President Donald Trump addresses a joint session of Congress on Capitol Hill in Washington, Tuesday, March 4, 2025 (AP Photo/Alex Brandon).

A federal judge in Washington, D.C., on Friday halted key sections of President Donald Trump’s sweeping executive order purporting to unilaterally change the rules regarding how federal elections are run, finding that the plaintiffs in the case were “substantially likely to prevail” on the merits.

In a 120-page order, U.S. District Judge Colleen Kollar-Kotelly issued a preliminary injunction blocking the president’s measure that would require amending the national voter registration form to require proof of U.S. citizenship as well as a provision ordering federal agencies to “assess the citizenship” of individuals who receive public assistance before they are provided a voter registration form.

Kollar-Kotelly, an appointee of President Bill Clinton, wrote that allowing those measures to be implemented would cause “irreparable harm” to the plaintiffs and “would not be in the public interest.”

“Our Constitution entrusts Congress and the States — not the President — with the authority to regulate federal elections,” the order states. “Consistent with that allocation of power, Congress is currently debating legislation that would effect many of the changes the President purports to order. And no statutory delegation of authority to the Executive Branch permits the President to short-circuit Congress’s deliberative process by executive order.”

The court noted that the legislation in Congress is the Safeguard American Voter Eligibility [SAVE] Act, a Republican-backed measure critics have said could potentially disenfranchise millions of eligible voters. Many provisions of the SAVE Act are encompassed by Trump’s executive order.

The consolidated case challenging Trump’s Executive Order, “Preserving and Protecting the Integrity of American Elections,” was brought by three plaintiffs: two voting rights groups and the Democratic National Committee.

In their complaint, the plaintiffs claimed that the president lacks the power to issue the directives in his order, asserting that the executive has “no role in regulating federal elections” under the U.S. Constitution and relevant federal laws.

Kollar-Kotely rejected the plaintiffs’ request to block three other parts of Trump’s order because the claims were premature or were better addressed by a different court. Provisions not halted by the court include one directing the Departments of Homeland Security and State to give access to the so-called Department of Government Efficiency access to databases to “search for non-citizens who have registered to vote,” and two requiring states to stop counting mail-in votes received after election day or have federal funds withheld.

Trump’s order is an apparent attempt to bolster the false claim that he won the 2020 presidential election. Since his loss to Joe Biden, Trump has repeatedly promulgated erroneous conspiracy theories positing that the election was rife with voter fraud and rigged in favor of Democrats.

“[T]he United States now fails to enforce basic and necessary election protections employed by modern, developed nations, as well as those still developing,” Trump’s directive stated. “Free, fair, and honest elections unmarred by fraud, errors, or suspicion are fundamental to maintaining our constitutional Republic. The right of American citizens to have their votes properly counted and tabulated, without illegal dilution, is vital to determining the rightful winner of an election.”

Trump has continued to promote that fictitious narrative even after he took office for the second time. Earlier this month, he wrote on social media that the war between Russia and Ukraine “would never have happened if the 2020 Election had not been RIGGED, in other words, if I were President.”

Following Kollar-Kotelly’s order, White House spokesperson Harrison Fields issued the following statement to CBS News:

“President Trump will keep fighting for election integrity, despite Democrat objections that reveal their disdain for commonsense safeguards like verifying citizenship. Free and fair elections are the bedrock of our Constitutional Republic, and we’re confident in securing an ultimate victory in the courtroom.”

Former Mesa County Clerk and Recorder Tina Peters looks on during sentencing for her election interference case at the Mesa County District Court Thursday, Oct. 3, 2024, in Grand Junction, Colo. (Larry Robinson/The Grand Junction Daily Sentinel via AP).

The first election official convicted of a felony over 2020 election conspiracy theories promulgated by followers of Donald Trump is appealing an earlier contempt of court ruling in a related case.

Tina Peters, 68, is the former county clerk of Mesa County, Colorado. In August, she was convicted on seven counts of engaging in a security breach — related to unauthorized access to voting machines. In October, after a marathon hearing in which the defendant repeatedly expressed defiance and stuck to her theories, she was sentenced to nine years in state prison for those felony offenses.

While sitting in the gallery during a February 2022 hearing for one of her alleged co-conspirators, Peters allegedly used an iPad to record some of the proceedings. In May 2023, she was found guilty of contempt for that decidedly lesser charge — and fined $1,500.

In June, Peters appealed her contempt citation, with the state filing its reply brief the following month. This week, Peters’ attorney John Case appeared before a three-judge panel of the Colorado Court of Appeals.

