<p>A district court misinterpreted the law when it ruled that an adult adoptee can’t obtain her 1978 adoption records to provide her doctors with information about health predispositions, the Utah Supreme Court has ruled.</p>
<p>At issue is whether adoptee Marianne Tyson had shown “good cause” to obtain the records as required by Utah law, which seals adoption records for 100 years.</p>
<p>A district court had ruled that Tyson didn’t satisfy the “good cause” standard because the health and genetic information that she sought was not related to a specific medical condition.</p>
<p>The district court reasoned that giving Tyson access to the records would undermine the law’s privacy protections for birth parents.</p>
<p>The Utah Supreme Court ruled that the district court erred by trying “to breathe a more specific meaning into the phrase ‘good cause.’ Although it is understandable that the court would want more guidance than the statute provides, it interpreted the statute in a fashion that rewrote the law.”</p>
<p>“Stated differently,” the Utah Supreme Court said in its <a href="https://legacy.utcourts.gov/opinions/supopin/In%20re%20Adoption%20of%20M.A.20240222.pdf">Feb. 22 decision</a>, “if the legislature had wanted to impose a requirement that a petitioner point to something more than wanting to know her medical history, it could have put that in the statute. It did not, and it was error for the court to do so.”</p>
<p>The district court had determined that Tyson’s reasons for obtaining the records did not outweigh her birth mother’s interest in privacy.</p>
<p>“But instead of balancing both interests” as required by a Utah procedural rule, the district court “focused solely on the birth mother’s privacy interests,” the Utah Supreme Court said.</p>
<p>The state supreme court said it was returning the case to the trial court to conduct a balancing “that gives weight to both the birth mother’s privacy interests and Tyson’s reasons for wanting to see her adoption records.”</p>

<p>A gay adult film actor and member of the <a href="https://lawandcrime.com/?s=%22proud+boys%22" target="_blank" rel="noopener">Proud Boys</a> is going to prison for breaching the U.S. Capitol perimeter and confronting officers while wearing his desert-camouflaged jacket and jungle camouflage pants during the riots on Jan. 6, 2021.</p>
<p>Federal authorities say he played a leading role in escalating the riots that fateful day.</p>

<p>Steven Miles, 40, whose film persona is “Sgt. Miles,” was sentenced to 24 months in prison and 12 months of supervised release and ordered to pay $2,000 in restitution, officials said in a <a href="https://www.justice.gov/usao-dc/pr/florida-proud-boy-sentenced-felony-charge-assaulting-officers-and-breaking-window-during" target="_blank" rel="noopener">news release</a>. Miles pleaded guilty in October to a felony charge of assaulting, resisting, or impeding certain law enforcement officers.</p>
<p>According to court documents, Miles traveled from his home near Tampa to Washington, D.C. to contest the 2020 presidential election.</p>
<p>He and other members of the Proud Boys left the rally site long before the speeches began, walked to the West Front of the Capitol, and played a leading role in escalating the riot, authorities said. As the Proud Boys marched to the Capitol, they chanted, “USA!” “Where’s Antifa,” and “Whose Capitol? Our Capitol!”</p>
<p>The confrontation between the mob and the police escalated into a fight. Miles shoved and tried to punch an officer to break through the line. When the rioters breached a police line at another point, Miles rushed to take advantage, authorities said.</p>
<p>He was caught on closed-circuit television driving a wooden plank through a window of the Senate wing door to get in, followed by a rush of rioters overwhelming law enforcement.</p>
<p>Inside, Miles turned toward the Senate, where he ran into police officers who directed him outside.</p>
<p><a href="https://lawandcrime.com/u-s-capitol-breach/florida-man-charged-with-pushing-police-and-smashing-window-of-senate-door-as-jan-6-assault-cases-continue-to-climb/" target="_blank" rel="noopener">Law&amp;Crime</a> first reported on Miles after his April 12, 2022, arrest in the small city of Zephyrhills. On the day in question, a brown-bearded Miles arrived at the Capitol sporting a red “Make America Great Again” baseball hat, navy gloves, camouflage pants, a backpack, tan boots, and a tan camouflage jacket with a patch bearing his surname on his left sleeve.</p>
<p>In other photos, he wears a black shirt reading “Trump 2020 F— Your Feelings.”</p>
<p><a href="https://www.advocate.com/crime/2022/4/14/gay-adult-film-entertainer-sergeant-miles-arrested-role-jan-6-insurrection-capitol" target="_blank" rel="noopener">The Advocate</a> reported Miles is among several members of the LGBTQ+ community arrested during the Jan. 6 riots.</p>
