<p>Total bankruptcy filings rose 14.2 percent, with increases in both business and non-business bankruptcies, in the twelve-month period ending Dec. 31, 2024. This continues an ongoing rebound in filings after more than a decade of sharply dropping totals.</p>
<p>According to statistics released by the Administrative Office of the U.S. Courts, annual bankruptcy filings totaled 517,308 in the year ending December 2024, compared with 452,990 cases in the previous year.</p>
<p>Business filings rose 22.1 percent, from 18,926 to 23,107, in the year ending Dec. 31, 2024. Non-business bankruptcy filings rose 13.9 percent to 494,201, compared with 434,064 in December 2023.</p>
<p>Bankruptcy totals for the previous 12 months are reported four times annually.</p>
<p>For more than a decade, total filings fell steadily, from a high of nearly 1.6 million in September 2010 to a low of 380,634 in June 2022. Total filings have increased each quarter since then, but they remain far lower than historical highs.</p>

	Business filings rose 33.5 percent, from 17,051 to 22,762 in the year ending September 30, 2024. Non-business bankruptcy filings rose 15.5 percent to 481,350, compared with 416,607 in the previous year.

<p><a href="https://lawandcrime.com/?s=giuliani+" target="_blank" rel="noopener">Rudy Giuliani’s</a> quest to cut down hundreds of thousands in bankruptcy fees by nearly half has not gone on in his favor, even after he claimed to be “overbilled” and even after the judge in the case and the forensic financial advisor both reduced the amount of money owed.</p>
<p>A Friday <a href="https://storage.courtlistener.com/recap/gov.uscourts.nysb.319064/gov.uscourts.nysb.319064.320.0.pdf" target="_blank" rel="noopener">filing</a> from Global Data Risk noted that the prior ask of $324,843.75 in fees was dropping down to $300,480.47, as a consequence of the objections of the U.S. Trustee’s Office and U.S. Bankruptcy Judge Sean Lane’s decision.</p>
<p>“In response to objections that the United States Trustee raised informally, GDR agreed to voluntarily reduce its fees by $7,562.50. The Court reduced the total fees to be paid by an additional $16,800.78,” a footnote detailed.</p>

<p>While a reduction of $24,363.28 is better than nothing for Giuliani’s purposes, it’s a far cry from what he wanted.</p>

<p>In August, Global Data Risk <a href="https://storage.courtlistener.com/recap/gov.uscourts.nysb.319064/gov.uscourts.nysb.319064.310.0.pdf" target="_blank" rel="noopener">filed its fee application</a> and demanded $324,843.75 for “1,181.25 hours of services” and $6,854.29 more in expenses racked up over the course of the bankruptcy, totaling the fee demand at that time at $331,698.04. <a href="https://lawandcrime.com/high-profile/rudy-giuliani-objects-to-high-amount-in-fees-racked-up-by-forensic-financial-investigator-in-bankruptcy/" target="_blank" rel="noopener">In response</a>, Giuliani filed documents looking to slice the professional fees he owes nearly in half, claiming that he was “overbilled” due to “duplicative time entries” and “excessive” research-related services. He asked for a reduction of $151,662.50 from the tab, a discount of roughly 46 percent.</p>

<p>Global Data Risk <a href="https://lawandcrime.com/high-profile/forensic-financial-firm-insists-rudy-giuliani-is-on-another-bad-faith-crusade-to-avoid-paying-bankruptcy-related-tab/" target="_blank" rel="noopener">insisted</a> in reply that Giuliani “got an incredible deal” under the circumstances and yet he was still mounting “another baseless and bad faith crusade” to avoid paying up.</p>
<p>Why didn’t Giuliani get the fee reduction he asked for? At a hearing last week, the judge reportedly remarked that Giuliani’s own conduct in the bankruptcy was to blame.</p>
<p>“There was an alarming and inappropriate lack of financial transparency by the debtor … which led to the need for this work,” Lane said, <a href="https://www.cnn.com/2024/09/24/politics/rudy-giuliani-bankruptcy/index.html" target="_blank" rel="noopener">according to CNN</a>.</p>
<p>In other words, had there been transparency there would have been no need for creditors — defamed Georgia 2020 election worker Shaye Moss, Dominion Voting Systems, and Noelle Dunphy — <a href="https://lawandcrime.com/high-profile/rudy-giuliani-bashes-onerous-punitive-request-to-drain-all-funds-in-his-bank-accounts-to-pay-financial-investigator-before-apartment-sale/" target="_blank" rel="noopener">to hire Global Data Risk to investigate his finances</a>, and there would have been no whopping fees.</p>

	Personal and business bankruptcy filings rose 16.2 percent in the twelve-month period ending June 30, 2024, compared with the previous year. 
</p>
<p>
	According to statistics released by the Administrative Office of the U.S. Courts, annual bankruptcy filings totaled 486,613 in the year ending June 2024, compared with 418,724 cases in the previous year.
</p>
<p>
	Business filings rose 40.3 percent, from 15,724 to 22,060 in the year ending June 30, 2024. Non-business bankruptcy filings rose 15.3 percent to 464,553, compared with 403,000 in the previous year.
</p>
<p>
	Bankruptcy totals for the previous 12 months are reported four times annually. For more than a decade, total filings fell steadily, from a high of nearly 1.6 million in September 2010 to a low of 380,634 in June 2022. Total filings have increased each quarter since then, but they remain far lower than historical highs.

