<p><strong>Updated:</strong> U.S. Supreme Court Justice Samuel Alito said he spoke with President-elect Donald Trump on Tuesday to provide a job reference for one of his former law clerks.</p>
<p>Alito said in a statement the ex-clerk, William Levi, had asked him to take the phone call, according to <a href="https://abcnews.go.com/US/trump-speaks-justice-alito-amid-push-halt-criminal/story?id=117386419">ABC News</a>, which broke the story.</p>
<p>Stories followed in publications that include the <a href="https://www.nytimes.com/2025/01/08/us/justice-alito-trump.html">New York Times</a>, <a href="https://www.reuters.com/world/us/supreme-court-justice-alito-spoke-trump-tuesday-abc-news-reports-2025-01-08">Reuters</a>, <a href="https://www.cnn.com/2025/01/08/politics/alito-trump-conversation/index.html">CNN</a> and <a href="https://www.foxnews.com/politics/justice-alito-says-he-spoke-trump-about-former-clerk-before-hush-money-filing-high-court">Fox News</a>.</p>
<p>Levi formerly work as chief of staff to then-U.S. Attorney General Bill Barr during Trump’s first presidency. He is now being considered for a government position in the new administration.</p>
<p>A day after the phone call, lawyers for Trump <a href="https://www.supremecourt.gov/DocketPDF/24/24A666/336760/20250107212856360_2025-01-07%20-%20Trump%20v.%20New%20York%20-%20Supreme%20Court%20Stay%20Application.pdf">asked</a> the Supreme Court <a href="https://www.abajournal.com/news/article/trump-could-make-these-appellate-arguments-after-trial-he-calls-rigged-aba-president-comments">to stay his Friday sentencing</a> for allegedly falsifying business records to conceal a hush-money payment to adult film actress Stormy Daniels. Prosecutors said the payment violated a New York law barring use of unlawful means to promote a candidacy—in this case, Trump’s presidential bid in 2016.</p>
<p>Alito said Wednesday, however, that the case was not discussed.</p>
<p>“We did not discuss the emergency application he filed today, and indeed, I was not even aware at the time of our conversation that such an application would be filed,” Alito said in the statement. “We also did not discuss any other matter that is pending or might in the future come before the Supreme Court or any past Supreme Court decisions involving the president-elect.”</p>
<p>On Thursday evening, the Supreme Court <a href="https://www.abajournal.com/syndicated/article/in-5-4-vote-supreme-court-refuses-to-delay-trumps-hush-money-sentencing">denied</a> Trump’s emergency application in a 5-4 vote. Alito, who did not recuse himself, voted with Justices Neil Gorsuch, Clarence Thomas and Brett Kavanaugh in favor of granting Trump’s request to delay his Friday sentencing. They did not indicate their reasoning in the <a href="https://www.supremecourt.gov/orders/courtorders/010925zr_2d8f.pdf">unsigned order</a>.</p>

