentenced</a> Martin to spend nine months in the Kalamazoo County Jail — with two favorable conditions. First, the sentence is delayed to start until February 2026. Second, the judge also scheduled a conference for December of this year that could lead to the sentence being jettisoned entirely.</p>
<p>Regardless of his time behind bars, however, the defendant was sentenced to three years of probation that began this week.</p>

<p>The incident occurred on Aug. 16, 2023, when Martin left home with his two children in tow. The defendant dropped his daughter off at her day care, but forgot about his son, he would later tell investigators. Instead, Martin drove straight to work where he stayed from roughly 7 a.m. to 3 p.m. before getting back in the car to go grocery shopping.</p>
<p>The boy was discovered, lifeless, outside of a Family Fare supermarket in Vicksburg — a small village located just a few miles south of Kalamazoo — when his father arrived at the store. In sum, the boy was strapped into his car seat in the back for about nine hours.</p>
<p>The outside temperature peaked at 84 degrees that day in western Michigan, but the inside temperature of the vehicle was likely closer to 120 degrees because of the rolled-up windows, police said.</p>

<p>“The day that happened was the worst day of my life,” Martin said during the sentencing hearing, according to a courtroom report by Kalamazoo-based <a href="https://wwmt.com/news/arc/chad-martin-vicksburg-family-fare-toddler-death-court-crime-police-sentencing-kalamazoo-county-west-michigan" target="_blank" rel="noopener">CBS affiliate WWMT</a>. “I deserve whatever punishment I get.”</p>
<p>The Wolverine State, for its part, did not have an issue with the relatively lenient sentencing meted out to the father in this case.</p>
<p>“The Kalamazoo County Sheriff’s Office conducted a very thorough investigation so that we could feel confident in saying that this truly was an accident,” Kalamazoo County Prosecutor Jeff Getting told Grand Rapids-based <a href="https://www.wzzm13.com/article/news/local/vicksburg-father-who-went-work-found-toddler-dead-backseat-learns-sentence/69-22fa362f-a220-4685-a3f6-1b5a913cf293" target="_blank" rel="noopener">ABC affiliate WZZM</a>. “And I think it’s also important that we recognize that the child’s mother was supportive of this outcome, that the defendant not be sentenced to prison because of this. And I think that those are important distinguishing factors.”</p>
<p>The father explained that his daughter, who is a bit older, walks herself into her own day care while the boy would need to be carried in, according to court documents obtained by WZZM. Martin also said he “never checks the backseat when he gets to work” and that the children “always sleep in the vehicle en route to daycare.”</p>
<p>“I guess I went straight to work,” Martin told investigators.</p>

<p>The boy’s mother also spoke at the sentencing hearing — explaining the turmoil caused by a loss she knows was accidental but avoidable and admitting that she struggled with what Martin’s sentence should be.</p>
<p>“You will never know the true depth of the pain you caused,” Samantha Brown haltingly said through tears, according to WWMT. “There is no justice for my son or daughter or for me.”</p>

<p>A mother in <a href="https://lawandcrime.com/lawsuit/i-needed-to-go-back-to-my-kid-bank-fired-mom-who-asked-for-leave-to-take-care-of-dying-daughter-lawsuit-says/" target="_blank" rel="noopener">Michigan</a> was arrested last week for the death of her 18-month-old daughter, who <a href="https://lawandcrime.com/crime/deceased-for-several-days-11-year-old-boy-was-suffocated-by-manic-mom-who-rampaged-rv-park-police-say/" target="_blank" rel="noopener">suffocated</a> between the driver’s seat and front door of the woman’s <a href="https://lawandcrime.com/crime/teen-charged-with-intoxication-manslaughter-after-6-family-members-killed-in-wrong-way-head-on-collision-thc-wax-and-vape-pen-found-in-his-pickup-truck/" target="_blank" rel="noopener">pickup truck</a> after being left with three other kids while her mom grabbed lunch for her husband, police say.</p>
<p>Angelica Linda Arechiga, 27, of <a href="https://lawandcrime.com/crime/karma-has-no-expiration-date-victims-mother-rebukes-woman-who-shot-ex-to-death-and-took-child/" target="_blank" rel="noopener">Grand Rapids</a>, is charged with “child abuse: leaving a child in a vehicle resulting in death” for the October 2024 incident, according to local NBC affiliate <a href="https://www.woodtv.com/news/target-8/mom-charged-after-toddler-suffocates-in-parked-pickup/" target="_blank" rel="noopener">WOOD</a>. It’s reportedly the first time that the charge has been handed down to anyone in Kent County. The station spoke to Arechiga after her arrest last week about what allegedly happened that day to her daughter, Juliet Magdelena.</p>
<p>“I just want people to know that this was an accident,” Arechiga said while crying, per WOOD. “Yes, I could have done things differently that day. But I’ve learned from my mistakes. If I could go back in time to change things, I would, but I can’t.”</p>