<p>The judge presiding over Rudy Giuliani’s bankruptcy on Thursday granted a reprieve by declining to decide, then and there, whether the former New York City mayor should have to sell his million-dollar Florida condo, but the jurist also issued a clear warning: The worst is very likely yet to come.</p>
<p>Before a Thursday hearing, Giuliani asked U.S. Bankruptcy Judge Sean Lane not to force him to sell the condo as he appeals the $148 million Georgia election workers defamation judgment that sent him into bankruptcy. Giuliani has maintained that the judgment was “unreasonable on its face” and has <a href="https://lawandcrime.com/high-profile/in-bankruptcy-filing-rudy-giuliani-calls-148-million-defamation-judgment-unreasonable-on-its-face-and-doubts-threatened-georgia-election-workers-suffered-any-damages/" target="_blank" rel="noopener">expressed doubts</a> that Ruby Freeman and Shaye Moss suffered “any” damages.</p>
<p><a href="https://lawandcrime.com/uncategorized/rudy-giuliani-begs-bankruptcy-court-to-let-him-keep-his-florida-condo-so-he-can-keep-podcasting-to-pay-creditors/" target="_blank" rel="noopener">Giuliani argued</a> that ordering him to sell the Florida condo now when, in his view, the judgment may be significantly reduced on appeal, would cause him irreparable harm — and, in any event, he’s already agreed to sell his Manhattan property. He also said he’s “working diligently to grow his broadcast income” and plans to use the Florida condo to do so, which would “only serve to benefit creditors.”</p>

<p>While Lane did not make Giuliani sell the Florida property, Reuters <a href="https://www.reuters.com/legal/judge-warns-giuliani-about-pyrrhic-victory-florida-condo-dispute-2024-04-04/" target="_blank" rel="noopener">reported</a> that the bankruptcy judge did ominously forecast that lawyers representing the Official Committee of Unsecured Creditors could lash out as harshly as one might imagine.</p>
<p>“The debtor may succeed in fending off this motion, only to be faced with far more draconian requests for relief in the future,” he reportedly said, warning that Giuliani’s assets may be pursued through other means. The Associated Press <a href="https://apnews.com/article/rudy-giuliani-bankruptcy-georgia-a63f6da1287e244d3e83be4a2b7c6769?taid=660f7bf02d12050001ae9a98&amp;utm_campaign=TrueAnthem&amp;utm_medium=AP&amp;utm_source=Twitter" target="_blank" rel="noopener">reported</a> that the judge mentioned the committee may seek the appointment of a Chapter 11 bankruptcy trustee — <a href="https://www.cacb.uscourts.gov/faq/trustee-what-their-role-bankruptcy-case" target="_blank" rel="noopener">that is</a>, a trustee who would “manage the affairs of the debtor and make all decisions” about Giuliani’s property and has the power to “propose a plan of reorganization.”</p>
<p>“This is a warning shot across the bow,” the judge reportedly told Giuliani, urging him to “promptly” clarify in detail the state of his finances.</p>
<p>There does appear to be some support for the judge’s warnings that the committee appointed to represent those Giuliani owes will assume an aggressive posture after the court declined to immediately rule on the Florida condo issue, amounting to a win for Giuliani — for now.</p>
<p>The committee, <a href="https://lawandcrime.com/high-profile/rudy-giulianis-discovery-misconduct-in-defamation-case-opens-door-for-bankruptcy-lawyers-to-demand-docs-on-legal-services-for-trump-cable-tv-earnings-and-more/">frustrated by delay tactics in early March</a>, told the judge it was pursuing documents on the “nature of any legal services” that Giuliani “performed, or continue[s] to perform” for former President Donald Trump. The committee, adding that Giuliani and several allies (including his son Andrew Giuliani) should be made to sit for a deposition, demanded documents and communications “sufficient to show” Giuliani’s yearly and monthly earnings from media appearances, including on cable TV and radio, from his podcasts Common Sense (distributed through YouTube, Rumble and Spike), Uncovering the Truth, and The Rudy Giuliani Show, and from his America’s Mayor Live streaming on Instagram, Facebook, Gettr, and YouTube.</p>