<p>Dentons and Boies Schiller Flexner are asking a New York City federal judge to toss a racketeering lawsuit against them in legal briefs that deride the allegations by its former clients as “literally incoherent” and “utterly implausible.”</p>
<p><a href="https://www.law360.com/articles/2255078">Law360</a> and <a href="https://www.reuters.com/legal/litigation/boies-schiller-dentons-say-lawsuit-against-them-over-senegal-deal-incoherent-2024-11-01">Reuters</a> have coverage of the law firms’ briefs seeking dismissal (<a href="https://fingfx.thomsonreuters.com/gfx/legaldocs/gkvlbdqomvb/Corsini%20v.%20Dentons%20-%20BSF%20motion%20to%20dismiss.pdf">here</a> and <a href="https://fingfx.thomsonreuters.com/gfx/legaldocs/xmvjbrqdavr/Corsini%20v.%20Dentons%20-%20Dentons%20motion%20to%20dismiss.pdf">here</a>), which were filed Oct. 31.</p>
<p>Dentons said former clients Frank Corsini and his companies had stiffed Dentons on $1.9 million in legal fees, and contrary to the suit allegations, it was the “plaintiffs themselves who have long been unjustly enriched.”</p>
<p>Boies Schiller said it also received no fees from the plaintiffs because its representation was on a contingency basis in an ultimately unsuccessful arbitration before a panel of the International Chamber of Commerce. The plaintiffs “received the benefit of first-class counsel,” Boies Schiller argued, “without having to pay a dime.”</p>
<p>The $300 million suit by Corsini and two of his companies <a href="https://www.abajournal.com/news/article/dentons-and-boies-schiller-face-300m-racketeering-suit-after-client-loses-international-arbitration">had alleged</a> that Dentons and Boies Schiller ignored “red flags” suggesting that his contract to develop a power plant in Senegal, a country in West Africa, was invalid. The firms then schemed to generate legal fees, he said in the April suit.</p>
<p>Dentons had represented Corsini in negotiations with Senegal’s energy supplier Senelec. The contract signed by a Senelec representative was invalid because it was not approved by Senelec’s board, Corsini said. He also claimed that Boies Schiller failed to verify whether the contract was valid before the arbitration.</p>
<p>Corsini alleged that the firms and several attorneys violated the Racketeer Influenced and Corrupt Organizations Act by seeking to present false testimony about the invalid contract to the arbitration tribunal. He also alleged fraud and unjust enrichment.</p>
<p>Dentons responded that the plaintiffs’ claims had “fatal flaws,” and their narrative was “utterly implausible.” Even though a Dentons partner provided testimony that supported the position of Corsini’s companies in the arbitration, the plaintiffs manufactured “a laundry list of absurd allegations, all premised on conclusory buzzwords without foundation,” Dentons said.</p>
<p>Boies Schiller said the plaintiffs’ claims “ignore controlling law and are devoid of any particularized allegations of how they were supposedly defrauded. More fundamentally, plaintiffs’ claims are literally incoherent: They seek (astronomical) damages based on the dismissal of a prior arbitration claim in which BSF represented them on contingency and which plaintiffs now allege never had merit in the first place.”</p>
<p>Dentons said it would be seeking sanctions in a future motion.</p>
<p>Paul Amandio Batista, the lawyer for the plaintiffs, commented on the dismissal arguments in an email to Law360.</p>
<p>“I look forward to the day when jurors hear evidence at trial about the misconduct of these two major firms,” he said. “Jurors have a refreshing ability to understand reality, and the reality here is that two immense law firms abused Mr. Corsini.”</p>
<p>The case, filed in the U.S. District Court for the Southern  District of New York, is <em>Corsini v. Dentons</em>.</p>

<p>Special counsel Jack Smith’s arguments against Donald Trump’s claims of presidential immunity in the Jan. 6 case were published, to a large degree, on the public docket by the court overseeing the matter in a “<a href="https://lawandcrime.com/high-profile/jack-smith-slams-trumps-irrelevant-jan-6-discovery-demands-anticipates-frivolous-appeal-and-teases-text-message-evidence-as-voluminous-immunity-filing-looms/" target="_blank" rel="noopener">voluminous</a>” and “<a href="https://lawandcrime.com/high-profile/the-incoherence-judge-in-jan-6-case-gives-jack-smith-permission-to-filed-oversized-brief-on-immunity-and-says-trumps-arguments-dont-make-any-sense/" target="_blank" rel="noopener">oversized</a>” opening brief on Wednesday.</p>
<p><a href="https://storage.courtlistener.com/recap/gov.uscourts.dcd.258149/gov.uscourts.dcd.258149.252.0.pdf" target="_blank" rel="noopener">The filing</a> contains a litany of new, never-before-revealed information about the behavior of the 45th president – and those in his orbit – in the days, weeks, and months following his 2020 election loss.</p>
<p>While the government alleges Trump and several co-conspirators spread “knowingly false claims of election fraud,” there were apparently some claims about the integrity of the election so outlandish that even Trump himself privately expressed doubts.</p>
<p>In one instance, those rebuffed-by-Trump claims were made during a press conference by pro-Trump attorney <a href="https://lawandcrime.com/tag/sidney-powell/" target="_blank" rel="noopener">Sidney Powell</a>, according to the brief. Later, when speaking with others about the allegations Powell released into the public sphere, Trump ridiculed them.</p>

