<p>Vice President <a href="https://lawandcrime.com/high-profile/obviously-you-shouldnt-be-pardoned-jd-vance-breaks-from-trumps-had-no-choice-claims-about-jan-6-rioters-and-says-violent-offenders-should-stay-locked-up-and-charged/" target="_blank" rel="noopener">JD Vance</a> took to X on Sunday and suggested that <a href="https://lawandcrime.com/high-profile/unfair-competition-trump-now-wants-20-billion-from-cbs-over-kamala-harris-60-minutes-interview-as-he-amends-lawsuit-to-add-new-claims-and-a-co-plaintiff/" target="_blank" rel="noopener">President Donald Trump</a> has “legitimate power” to ignore judges when carrying out executive orders, claiming courts “aren’t allowed” to <a href="https://lawandcrime.com/high-profile/false-and-repugnant-states-and-doctors-team-up-to-block-trumps-executive-order-on-transgender-medical-care-lawsuit-seeks-permanent-injunction/" target="_blank" rel="noopener">overrule the new POTUS</a>.</p>
<p>“If a judge tried to tell a general how to conduct a military operation, that would be illegal,” Vance <a href="https://x.com/JDVance/status/1888607143030391287" target="_blank" rel="noopener">wrote</a> in an X post. “If a judge tried to command the attorney general in how to use her discretion as a prosecutor, that’s also illegal. Judges aren’t allowed to control the executive’s legitimate power.”</p>

<p>Earlier on Sunday morning, Vance <a href="https://x.com/Vermeullarmine/status/1888376498383618100" target="_blank" rel="noopener">shared a post</a> from Harvard Law School professor Adrian Vermeule, who claimed: “Judicial interference with legitimate acts of state, especially the internal functioning of a co-equal branch, is a violation of the separation of powers.”</p>
<p>On Sunday evening, Vance <a href="https://x.com/KurtSchlichter/status/1888705522045788249" target="_blank" rel="noopener">shared a post</a> from columnist and trial lawyer Kurt Schlichter, which said: “What if the judicial decision is lawless? A key component of the constitutional framework is judicial modesty, which is backed up by the fact that the judiciary has nothing to compel obedience, except its credibility.”</p>
<p>Vance’s signaling came after tech billionaire and DOGE leader Elon Musk voiced his disapproval of being blocked, along with the Department of Government Efficiency, by <a href="https://lawandcrime.com/high-profile/no-one-is-above-the-law-federal-court-blocks-musk-and-doge-from-accessing-sensitive-government-data-orders-employees-to-destroy-all-copies-and-downloads/" target="_blank" rel="noopener">a federal judge</a> from accessing sensitive information provided by the Treasury Department.</p>

<p>Resharing a post from an account called “Insurrection Barbie” on X, Musk suggested that Trump could step in and do something if judges continued to go against him in court.</p>
<p>“I don’t like the precedent it sets when you defy a judicial ruling, but I’m just wondering what other options are these judges leaving us,” the <a href="https://x.com/DefiyantlyFree/status/1888366433886708011" target="_blank" rel="noopener">post</a> said.</p>
<p>Vance, Musk and others who have floated the possibility of Trump ignoring federal rulings have gotten serious pushback and criticism online, with lawmakers and experts calling them out on social media.</p>
<p>“It’s called the ‘rule of law’ @jdvance,” <a href="https://x.com/danielsgoldman/status/1888644011868520905" target="_blank" rel="noopener">wrote</a> Rep. Daniel Goldman (D-NY), lead counsel for Trump’s first impeachment, on X. “Our constitution created three co-equal branches of government to provide checks and balances on each other (‘separation of powers’). The judiciary makes sure that the executive follows the law. If you do, then you won’t have problems.”</p>
<p>Georgetown Law professor Stephen Vladeck wrote, “Just to say the quiet part out loud, the point of having unelected judges in a democracy is so that *whether* acts of state are ‘legitimate’ can be decided by someone other than the people who are undertaking them.”</p>
<p>Former Rep. Liz Cheney said, “If you believe any of the multiple federal courts that have ruled against you so far are exceeding their statutory or Constitutional authority, your recourse is to appeal. You don’t get to rage-quit the Republic just because you are losing. That’s tyranny.”</p>