<p>The creditors’ lawyers complained that Giuliani’s “historical pattern of financial obfuscation and discovery misconduct” could come into play again, <a href="https://lawandcrime.com/high-profile/blobs-of-indecipherable-data-judge-excoriates-giuliani-for-paying-lip-service-to-legal-process-despite-doing-this-for-50-years/" target="_blank" rel="noopener">as it did in the Freeman case</a> that led to the bankruptcy proceedings. They claimed that several Giuliani asset disclosures were “incomplete or otherwise inconsistent,” whether for vagueness or for valuation discrepancies (including for New York Yankees World Series rings).</p>
<p>“Further, to date in the Chapter 11 Case, Giuliani and his counsel have been, at best, slow to respond to requests by the Committee to obtain documents and information regarding Giuliani’s assets and financial condition, and his financial disclosures to date in the instant case have been, at best, insufficient,” the committee said.</p>

<p>
	Total bankruptcy filings rose 16.8 percent, with significant increases in both business and non-business bankruptcies, in the twelve-month period ending Dec. 31, 2023. This accelerates a continuing rebound in filings after more than a decade of sharply dropping totals.
</p>
<p>
	According to statistics released by the Administrative Office of the U.S. Courts, annual bankruptcy filings totaled 452,990 in the year ending December 2023, compared with 387,721 cases in the previous year.
</p>
<p>
	Business filings rose 40.4 percent, from 13,481 to 18,926, in the year ending Dec. 31, 2023. Non-business bankruptcy filings rose 16 percent to 434,064, compared with 374,240 in December 2022.
</p>
<p>
	Bankruptcy totals for the previous 12 months are reported four times annually.
</p>
<p>
	This is the fourth straight quarter that total bankruptcy filings have risen, following a decade-plus decline. Bankruptcies fell especially sharply after the pandemic began in early 2020, despite some COVID-related disruptions to the economy.
</p>
<p>
	Despite the recent increases, the newest totals remain far lower than in December 2010, when filings peaked at just less than 1.6 million.

<p>Lawyer Rudy Giuliani, who once represented former President Donald Trump, owes more than $152 million, and that doesn’t include the potential damages that he faces in pending lawsuits, according to his Chapter 11 bankruptcy filing Thursday.</p>
<p>The debts include $1.36 million owed to Davidoff Hutcher &amp; Citron, a law firm that represented Giuliani in criminal cases, and more than $387,000 owed to a firm that represented him in legal ethics proceedings, the <a href="https://www.nytimes.com/2023/12/21/us/politics/rudy-giuliani-bankruptcy.html">New York Times</a> reports.</p>
<p>The largest debt, however, is the <a href="https://www.abajournal.com/news/article/what-are-giulianis-next-steps-after-148m-defamation-verdict-can-he-afford-appeal-bond">$148 million</a> that Giuliani was ordered to pay to two Georgia election workers for defamation and emotional distress for false claims about vote tampering.</p>
<p>Giuliani estimates the value of his assets at $1 million to $10 million in the <a href="https://static01.nyt.com/newsgraphics/documenttools/385e30feedbd4a56/29741153-full.pdf">Dec. 21 petition</a>, filed in the U.S. District Court for the Southern District of New York.</p>

<p>Ted Goodman, a political adviser and a spokesperson for Giuliani, told the New York Times that the bankruptcy filing will give Giuliani time to pursue an appeal in the election-workers case, provide transparency for his finances, and “ensure all creditors are treated equally and fairly throughout the process.”</p>
<p>Giuliani’s potential liabilities include several pending suits, including two by voting machine companies Dominion Voting Systems and Smartmatic, which sued over stolen-election claims.</p>

	Total bankruptcy filings rose 13 percent, and business bankruptcies rose nearly 30 percent, in the twelve-month period ending Sept. 30, 2023. This continues a moderate rebound after more than a decade of sharply dropping totals.   
</p>
<p>
	According to statistics released by the Administrative Office of the U.S. Courts, annual bankruptcy filings totaled 433,658 in the year ending September 2023, compared with 383,810 cases in the previous year. 
</p>
<p>
	Business filings rose 29.9 percent, from 13,125 to 17,051, in the year ending Sept. 30, 2023. Non-business bankruptcy filings rose 12.4 percent to 416,607, compared with 370,685 in September 2022. 
</p>
<p>
	Bankruptcy totals for the previous 12 months are reported four times annually. 
</p>
<p>
	This is the third straight quarter that total bankruptcy filings have risen, following a decade-plus decline. Bankruptcies fell especially sharply after the pandemic began in early 2020, despite some COVID-related disruptions to the economy.  
</p>
<p>
	Even with the recent increases, total filings remain far lower than in September 2010, when filings peaked at just less than 1.6 million.