“Treat my client as if she were some other poor person and not outspoken or a public figure,” the defense attorney pleaded with the appellate court in Denver, according to a courtroom report by Courthouse News Service.

Authorities claim Peters and her deputy clerk Belinda Knisley engaged in election equipment tampering and official misconduct by allowing an unauthorized third party to make copies of voting machine hard drives before and after a “trusted build” systems upgrade — a software update — in May 2021. Knisley is alleged to have made sure security cameras were turned off in the room where the machines were stored so photographs could be taken by the third party during the trusted build. She ultimately pleaded guilty to trespassing, first-degree official misconduct and violation of duty and was given two years of unsupervised probation, 150 hours of community service and agreed to testify against Peters.

The iPad incident occurred during one of Knisley’s hearings.

On appeal, Peters claims the prosecution failed to prove their case.

“To prove the contents of a recording, the original recording must be presented consistent with the Best Evidence Rule,” the appellate brief reads. “Because the prosecution presented no evidence that Ms. Peters’ iPad contained a recording of the February 7, 2022, hearing, the prosecution failed to meet its burden of proof beyond a reasonable doubt, and the contempt must be vacated.”

The defendant also argued there was no lawful court order in effect that specifically made recording proceedings verboten.

“The trial court never found as a fact that Judge Barrett had entered a lawful order that prohibited recording the proceedings in his courtroom,” the appellate brief goes on. “Nor did the court find that Ms. Peters knew of the order before the District Attorney accused her of recording. Because the trial court failed to make findings as to two of the four elements of proof required by [relevant case law], the Court of Appeals must reverse and remand for a new trial.”

During the incident in question, Mesa County Judge Matthew Barrett did not sanction Peters. Instead, he warned her after a bit of back-and-forth between the court, Peters, and a prosecutor.

Peters, for her part, denied recording.

Here’s how the judge ended the interaction:

Well, the bottom line is — as I mentioned, there’s a sign on the door that says no recording, video, audio — it’s all common sense for most folks to know that. This is a recorded proceeding in any event. So, this is the one warning that the individual in the courtroom will get. If I find that someone has violated this order in the future, then I’ll take appropriate action, and it will be appropriate — no doubt in my mind about that.

During oral arguments, Case was asked if the sign on the door saying not to record the proceedings was equivalent to a court order.

“Who knows?” Peter’s attorney reportedly answered, “The only person who knows what the order is is Judge Barrett.”

When another judge asked whether lying to the judge about recording would qualify as contempt, Case answered in the affirmative — saying any lie to a judge would be a violation.

But in this case, the defense attorney said, there is simply not enough evidence that Peters lied about the recording issue.

“That was the only evidence she could show that proved her innocence and the judge wouldn’t admit it,” Case told the panel of judges.

During the state’s time at the dais, 21st Judicial District Deputy Attorney Richard Tuttle said the prosecution wanted to use iPad evidence but could not figure out the password.

“Peters’ Counsel then requested at the hearing that the iPad be released, and the trial court denied the request,” the state’s reply brief notes.

What looked like a stalemate was decided by the judge overseeing the contempt hearing — who was not the same judge from the original Knisley hearing. In fact, a second judge issued the contempt citation; a third judge altogether conducted the hearing at issue in the appeal. Barrett would eventually preside over Peters’ felony trial.

During oral arguments, at least one judge appeared skeptical of the state’s claims about the sufficiency of the alleged court order, according to Courthouse News. The prosecutor said the prohibition on recording was “apparently” part of a broader decorum order.

“Your wording is interesting, ‘The decorum order apparently prohibited recording,’” Court of Appeals Judge Stephanie Dunn told the prosecutor. “The burden is on the prosecution to prove it beyond a reasonable doubt.”

Special counsel Jack Smith filed court documents on Monday to dismiss the criminal election interference case against President-elect Donald Trump before he takes office in January, citing long-standing Justice Department policy prohibiting the indictment and prosecution of a sitting president. The request was subsequently granted by U.S. District Judge Tanya Chutkan just a few hours after Smith’s filing, meaning the charges stemming from Trump’s alleged attempt to undermine the 2020 election on Jan. 6 are over.

While the dismissal was inevitable, Smith requested that the case against Trump be dismissed “without prejudice,” meaning there would be nothing barring prosecutors from bringing the same charges again in the future.

In her order granting the request, Chutkan wrote that “dismissal without prejudice is appropriate here,” noting that Trump’s presidential immunity from prosecution will not be permanent.

“Dismissal without prejudice is also consistent with the Government’s understanding that the immunity afforded to a sitting President is temporary, expiring when they leave office,” Chutkan wrote.