<p>Since Trump took office and began issuing executive orders, judges have been stepping up to stop or delay his actions in multiple districts across the country.</p>
<p>A federal judge in Rhode Island, for instance, has <a href="https://lawandcrime.com/high-profile/congress-has-not-given-the-executive-limitless-power-federal-judge-torches-trump-admin-with-order-blocking-spending-freeze-says-actions-violate-the-constitution/" target="_blank" rel="noopener">barred the Trump administration</a> from enforcing its murky and controversial federal spending freeze by issuing a temporary restraining order late last month. In Washington state, a federal judge issued a temporary restraining order in mid-January halting Trump’s executive order ending birthright citizenship in the United States.</p>
<p>“This is a blatantly unconstitutional order,” said U.S. District Judge John Coughenour, an appointee of President Ronald Reagan, during a hearing last month.</p>

<p>New York Attorney General Letitia James was celebrating a victory against the Trump administration on Friday as she and a 19-state coalition secured a temporary restraining order that was granted blocking DOGE’s access to the sensitive treasury info.</p>
<p>“From the moment Elon Musk and his DOGE employees gained unprecedented access to our personal private data, state bank account details, and other sensitive information, Americans across the country have been horrified,” James said in a statement. “We knew the Trump administration’s choice to give this access to unauthorized individuals was illegal, and this morning, a federal court agreed.”</p>
<p>The White House has not responded to media requests for comment on Vance’s post or whether Trump plans to fight any of the judges’ rulings. He has yet to say whether he will do so.</p>

<p>A teenager and two parents are facing felonies for their alleged roles in a crash that killed another 18-year-old woman in <a href="https://lawandcrime.com/tag/georgia/" target="_blank" rel="noopener">Georgia</a>.</p>
<p>The driver of the vehicle involved in the crash, 18-year-old Hannah Hackemeyer, is charged with three counts of <a href="https://lawandcrime.com/tag/homicide/" target="_blank" rel="noopener">homicide</a> by vehicle and driving under the influence, among other crimes, DeKalb County District Attorney Sherry Boston said in a press release. Her friend’s parents, Sumanth Rao, 50, and Anindita Rao, 49, are facing <a href="https://lawandcrime.com/tag/involuntary-manslaughter/" target="_blank" rel="noopener">involuntary manslaughter</a> charges for allegedly allowing the teens to drink before the fateful crash that killed Sophia Lekiachvili.</p>
<p>Prosecutors say Hackemeyer, Lekiachvili, and the Rao’s daughter were drinking at the Rao household the night of Feb. 23 and into Feb. 24. The underage teens were drinking with the blessing of Sumanth Rao and Anindita Rao. Boston told reporters Wednesday at a <a href="https://www.youtube.com/watch?v=4Zb0J2MQBS8" target="_blank" rel="noopener">press conference</a> the Rao home was known as the “party house” where underage drinking was the norm.</p>

<p class="text | article-text">“Halloween, Homecoming, the last day of school,” Boston said. “It is a miracle that nothing happened prior to Feb. 24. Mr. and Mrs. Rao’s choices that night led to the death of a teenage girl.”</p>
<p>According to prosecutors, the teens had just polished off a bottle of wine when they decided to go for a drive shortly before midnight. With Hackemeyer driving, Lekiachvili sat in the front passenger seat while the Rao girl rode in the back seat. They had an open bottle of wine in the car. Hackemeyer allegedly was driving the Mazda CX-5 nearly 100 mph — more than 60 mph over the speed limit — when she lost control and crashed, causing the car to roll over.</p>
<p>Hackemeyer and the Rao girl crawled out of the car. First responders rushed to the scene where they found Lekiachvili trapped in the passenger seat. They extricated her and rushed the teen to the hospital where she died from her injuries.</p>
<p>An investigation unveiled that Hackemeyer allegedly had a Blood Alcohol Concentration of 0.046, which is more than twice the legal limit for someone under the age of 21.</p>

<p>“This crash was a foreseeable consequence of allowing underage drinking in their home and worse — allowing someone who they knew had consumed alcohol — to drive,” Boston said in a statement. “We recognize that prosecuting these cases will not bring Sophia back, but we hope that by pursing justice in her death, we may prevent future tragedies.”</p>

