A Connecticut man allegedly beat a woman to death with a baseball bat over $200 in cocaine, then lived with her body in their apartment for a week-and-a-half before he dismembered her, put her torso in a suitcase and rolled it to a nearby cemetery.

Donald Coffel stands accused of murder in the death of 58-year-old Suzanne Wormser in the city of Groton. According to a probable cause arrest affidavit posted to local CBS affiliate WFSB, Groton city police began investigating on March 19 when a passerby smelled a foul odor from a suitcase at the entrance of Colonel Ledyard Cemetery. The caller told cops he had noticed the suitcase near some trash cans and became curious about what was inside. When he walked up to the suitcase, it smelled as if something was rotting inside, so he called police.

More from Law&Crime: ‘Identification took some time’: 70-year-old woman found chopped up in closet, her body parts stowed away in over a dozen trash bags — son in custody, cops say

Cops got on scene and opened the suitcase to find the torso of a woman’s body that was missing the head and other extremities. Police on April 11 posted a press release on its Facebook page about the death along with an FBI tip line. Wormser’s sister called in to say she hadn’t heard from her in months and she didn’t call to wish her a happy birthday, which was unlike her. She gave cops Wormser’s address and detectives went to check out the apartment in the 100 block of Allen Street, which happens to be less than 1,000 feet from the cemetery.

Officers also learned that Coffel had lived with her for a time. Neighbors told cops they hadn’t seen Wormser in months and Coffel was in the hospital. Cops entered the home and it was evident there had been a crime committed, the affidavit said. There was blood on the walls, rugs, furniture and clothing. Investigators also found a baseball bat hidden behind a bookcase. On the bat, there appeared to be dried blood and strands of brown hair matted on it, according to the cops.

Detectives went to the hospital to speak with Coffel, who was receiving treatment for pancreatic cancer. During a noncustodial interview, Coffel explained that he used to be Wormser’s neighbor before he moved to Arizona for a few months to live near his sister. That didn’t work out, so he moved back to Groton. Since he didn’t have anywhere else to live, Wormser allowed him to live with her starting in late November. He told cops Wormser had drug and mental health problems, and he didn’t particularly like her, but he tolerated her since she was allowing him to live in the apartment.

Coffel said he had back surgery in late December and stayed in the hospital before returning home in late January. He said she was there when he came home, but later left. Cops noted in the affidavit he “seemed to settle on the idea of the victim going missing between January and February when he came back from a hospital visit.” Coffel allegedly said he didn’t know where she went and it wasn’t unusual for her to leave for a day or two at a time and return.

Meanwhile, investigators tested the blood in the apartment and it came back as a DNA match to the remains found in the suitcase at the cemetery.

Detectives received a call on April 22 from a witness who told them Coffel allegedly admitted to him that he beat Wormser with a baseball bat because she stole $200 worth of cocaine that was in his briefcase. They returned to the hospital on April 23 and confronted Coffel about this revelation and questioned if they were going to find his DNA on her body, the affidavit said. After repeated questioning, Coffel allegedly copped to his crime.

“Alright man,” he said, according to the affidavit. “I did it. I hit her in the head with a f—ing baseball bat and it cracked her f—ing head open.”

Coffel allegedly told cops he killed her sometime in the early part of January. Upset about the missing drugs, he said he walked up to her with the bat and hit her in the head three times, killing her, according to cops. After about a week-and-a-half of living with the body, he used a hacksaw to chop her up, cops said. He disposed of her parts in trash bags and dumped them in two different dumpsters, the affidavit said. He put the torso in the suitcase and took it over to the cemetery, according to the affidavit.

Police obtained a warrant for murder and arrested him at the hospital, where he remains.

Because the case was so gruesome and there were so few details publicly released in the early part of the investigation, rumors swirled about a possible serial killer. But cops debunked that rumor at a Friday press conference announcing Coffel’s arrest.

Coffel is being held on a $1 million bond.

In yet another almost-replay of the arguments made before the lower court in Donald Trump’s long-stalled-out Mar-a-Lago case, a group of law professors, legal scholars and a public interest law firm are asking the 11th Circuit Court of Appeals to let them file a brief as amici curiae (“friends of the court”) — on the defendant’s behalf.