In the six-page motion to dismiss filed in Washington, D.C., federal court, Smith reiterated the DOJ’s policy before emphasizing that his hands were tied. He also emphasized that the department and the country “have never faced the circumstances here,” regarding a private citizen under indictment being elected to the highest office in the land.

“After careful consideration, the Department has determined that OLC’s [Office of Legal Counsel] prior opinions concerning the Constitution’s prohibition on federal indictment and prosecution of a sitting President apply to this situation and that as a result this prosecution must be dismissed before the defendant is inaugurated. That prohibition is categorical and does not turn on the gravity of the crimes charged, the strength of the Government’s proof, or the merits of the prosecution, which the Government stands fully behind. Based on the Department’s interpretation of the Constitution, the Government moves for dismissal without prejudice of the superseding indictment.”

Smith, appointed special counsel two years ago, has spearheaded two federal criminal investigations into Trump. One, in Florida, involving Trump’s alleged mishandling of classified documents following his first term in office, and another, in Washington, D.C., involving his alleged efforts to overturn the results of the 2020 presidential election.

In the D.C. case, Chutkan had been saddled with deciding what aspects of the initial indictment against Trump could remain in light of the U.S. Supreme Court’s sweeping ruling earlier this year that made a sitting president immune from prosecution for any official acts taken while in office. Additionally, evidence of a president’s official acts cannot be used against a president in a criminal case, even where the underlying conduct is personal in nature.

There’s not much chance that the case will result in concrete answers to the presidential immunity questions, as many expect Trump to pardon himself before leaving office.

In addition to seeking dismissal without prejudice, Smith’s memo repeatedly noted that Trump may not be entirely clear of legal trouble once his second stint in office ends.

“OLC explained that because a sitting President’s immunity is ‘temporary,’ extending only so far as his term in office, it ‘would not subvert the important interest in maintaining the ‘rule of law,”” the memo states, adding that such immunity “would generally result in the delay, but not the forbearance, of any criminal trial.”

The Florida document-hoarding case was dismissed in July by U.S. District Court Judge Aileen Cannon. The Trump-appointed judge reasoned that U.S. Attorney General Merrick Garland unlawfully appointed Smith. As a result, Cannon dismissed the classified documents prosecution, tying the special counsel’s case up in appeals until the election. Smith is similarly seeking to dismiss that case from the appellate court without prejudice.

However, Smith did ask that the court of appeals keep the case against Trump’s co-defendants, Walt Nauta and Carlos De Oliveira, indicating he plans to continue their prosecutions. Nauta and De Olivera have both pleaded not guilty to the election subversion charges.

As Law&Crime previously reported, Smith has reportedly told people involved with the investigation that he will be resigning before Trump takes office on Jan. 20.

FILE — Former Wisconsin Supreme Court Justice Michael Gableman, an investigator hired by Republicans to look into former President Donald Trump’s 2020 loss in the battleground state, who refused to answer questions from Circuit Court Judge Frank Remington, leaves the stand, on Friday, June 10, 2022, at the Dane County Courthouse in Madison, Wis. (Amber Arnold/Wisconsin State Journal via AP, File).

Legal regulatory authorities in Wisconsin on Tuesday filed a disciplinary complaint against a former state supreme court justice who criticized the Badger State’s 2020 election procedures.

Michael Gableman, a Republican, was hired by Wisconsin Assembly Speaker Robin Vos, also a Republican, in 2021 to lead one of many investigations into the integrity of the 2020 presidential election and provide recommendations for how to make future elections better.

In the end, Gableman was unceremoniously sacked by Vos himself after calling for the elected official’s ouster in a primary challenge – and because his investigation, while sporting a hefty price tag, found “absolutely no evidence” of voter fraud and produced little of value.

“Here, I guess what we found out from this long and tortuous road is that at least for the first part of this investigation, there was no actual work being done,” then-Dane County judge Valerie Bailey–Rihn said during a hearing in July 2022. “The taxpayers are paying $11,000 for somebody to sit in a New Berlin library to learn about election law because they had no experience in election law.”

While fizzled out investigations and lackluster reports are beyond the agency’s mandate, regulators say Gableman repeatedly violated professional rules of conduct incumbent on all Wisconsin attorneys in order to secure his own position, during the inquiry, and then again during a subsequent investigation into the failed quest to find fraud.

Chief among those alleged violations are a series of “false statements” the onetime jurist made in petitions that aimed to force the mayors of Green Bay and Madison to respond to subpoenas.

“These petitions contained false statements and failed to inform the tribunal of material facts known to Gableman that would enable the tribunal to make an informed decision,” the charging document reads.

Later, when the mayors did respond to those subpoenas, Gableman allegedly “made false statements about the responses.”