<p>On Nov. 19, 2020, Powell, <a href="https://lawandcrime.com/tag/rudy-giuliani/" target="_blank" rel="noopener">Rudy Giuliani</a>, Jenna Ellis and others presented a “<a href="https://www.c-span.org/video/?478246-1/trump-campaign-news-conference-legal-challenges" target="_blank" rel="noopener">Legal Challenges Update</a>” during a flag-draped press conference in Washington, D.C., outlining several purported “paths to victory.” Those paths were premised on various kinds of litigation aimed at overturning the results in several swing states where President Joe Biden narrowly, but decisively, defeated Trump.</p>
<p>Giuliani was first at the dais – where he largely spread false claims about election-rigging efforts in Philadelphia and Wisconsin.</p>
<p>Then it was Powell’s turn.</p>
<p>“What we are really dealing with here and uncovering more by the day is the massive influence of communist money through Venezuela, Cuba, and likely China, and the interference with our elections here in the United States,” she said. “The Dominion voting systems, the Smartmatic technology software, and the software that goes into other computerized voting systems here, as well, not just Dominion, were created in Venezuela at the direction of Hugo Chavez to make sure he never lost an election after one constitutional referendum came out the way he did not want it to come out.”</p>
<p>Later that same night, Trump watched then-Fox News personality <a href="https://www.foxnews.com/opinion/tucker-carlson-rudy-giuliani-sidney-powell-election-fraud" target="_blank" rel="noopener">Tucker Carlson criticize Powell</a>, who likened her legal arguments to an unleashed Kraken, for her unwillingness to back up those claims, the brief alleges. After her widely-pilloried comments about the late Venezuelan president’s alleged connection to voting machine manufacturers, Carlson’s team invited her to appear on the show.</p>
<p>“We would have given her the whole hour,” the then-host said. “We would have given her the entire week, actually, and listened quietly the whole time at rapt attention. But she never sent us any evidence, despite a lot of polite requests. When we kept pressing, she got angry and told us to stop contacting her. When we checked with others around the Trump campaign, people in positions of authority, they also told us Powell had never given them any evidence to prove anything she claimed at the press conference.”</p>
<p>Later on, Trump and another person were discussing Powell’s performance during the press conference – and Carlson’s understanding of how Powell’s allegations fared.</p>
<p>“He acknowledged to [redacted] that [Powell] had appeared ‘unhinged’ in the press conference,” the brief reads.</p>
<p>The insults continued.</p>
<p>“On November 20, the day after the press conference, the defendant made a similar comment to [redacted] and [redacted] two White House staffers who also volunteered for his Campaign,” the brief goes on. “In casual conversation after another meeting had ended, the defendant told [the first staffer] and [the second staffer] that [Carlson] had ‘eviscerated’ or ‘destroyed’ [Powell].”</p>
<p>After that, Trump got onto a phone call with Powell directly, according to the brief. During the call, Trump mentioned the Fox News segment and gave Powell a chance to explain herself – putting the conversation on speakerphone so both staffers could listen along.</p>
<p>“While [Powell] responded, the defendant placed the call on mute and to [the first staffer] and [the second staffer] mocked and laughed at [Powell], called her claims ‘crazy,’ and made a reference to the science fiction series Star Trek when describing her allegations,” the brief says.</p>
<p>But it was not just Trump and Carlson who made their issues with Powell’s unsupported theories known.</p>
<p>Smith alleges that during “the same time period,” yet another trusted person “told” Trump that Powell’s “claims were unreliable and should not be included in lawsuits,” In response, Trump allegedly “agreed that he had not seen anything to substantiate [Powell’s] allegations.”</p>
<p>On Nov. 22, 2020, Giuliani issued a statement distancing the Trump campaign from Powell – insisting she was “practicing law on her own.”</p>
<p>Still, Powell managed to obtain the Trump imprimatur.</p>
<p>“Nonetheless, the defendant continued to support and publicize [Powell’s] knowingly false claims,” the brief goes on.</p>
<p>In the days that followed, Trump personally sent two tweets promoting Powell’s failed lawsuit alleging electoral fraud in Georgia.</p>
<p>And that, Smith says, is of a piece with the fundamental artifice of the alleged conspiracy to overturn the 2020 election.</p>
<p>“The throughline of these efforts was deceit,” Smith’s brief reads.</p>
<p>And those efforts – derided by Smith as “lies” – were known to be lies by Trump and his co-conspirators, the brief alleges.</p>
<p>“At its core, the defendant’s scheme was a private criminal effort,” Smith’s brief goes on. “In his capacity as a candidate, the defendant used deceit to target every stage of the electoral process.”</p>