On Tuesday, South Texas College of Law Professor Josh Blackman and Florida lawyer Michael Adam Sasso argued that legal scholar and Professor Seth Barrett Tillman, former prosecutor Robert W. Ray, and the conservative Landmark Legal Foundation should be allowed their say as special counsel Jack Smith looks to reanimate the prosecution.

In a motion for leave to file their brief, the attorneys say it is effectively their clients’ turn to catch the court’s ear — because two groups of pro-prosecution amici were allowed to file their own briefs late last month. And, they argue, this is not entirely unlike déjà vu: U.S. District Judge Aileen Cannon allowed all three groups to file briefs in the lower court case and she seriously considered each group during oral arguments.

“These amici advanced arguments that supplemented the positions taken by the Special Counsel and the Defendants,” the motion reads. “The District Court’s order cited these three amici. Now, as this case continues on appeal, assistance from amici continues. The constitutional lawyers have already filed their brief. And the Ray-Tillman-Landmark Amici now seek leave to file a brief.”

In their late September briefs, the pro-prosecution amici argued for the appellate court to reverse the dismissal of the Mar-a-Lago prosecution and for the case to be reassigned to another jurist.

In July, after “careful study,” Cannon threw out the case by finding U.S. Attorney General Merrick Garland had unlawfully appointed Smith as special counsel. She favorably cited several sections of Justice Clarence Thomas’ concurrence in Trump’s Supreme Court immunity case.

While Smith has not tried to have Cannon removed, the pro-prosecution amici cited several reasons related to the pace of the case and access to certain information in their effort.

More Law&Crime coverage: Mar-a-Lago judge allows former Scalia clerk, law professor, and attorney for anti-Trump coalition to argue in court over Jack Smith’s power to prosecute

The pro-Trump amici, however, largely sidestep the issue of Judge Cannon continuing on the case one way or another — by arguing that the dismissal was properly decided.

“The District Court correctly dismissed the indictment,” the pro-Trump amici argue in their 48-page Tuesday filing.

The lone reference to the removal effort is in a footnote:

Judge Cannon carefully parsed the historical record, and read it in a charitable manner toward Smith. This effort to reassign the case, which Smith wisely did not support, is as meritless as the “orchestrated campaign” of frivolous complaints filed against Judge Cannon.

And that historical record, the brief argues, “is not spotty — it is near-empty” when it comes to outside lawyers hired as special counsels with the kind of power and authority that Smith currently claims.

“Contrary to Smith’s incomplete account, this documentary record shows that during these six presidential administrations, Attorneys General retained outside lawyers as Special Counsels either: (1) to assist a U.S. Attorney with prosecutions, or (2) to assist the Attorney General with an investigation,” the filing reads. “In none of these matters did the Attorney General appoint an outside lawyer as a Special Counsel, and then delegate to him the powers now claimed by Smith: all of the powers of a Senate-confirmed U.S. Attorney.”

And, the potential amici say, Cannon even gave Smith some leeway earlier on. This leeway, they say, was undeserved.

“The District Court understated how weak the historical record is for Smith,” the brief argues.

More Law&Crime coverage: Lawyers, law professors, ex-DOJ officials tell 11th Circuit that Trump’s dismissed yet ‘seemingly straightforward’ Mar-a-Lago case must be taken away from Judge Cannon

In the proposed brief, the would-be amici — who the 11th Circuit has yet to approve — also spend substantial time going after Smith for relying on the landmark Supreme Court case of United States v. Nixon.

In that case, the justices found that four particular statutes “vested in” the attorney general “the power to appoint subordinate officers to assist him in the discharge of his duties.” Those same statutes were later used by Garland to imbue Smith with prosecutorial power.

In Cannon’s opinion, however, she dismissed that statement as “dicta” because, among other reasons, the case itself was not about “the Attorney General’s statutory appointment authority or the Appointments Clause more generally.” Trump’s attorneys have indicated they agree the language in Nixon was dicta.

The pro-Trump amici also say the Nixon case should not have any bearing here — but distinguish their arguments somewhat.

“Defendants’ attorneys seek only to show that United States v. Nixon’s contested language is dicta,” the motion for leave to file reads. “Ray-Tillman-Landmark, by contrast, seeks to establish that Nixon was a unique decision based on unique facts and a unique statutory and regulatory regime, which is not applicable in the instant litigation.”

In the Nixon decision, the justices, “expressly and repeatedly described the circumstances giving rise to the conflict between Nixon and [Special Prosecutor Leon] Jaworski as unique,” the brief reads.

