A Jan. 6 rioter from Texas who got hit with an arrest warrant for online solicitation of a minor after being pardoned by President Donald Trump is back behind bars after being busted Thursday following a surveillance operation, cops say.

Andrew Taake, 36, was taken into custody by the Harris County District Attorney’s Fugitive Apprehension squad with help from multiple law enforcement agencies after a warrant was issued for his arrest late last month, according to prosecutors. Taake was caught in Leon County, Texas, and must now face justice in Houston for a 2016 charge of online solicitation of a minor. He was on pretrial release when the 2021 Capitol attack unfolded, which landed him a six-year prison sentence for attacking police officers with a metal whip and dousing them in bear spray.

Taake pleaded guilty in December 2023 to one count of assaulting, resisting, or impeding officers using a dangerous weapon. Last month, Trump scrubbed away the charge with a “full, complete and unconditional” pardon of Taake and his roughly 1,500 fellow rioters. Prosecutors in Harris County took up the solicitation charge — now that his federal case is no longer active — as a result.

“Re-arresting individuals, like Taake, who were released with pending State warrants, will require significant resources,” District Attorney Sean Teare said in a statement before Taake’s arrest. “Know that we are already in the process of tracking Taake down, as he must answer for 2016 charge of soliciting a minor online.”

According to prosecutors, Taake was apprehended Thursday after a surveillance operation on Tuesday confirmed he was staying at a residence in Leon County.

“We would like to thank the coordinated efforts of our office’s Fugitive Apprehension Section, Leon County Sheriff’s Office, and Texas Department of Public Safety for their diligence in getting this suspected child predator back into custody,” Teare said in a statement.

Taake made headlines at the time of his Jan. 6 arrest after he was turned in by a woman he met on the dating app Bumble. He was sentenced to 74 months in prison last year — followed by 36 months of supervised release — in addition to paying $2,000 in restitution.

More from Law&Crime: ‘Galvanized and ready’: Family members of Jan. 6 rioters and their victims say they’re ‘terrified’ of what’s to come now that Trump pardons actually happened

According to the Houston Chronicle, Taake was allegedly soliciting a person in 2016 who he “believed to be younger than 17 years of age.” He was 27 at the time.

Authorities say Taake talked on social media with an undercover cop posing as a 15-year-old girl. He allegedly sent “multiple explicit messages” and asked to meet up with her — even admitting that he “could go to jail” if anyone found out what he was doing. Taake allegedly went to an address that the undercover provided and cops arrested him. If convicted, he faces a decade in prison.

Standing on the northwest stairwell of Capitol steps at 1:54 p.m., Andrew Kyle Grigsby was among the first rioters to engage with cops, feds say. He is facing charges of civil disorder, assaulting, resisting, or impeding officers using a dangerous weapon and inflicting bodily injury, entering and remaining in a restricted building or grounds with a dangerous weapon, disorderly and disruptive conduct in a restricted building or grounds using a dangerous weapon, and engaging in physical violence in a restricted building or grounds with a dangerous weapon.

More coverage from Law&Crime: ‘Obviously you shouldn’t be pardoned’: JD Vance breaks from Trump’s ‘had no choice’ claims about Jan. 6 rioters and says violent offenders should stay locked up and charged

He was arraigned on the charges in Washington, D.C., on Friday. According to the FBI’s statement of facts about Grigsby’s alleged conduct, surveillance cameras showed him on the steps with a group of other rioters. As the mob was trying to break through the police line, Grigsby was seen holding a black canister, later determined to be bear spray, in his right hand. Grigsby allegedly raised the canister and dispersed the spray at cops, causing them to temporarily retreat.

“One of those officers described himself being unable to breathe or see without unbearable, tortuous pain,” a press release from the U.S. Attorney’s Office for the District of Columbia reads.

More coverage: ‘I will refuse a pardon from felon Trump!’: Jan. 6 rioter says she doesn’t want record wiped clean after being ‘bullied by MAGA’ for showing remorse

Prosecutors say Grigsby then went down the stairs where he got ahold of a police riot shield. Witnesses who knew Grigsby identified him from photos in the months following the riot. Agents tried to interview Grigsby at his home in Eubank, some 60 miles south of Lexington. He wasn’t home but a family member confirmed he had been at the riot. The family member also reportedly said that Grigsby had deleted photos from their phone of him at the Capitol.

Agents got Grigsby on the phone and while he admitted being in Washington, D.C., on that day, he said he never entered the Capitol. He also claimed he was not deploying the bear spray at cops, but rather at rioters fighting said cops.

However surveillance footage clearly showed him spraying it at cops, the FBI said.

Grigsby was indicted in November 2023 and again in August but it was under seal until his arrest last week. He remains behind bars, according to the feds.

Left: Dustin Ray Williams. Right: Williams grabbing at police officers during the Jan. 6 riots at the U.S. Capitol (Department of Justice).

A Texas man will spend nearly two years behind bars for his role in the Jan. 6 riot in which he grappled with cops and stayed inside the U.S. Capitol grounds for about two hours as they prevented Congress from certifying the results of the 2020 Presidential election.

U.S. District Judge Beryl A. Howell on Friday sentenced 33-year-old Dustin Ray Williams to 22 months in prison followed by three years of probation, according to the U.S. Attorney’s Office for the District of Columbia. Williams pleaded guilty on July 11 to assaulting, resisting, or impeding certain officers.

More coverage from Law&Crime: Jan. 6 rioter who assaulted D.C. cops gets another conviction for planning ‘assassination missions’ on FBI agents

FBI agents received a tip in the days following the riot after Williams posted a video on Facebook describing the “TRUTH” about the riots, a criminal complaint said. He claimed he did not commit any violence or vandalism. He described the rally in which then-President Donald Trump fed his supporters lies about a stolen election as peaceful. Williams then peddled the debunked theory that the riot was “a sophisticated, orchestrated infiltration conducted by Antifa and funded by the ‘Swamp.””

But video from the Capitol showed that Williams had indeed rioted, and was easy to spot.

Williams wore a bright orange construction shirt with the name of a Colorado business he previously did business with, feds said. The shirt had the name and phone number of the business on the back, resulting in the owner reportedly receiving a slew of angry and threatening phone calls.

The complaint says the video showed Williams shoving and grabbing at police officers and their shields for about 25 seconds before he was pepper sprayed. Cell phone camera footage also captured Williams “threateningly” shouting at cops “You shot an unarmed person,” and “There’s a lot more coming, motherf—ers,” feds said.

Agents also noted that he was confronting people trying to break windows to get inside the building. In his sentencing memorandum, Williams said he “truly regrets” taking part in the riot and had never been arrested prior to the incident. He also didn’t commit a “violent assault” worthy of significant incarceration.

“Mr. Williams traveled to Washington, D.C., as many thousands of others did, to show political support,” his attorney, Kyle Wackenheim, wrote. “There is no evidence to suggest Mr. Williams traveled with the intent to disrupt the certification process or to otherwise wreak havoc. He came plain clothed and did not carry a flag. Unlike many, Mr. Williams did not come with protective gear, such as padding, helmets, goggles, backpack, or body armor. He did not carry a radio or pepper/bear spray.”

Cops arrested Williams on Aug. 1, 2023. So far more than 1,500 people have been charged in the riot including 600 who like Williams assaulted police officers. Those who still have pending cases have been asking to delay hearings as Trump, slated to enter his second term in January, has indicated he may issue pardons to the defendants.

Have a tip we should know? [email protected]