<p>The New Jersey Supreme Court has tossed a pending ethics complaint against a judge who sometimes allowed his secretary to work remotely in violation of office policy.</p>
<p>The New Jersey Supreme Court found no ethics violations by New Jersey Judge Douglas H. Hurd in an <a href="https://www.njcourts.gov/sites/default/files/advisory-committee-on-judicial-conduct/hurd-douglas-h/2023-140/hurd_order_acjc.pdf">Oct. 16 order</a>, report <a href="https://www.law360.com/publicpolicy/articles/1891221">Law360</a> and <a href="https://www.law.com/njlawjournal/2024/10/17/nj-supreme-court-steps-in-to-dismiss-controversial-ethics-complaint-against-mercer-county-presiding-judge">Law.com</a>. Hurd is civil presiding judge in the Mercer vicinage in Trenton, New Jersey.</p>
<p>It is rare for the New Jersey Supreme Court to dismiss a disciplinary case before a ruling by the New Jersey Advisory Committee on Judicial Conduct, sources told Law.com.</p>
<p>New Jersey courts were working remotely during the COVID-19 pandemic. When in-person operations resumed, a new policy allowed remote work for one and then two days per week. But the new policy did not apply to judges, secretaries of judges, and judicial law clerks, according to the <a href="https://www.njcourts.gov/sites/default/files/advisory-committee-on-judicial-conduct/hurd-douglas-h/2023-140/formalcomplaint_douglashurd.pdf">Jan. 30 ethics complaint</a>.</p>
<p>Despite the requirement for in-office work, Hurd’s secretary was allowed to work remotely “on a periodic basis” for about six months in 2022, the <a href="https://www.abajournal.com/news/article/judge-faces-potential-discipline-for-allowing-secretary-to-work-remotely">ethics complaint said</a>.</p>
<p>Hurd thought that he had discretion to allow remote work in light of the secretary’s “incredible work ethic,” according to an <a href="https://www.njcourts.gov/sites/default/files/advisory-committee-on-judicial-conduct/hurd-douglas-h/2023-140/amended_answer_douglas_hurd.pdf">amended answer</a> to the ethics complaint.</p>
<p>The secretary worked remotely about three to six days per month during a five- to six-month period. Hurd immediately ended his approval for remote work when he was advised that he didn’t have the discretion to allow it.</p>
<p>Hurd declined to comment on the dismissal of the complaint when Law360 contacted a representative.</p>
<p>Law.com spoke with lawyers who were relieved to hear that the ethics complaint was tossed.</p>
<p>Michael Donahue, managing shareholder of Stark &amp; Stark in Hamilton, New Jersey, told Law.com that Hurd had “an unblemished reputation.” While the complaint was pending, Hurd “kept his head up and the vicinage running,” Donahue said.</p>
<p>“I am incredibly relieved and gratified to hear the news that the New Jersey Supreme Court has seen the right side of this issue,” Donahue said.</p>
<p>A new policy adopted after the ethics complaint was filed allows law clerks and secretaries to work remotely up to four days per month with judicial approval, according to Law.com.</p>

<p>A sleep-deprived prisoner can show that his treatment constituted cruel and unusual punishment without proving that his health issues stemmed from the restricted bedtime hours, a federal appeals court has ruled.</p>
<p>The 5th U.S. Circuit Court of Appeals at New Orleans ruled for Texas inmate Michael Garrett in a <a href="https://www.ca5.uscourts.gov/opinions/pub/22/22-40754-CV0.pdf">March 22 opinion</a>. He is incarcerated in the Estelle Unit in Huntsville, Texas, where inmates are afforded only three and a half hours of sleep per night.</p>
<p>Bedtime is 10:30 p.m., and breakfast begins at about 2 a.m. But sleep is not continuous. The prison conducts an inmate count at 1 a.m.</p>
<p>The author of the March 22 opinion is Judge Edith Brown Clement, an appointee of former President George W. Bush. Her opinion was joined by two appointees of former President Donald Trump, Judge Kurt D. Engelhardt and Judge Andrew S. Oldham.</p>
<p>Garrett suffers from migraines, seizures, vertigo, a skin condition, edema, hypertension and kidney disease.</p>
<p>A federal judge had ruled against Garrett for two reasons. First, the judge said, Garrett didn’t prove a substantial risk of serious harm because he didn’t show a cause-and-effect relationship between the sleep deprivation and his health complaints. Second, the judge said, Garrett hadn’t established deliberate indifference by prison officials because the schedule was based on a legitimate penological interest.</p>
<p>The 5th Circuit said the judge was wrong on both issues.</p>
<p>A prisoner only had to show a substantial risk of serious harm, not actual harm, the appeals court said. And, under U.S. Supreme Court precedent, a prison’s penological purpose has no bearing on conditions-of-confinement claims, the appeals court said.</p>
<p>The case returns to the district court for application of the correct legal standards, according to <a href="https://www.haynesboone.com/news/press-releases/haynes-boone-secures-victory-for-prisoner-denied-adequate-sleep-in-landmark-eighth-amendment-case">a March 25 press release</a> by Haynes Boone, which represented Garrett on a pro bono basis.</p>
<p>“This ruling marks an important victory and key step in Mr. Garrett’s decadelong quest for an ordinary night’s sleep,” said Hanes Boone associate Chris Knight in the press release.</p>
<p>He argued the case before the 5th Circuit in December.</p>
<p>The case is also important, Knight said, because it abrogates 5th Circuit decisions that had applied the wrong standard.</p>