<p>According to WOOD, Arechiga was arraigned last week in Grand Rapids District Court and released on a personal recognizance bond. She is accused of leaving her daughter unsupervised and “unrestrained” for 15 minutes in her pickup on Oct. 9 while it was parked in a grocery store parking lot near South Division Avenue and Hall Street.</p>
<p>“Angelica left Juliet, an 18-month-old child unattended in a vehicle for a period of 15 minutes unrestrained and with no adult supervision which posed an unreasonable risk of harm or injury to Juliet, causing her death,” her probable cause affidavit says, according to WOOD. Magdelena’s death was listed as “asphyxia by wedging” and the manner of death was reported as an accident, the station reports.</p>
<p>“Horrible things can happen when children are left alone in a vehicle for even a short period of time,” Kent County Prosecutor Chris Becker told WOOD.</p>
<p>Witnesses who were inside the grocery store where Arechiga left her car parked said she came rushing inside in a panic after coming out to find her daughter unconscious.</p>
<p>“She just comes in screaming,” a worker recalled, asking WOOD to remain anonymous. “We were confused … (the toddler) had Cheetos dust on her hands so we were like, ‘Maybe she was (choking) on her chips?’ So my cousin started patting her on the back but when her mom was able to talk, she was like ‘No, no …. she got her head stuck … and she’s not breathing.&#8221;”</p>
<p>First responders reported that the toddler’s pulse was “faint” when they first arrived on scene, according to WOOD. “It was the saddest thing,” the worker said. “When (the mom) said that (Juliet) was playing with her sister (in the truck), I thought the sisters were at least 6, 8 or 10 years old. But when they came out walking, they were like 4, 5, and there was a baby.”</p>

<p>An <a href="https://www.legacy.com/us/obituaries/name/julieta-magdalena-obituary?id=56556412" target="_blank" rel="noopener">online obituary</a> for Magdelena describes the child as a “loving and sweet baby” who was a “daddy’s girl.” Her mom is due to appear in court later this month.</p>
<p>“She was very smart and was already talking and practicing saying ‘thank you’ and ‘you’re welcome’ in Spanish,” the obituary says. “Julieta seemed to enjoy watching the world and taking in everything around her, silently watching and learning from everyone in her life.”</p>

<p>Police in <a href="https://lawandcrime.com/tag/texas/">Texas</a> say they believe a 25-year-old man put a 3-month-old in danger when he used the baby to wipe snow off a car as part of a stunt to go <a href="https://lawandcrime.com/tag/viral-video/" target="_blank" rel="noopener">viral</a> on TikTok.</p>
<p>A winter storm hit the Lone Star state last week, blanketing the region with snow. After observing the video online, Port Arthur Police Department and Child Protective Services started investigating, Beaumont <a href="https://www.12newsnow.com/article/news/crime/man-under-investigation-after-viral-video-of-using-baby-to-clean-snow/502-c0c20433-d070-4952-8cea-41ac2d365019" target="_blank" rel="noopener">ABC and NBC affiliate KBMT</a> reported. Police told the station they are trying to obtain an arrest warrant for child endangerment and the Jefferson County District Attorney’s Office could issue a warrant for the man’s arrest as soon as this week.</p>

<p>Videos tend to pop up on social media of parents using their young kids as a snow brush as a joke. This video showed the man taking the baby and wiping the car’s windshield to clear off the snow.</p>
<p>But the police chief is not laughing.</p>
<p>“It’s a sad situation. I know a lot of people go to social media and they are looking for clicks … but this is not a deal where you should put a baby on the windshield,” Port Arthur Police Chief Tim Duriso told the TV station.</p>
<p>Cops reportedly conducted a welfare check on the child when they were made aware of the video. They have since learned that the man was not the only one on the scene of the incident.</p>