As Law&Crime previously reported, Gableman earlier found himself in hot water for a series of courtroom outbursts after flouting a court order to respond to open records requests.

During the June 2022 hearing, the ex-justice was accused by a sitting judge of disrupting court proceedings by disparaging the court and by making “misogynistic” comments about a female attorney. That incident was the original basis for the referral to Wisconsin’s Office of Lawyer Regulation – and is cited among the charges.

In sum, Gableman is accused of 10 separate violations.

Another point of contention for regulators was the circumstance in which Gableman accepted his position of special counsel to the legislature. To hear the regulators tell it, the former jurist was never really on board with the goal of shoring up the electoral system. Rather, the filing says, Gableman was intent on advancing an agenda in line with the false claim the 2020 election was somehow stolen.

From the charging document at length:

Vos defined the objective as gathering facts about how recent elections in Wisconsin had been administered, and to suggest possible legislative changes for the Assembly to consider.

Vos made clear the objective was prospective, meaning it was to assist the Assembly in determining what legislative changes, if any, were needed in the elections administration of future elections/

Significantly, Vos’s stated objective did not include (1) supporting an effort to overturn the 2020 Presidential elections results; (2) determining whether the election was “stolen;” (3) analyzing whether it was possible to decertify the Wisconsin Electors; or (4) holding officials accountable for prior actions in administering elections.

“Despite Vos’s clear, unambiguous instruction that the objective of the investigation was to find facts useful for the Assembly’s consideration of prospective legislative changes to election administration, Gableman included in his report an appendix setting forth his legal opinion that the legislature could ‘decertify’ results of the 2020 Wisconsin General Election for President, in which Joseph Biden had been declared the winner,” the complaint goes on. “This was contrary to the agreed-upon objective of the representation.”

Investigators also allege Gableman made “multiple demonstrably false statements” during the regulatory inquiry by averring his “responsibilities did not include giving legal advice.”

“Gableman did give legal advice,” the complaint alleges.

Defamed election workers in Georgia are still brawling with Rudy Giuliani in court as they attempt to collect as much of their $148 million judgment as possible in property, including $2 million in “never paid” legal fees stemming from Giuliani’s ill-fated 2020 election lawyering for Donald Trump and his campaign.

Lead plaintiff Ruby Freeman and her daughter Shaye Moss in August asked a federal court to order Giuliani to “turn over personal property in his possession” and to appoint them as “receivers with the power to take possession of, and sell, both real and personal property that Mr. Giuliani does not turn over,” like his New York apartment and his Florida condo.

At the time, Freeman and Moss cited Giuliani’s under oath testimony in his since dismissed bankruptcy case that he was “owed ‘about two million dollars’ by the Trump 2020 Presidential Campaign (the ‘Trump 2020 Campaign’) and/or the Republican National Committee for his work following the 2020 presidential election.” They demanded that the fee claim be turned over to them.

Left: Shaye Moss. Right: Ruby Freeman, during Jan. 6 Committee testimony (AP Photo/Jacquelyn Martin, File).

Giuliani responded in early October that he was concerned about timing — so close to the 2024 election — and optics.

“The Court, in its discretion, should postpone a turnover of this claim until November 6, 2024, the day after Election Day,” Giuliani requested, later warning that the media would make it seem like he had turned on Trump.

“Plaintiffs will or may use this assignment for an improper, political (or, at least, collateral) purpose, creating the confusing, and inaccurate, appearance that Defendant is now somehow suing candidate Trump, thereby generating an accompanying, and unnecessary, media frenzy,” his opposition filing argued. “Plainly, the value of this claim will not depreciate between now and November 6, 2024.”

On Friday, Freeman and Moss replied that there was “no merit” to Giuliani’s concerns about timing and appearances. The plaintiffs, therefore, demanded that Giuliani’s “control over this legal claim should be severed immediately.”

“There is no merit to Defendant’s objection. The ‘appearance’ that a judgment debtor is seeking repayment of an outstanding debt for the benefit of creditors is not a meaningful reason to withhold relief under CPLR § 5225 or §5228, and Mr. Giuliani cites no authority to the contrary,” the plaintiffs said. “If anything, Mr. Giuliani’s unwillingness to appear adverse to former President Trump or his campaign further underscores that Mr. Giuliani cannot be trusted to monetize or even preserve the value of this claim for his creditors.”

Freeman and Moss added that it will be “abundantly clear” who is suing whom.

