<p>Police in <a href="https://lawandcrime.com/tag/florida/" target="_blank" rel="noopener">Florida</a> have released body camera footage showing a Sarasota officer plowing into 8-year-old Gerard Butler on a dirt bike with his patrol car as the boy’s family watches on in horror.</p>
<p>“You just hit my f—ing nephew!” a man can be heard yelling on video, which was posted online by the Sarasota Police Department on Wednesday.</p>

<p>The man repeated the phrase before numerous others ran up and began shouting at the involved officer, who has not been publicly named.</p>
<p>“You’re dead a– wrong,” another person shouts. “You’re dead a– wrong!”</p>

<p>Speaking in a video statement that precedes the <a href="https://lawandcrime.com/tag/bodycam/" target="_blank" rel="noopener">body camera footage</a>, Sarasota Police Chief Rex Troche outlined what allegedly happened that Monday evening in the west Floridian city, saying the crash was under investigation.</p>
<p>“The collision occurred around 6:30 in the evening,” Troche explained. “The officer was leaving the scene of a separate call for service when the child entered the intersection in front of the officer’s vehicle.”</p>
<p>Police transported the boy to a hospital that night and treated him for severe injuries that required two brain surgeries, knee surgery, and jaw surgery that he’s scheduled to undergo, according to Tampa <a href="https://www.wtsp.com/article/news/local/sarasotacounty/child-injured-dirt-bike-crash-sarasota-officer/67-dafa00e8-6fa1-4e97-96f2-57b02aba3110" target="_blank" rel="noopener">CBS affiliate WTSP</a>. He had recently received the bike over the weekend as an early birthday present, the station reported.</p>
<p>“We cannot imagine how difficult this is for his family,” Troche said. “Our thoughts and prayers are with you.”</p>

<p>Sarasota police investigators have partnered with the <a href="https://lawandcrime.com/crazy/florida-highway-patrol-3-women-found-naked-in-public-said-they-were-just-air-drying-after-a-shower/" target="_blank" rel="noopener">Florida Highway Patrol</a> to conduct a probe of the incident, the department reports.</p>
<p>The boy’s mother, Regina Sanders, spoke with WTSP and blasted Sarasota officers, claiming they abuse their power on the road and are constantly speeding.</p>
<p>“The cops, you just see them flying at least hitting 60 miles and they don’t care about the stop signs just flying through the roads,” Sanders said. “The cops teach us not to speed in residential areas. They have speed limits on the side of the roads for a reason. Whether he had a call or not, you had no business going that fast.”</p>
<p>SPD officials say the officer involved has been placed on restrictive administrative duty and will remain so until their investigation is complete. It’s unclear whether the officer was speeding at the time of the crash.</p>

<p>WHITETHORN, Calif.  —  A mountain bike skills park in the Bureau of Land Management King Range National Conservation Area (NCA) will be undergoing important maintenance from Monday, Oct. 28 through Nov. 1. The BLM is asking riders to avoid the Tolkan Terrain Park while work is underway to enhance the riding experience for enthusiasts.</p>
<p>“This project is important to ensure that the features of the terrain park are in top shape for riders,” said Paul Sever, manager of the King Range NCA. “The 25 miles of mountain bike trails on <a href="https://www.blm.gov/programs/recreation/mountainbike/paradiseroyale">Paradise Royale</a> and Pacific Rim trail network will remain available during the project.&#8221;</p>
<p>The <a href="https://www.blm.gov/programs/national-conservation-lands/california/king-range-national-conservation-area">King Range NCA</a> offers a wide variety of hiking and camping ranging from the Lost Coast wilderness trail to high elevation hiking routes offering spectacular Pacific Ocean vistas. A <a href="https://www.blm.gov/sites/default/files/docs/2023-02/King_Range_Trip_Planning%20_Guide_2022_508.pdf">planning guide</a> provides important information on visiting.</p>
<p>The King Range NCA encompasses 68,000 acres along 35 miles of California’s north coast. It is the Nation&#8217;s first NCA, designated in 1970. The King Range NCA’s Douglas fir-covered peaks attract hikers and hunters, while the coast beckons to surfers and anglers. World-class mountain bike trails, and 42,585 acres of coastal wilderness are two of the highlights of this incredibly unique area.</p>

<p>A bicyclist who wasn’t on a designated bicycle route when he was injured by a pothole can’t recover from the city of Chicago, even though there was a Divvy bicycle rental station nearby, the Illinois Supreme Court ruled last month.</p>
<p>The state supreme court ruled against bicyclist Clark Alave, who said he was thrown from his bicycle after striking the pothole in 2019, fracturing his teeth, injuring his hip and shoulder, and causing facial cuts and scars.</p>
<p>The <a href="https://chicago.suntimes.com/2023/12/24/24014373/illinois-supreme-court-chicago-cyclists-bike-pothole-safety-pothole-transportation-court-safety">Chicago Sun-Times</a>, the <a href="https://cookcountyrecord.com/stories/653370680-illinois-supreme-court-says-cyclist-can-t-sue-chicago-for-injuries-caused-by-pothole">Cook County Record</a> and Capitol News Illinois via <a href="https://news.wttw.com/2023/12/20/illinois-supreme-court-rules-chicago-not-liable-street-pothole-not-intended-cyclists">WTTW</a> have coverage.</p>
<p>The Illinois Supreme Court interpreted the Illinois Tort Immunity Act, which said cities have a duty to maintain their property in a reasonably safe condition for use by people “intended and permitted” to use the property.</p>
<p>Chicago permits bicyclists to use any roadway that motorists use, but that doesn’t mean that bicyclists are intended to use all those roadways, the Illinois Supreme Court said in its <a href="https://ilcourtsaudio.blob.core.windows.net/antilles-resources/resources/5b96c141-aa4d-43b0-a310-f11c83c5abcb/Alave%20v.%20City%20of%20Chicago,%202023%20IL%20128602.pdf">Dec. 14 opinion</a>.</p>
<p>In Alave’s case, he was riding on a road without a designated bike lane and signage, indicating that the city did not intend him to be using the road, the state supreme court said.</p>
<p>The presence of a Divvy station about 100 feet away only establishes that the city permitted bicycling on the road—not that it intended it, the state supreme court said. The Illinois Supreme Court noted that city code allows bicyclists to ride on the sidewalk to access the nearest bicycle lane; in this case, the nearest bicycle lane was one block away, the city said.</p>
<p>Michael S. Keating, who filed an amicus brief on behalf of the advocacy nonprofit Ride Illinois, said in a statement the Illinois Supreme Court’s decision affirmed “harsh precedent” that distinguished between permitted and intended users of roads, according to the Cook County Record.</p>
<p>“This holding simply does not reflect that massive surge in bicycling that has occurred in Chicago, the suburbs and throughout the rest of Illinois,” Keating said. “On that fact alone I think the Illinois Supreme Court should have clarified more specifically what ‘intended’ means beyond just the presence of bike lanes, a bike map or signs.”</p>
<p>Keating did, however, praise the Illinois Supreme Court for a Nov. 30 decision <a href="https://www.abajournal.com/news/article/can-injured-bicyclist-tap-dads-uninsured-motorist-coverage-despite-policy-exclusion-its-covered-top-illinois-court-says">holding that</a> an uninsured motorist policy must cover a policyholder’s son who was injured by a hit-and-run driver while riding his bicycle.</p>