<p>“He had two other females with him at the time. We suspect one of them was the mom. They checked on the baby. The baby was just fine,” said Duriso.</p>
<p>It’s not clear if the two other people could face charges.</p>

<p>McClatchy News <a href="https://www.charlotteobserver.com/news/nation-world/national/article299189895.html">reports</a> the video has since been taken down from TikTok.</p>
<p>Port Arthur is about 90 miles east of Houston along the Texas border with Louisiana.</p>

<p>A sheriff’s deputy who crashed on body camera lied by omission by initially hiding the fact that he was looking at porn at the time, says the Lake County Sheriff’s Office.</p>
<p>“Gosh darn it,” he said on footage after the crash. “Yeah, that f—ing really sucked.”</p>
<p>The internal affairs report from the Office of Professional Standards determined that he lied, was looking at porn on his phone while driving the patrol vehicle, and also failed to wear his seat belt.</p>
<p>Law&amp;Crime is not naming him because he has not been charged with a crime. The deputy resigned during the investigation, Cpl. Chanel Martin of the Lake County Sheriff’s Office told Law&amp;Crime in an email.</p>
<h3><strong>The crash</strong></h3>
<p>His bodycam from the afternoon of Nov. 6, 2024, shows him with his phone out, though it is unclear what it has on. But what is clear is that the yellow air bag bursts out.</p>
<p>He indicated to at least one passerby he was OK. He walked over to another vehicle that apparently got caught up in the crash. Law&amp;Crime is omitting this encounter because it shows the woman, but in it, the deputy is checking on her.</p>
<p>“Hello, ma’am,” the deputy tells the other driver in the video. “Are you OK? I’m so sorry.”</p>
<p>“It’s OK,” she said.</p>
<p>“My brakes locked up,” he said.</p>
<p>She said she was OK.</p>

<h3><strong>The internal affairs report</strong></h3>
<p>According to the internal affairs report, the deputy allegedly wrote that he ended a phone call when he saw a vehicle stopped in front of his because a school bus was stopped in the opposite lane with lights on.</p>
<p>On top of that, the light for his auto-brake system was on after he left speed calibrations at the IPS range, so his brakes locked up.</p>
<p>But a sergeant who reviewed video footage determined the deputy was looking at images on his phone when the crash happened.</p>
<p>The deputy allegedly described having finished a call with a colleague at the time of the crash.</p>

<p>“He went on to say that he was scrolling through text messages on his phone from a group text with his sector three colleagues just prior to the crash,” the report stated. “He stated he was not sending text messages when the crash occurred.”</p>
<p>But video did not show him scrolling through texts, authorities said. Instead, he was allegedly “viewing a picture or a video at the time of the crash,” the report stated. A supervisor later described there being no videos or pictures in the group chat.</p>
<p>The investigator also determined that the deputy was not wearing a seat belt at the time of the crash.</p>
<p>In an interview on Nov. 20, 2024, the deputy admitted he was, in the report’s words, “looking at inappropriate pictures.” Asked to clarify what he meant, he allegedly “stated pornographic material like boobs or whatnot.”</p>
<p>He reiterated that his bakes did lock up, but he did not have the time to stop when he realized the vehicle was stopped in front of him.</p>
<p>He ultimately admitted “he knew he was looking at inappropriate pictures, which was the leading cause of the crash, and he deliberately left that information out of his report.  He stated that it is called lying by omission.  He further said he knows that one all too well.”</p>

<p>A 24-year-old woman in <a href="https://lawandcrime.com/tag/michigan/">Michigan</a> who drove away after a friend fell out of her <a href="https://lawandcrime.com/crime/somebody-knows-something-student-mysteriously-left-to-die-in-the-middle-of-the-road-after-house-party-as-family-demands-answers/">moving car</a> and died in the middle of the road will be <a href="https://lawandcrime.com/tag/sentenced/">going to jail</a>. An Oakland County judge ordered Kentia M. Fearn to spend ninety days in jail for her role in the death of Mia Kanu, court records reviewed by Law&amp;Crime show.</p>
<p>Fearn pleaded no contest in October to one count of leaving the scene of an accident resulting in death as well as one count of operating a motor vehicle while intoxicated. In addition to her incarceration, Fearn was also sentenced to three years of probation.</p>
<p>The deadly incident took place shortly after Fearn and Kanu left a party in the early morning hours of June 3, 2023, in a car that Fearn was driving.</p>