“In any litigation with respect to the Legal Fee Claim—including in the event any such litigation is commenced prior to November 6, 2024—Plaintiffs would bring such litigation in their capacity as receivers for, or as assignees of, Mr. Giuliani’s interest in the claim, and would make that status abundantly clear both in the case caption and in the body of any complaint,” the filing said. “No reasonable observer would misinterpret such a filing as a suit by Mr. Giuliani against former President Trump, the 2020 Trump Campaign, or any other party.”

The Trump legal claim aside, plaintiffs are apparently open to the idea that neither New York Yankees World Series rings nor a watch that belonged to Giuliani’s grandfather will be subject to collection.

As Law&Crime noted recently, Giuliani’s son Andrew Giuliani filed documents claiming that the rings are his and have been since 2018, when his father gifted them to him.

Freeman and Moss are asking the judge to let discovery play out and for the younger Giuliani to sit for a deposition on the rings, perhaps ahead of November, before a ruling is issued on “turnover or receivership.”

The plaintiffs are taking a similar approach with Giuliani’s grandfather’s watch.

“As a gesture of good faith, Plaintiffs are prepared to recognize that exemption with respect to Mr. Giuliani’s grandfather’s watch, if he is able to produce satisfactory evidence showing that the watch”s value does not exceed the $1,000 exemption limit,” the filing said. “If ongoing negotiations do not resolve this issue, the Court should order that the watch be taken into receivership pending Mr. Giuliani’s production of such satisfactory evidence of value.”

Could all of this largely end up being much ado about nothing? In the words of the plaintiffs, maybe [emphasis ours]:

On October 15, 2024, Plaintiffs filed a consent letter motion, apprising the Court that Plaintiffs and Defendant are discussing a proposal that may, if successful, moot any remaining disputes raised in Defendant’s opposition to the Motion to Enforce Judgment. Those negotiations are ongoing, and by filing their reply brief today, Plaintiffs do not intend to convey to the Court that the negotiations referred to in their prior letter-motion have concluded without success; instead, Plaintiffs have filed their reply brief in support of the Motion to Enforce Judgment consistent with the Court’s deadline of October 19, 2024. Plaintiffs will file a status report by the end of the day on October 22, 2024, updating the Court of the status of those negotiations.

Giuliani’s camp has said that the judgment enforcement action was designed to “censor and bully” him and to “harass and intimidate” from exercising his First Amendment rights.

The presiding judge in Georgia’s election interference case over the 2020 presidential election has rejected Rudy Giuliani’s request for more time to file pretrial motions.

Fulton County Superior Court Judge Scott McAfee on Friday denied the former New York City Mayor’s motion for an “indefinite extension” of the court’s motions deadline, reasoning that his attorneys failed to provide any reason as to why they had been unable to get through the discovery materials provided in the case.

“The Defendant moves for an indefinite extension of the January 8th motions deadline citing
his incomplete review of voluminous discovery,” McAfee wrote in the 1-page order. “Defendant does not articulate exactly what discovery must still be reviewed, or why the review has not been completed in the approximately four months that have passed since arraignment.”

The presiding judge also took aim at Giuliani’s counsel, alleging that they made a false claim about the previously filed motion in their request for an extension.

“While defendant claims to have filed ‘many’ motions concerning discovery, none appear on the docket, McAfee wrote. “Extensions are only considered upon filing of a particularized motion containing a detailed, fact-based explanation of the need for the extension including the amount of time needed. The motion is DENIED. All deadlines remain in place.”

Giuliani’s 14 co-defendants in the case include high-profile names such as former President Donald Trump, former White House Chief of Staff Mark Meadows, and “coup memo” author John Eastman. They have all entered pleas of not guilty.

In the indictment, Fulton County District Attorney Fani Willis accused the defendants of violating the Peach State’s racketeering laws to subvert President Joe Biden’s 2020 election victory. Giuliani faces 14 criminal counts, including RICO (Racketeering Influenced and Corrupt Organizations) violations, forgery, false statements, conspiracy to influence an election, perjury, and influencing witnesses.

Former Trump attorneys Sidney Powell, Jenna Ellis, Kenneth Chesebro, and Georgia bail bondsman Scott Graham Hall have all pleaded guilty.

Friday’s order is only a small dose of the legal woes recently incurred by Trump’s former personal attorney. Giuliani last month filed for bankruptcy after he was ordered to pay two election workers in Georgia $148 million for making false and defamatory claims about them in connection with the 2020 election.

He is also being sued by his former attorneys for $1.3 million in fees they say he owes, as well as a former employee, Noelle Dunphy, who is seeking $10 million after filing a lawsuit accusing Giuliani of “sexual assault and harassment, wage theft, and other misconduct.”

Fulton County prosecutors are seeking an Aug. 5 start to the election racketeering trial.