<p>A <a href="https://lawandcrime.com/tag/south-carolina/" target="_blank" rel="noopener">South Carolina</a> man will spend the rest of his life behind bars for the <a href="https://lawandcrime.com/tag/murder/" target="_blank" rel="noopener">murder</a> of a longtime friend turned <a href="https://lawandcrime.com/tag/landlord/" target="_blank" rel="noopener">landlord</a> who eventually served him an eviction notice amid their protracted falling out.</p>
<p>On Thursday, Nathan Wesley Zeigler, 64, was sentenced to life in prison without the possibility of parole by 1st Judicial Circuit Court Judge Heath Taylor for the murder of Charles Jacob “CJ” Young, 82.</p>
<p>For 20 years, Young allowed Zeigler to live in his home for free.</p>
<aside class="o-callout__recirculate o-callout"/>
<p>Friends before the living arrangements were made, Young moved away to New York and gave Zeigler the keys to his home in Dorchester County. First Assistant Solicitor Kelly LaPlante said Young considered Zeigler a son, according to Charleston-based <a href="https://www.live5news.com/2024/03/21/dorchester-county-man-sentenced-murder-over-eviction/" target="_blank" rel="noopener">CBS affiliate WCSC</a>.</p>
<p>The <a href="https://www.brownandsonfuneralhome.com/obituary/charles-young" target="_blank" rel="noopener">dead man’s obituary</a> describes his time in the Empire State:</p>
<blockquote>
<p>“CJ” had two things that he knew he wanted to do in life, that was to make people happy and be an entrepreneur. He never did anything that his heart wasn’t fully in. So, with a determined mind, he started his own furniture upholstery business on August 8, 1983, C.Y. Upholstery in NYC. “CJ&#8221;”s first opening was in Brooklyn, NY however he relocated to Manhattan, NY where the business exploded for him. He attracted customers from all over …</p>
</blockquote>
<p>After decades, the upholstery business was closed. The free real estate did not last — and, in time, neither did the friendship.</p>
<p>When Young retired, he moved back to the Palmetto State and back into his house on Johnson Road and Honeysuckle Road in Harleyville — a tiny town roughly 45 miles northwest of Charleston.</p>
<p>Problems ensued after Young’s homecoming. Police were called to deal with domestic disturbances on multiple occasions. An incident report obtained by <a href="https://www.postandcourier.com/news/82-year-old-man-fatally-shot-in-dorchester-co-suspect-charged-with-murder/article_bc6acf94-7020-11ec-9c57-af0fa3e34657.html" target="_blank" rel="noopener">The Post and Courier</a> suggests Young’s brother was often on the property — or had also come to live there.</p>
<p>In December 2021, Young served Zeigler with an eviction notice — but after years of rent-free living, he simply refused to leave.</p>
<p>On Jan. 7, 2022, there was a full house.</p>
<p>Late that morning, Young called 911 and begged them to send help. A dispatcher heard another voice shouting: “I told you I wasn’t playing with you.” Then they heard the gunshot.</p>
<p>Dorchester County deputies responded around noon. Young was found dead in the kitchen with a gunshot wound to his neck.</p>
<p>The victim’s obituary continues:</p>
<blockquote>
<p>“CJ” was the “fun” and had plenty of liveliness and love to go around. He made it his business to travel the world and see what was out there to discover. Although on some of these trips he would just go and not tell anyone he was going, he always had a story to tell about his adventure when he came home. “CJ” enjoyed meeting new people all over the world, he invited and hosted people from various countries and cultures into his home in NYC. Many would agree that “CJ” was a very outgoing person. As a gracious host, he always made you feel comfortable around him. He loved to cook, and you didn’t know what you were going to be served when he was in the kitchen. Oh “CJ” had an exquisite palette and what may have looked strange always tasted delicious. He hosted an annual family gathering at his home in S.C. which would draw crowds both near and far. Dozens upon dozens of people would attend. This event was a true testament on how much “CJ” loved family.</p>
</blockquote>
<p>Zeigler was found sitting in a chair in the backyard and was detained by a Harleyville police officer until backup could arrive.</p>
<p>Young’s brother spoke with deputies and said he had overheard the two get into it in the kitchen. At one point, Young told Zeigler to “move something out of his way,” followed by the telltale bang, the brother said. Upon entering the kitchen, he said he saw his brother on the floor, “not moving,” and Zeigler walking outside “with a gun in hand.”</p>
<p>Investigators found the murder weapon inside of a grill.</p>
<p>Zeigler was charged with one count each of murder and possession of a firearm during a crime.</p>
<p>During the trial, the defendant admitted to shooting Young but claimed self-defense.</p>
<p>“This was not self-defense, this was a senseless murder,” Assistant Solicitor Shannon Elliott told the jurors, according to a courtroom report by Greenville-based <a href="https://www.wyff4.com/article/south-carolina-fatal-shooting-on-phone-with-911/60277341" target="_blank" rel="noopener">NBC affiliate WYFF</a>.</p>
<p>Jurors deliberated just shy of four hours before returning a guilty verdict earlier this week. Zeigler was sentenced quickly after.</p>