<p>As Law&amp;Crime <a href="https://lawandcrime.com/crime/driver-who-fled-after-veterinary-student-jumped-from-moving-jeep-and-died-is-arrested-prosecutors/">previously</a> <a href="https://lawandcrime.com/crime/somebody-knows-something-student-mysteriously-left-to-die-in-the-middle-of-the-road-after-house-party-as-family-demands-answers/">reported</a>, officers with the Southfield Police Department at about 4:32 a.m. on June 3 responded to a strip of road in front of the Coach House Apartments on Providence Drive, about 15 miles northwest of Detroit, in regards to a report about an adult female lying motionless in the street, the Detroit Free Press <a href="https://www.freep.com/story/news/local/michigan/oakland/2023/06/12/mia-kanu-female-dead-southfield-homicide/70314305007/">reported</a>. The female — later identified as Kanu — was transported to Ascension Providence Hospital in Southfield, where medical personnel said she had suffered severe head trauma and admitted her into the intensive care unit and placed her on life support.</p>
<p>The person who called 911 was a passerby who did not know Kanu.</p>
<p>Kanu remained in the hospital for two days before she was declared dead on June 5, but remained on life support for an additional three days because she was an organ donor. According to the Free Press, staffers at Ascension Providence honored Kanu with a “walk of life” ceremony as she was brought to the operating room.</p>
<p>“There was no brain activity. Her liver went to a baby, her kidneys went to a recipient and her tissues and muscles were donated to the Gift of Life,” her mother, Bianca Vanmeter, told the newspaper. “She just looked like a beautiful angel laying in bed.”</p>
<p>Vanmeter reportedly said she saw her daughter before she went to work at the Green Lantern restaurant in Berkley on the morning of June 2. When Kanu finished her shift at the restaurant, her mother said she was picked up by a female friend who was staying at her house, along with her daughter, and the two went with friends to a house party.</p>
<p>Prosecutors in Oakland County said that after leaving the party, Kanu fell out of Fearn’s vehicle onto the road. Fearn allegedly did not stop. Instead, she left the area and did not alert anyone or call 911, authorities said.</p>
<p>“The law requires anyone involved in an accident to stop and immediately report the accident to authorities,” Oakland County Prosecutor Karen McDonald said. “Leaving the scene when someone is seriously injured or dies is a felony. My office will hold those who do so accountable.”</p>
<p>Fearn was arrested and charged in Kanu’s death about three months after the incident.</p>
<p>Kanu’s <a href="https://www.tributearchive.com/obituaries/28172467/mia-amelia-kanu">obituary</a> said she was “a treasure to all those who loved her.”</p>
<p>“Mia, was a wonderful daughter, granddaughter, sister, niece, cousin and friend who touched the lives of all those around her,” the tribute stated. “Mia dedicated her life to God, her family and friends. To all those that she encountered, Mia was kind, loving, sweet and funny. She was a team leader in all that she did and was a very active team player in volleyball and school activities.”</p>

<p>A 10-count indictment has been unsealed in a <a href="https://lawandcrime.com/crime/couple-charged-with-murdering-government-witness-in-massive-fake-car-crash-scam/" target="_blank" rel="noopener">murder and insurance fraud</a> case out of <a href="https://lawandcrime.com/tag/new-orleans/" target="_blank" rel="noopener">New Orleans</a>, in which lawyers and residents are accused of orchestrating “staged collisions” around the Crescent City for money — with paid “spotters,” “slammers” and “runners” in on the take — and one of the alleged schemers being killed off for talking to cops, according to federal prosecutors.</p>
<p>The <a href="https://lawandcrime.com/tag/u-s-attorneys-office/" target="_blank" rel="noopener">U.S. Attorney’s Office</a> unsealed the indictment this week and listed charges for New Orleans residents Ryan “Red” Harris, 36; Sean Alfortish, 57; Vanessa Motta, 43; Jason Giles, 45; Leon “Chunky” Parker, 51; Diaminike Stalbert, 34; Carl Morgan, 66; and Timara Lawrence, 34; as well as the local law firms Motta Law, LLC, and The King Firm, LLC.</p>
<p>Giles and Motta are both attorneys based in the Big Easy, while Alfortish — Motta’s fiance — is disbarred.</p>
<p>Charges were first filed in the homicide and insurance fraud case back in May against Harris and his girlfriend, Jovanna Gardner, 39, of Chalmette, <a href="https://lawandcrime.com/?s=Louisiana" target="_blank" rel="noopener">Louisiana</a> for first-degree <a href="https://lawandcrime.com/?s=murder" target="_blank" rel="noopener">murder</a> of a government cooperator after the alleged widespread fraud conspiracy was uncovered. Several others who were involved have pleaded guilty and agreed to cooperate with prosecutors, including convicted “slammer” Damian Labeaud, who is scheduled to be sentenced in January, and his partner Roderick Hickam. Prosecutors initially declined to release the identities of the lawyers and firms that were allegedly involved.</p>