<p>Arguments continue to be made in the disqualification controversy targeting Fulton County District Attorney <a href="https://lawandcrime.com/tag/fani-willis/" target="_blank" rel="noopener">Fani Willis</a> and special prosecutor Nathan Wade as the judge overseeing the matter considers the evidence and relevant legal standards.</p>
<p>Fulton County Superior Court Judge Scott McAfee is, inevitably, <a href="https://lawandcrime.com/high-profile/georgia-prosecutor-has-evidence-fani-willis-and-special-prosecutor-in-trump-rico-case-began-dating-years-ago-court-filing-alleges/" target="_blank" rel="noopener">being inundated</a> with <a href="https://lawandcrime.com/high-profile/another-witness-comes-forward-about-fani-willis-relationship-with-special-prosecutor-in-trump-rico-case-but-legal-experts-question-whether-judge-will-reopen-evidence/" target="_blank" rel="noopener">post-hearing filings</a> as 15 co-defendants still remain in the racketeering (RICO) and election subversion case against Donald Trump. Most, if not all, of those co-defendants have signed onto the effort to remove Willis and her entire office from the case.</p>
<p>An <a href="https://www.documentcloud.org/documents/24463880-clark-reply-willis-dq">11-page brief</a> filed in Fulton County Superior Court on Wednesday by co-defendant <a href="https://lawandcrime.com/tag/jeffrey-clark/" target="_blank" rel="noopener">Jeffrey Clark</a>, a former U.S. Department of Justice lawyer charged in the <a href="https://lawandcrime.com/high-profile/the-motion-is-denied-trump-co-defendant-and-ex-doj-official-jeffrey-clark-loses-effort-to-delay-proceedings-in-georgia-rico-case/" target="_blank" rel="noopener">fake electors plot</a>, accuses Willis of ratifying perjury, misstating the law, and several “actual” conflicts of interest.</p>