<p>The family of a mother killed by a police vehicle speeding through a <a href="https://lawandcrime.com/?s=connecticut" target="_blank" rel="noopener">Connecticut</a> neighborhood while responding to a burglary call with no lights and sirens has filed a <a href="https://lawandcrime.com/?s=lawsuit" target="_blank" rel="noopener">lawsuit</a> against the city and the officer they blame for the death.</p>
<p>Katherine Colon was walking on West Main Street in New Britain on Sept. 21, 2023, at 1 a.m. when she was hit by New Britain Police Officer Connor Reinsch, who was speeding through a neighborhood at 60 mph in a 25 mph zone to a burglary call when he hit her, according to the <a href="https://assets.ctfassets.net/3kqcuzntcg31/2GmuARdYbkOfdECUR5lEpH/8435ad3b515d0a392d4815588e2f2128/Katherine_Colon_complaint__3.19.2024_.pdf" target="_blank" rel="noopener">lawsuit</a>, which seeks $15,000.</p>
<p>“It makes me sick to know that we still have officers who are speeding down these streets without their lights on and who could potentially kill another individual,” Maribel Rodriguez, Colon’s daughter, told Hartford CBS affiliate <a href="https://www.wfsb.com/2024/03/20/family-new-britain-woman-struck-killed-by-officer-files-lawsuit/" target="_blank" rel="noopener">WFSB</a>.</p>
<p>The family’s attorney, Joaquin Madry, said in a <a href="https://www.registercitizen.com/news/article/katherine-colon-kids-sue-new-britain-cop-reinsch-19301211.php" target="_blank" rel="noopener">statement</a> that no emergency is so great that it warrants endangering the lives of others.</p>
<p>“The driver of this vehicle is responsible for the death of Katherine Colon, and so is the city of New Britain,” Madry said.</p>
<p>The lawsuit alleges Reinsch operated his vehicle without due regard for the safety of all persons and property, drove his motor vehicle at a rate of speed greater than is reasonable for the conditions, and allowed himself to be distracted while operating his motor vehicle. The suit also alleges he failed to keep a proper lookout for pedestrians on the roadway, did not slow down to avoid the collision, and did not apply his brakes in time to avoid colliding with Conlon.</p>
<p>In addition to Reinsch, the lawsuit names the city of New Britain. A city spokesperson told WFSB that Reinsch remains an officer on restricted duty and declined to comment on the pending litigation.</p>
<p>A <a href="https://portal.ct.gov/-/media/DCJ/02292024Colon.pdf" target="_blank" rel="noopener">report</a> recently released by Waterbury State’s Attorney Maureen T. Platt blamed Reinsch and Colon, saying she had also placed herself in danger by wearing dark clothing and failing to use a crosswalk. The report said she had also been legally intoxicated, under the influence of alcohol and drugs, including cocaine and fentanyl.</p>
<p>In October, Colon’s mother, Maribel Candelaria, spoke out during a rally where hundreds marched in the streets demanding accountability, the <a href="https://newbritainprogressive.com/2023/10/25/justice-for-katherine/" target="_blank" rel="noopener">New Britain Progressive</a> reported.</p>
<p>“My heart is forever broken into a million pieces. One part is filled with memories, the other parts die with her,” she said. “As a mother, I can’t sleep at night knowing what the police did to my daughter. They ride around like they own the streets, speeding and harassing. I’ve never been treated with dignity or humanity by the police, but for them to take my daughter for absolutely no reason is infuriating, it makes me angry. We need accountability for what happened to my daughter.”</p>