<p>“From approximately 2011 through approximately 2017, Labeaud, Hickman, and others staged numerous collisions for Giles, The King Firm, Keating, and others,” the complaint for the unsealed indictment says, listing seven new defendants that weren’t named in May.</p>
<p>Prosecutors accuse the group of “conspiring to file and pursue” fraudulent lawsuits based on the staged collisions they allegedly carried out. The defendants used “coded language,” including fishing terms, to disguise conversations about their illegal “scheme,” according to DOJ officials.</p>
<p>“The scheme included individuals who rode in automobiles as passengers knowing they would be part of staged collisions,” the agency said in a <a href="https://www.justice.gov/usao-edla/pr/ten-count-indictment-unsealed-charging-eight-individuals-and-two-law-firms-offenses" target="_blank" rel="noopener">statement</a> Monday, the day the full indictment was unsealed. “Those individuals later lied as part of fraudulent insurance claims and fraudulent lawsuits based on the staged collisions. Additionally, the scheme included individuals who drove automobiles and intentionally collided with 18-wheeler tractor-trailers and other commercial vehicles, in order to stage collisions (‘slammers’). After the staged collisions, the slammers would flee the scene and a passenger would falsely claim to have been driving at the time of the collision.”</p>
<p>According to the complaint, “runners” were in charge of referring individuals involved in automobile collisions to the lawyers and law firms for money.</p>
<p>One of the group’s members, Cornelius Garrison, started “covertly cooperating” with federal agents in October 2019 and they allegedly found out about it, according to the <a href="https://www.justice.gov/usao-edla/pr/five-count-indictment-unsealed-charging-local-pair-conspiracy-commit-murder-federal" target="_blank" rel="noopener">DOJ investigators.</a> He had worked for both Harris and Gardner in the alleged scam and was serving as both a “slammer” and a “spotter” for the couple, which are described as positions that require theatrics.</p>
<p>Prosecutors say the group planted passengers in cars or semi-trucks after hitting them with vehicles and then those people filed bogus insurance claims. After the crash occurred, slammers would flee and spotters communicated with them on whether police were in pursuit or nearby. Oftentimes, spotters are tasked with pretending to be witnesses and required to flag down commercial vehicles. Once a person pulls over to help, the people involved would start blaming them for the collision, according to court documents.</p>
<p>The Justice Department believes Garrison was murdered by Harris and Gardner in September 2020 after he was federally indicted on conspiracy to commit mail fraud and other charges associated with the bogus wrecks that same week. He was indicted on Sept. 18 and found dead on Sept. 22 inside his home — shot multiple times, according to prosecutors.</p>

<p>Harris and Gardner were charged with conspiracy to commit mail and wire fraud, conspiracy to commit witness tampering through murder, conspiracy to retaliate against a witness through murder and other crimes.</p>
<p>Gardner has since pleaded guilty to a reduced charge of witness tampering, while claiming that Harris admitted to her that he killed Garrison.</p>
<p>Each defendant in the newly unsealed indictment faces a charge of conspiring to commit mail and wire fraud, which carries a prison sentence of up to 20 years upon conviction.</p>
<p>Motta, Giles and Alfortish also face witness tampering and obstruction of justice charges, which carry maximum sentences of 20 years and 10 years, if convicted, respectively. Harris faces three additional counts of retaliation against a witness through murder, causing death through use of a firearm and witness tampering through murder.</p>
<p>Attempts by Law&amp;Crime to reach the King Firm and Motta Law for comment were unsuccessful Thursday.</p>