<p>Clark is an environmental lawyer whom <a href="https://www.pbs.org/newshour/politics/watch-former-top-doj-official-richard-donoghue-speaks-on-jeffrey-clarks-push-for-false-election-fraud-claims" target="_blank" rel="noopener">Trump nearly tapped</a> to be acting attorney general in his failed scramble to retain the presidency after losing to Joe Biden in the 2020 election. Clark previously worked as an assistant attorney general at one sub-agency within the DOJ and as an acting assistant attorney general within another.</p>
<p>The charges against Clark are based on an unsent draft letter falsely claiming the DOJ “identified significant concerns that may have impacted the outcome of the election in multiple states, including the state of Georgia.” Clark’s draft also called on officials to convene the state legislature and consider advancing a slate of contingent, or fake, electors committed to voting for Trump in the Electoral College.</p>
<p>Clark’s filing, prepared by Harry MacDougald, is stylized as a reply to <a href="https://lawandcrime.com/high-profile/appalling-and-unforgivable-fani-willis-and-defense-in-trump-rico-case-file-hard-charging-motions-claiming-the-other-side-is-wrong-about-disqualification-law/" target="_blank" rel="noopener">the district attorney’s supplemental post-hearing brief</a> — but begins by discussing an issue that the state’s brief did not address at all.</p>
<p>Instead, the filing centers an argument that Willis, and attorneys in her office, bear some measure of responsibility for perjury allegedly committed by Wade during the disqualification hearing.</p>
<p>Wade has said different things about the unraveling of his marriage — specifically regarding his marital fidelity — in his responses to two different sets of interrogatories. <a href="https://lawandcrime.com/high-profile/our-relationship-wasnt-a-secret-lead-prosecutor-in-trump-rico-case-says-broken-marriage-excuses-inconsistent-statements-about-extramarital-affair-with-fani-willis/" target="_blank" rel="noopener">During his testimony</a> in February, he attempted to excuse those inconsistencies filed in court documents.</p>
<p>Clark says Wade lied and that Willis had a duty to correct those lies.</p>
<p>“Wade obviously lied under oath in his testimony on February 15, 2024 when he was attempting to explain his obviously false interrogatory responses in his divorce case,” the reply reads. “We are now 20 days past that testimony. In that intervening period, the District Attorney has said and done nothing whatsoever to either disavow Mr. Wade’s perjured testimony or require him to correct it.”</p>
<p>Categorizing this alleged failure as a “spectacular breach” of her duty, Clark’s filing argues Willis has violated her duty of candor under the professional rules of conduct that govern Peach State lawyers.</p>
<p>“The reason for this state of affairs is obvious — it is in the District Attorney’s personal, individual interests that Mr. Wade’s perjury go uncorrected,” the reply goes on. “Ms. Willis has ratified Mr. Wade’s perjury by not repudiating it as her duty requires. The District Attorney’s professional judgment has not been merely impaired by her conflicts of interest, it has been corrupted beyond redemption.”</p>
<p>Clark’s defense attorney previously raised Wade’s alleged perjury during his own closing arguments in the hearing last week.</p>
<p>“The husband is hiding things from his wife,” MacDougald said. “He lied in his interrogatories and then he got on that stand and lied about lying in his interrogatories. And the lawyers for the DA, the DA’s office, they just sat there and let him do it. They did nothing to correct obviously perjured testimony. And that’s reason enough to disqualify all of them.”</p>
<p>The issue with Wade’s testimony — along with various other aspects of Wade’s long-running divorce case — are later cited to as relevant to four (out of six) “actual conflicts” that have arisen since Willis and Wade were accused of nepotism and self-dealing in a <a href="https://lawandcrime.com/high-profile/this-type-of-nepotism-might-be-forgiven-in-the-abstract-trump-co-defendant-demands-da-be-disqualified-over-allegedly-improper-romantic-relationship-with-rico-special-prosecutor/" target="_blank" rel="noopener">January motion</a> filed by co-defendant and Trump 2020 campaign staffer Mike Roman.</p>
<p>One such actual conflict was the <a href="https://lawandcrime.com/high-profile/an-attempt-to-harass-and-damage-georgia-da-wants-protective-order-against-special-prosecutors-wife-for-allegedly-interfering-in-trump-case/" target="_blank" rel="noopener">unusual decision by the district attorney herself</a> to file a nonparty motion in Wade’s divorce to obtain a protective order against Wade’s estranged wife, Clark argues.</p>
<p>“In that filing the District Attorney violated Rule of Professional Conduct 3.4(h) by abusing the power of her office to threaten her boyfriend’s wife with criminal prosecution to gain advantage for herself and her boyfriend in her boyfriend’s divorce,” the reply reads. “This is also an actualized conflict of interest in which she advanced her personal interests and those of Mr. Wade to the detriment of her professional duties.”</p>
<p>The state has attempted, <a href="https://lawandcrime.com/high-profile/absolutely-absurd-fulton-county-das-office-blasts-trump-rico-defendants-but-struggles-to-answer-judges-questions-while-defending-fani-willis-in-disqualification-hearing/" target="_blank" rel="noopener">with questionable success so far</a>, to convince McAfee that an actual conflict of interest is the legal standard by which a prosecutor can be removed from a case in Georgia.</p>
<p><a href="https://www.documentcloud.org/documents/24460101-state-supplemental-on-hearing-dq-willis-motion" target="_blank" rel="noopener">In their supplemental brief</a>, the state also essayed an even higher burden on the defense which would apply the “actual conflict” standard to a very specific set of facts. Namely, that a prosecutor must have a monetary interest in the outcome of a case.</p>
<p>MacDougald rubbished that theory as not in accord with the law.</p>
<p>“This ignores that a prosecutor’s statutory duty of impartiality inheres in every official act they take, not just conviction,” the reply reads. “The enforcement process has a milestone at the point of conviction but the process obviously begins earlier.”</p>
<p>The reply goes on to cite case law in Georgia which, it claims, stands for the proposition that “indictments were to be quashed if the personal interest existed when the case was presented to the grand jury.”</p>
<p>Clark’s reply likens those facts to the present case, at length:</p>

<p>Here, Mr. Wade was paid over $650,000 over a two-year period beginning long before the indictment and long before any conviction, and the District Attorney received gifts from him during this period. She therefore had a personal interest in the case that was operative at the time of indictment. The State’s suggestion that this does not matter because the interest must be in conviction alone should be rejected because it is premised on the false notion that prosecutors have no duties of impartiality at any other time in the progress of a criminal case.</p>