<p>Lawyers were left scratching their heads over the Mar-a-Lago trial judge’s Monday order asking the prosecution and defense to propose jury instructions under the assumption that the Presidential Records Act (PRA) allowed former Donald Trump to unilaterally decide that classified documents were personal.</p>
<p>Unsurprisingly, the reaction to U.S. District Judge Aileen Cannon’s order was swift and unequivocal, with some pointing out that likelihood of acquittal has gone up.</p>
<p>Conservative lawyer George Conway called the order the “most bizarre” he’s ever seen a federal judge docket, leapfrogging two other orders Cannon has already issued in the case.</p>
<p>“In the decades that I have been a lawyer, this is the most bizarre order I’ve ever seen issued by a federal judge,” Conway <a href="https://x.com/gtconway3d/status/1769869904667123860?s=20" target="_blank" rel="noopener">said</a>. “What makes that all the more amazing is that the second and third most bizarre orders I’ve ever seen in federal court were also issued by Judge Cannon in this case.”</p>

<p>Conway’s criticism was in response to a post by former Obama administration “Ethics Czar” Norm Eisen, who wrote that the order was “clumsy &amp; amateurish” and ignored the “different body of law” that governs classified documents, “including EO 13526.”</p>
<p><a href="https://lawandcrime.com/high-profile/unconvinced-mar-a-lago-judge-says-its-difficult-to-see-how-trumps-nod-to-george-washington-can-make-espionage-act-indictment-vanish/" target="_blank" rel="noopener">Since a motion hearing last week</a>, Cannon has rejected Trump’s motion to dismiss on grounds of Espionage Act “unconstitutional vagueness” — without prejudice, meaning the defense can raise it again later and “as appropriate in connection with jury-instruction briefing and/or other appropriate motions.” But the judge has not yet ruled on the other argued motion to dismiss, under the Presidential Records Act (PRA).</p>
<p>When special counsel Jack Smith <a href="https://lawandcrime.com/high-profile/fundamentally-wrong-jack-smith-hammers-trump-and-stephen-miller-backed-arguments-that-the-presidential-records-act-should-make-mar-a-lago-prosecution-go-away/" target="_blank" rel="noopener">submitted his arguments</a>, he, like Eisen, emphasized that executive order 13526 — “in force throughout Trump’s Presidency and through the allegations in the Superseding Indictment” — states that classified materials “can be accessed only by a person who an appropriate United States official determines is eligible for such access; who has signed an approved non-disclosure agreement; and who has a ‘need to know’ the classified information.”</p>
<p>“Under the provisions of EO 13526, the Superseding Indictment alleges, once Trump left office, he no longer had authorization to possess classified information, he never received a waiver entitling him, as a former President, to possess it, and he stored documents at a location that was not an authorized location for the storage, possession, review, display, or discussion of classified documents,” the special counsel said, rejecting the notion that the PRA allowed Trump to declare, by fiat, that national defense information documents were merely personal belongings.</p>
<p>Now, Cannon has ordered the defense and the prosecution to file, by April 2, “proposed jury instructions limited to the essential elements” of the 32 willful retention of national defense information counts Trump faces — but in light of the PRA. She ordered the two sides to “engage with” two “competing scenarios and offer alternative draft text that assumes each scenario to be a correct formulation of the law to be issued to the jury [.]” The latter scenario would plainly <a href="https://x.com/joshgerstein/status/1769858652649767280?s=20" target="_blank" rel="noopener">pave a path for acquittal</a>:</p>