The amici go on to cite at least four instances in which some permutation of the word “unique” is used to describe the situation between the president and the prosecutor in the Nixon case.

“The clear implication is that the nexus of facts and operative law involving pre-Nixon Special Counsels, were, in fact, dissimilar, and that the Court’s analysis should not be extended to different facts concerning future Special Counsels,” the brief reads. “Nixon was the proverbial ticket good for one ride — or perhaps, one president.”

He was charged with assaulting an officer of the United States, assaulting an officer of the United States with a deadly or dangerous weapon, obstruction of an official proceeding, unlawful entry and physical violence on restricted building or grounds and violent entry and disorderly conduct on Capitol grounds. Defense attorneys are reviewing the offer, and a plea hearing is set for May 10, according to the court docket.

Jackson joined rioters as they tried to break through the barricaded doorway of the Senate wing entrance on the west side of the Capitol building, authorities said. Thousands of Donald Trump supporters were there that day protesting Congress certifying Joe Biden’s 2020 electoral win.

Video surveillance footage captures Jackson making a fist and repeatedly striking a Capitol officer while trying to enter the building, officials said. Authorities said video footage shows Jackson — in a black hooded sweatshirt, a tan military-style backpack, and a light blue surgical mask on his face — repeatedly striking a group of officers with a metal baseball bat.

In an interview with Baltimore’s CBS affiliate WJZ-TV on Jan. 6, he said, “I had a bat. They were pepper spraying people. Then, they got me in the eye.” Asked why he was there, Jackson said he was “fighting for America. We’ve been taken over by globalists, by the Chinese. Fighting for America. I’m not here for Trump. I’m here for America.”

Police allegedly linked Jackson through social media posts showing him swinging the bat. He turned himself in on Jan. 18, 2021, confessed to participating in the protest and identified himself in video and photos, officials said.

In arguing against pretrial detention, Brandi Harden, his defense attorney, described him in court documents as recently homeless, said he had no criminal record, that there were no reports of injuries to officers by him and he voluntarily surrendered when he learned he was wanted.

While in custody, the lawyer said, he allegedly admitted he was there on Jan. 6, identified himself in photos and videos, and “bizarrely rambled in a social media video” about why he was there.

The lawyer argued that while the case against him is serious, the circumstances of the offense must be viewed “through the lens of an event inspired by the President of the United States.”

She also argued that the government exhibits “paint a picture of a mentally challenged teenager” inspired by “inflammatory propaganda.”

“Apparently unaware that a public video admission to criminal conduct at the U.S. Capitol could strip him of the right to vote, Mr. Jackson oddly explains that he has ‘learned a lesson’ from not voting in the 2020 presidential election, (‘because I thought my vote didn’t count’) ensuring that he would ‘vote in future elections.””

She said in court documents he had been on track to graduate from high school in the spring of 2021 but was suddenly faced with homelessness after his mother lost her housing. She moved into a women’s shelter, and he was forced to temporarily move in with his brother, who his lawyer wrote was “an unwilling caregiver” who became overwhelmed with his brother’s care shortly after moving in.

“Mr. Jackson has been diagnosed with several mental health conditions that limit his ability to perform the most basic daily functions,” she wrote.

Prosecutors said his actions that day were violent and he posed a danger to the community.

Prosecutors said he was part of a large mob that outnumbered law enforcement at the Senate wing entrance. They said he was part of a group that tore out windows, ripped open the blocked entrance, and attacked law enforcement. They noted he was allegedly seen striking an officer with his fist several times before the mob forced their way inside and overran the law enforcement, officials said.

“The defendant’s assaultive behavior in part allowed the large mob of individuals to successfully breach the U.S. Capitol, putting additional law enforcement officers and members and staff of Congress at grave risk,” court documents said. “The defendant’s actions allowed other rioters to commit multiple other criminal acts inside the building.”

They argued that was just the beginning of his unlawful conduct and said he got a bat shortly before 4:50 that day.

“Not content with assaulting law enforcement officers with his fists, the defendant physically assaulted law enforcement officers with the bat in order to regain entry,” court documents said. “The defendant’s actions were violent, criminal, and represented a further dangerous escalation aimed at allowing other violent rioters to unlawfully enter the U.S. Capitol. Officers could have easily been seriously injured, if not killed, by his repeated downward blows with the baseball bat.”