<p>(a) In a prosecution of a former president for allegedly retaining documents in violation of 18 U.S.C. § 793(e), a jury is permitted to examine a record retained by a former president in his/her personal possession at the end of his/her presidency and make a factual finding as to whether the government has proven beyond a reasonable doubt that it is personal or presidential using the definitions set forth in the Presidential Records Act (PRA).</p>
<p>(b) A president has sole authority under the PRA to categorize records as personal or presidential during his/her presidency. Neither a court nor a jury is permitted to make or review such a categorization decision. Although there is no formal means in the PRA by which a president is to make that categorization, an outgoing president’s decision to exclude what he/she considers to be personal records from presidential records transmitted to the National Archives and Records Administration constitutes a president’s categorization of those records as personal under the PRA.</p>
</blockquote>
<p>The attorney reactions only amped up from here, with some suggesting that Smith may have enough to seek the “extraordinary remedy” of a <a href="https://lawandcrime.com/awkward/doj-backed-writ-of-mandamus-in-michael-flynn-case-but-opposed-it-when-hillary-clintons-emails-were-involved/" target="_blank" rel="noopener">writ of mandamus</a> from the U.S. Court of Appeals for the 11th Circuit, <a href="https://lawandcrime.com/high-profile/trump-appointed-judge-who-improperly-blocked-doj-from-investigating-former-president-reportedly-assigned-to-oversee-mar-a-lago-criminal-case/" target="_blank" rel="noopener">a court that has had to overturn Cannon’s decision-making before</a>.</p>
<p>Former special counsel Robert Mueller’s  ex-top lieutenant Andrew Weissmann said that mandamus should be on the table for Jack Smith after Cannon’s latest bit of “legal inanity.”</p>
<p>“This is the kind of legal inanity that could lead Jack Smith to seek to mandamus Judge Cannon- ie to get the 11th Circuit appeals court to hear this and reverse her for the third time- which could also be the proverbial three strikes and you’re out,” Weissmann said.</p>

<p>Weissmann <a href="https://www.msnbc.com/the-last-word/watch/weissmann-what-jack-smith-should-do-after-judge-cannon-s-nutty-order-206890565546" target="_blank" rel="noopener">repeated this on MSNBC</a>.</p>
<p>“There’s a reason you’ve never seen anything like it,” Weissmann said, before dropping two M-words: the first was “<a href="https://www.collinsdictionary.com/us/dictionary/english/meshuggenah#google_vignette" target="_blank" rel="noopener">meshuggenah</a>,” describing the order, and the second was mandamus.</p>
<p>“Please draft a jury instruction assuming that the earth is flat. And the second one is please draft a jury instruction that the earth is square,” Weissmann characterized the order. “And so, the second M-word is mandamus. Mandamus is the ability — it’s not an appeal. It’s for extraordinary actions by a district court that so clearly violate the law that you can appeal it right then and there.”</p>
<p>“What she did today is so nutty,” he added.</p>
<p>National security lawyer Bradley Moss, also appearing on MSNBC alongside Weissmann, cautioned against seeking mandamus right away.</p>
<p>“So, Jack Smith, if he doesn’t take Andrew up on his idea of seeking mandamus, and I actually don’t think they’re going to do that yet, I think they’re going to try to fashion a response to this to basically say ‘Alright, judge, I’m not sure where you were going with that, but um, no, that’s not how this works. If you think that’s the state of the law is what you put in that second line item, that’s fine. Issue a ruling, grant Trump’s motion to dismiss, as he outlined it under the Presidential Records Act, and will take it to the 11th Circuit,&#8221;” Moss said. “But that’s an issue of law for the judge, that’s not an issue for the jury.”</p>
<p>“There’s nothing for the jury to do with that instruction. If that is what they went to trial with, I was Trump’s lawyers I’d sit there and take a nap through trial, play Candy Crush, and then the moment the government rested, ‘I move for a directed verdict for acquittal’ because you can’t lose,” he continued. “Because the jury instruction automatically grants you a win.”</p>
<p>Moss suggested Smith will push back on the order before seeking mandamus. The attorney separately called the second scenario posed by Cannon “legally insane.”</p>

<p>Attorney Robert Kelner viewed the mandamus route “unlikely” at this stage, but he still regarded the order as “sufficiently bonkers” to make Smith think about it.</p>

<p>George Conway scathingly chimed in again by saying it’s clear to him that Cannon has no idea what she’s doing as a lawyer, let alone as a judge.</p>

<p>Smith has already threatened to appeal if Cannon separately refuses to reconsider a “<a href="https://lawandcrime.com/high-profile/a-manifest-injustice-jack-smith-warns-of-appeal-if-mar-a-lago-judge-wont-correct-clear-error-threatening-to-expose-witness-names/" target="_blank" rel="noopener">clear error”</a> that could <a href="https://lawandcrime.com/high-profile/trump-employee-5-says-threat-of-mar-a-lago-judge-naming-witnesses-which-visibly-shocked-jack-smith-in-court-inspired-him-to-speak-out-and-reveal-identity-for-first-time/" target="_blank" rel="noopener">out government witnesses through discovery,</a> but the judge has not made a ruling on that issue either.</p>
<p>The special counsel made waves once before by seeking a rarely granted <a href="https://lawandcrime.com/supreme-court/jack-smith-sets-stage-for-extraordinary-scotus-showdown-over-trumps-jan-6-absolute-immunity-claims-asks-justice-to-treat-case-just-like-watergate/" target="_blank" rel="noopener">writ of certiorari before judgment</a> from the U.S. Supreme Court on Trump’s claims of “absolute immunity” from prosecution in his Jan. 6 case, so perhaps the Special Counsel’s Office wouldn’t shy away from pursuing similarly extraordinary relief.</p>

	Federal jurors can fade to the background in popular courtroom dramas full of surprise witnesses and passionate sidebars, but they’re center stage in the real justice system.

	“It’s not Hollywood,” said Kris Porter, a jury administrator in the Western District of Washington. “The stuff on TV shows is very different from the courtroom.”
</p>
<p>
	When a summons could arrive in the mail any day, it helps to know what’s fact and what’s fiction about jury service. A federal judge, juror, and two jury administrators answered frequently asked questions about jury service to dispel misconceptions about <a href="https://www.uscourts.gov/services-forms/jury-service">serving on a jury</a>. Their answers have been edited for clarity.

<h2>
	What is the role of a jury?<br />
</h2>
<p>
	“Juries are collections of people drawn from the community, and they have the same role in all courts,” said Judge Edward M. Chen of the Northern District of California. “They’re charged with finding the facts, determining what happened, applying the instructions on the law given by the judge, and rendering a verdict.”
</p>
<h2>
	What are the qualifications to become a juror?<br />
</h2>
<p>
	U.S. citizens who are at least 18 years old generally <a href="https://www.uscourts.gov/services-forms/jury-service/juror-qualifications-exemptions-and-excuses">qualify for federal jury service</a>, and no special training is required to become a juror, said Porter, a jury administrator in the Western District of Washington.
</p>
<p>
	“All you have to do is listen and judge fairly,” Porter added. “Jury service is part of your civic duty, and the administration of justice can’t happen without the American public’s involvement in the jury process.”
</p>
<h2>
	How long do federal jury trials last, and how likely am I to be summoned?<br />
</h2>
<p>
	“Most trials are only three to four days, and a very small percentage of Americans ever get the chance to serve on a jury,” said Anne Brabham, a jury administrator in the Northern District of Texas. “If you are summoned, you’re lucky. The jurors who do serve email us back and say, ‘I’m glad I did this.’”

	Brabham added that courts are careful not to summon more jurors than are needed to <a href="https://www.uscourts.gov/services-forms/jury-service/juror-selection-process">select an impartial panel</a>. “A frequent complaint I hear from jurors is, ‘I came in, just sat down, and wasted my time.’ I try to convey that each juror’s participation in the process is essential to our constitutional right to trial by jury. While cases often settle or defendants decide to enter pleas on the day of trial, the readiness of the jury may be the catalyst needed to bring the case to conclusion. We release jurors as quickly as possible to minimize the impact on their time.”

	What is it like to serve as a juror?<br />
</h2>
<p>
	“Before serving on a jury, I wasn’t fully aware of how <a href="https://www.uscourts.gov/services-forms/jury-service/juror-selection-process">the judge and jury work together</a>,” said Diane Wilkinson, a juror in a recent trial in the Western District of Washington. “The judge’s instructions and decisions helped me have confidence in the process. It was also helpful to be reminded that our decision had to be based on the law, whether we agreed with it or not and whether we liked it or not. I am more convinced than ever that we are lucky to have jury trials in our nation, and jury service is our chance to contribute to our country.”
</p>
<h2>
	How do diverse juries serve justice?<br />
</h2>
<p>
	“It’s important to have a jury of our peers – a breadth of views,” said Judge Chen. “It’s useful to have people from different perspectives in the same room because not all people have the same experience and see things the same way. There are studies that show the more representative jurors are, the more complete discussions they have.”

	Jury service is a civic duty enshrined in the country’s founding documents and allows U.S. citizens to be direct participants in administering justice.
</p>

	For Judge Chen, jury service “keeps the law close to the people.”
</p>

	“Jury service is a part of democracy in action – people from the community sitting in judgment of people from the community,” Chen said. “Jury service is a valuable experience for jurors and essential to the courts. Jury service is their chance to contribute to our legal and justice system, and we need their voices and their collective judgment.”
